In the dissertation, I consider the permissibility of a familiar set of responses to wrongdoing in our interpersonal relationships—those responses that constitute the imposition of some cost upon the wrongdoer. Some of these responses are, I argue, properly considered punishing, and some of these instances of punishing are in turn permissible. Punishment as I understand it is a broad phenomenon, common in and to all human relationships, and not exclusively or even primarily the domain of the state. Personal interactions expressive (...) of wrong-reactive attitudes like disappointment, anger, and guilt will sometimes constitute punishment so understood. I consider childhood punishment, self-punishment, and punishment between friends, concluding that punishment in the context of our personal relationships may sometimes be appropriate where undertaken not for the sake of deterrence nor of retributive justice, but for the sake of the aims constitutive of the relationship in which it occurs. In recent years, business ethics and economic scholars have been paying greater attention to the development of commons organizing. The latter refers to the processes by which communities of people work in common in the pursuit of the common good. In turn, this promotes commons organizational designs based on collective forms of common goods production, distribution, management and ownership. In this paper, we build on two main literature streams: the ethical approach based on the theory of the common good of (...) the firm in virtue ethics and the economic approach based on the theory of institutions for collective action developed by Ostrom’s research on common-pool resources to avert the tragedy of the commons. The latter expands to include the novel concepts of new commons, “commoning” and polycentric governance. Drawing on the analysis of what is new in these forms of organizing, we propose a comprehensive model, highlighting the integration of two sets of organizing principles—common good and collective action – and five problem-solving processes to explain the main dimensions of commons organizing. We contribute to business ethics literature by exploring the convergence between the ethical and economic approaches in the development of a commons organizing view. (shrink)

Exposing the religious roots of our ostensibly godless age, Michael Allen Gillespie reveals in this landmark study that modernity is much less secular than conventional wisdom suggests. The health care needs of rural populations often differ from those of their urban counterparts. And the ethical dilemmas that caregivers face are distinctively shaped in rural settings, not only by resource constraints, but by the nature of life in small, close-knit communities as well.

Background: Nurse managers are responsible for solving work-related ethical problems to promote a positive ethical culture in healthcare organizations. Objectives: The aim of this study was to describe the activities that nurse managers use to solve work-related ethical problems. The ultimate aim was to enhance the ethical awareness of all nurse managers. Research Design: The data for this descriptive cross-sectional survey were analyzed through inductive content analysis and quantification. Participants and research context: The data were collected in 2011 using a (...) questionnaire that included an open-ended question and background factors. Participants were nurse managers working in Finnish healthcare organizations (n = 122). Ethical considerations: Permission for the study was given by the Finnish Association of Academic Managers and Experts of Health Sciences. Findings: Nurse managers identified a variety of activities they use to solve work-related ethical problems: discussion (30%), cooperation (25%), work organization (17%), intervention (10%), personal values (9%), operational models (4%), statistics and feedback (4%), and personal examples (1%). However, these activities did not follow any common or systematic model. Discussion and conclusion: In the future, nurse managers need a more systematic approach to solve ethical problems. It is important to establish new kinds of ethics structures in organizations, such as a common, systematic ethical decision-making model and an ethics club for nurse manager problems, to support nurse managers in solving work-related ethical problems. Argument evaluation, the ability to separate prior belief from evaluation of the quality of an argument, is an essential element of critical thinking. The present study examined the ability of three personality traits (dogmatism, openness to experience, and open-mindedness) to predict argument evaluation quality and belief bias. One hundred and twelve undergraduate students completed the Argument Evaluation Test (Stanovich & West, 1997), measures of Dogmatism, Open-Mindedness, Openness to Experience, and a Vocabulary test. Argument Evaluation Quality was negatively related to Dogmatism, (...) and positively related to Openness to Experience and Vocabulary. Path analysis showed that, when controlling for Vocabulary, Dogmatism was the only personality variable that significantly (negatively) predicted Argument Evaluation Quality. None of the variables in our study were related to belief bias. Implications for future research and educational practice are discussed. (shrink)

