Les entreprises sociales connaissent un fort développement et font l'objet de nombreuses recherches qui analysent leurs spécificités. Les caractéristiques qui sont le plus souvent mises en avant ont trait à la nature de leurs activités, et à leurs poursuites d'objectifs à la fois économiques et sociaux. La mobilisation de multiples parties prenantes, à l'origine des espaces publics développés par ces initiatives, constitue aussi une dimension centrale. La question de leurs rapports aux politiques publiques, pour que la légitimation de ces initiatives (...) n'entraîne pas leur instrumentalisation et la perte de leur dimension d'espaces publics, est alors posée. La reconnaissance d'un droit social pour ces initiatives représenterait un moyen de respecter l'originalité de ces expériences, sans les soumettre au droit étatique.Social enterprises are developing greatly and are the subject of a lot of research that analyses their specific features. The characteristics often underlined are relative to the nature of their activities and their aims which are both economic and social. Another central dimension is the mobilization of multi-stakeholders determining their dimension of public spheres. Their link with public policies is an issue - to what extent does the legitimization of these initiatives lead to their instrumentalisation and the loss of their public sphere dimension? To answer this question, it can be argued that the recognition of a social law for these initiatives would represent a way to legitimate the innovative aspects of these experiments without submitting them to a tutelary relation with the State. This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

The Covid‐19 pandemic has sparked rapid and voluminous production of bioethics commentary in popular media and academic publications. Many of the discussions are new twists on an old theme: how to fairly allocate scarce medical resources, such as ventilators and intensive care unit beds. In this essay, we do not add another allocation scheme to the growing pile, partly out of appreciation that such schemes should be products of inclusive and transparent community engagement and partly out of recognition of their (...) limited utility for physicians working in the field. Instead, we make the more modest claim that context matters when making such decisions and, more specifically, that recommendations from high‐income countries about fair allocation during Covid‐19 should not be cut and pasted into low‐income settings. We offer a few examples of why seemingly universal, well‐intentioned ethical recommendations could have adverse consequences if unreflectively applied in sub‐Saharan Africa. (shrink)

A vital and underappreciated dimension of social interaction is the way individuals justify their actions to others, instinctively drawing on their experience to appeal to principles they hope will command respect. Individuals, however, often misread situations, and many disagreements can be explained by people appealing, knowingly and unknowingly, to different principles. On Justification is the first English translation of Luc Boltanski and Laurent Thévenot's ambitious theoretical examination of these phenomena, a book that has already had a huge impact on (...) French sociology and is likely to have a similar influence in the English-speaking world. In this foundational work of post-Bourdieu sociology, the authors examine a wide range of situations where people justify their actions. The authors argue that justifications fall into six main logics exemplified by six authors: civic (Rousseau), market (Adam Smith), industrial (Saint-Simon), domestic (Bossuet), inspiration (Augustine), and fame (Hobbes). The authors show how these justifications conflict, as people compete to legitimize their views of a situation. On Justification is likely to spark important debates across the social sciences. Parental effects are a major source of phenotypic plasticity and may influence offspring phenotype in concert with environmental demands. Studies of “environmental epigenetics” suggest that (1) DNA methylation states are variable and that both demethylation and remethylation occur in post‐mitotic cells, and (2) that remodeling of DNA methylation can occur in response to environmentally driven intracellular signaling pathways. Studies of mother‐offspring interactions in rodents suggest that parental signals influence the DNA methylation, leading to stable changes in gene expression. If parental (...) effects do indeed enhance the “match” between prevailing environmental demands and offspring phenotype, then the potential for variation in environmental conditions over time would suggest a mechanism that requires active maintenance across generations through parental signaling. We suggest that parental regulation of DNA methylation states is thus an ideal candidate mechanism for parental effects on phenotypic variation. (shrink)

