This paper aims to bring a hidden “metaphysical” horizon in Husserl’s famous text “The Origin of Geometry” to light. This will be achieved in three steps: first, by analyzing the two essential manners in which the problem of history is thematized in this text, namely, both as a “basic problem” and as a “limit problem”; second, by highlighting the direct connection of this twofold problematization of history to Husserl’s own concept of metaphysics; and third, by exploring the relation between the (...) “metaphysical” limit-problem of history implicit in the “Geometry” text and the explicit historical reflections in the Crisis itself. In so doing, Husserl’s concept of metaphysics, which remains largely unknown, and the thematization of history as a “limit problem” in phenomenology, which gives expression to the fundamental engagement of phenomenology in history, can be illuminated through each other. Accelerated approval of aducanumab for mild Alzheimer's by the U.S. Food and Drug Administration on June 7, 2021, has generated substantial medical, scientific, and ethical controversy. That approval was contrary to the nearly unanimous judgment of the FDA's Advisory Committee that little reliable evidence existed of significant benefit, even though the drug did reduce β‐amyloid. Three major ethical problems were created by this approval: (1) Medicare resources would be unjustly squandered, given the drug's $56,000 annual price and the 3.1 million (...) older potential American patients needing the drug; (2) physicians will feel ethically compelled to provide the drug to desperate, insistent patients, given FDA approval and in spite of side effects of brain bleeds and brain swelling; (3) and false hopes are generated for patients. A needed corrective by the federal government would reduce reimbursement to the bare cost of producing the drug (plus only a modest profit) until a phase IV trial has been successfully completed. Illusionism about consciousness entails that phenomenal consciousness doesn’t exist. The distribution question concerns the distribution of consciousness in the animal kingdom. Skepticism of animal consciousness is the view that few or no kinds of animals possess consciousness. Thus, illusionism seems to imply a skeptical view on the distribution question. However, I argue that illusionism and skepticism of animal consciousness are actually orthogonal to each other. If illusionism is true, then phenomenal consciousness does not ground intrinsic value so that the non-existence (...) of phenomenal consciousness would not have ethical implications. In this case, the adequate reaction is to reformulate the distribution question in terms of the quasi-phenomenal functional features associated with the illusion of phenomenal consciousness which do ground intrinsic value. Hence, either illusionism is false or the distribution question does not concern phenomenal consciousness. In any case, illusionism does not directly tell us anything about the distribution question. However, since illusionism forces us to revise our traditional conception of consciousness, it indirectly affects research on animal consciousness by questioning that consciousness is a unified and an all-or-nothing property. This article probes the relationship among constitutionalism, extra-legal prerogative power, and citizen judgment. While much has been written about the nature of Lockean prerogative, and while his theory serves as a direct inspiration for contemporary "normative extra-legalists," key participants in the debate over emergency powers, less attention has been paid to how the people judge prerogative. Attention to this issue is useful because an examination of the process of political judgment of extra-legalism in Locke leads to a complication of the (...) current extra-legalist vision of democratic mechanisms of accountability. The author argues that the extra-legal approach is right to consider the role of democratic publics in potentially constraining the exercise of emergency powers but wrong to formulate that role as one extra-constitutional power checking another extra-constitutional power. The author situates both prerogative power and citizen judgment of it at the threshold of the constitutional order. (shrink)

Understanding Kant’s account of desire is vital to the project of evaluating his views about moral psychology, as well as his account of freedom qua autonomy. In Anthropology from a Pragmatic Point of View, Kant claims that “Desire (appetitio) is the self-determination of a subject's power through the representation of something in the future as an effect of this representation” (7:251). My goal is to clarify which of the subject’s specific capacities Kant means by the “subject's power,” and what role (...) this capacity plays in desire. I argue that the subject's power cannot be her capacity to act. Rather, the subject's power is best understood as her capacity to generate the psychological states that cause action. I call these motivational states 'activation signals'. Desire consists in the self-determination of the subject’s capacity to generate activation signals by her representation of the object of desire together with an accompanying incentive. (shrink)

At the turn of the last century, paleontologists wagered that they could find the missing link between lobe-finned fish and early terrestrial vertebrates. Given how these evolutionary relatives are distributed in the fossil record, Daeschler et al. predicted that some transitional form awaited discovery in late Devonian outcrops of the Canadian Arctic. It was there that they won their bet: the team soon found Tiktaalik roseae, a “fishopod” with a mix of aquatic and terrestrial traits. BackgroundIn its 2015 decision in Montgomery v. Lanarkshire Health Board, the Supreme Court of the United Kingdom overruled the long-standing, paternalistic prudent doctor standard of care in favour of a new reasonable patient standard which obligates doctors to make their patients aware of all material risks of the recommended treatment and of any reasonable alternative treatment. This landmark judgment has been of interest to the rest of the common law world. A judicial trend of invoking Montgomery to impose more stringent (...) requirements on doctors is discernible in subsequent decisions since then.Main bodyIn this narrative review, without questioning the idea that properly informed patients should play a more active role in procedures affecting their own health in furtherance of their autonomy, safety, and consumer rights, we identify and analyse, with the aid of realistic clinical thought experiments, three practical conundrums that the Montgomery standard may inflict on the daily work of doctors, unfairly exposing them to arbitrary legal risks.ConclusionsThese conundrums pertain to the ascertainment of the risks that must be disclosed to the patient under the test of ‘materiality’; the legal uncertainty as to the scope of the exceptions; and the actual ability of doctors to cope with the pressures of time. These conundrums offer ripe opportunities to rethink the proper role of judicially developed medical law in modern health care practice. (shrink)
