A question, long discussed by legal scholars, has recently provoked a considerable amount of philosophical attention: ‘Is it ever appropriate to base a legal verdict on statistical evidence alone?’ Many philosophers who have considered this question reject legal reliance on bare statistics, even when the odds of error are extremely low. This paper develops a puzzle for the dominant theories concerning why we should eschew bare statistics. Namely, there seem to be compelling scenarios in which there are multiple sources of (...) incriminating statistical evidence. As we conjoin together different types of statistical evidence, it becomes increasingly incredible to suppose that a positive verdict would be impermissible. I suggest that none of the dominant views in the literature can easily accommodate such cases, and close by offering a diagnosis of my own. (shrink)

Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation (...) in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. Ways and words about infinity have frequently hidden a continuing paradox inspired by Zeno. The basic puzzle is the tortoise's – Mr T's – Extension Challenge, the challenge being how any extension, be it in time or space or both, moving or still, can yet be of an endless number of extensions. We identify a similarity with Mr T's Deduction Challenge, reported by Lewis Carroll, to the claim that a conclusion can be validly reached in finite steps. Rejecting common (...) solutions to both challenges, we use a Wittgensteinian approach for dissolution, noting also that other paradoxes, such as the Surprise Examination and Yablo's, trap us inconsistently into similar endlessnesses. In so doing, we encounter a hopping flea, generate a proportionality paradox and consider the knight's move in chess. (shrink)

In other fields we so seldom try to think in the abstract, or by pure logic, that we do not notice this. But obviously it is just as true. Wherever there is any set of interrelated concepts, there, quite apart from all questions of application (...) or the things we use them of, we have generated a whole complex array of orderly relations or patterns of meaning. And there must be a truth about these - a purely logical truth, in abstracto, and a truth which is certain apart from experience - even though this is only a part of the truth which we want to discover, and the rest of it is of a quite different sort which depends upon experience. Ordinarily we do not separate out this a'priori truth, because ordinarily we do not distinguish the purely logical significance of concepts from the application of words to sensible things. In fact it is only the mathematician who is likely to do this at all. But I should like to indicate that this separation is always possible and that it is important for the understanding of knowledge. To this end, let me use the term 'concept' for this element of purely logical meaning. We can then discriminate the conceptual element in thought as the element which two minds must have in common - not merely may have or do have but absolutely must have in common - when they understand each other. Happiness is currently the topic of a wide range of empirical research, and is increasingly becoming the focus of public policy. The interest in happiness largely stems from its connection with well-being. We care about well-being – how well our lives are going for us. If we are happy it seems that, to some extent, we must be doing well. This suggests that we may be able to successfully measure well-being through measuring happiness. The problem is that both happiness and (...) well-being are elusive and their measurement is far from uncontroversial. What exactly does information about happiness tell us about well-being? Is there more to well-being than happiness? If so, to what extent is happiness connected to well-being? These are controversial questions, but answers to them must be given if we are to make progress in the measurement of well-being. I argue that we should view happiness as an indicator of changes in well-being. I call this the Indicator View. According to this view, someone can be doing badly yet be happy insofar as their well-being is improving (and vice versa). More precisely, the Indicator View is the view that happiness is a defeasible indicator of local changes in well-being. Thus, we can successfully measure an important aspect of well-being through measuring happiness. I argue in favour of this view on the basis of an understanding of well-being that is widely acceptable. The Indicator View, therefore, has the potential to unite divided opinion over what happiness research can tell us about well-being. (shrink)