Interaction analysis opens promising perspectives for nursing education. Sixteen students and three teachers conducted an interaction analysis, based on video-recorded therapeutic activities. The study aims to understand the practice of self-disclosure in psychiatric nursing. How does the use of interaction analysis tools in a training setting constitute a resource for the acquisition of professional skills? We show how this training design constitutes a resource for : a) the acquisition of clinical theoretical knowledge, b) the articulation of theoretical and practical knowledge, (...) c) the development of a non-judging descriptive posture useful for the clinical observation. With a meta-analysis of 85 studies and 190 experiments, the authors test the relationship between socially responsible investing and financial performance to determine whether including corporate social responsibility and ethical concerns in portfolio management is more profitable than conventional investment policies. The study also analyses the influence of researcher methodologies with respect to several dimensions of SRI on the effects identified. The results indicate that the consideration of corporate social responsibility in stock market portfolios is neither a weakness nor a (...) strength compared with conventional investments; the heterogeneous results in prior studies largely reflect the SRI dimensions under study. Technologies of democracy are instruments based on material apparatus, social practices and expert knowledge that organize the participation of various publics in the definition and treatment of public problems. Using three examples related to the engagement of publics in nanotechnology in France (a citizen conference, a series of public meetings, and an industrial design process), the paper argues that Science and Technology Studies provide useful tools and methods for the analysis of technologies of democracy. Operations of experiments and public demonstrations (...) can be described, as well as controversies about technologies of democracy giving rise to counter-experiments and counter-demonstrations. The political value of the analysis of public engagement lies in the description of processes of stabilization of democratic orders and in the display of potential alternative political arrangements. The present article is an edition of the Pathologia (1706), a Latin manuscript on the passions by Anthony Ashley Cooper, the third Earl of Shaftesbury (1671–1713). There are two parts, i) an introduction with commentary (http://dx.doi.org/10.1080/01916599.2012.679795), and ii) an edition of the Latin text with an English translation (http://dx.doi.org/10.1080/01916599.2012.679796) . The Pathologia treats of a series of topics concerning moral psychology, ethics and philology, presenting a reconstruction of the Stoic theory of the emotions that is closely modelled on Cicero and (...) Diogenes Lærtius. It contains a most detailed typology of the passions and affections as well as an analysis of a series of psychological connections, for example between admiration and pride. On the basis of his reconstruction of Stoic moral psychology and ethics, Shaftesbury argues that in one of his phases, Horace should be interpreted as a Stoic rather than as an Epicurean. The translation and the commentary draw attention to the relations between the Pathologia and Shaftesbury's English writings, most importantly Miscellaneous Reflections and the Inquiry Concerning Virtue, or Merit, which sheds light on several features of Shaftesbury's relation to Stoicism. La compréhension de l’œuvre de John Toland suppose qu’on étudie ses différentes stratégies d’exposition. Il faut distinguer entre une première tentative de propagande ouverte, puis le choix de l’art d’écrire au sens que lui donne Leo Strauss, enfin le repli des dernières années sur la communauté ésotérique. Cette étude souligne que Toland a réfléchi les modalités de la communication de sa philosophie et a tenté de répondre à une question importante : comment une hétérodoxie peut-elle s’exposer dans l’espace public?

En s'appuyant surtout sur l'Essay on Philosophical Method (1933) et sur The New Leviathan (1942), cet article expose les principaux arguments qu'a employés R. G. Collingwood contre le recours au sens commun qu'opérait G. E. Moore. Selon The New Leviathan, le recours au sens commun comme à une protection contre le scepticisme ou l'idéalisme conduit à la « persécution des scientifiques » et à l'« obscurantisme ». On peut tenir ce point de vue pour exagéré. Toutefois, si l'on examine la (...) construction de l'argument du sens commun, la pertinence de la critique de Collingwood apparaît. Cela n'empêche pas Collingwood d'utiliser la notion de sens commun, compris comme un ensemble de croyances fondamentales. Il n'y a aucune contradiction en l'espèce, pourvu qu'on distingue la notion du sens commun de l'argument du sens commun. (shrink)