This paper is concerned with the different forms of pleasure and identification activated in the consumption of dominant and subcultural print media. It centres on an analysis of the lesbian visual pleasures generated through the reading of fashion editorial in the new lesbian and gay lifestyle magazines. This consideration of the lesbian gaze is contrasted to the lesbian visual pleasures obtained from an against the grain reading of mainstream women's fashion magazines. The development of the lesbian and gay lifestyle magazines, (...) in the context of the pink pound, produces a situation in which an eroticized lesbian visual pleasure is the overt remit of the magazine, rather than a clandestine pleasure obtained through a transgressive reading of dominant cultural imagery. In contrast to the polysemic free-play of fashion fantasy by which readers produce lesbian pleasure in the consumption of mainstream magazines, responses to the fashion content in the lesbian magazine Diva suggest that in a subcultural context readers deploy a realist mode of reading that demands a monosemic positive images iconography. The article uses the concept of subcultural competency to consider the different ways lesbians read mainstream and subcultural print media and suggests that the conflict over Diva‘s fashion spreads may be linked to changing patterns of identification and the use of dress for recognizability. Derrida and Lacan: Another Writing argues that Jacques Derrida's philosophical understanding of language should be supplemented by Jacques Lacan's psychoanalytic approach to the symbolic order. Lacan adopts a non-philosophical, genetic or developmental approach to the question of language and in doing so isolates a dimension that Derrida cannot properly envisage: the imaginary. Michael Lewis argues that the real must be understood not just in relation to the symbolic but also in relation to the imaginary. The existence of an alternative (...) approach to the real that is other than language allows us to identify the idiosyncrasies of Derrida's purely transcendental approach, an approach that addresses language in terms of its conditions of possibility. Lacan shows us that an attention to the genesis of the symbolic order of language and culture should lead us to understand this real other in a different way.This book relates transcendental thought to the insights of non-philosophical thought, and, more specifically, it proposes a way in which philosophy might relate to the insights of the human and natural sciences. For the first time, Walter Benjamin's critical comments on educator and philosopher Rudolf Steiner are examined in depth. In particular, Benjamin detected protofascist themes within Steiner's seemingly progressive notion of child-centered, arts-based, developmentally appropriate early childhood education. But this does not mean that Benjamin completely rejected Steiner's work as mere ideology. Instead, we can find the subtle trace of Steiner's influence in Benjamin's own reflections on childhood. Here Tyson E. Lewis calls for a dialectical approach modeled by Benjamin that (...) allows us to critically interrogate Steiner's progressive education for protofascist tendencies, while also redeeming various insights into the lives of children. Hermann Grassmann's Ausdehnungslehre of 1844 and his Lehrbuch der Arithmetik of 1861 are landmark works in mathematics; the former not only developed new mathematical fields but also both contributed to the setting of modern standards of rigor. Their very modernity, however, may obscure features of Grassmann's view of the foundations of mathematics that were not adopted since. Grassmann gave a key role to the learning of mathematics that affected his method of presentation, including his emphasis on making initial assumptions explicit. (...) Since Erik Erikson's clinical and psychohistorical writings of the 1950s and 1960s, the notion of identity has served as a bridge between formulations of personality development and the psychosocial aspects of cultural cohesiveness. More recently, under the influence of a postmodern perspective, clinical writers have questioned the notion of a stable, integrative identity or self as an organizing agent in human behavior. In the area of gender identity, particularly, feminist theorists have criticized the construction of polarized gender identities both for (...) their psychological inadequacy and their cultural bias.A parallel line of criticism has developed at the cultural or historical level. Writers such as Benedict Anderson and Ernest Gellner have effectively contrasted the shallow ideological and historical roots of nationalism with the effort to base national identity on the appeal to tradition and continuity. Other writers have emphasized the heterogeneous condition of the contemporary nation in a postcolonial world. They contrast a static concept of cultural or national identity to a more fluid notion which incorporates the ongoing process of displacement that, they argue, characterizes national discourse. The identity structures that emerge from this critique, both within a clinical and a historical setting, are more ambiguous and unstable, and reflect the heterogeneous experience of contemporary culture.World historians such as William McNeill and Theodore von Laue have cited the boundedness of historians within their own cultural identities as a significant obstacle to the development of an intercultural approach to world history. These postmodern reformulations of identity theory challenge the notion of cultural boundedness by emphasizing the discontinuities endemic to modern life and the inescapably plural character of contemporary identity. Counterfactuals is David Lewis's forceful presentation of and sustained argument for a particular view about propositions which express contrary-to-fact conditionals, including his famous defense of realism about possible worlds. Since its original publication in 1973, it has become a classic of contemporary philosophy, and is essential reading for anyone interested in the logic and metaphysics of counterfactuals. The book also includes an appendix of related writings by Lewis.

This essay disentangles the complex relations between economic logic and legal logic. It distinguishes economic logic as a social process from economic logic as economic reasoning; economic reasoning to explain behavior from economic reasoning to evaluate behavioral outcomes; and legal reasoning in judicial contexts from legal reasoning in other contexts such as legislation and legal enforcement or compliance. It then argues first that economic logic as the logic of social processes deepens our understanding of how law develops and how it (...) influences behavior. But the essay argues second that economic logic plays at best a limited role in the logic of legal reasoning for two reasons. Much legal reasoning seeks to identify the goals we should and do pursue while economic logic takes such goals as given. This paper defends a novel version of moderate pessimism about moral deference, i.e., the view that we have pro tanto reason to try to avoid moral deference. The problem with moral deference is that it puts one in a bad position to form what I call morally worthy attitudes, i.e., non-cognitive attitudes that have moral worth in the same sense that certain actions have moral worth. Forming morally worthy attitudes requires a special sensitivity to the sufficiency of the moral reasons (...) one has to form these attitudes. However, when one defers about a moral claim, one takes it fully on trust, which entails that one is strongly disposed to not intentionally try to take precautions against believing that moral claim epistemically defectively (e.g., falsely or without sufficient justification). Thus, moral deference makes one strongly disposed to not try to acquire the sensitivity required for forming morally worthy attitudes. However, morally worthy attitudes are more valuable than merely fitting attitudes and plausibly have both final and non-final value. Thus, moral deference interferes with gaining something with final and non-final value. (shrink)

The current trajectory of artificial intelligence development suffers from fundamental epistemological shortcomings, resulting in the systematic operationalization of bias against non-white, non-male, and non-Western peoples. We argue that these failings are, in part, the result of certain Western rationalist epistemologies that exclude many ways of knowing about the world, and therefore they cannot provide a sufficient foundation on which to adequately, robustly, and humanely conceptualize intelligence. We present a new research agenda, Abundant Intelligences, an Indigenous-led, Indigenous-majority international, interdisciplinary research program (...) that imagines anew how to conceptualize and design artificial intelligence (AI) based on Indigenous knowledge (IK) systems. Abundant Intelligences draws on the rich plurality of Indigenous knowledge systems, bringing together diverse sets of thought, culture, and protocol together. We show IK systems provide one way to rebuild AI’s epistemological foundations and transform these tools’ current role in reinforcing colonial practices of exclusion, extraction, manipulation, and eradication into engines of abundance that enable us to care better for ourselves, our communities, and our world. Our proposition is to fully engage with AI to explore how different conceptions of intelligence could be embodied in these technologies. In this paper, we present the tenets of the research program in detail, account for our methodological approach, describe the impact and limitations, and conclude on a discussion of the implications of the program.