As the world population ages, the patients per physician ratio keeps on increasing. This is even more important in the domain of chronic pathologies where people are usually monitored for years and need regular consultations.To address this problem, we propose an automated system to monitor a patient population, detecting anomalies in instantaneous data and in their temporal evolution, so that it could alert physicians. By handling the population of healthy patients autonomously and by drawing the physicians' attention to the patients–at-risk, (...) the system allows physicians to spend comparatively more time with patients who need their services. In such a system, the interaction between the patients, the diagnosis module, and the physicians is very important. We have based this system on a combination of stochastic models, fuzzy filters, and strong medical semantics. (shrink)

Mario Bunge vient tout juste de prendre sa retraite universitaire à l’âge vénérable de 90 ans. Après plus de soixante ans d’enseignement de la physique et de la philosophie, il laisse une oeuvre foisonnante et riche. Son style unique allie des arguments incisifs à la clarté du propos. Sa méthode puise dans le vaste arsenal des sciences, de la physique à la sociologie. Bunge suit en cela l’héritage des Lumières, qui prônait la foi en la raison ainsi qu’un certain réalisme (...) et un matérialisme qu’il reprend et retravaille à la lumière des avancées théoriques contemporaines. Peu de philosophes depuis Leibniz ou Russell ont su faire preuve d’autant d’érudition scientifique. Nul doute qu’il mérite une place de choix dans les débats entourant la philosophie des sciences contemporaines.Mario Bunge has recently retired from academic life at the venerable age of 90 years old. After more than sixty years of teaching physics and philosophy, he leaves a rich and abundant work. His unique style allies quickness and precision. His method draws from the vast realm of sciences, from physics to sociology. He thus follows the Enlightenment’s heritage that advocated a faith in reason and a kind of realism and materialism, which Bunge reorganizes from the study of modern sciences. Few philosophers since Leibniz or Russell have shown this kind of scientific erudition. No doubt that he deserves a prominent role in the contemporary debates in philosophy of sciences. (shrink)

Individual-as-maximizing agent analogies result in a simple understanding of the functioning of the biological world. Identifying the conditions under which individuals can be regarded as fitness maximizing agents is thus of considerable interest to biologists. Here, we compare different concepts of fitness maximization, and discuss within a single framework the relationship between Hamilton’s (J Theor Biol 7:1–16, 1964) model of social interactions, Grafen’s (J Evol Biol 20:1243–1254, 2007a) formal Darwinism project, and the idea of evolutionary stable strategies. We distinguish cases (...) where phenotypic effects are additive separable or not, the latter not being covered by Grafen’s analysis. In both cases it is possible to define a maximand, in the form of an objective function ϕ(z), whose argument is the phenotype of an individual and whose derivative is proportional to Hamilton’s inclusive fitness effect. However, this maximand can be identified with the expression for fecundity or fitness only in the case of additive separable phenotypic effects, making individual-as-maximizing agent analogies unattractive (although formally correct) under general situations of social interactions. We also feel that there is an inconsistency in Grafen’s characterization of the solution of his maximization program by use of inclusive fitness arguments. His results are in conflict with those on evolutionary stable strategies obtained by applying inclusive fitness theory, and can be repaired only by changing the definition of the problem. (shrink)

The role of the major histocompatibility complex (MHC) in mate choice in humans is controversial. Nowadays, the availability of genetic variation data at genomic scales allows for a careful assessment of this question. In 2008, Chaix et al. reported evidence for MHC‐dependent mate choice among European American spouses from the HapMap 2 dataset. Recently, Derti et al. suggested that this observation was not robust. Furthermore, when Derti et al. applied similar analyses to the HapMap 3 European American samples, they did (...) not see a significant effect. Although some of the points raised by Derti et al. are relevant, we disagree with the reported absence of evidence for MHC‐dependent mate choice within the HapMap samples. More precisely, we show here that the MHC dissimilarity among HapMap 3 European American spouses is still extreme in comparison to the rest of the genome, even after multiple testing correction. This finding supports the hypothesis of MHC‐dependent mate choice in some human populations. (shrink)

Cet article présente un processus de fouille de données afin d’extraire des connaissances associées au motif de la parenté et de la famille dans un corpus en ancien français de la première moitié du XIIIe siècle. Après une numérisation puis un prétraitement des données fondé sur des techniques de TAL (Traitement Automatique du Langage), il a été procédé à une extraction de motifs séquentiels (enchaînements de voisinages de mots liés à la thématique traitée). Dans cet article, nous présentons les problèmes (...) liés à la numérisation et aux traitements du texte. Puis, nous détaillons ce processus automatique et exhaustif et analysons les premiers résultats obtenus en procédant à l’étude précise d’un motif séquentiel dans différents textes du cycle Lancelot-Graal. Entre le 15 avril 1970 et la mort de Sartre le 15 avril 1980, les deux hommes ne se quitteront plus. Abstract“Science Is Politics By Other Means” (SIPBOM) was coined in The Pasteurization of France, Latour’s 1984 empirical study of the birth of microbiology. Yet, it encapsulates an outstanding political theory of science that Latour has never formalized and that has remained unnoticed to this day. The theory is comprised of two dimensions. The first one is the ontological labor performed by science, that is, the laboratory production of new nonhumans. The second one is the ability of science to devise and (...) implement novel policies targeted at the new beings it produces. These “other means” are incorporated in political projects and contribute to the shaping of society. Fifteen years later, Latour published Politics of Nature ([1999] 2004), a full-blown political treatise equally devoted to the political character of science. It would be mistaken, however, to assume that it falls in the same SIPBOM paradigm as the Pasteur study. The compositionist theory it offers redefines politics as the institution of the nonhumans that make up external reality, a task that has traditionally been monopolized by Science. In this sense, “science is politics by other means” has become “politics is science by other means,” these “other means” now referring to “cosmopolitics,” that is, the due process advocated by compositionism. The first claim of the present paper is that the respective weight ascribed to politics and ontology is different in The Pasteurization of France and in Politics of Nature. The second claim is that compositionism is not as successful as Latour’s early theory to account for the politicity of science. (shrink)

The practice and development of modern medicine requires large amounts of data, particularly in the domain of cancer. The future of personalized medicine lies neither with “genomic medicine” nor with “precision medicine”, but with “data medicine”. The establishment of this DM has required far-reaching changes, to establish four essential elements connecting patients and doctors: biobanks, databases, bioinformatic platforms and genomic platforms. The “transformation” of scientific research areas, such as genetics, bioinformatics and biostatistics, into clinical specialties has generated a new vision (...) of care. Molecular tumor boards are one response to these changes and are now providing better access to next-generation sequencing and new cancer treatments to patients with inoperable or metastatic cancers, and those for whom the usual treatment has failed. However, MTB face a crucial ethical challenge: maintaining and improving the trust of patients, clinicians, researchers and industry in academic medical centers supported by private or public funding rather than providing genetic data directly to private companies. We believe that, in this era of DM, appropriate modern digital communication networks will be required to maintain this trust and to improve the organization and effectiveness of the system. There is, therefore, a need to reconsider the form and content of informed consent documents at all academic medical centers and to introduce dynamic and electronic informed consent. (shrink)

The paper offers a modelling of the sense of justice as it is displayed in ordinary situated disputes. While this model accounts for a plurality of legitimate forms of evaluation which are used in the process of critique and justification, it escapes a relativism of values by demonstrating that all these forms satisfy a set of common requirements. The reasonable character of the everyday sense of justice is also anchored in a reality test involving the engagement of objects which qualify (...) for a certain form of evaluation. The paper discusses this model in relation to competing theories of justice, and models of social action and interaction. (shrink)