The aim of this paper is to clarify the distinctive and the shared features of the three phenomena: irony, understatement, and litotes. These rhetorical figures have been defined as synonymous, distinct or overlapping in various accounts. This indicates an interrelation but also a need for clearer definitions. Here, each of these rhetorical figures is defined via two jointly necessary conditions. This approach sharpens the categories, enables clear-cut distinctions and helps to explain cases of overlap. German corpus data and examples from (...) the literature as a basis, allow differentiating between cases of understatement as a means of irony, and cases of litotes as a means of understatement. Beyond that, litotes and understatement allow for non-ironic uses. Interestingly, litotic irony is built on litotic understatement. This is due to the overt contrast necessary for both understatement and irony. (shrink)

Siminoff (bio), and Renie Schapiro (bio)This issue of the Kennedy Institute of Ethics Journal (KIEJ) centers on a piece of empirical research. The motivation behind the study of Laura Siminoff, Christopher Burant, and Stuart Youngner (2004) was to find out more about what the general public understands and believes about when a person is dead. More specifically, the study tried to (...) determine how members of the public define death, especially their acceptance and interpretation of the medical concept of "brain death," and their attitudes toward the so-called "dead donor rule," an informal but powerful social and legal norm insisting that the taking of organs for transplantation not cause the death of the source of those organs.As the demand for organs increases and the waiting list grows, the United States has explored multiple ways to expand the pool of potential donors. One approach has been to gerrymander (coherently or not) the line between life and death to shift patients who are extremely compromised but traditionally considered to be in the living category into the dead category. In this way, the dead donor rule remains technically intact. This reasoning is explicit in the report of the Harvard Medical School Ad Hoc Committee (1968) that "introduced" "brain death" to the American culture. Since then, other efforts to redraw the line have been proposed and rejected.One alternative to gerrymandering is to consider under what conditions, if any, it is morally acceptable to violate the dead donor rule. Some would argue that this alternative is the more "honest" approach. Rather than sidestepping moral problems by calling people dead, it brings the moral problems to the surface where the necessity of sticking to the rule can be considered on its own merits. However, when the Journal of the American Medical Association printed a position paper that proposed making anencepahlic newborns an exception to the dead donor rule, along with arguments about why this was acceptable, the outcry was so great that the proposal was retracted (AMA 1995).Clearly, our society has identified organ transplantation as a priority, although two papers in this volume (those by Courtney Campbell and by Megan Crowley-Matoka and Robert Arnold) take issue with that prioritization. The fact that the donor pool has remained relatively stable (and inadequate) despite massive efforts [End Page 211] to increase it speaks, at least in part, to the cultural and legal resistance to "new" ways to procure more organs. Voluntarism seems to have peaked. Financial incentives clash with the heavily endorsed notion of the "gift of life" and seem to many to violate the dignity of the human body. Presumed consent or eminent domain, in which the community has a greater claim to a person's organs than that person or his/her family, go against the grain of American individual freedom and the ethos of patient autonomy.Abandoning the dead donor rule generally is regarded as an even tougher sell to the American public and its legislators. The study by Siminoff and colleagues attempts, among other things, to gauge just how tough this sell would be. What the data actually demonstrate is a matter of interpretation, and this issue of the KIEJ is devoted to some of those interpretations. This article reports the results of an experiment involving 108 college students with varying backgrounds in biology. Subjects answered questions about the evolutionary history of sets of hominid and equine taxa. Each set of taxa was presented in one of three diagrammatic formats: a noncladogenic diagram found in a contemporary biology textbook or a cladogram in either the ladder or tree format. As predicted, the textbook diagrams, which contained linear components, were more likely than the cladogram formats to yield explanations (...) of speciation as an anagenic process, a common misconception among students. In contrast, the branching cladogram formats yielded more appropriate explanations concerning levels of ancestry than did the textbook diagrams. Although students with stronger backgrounds in biology did better than those with weaker biology backgrounds, they generally showed the same effects of diagrammatic format. Implications of these results for evolution education and for diagram design more generally are discussed. (shrink)

Based on the notion of time translation, we develop a formalism to deal with the logic of quantum properties at different times. In our formalism it is possible to enlarge the usual notion of context to include composed properties involving properties at different times. We compare our results with the theory of consistent histories.

The consumption of halal food may be seen as an expression of the Muslim identity. Within Islam, different interpretations of ‘halal’ exist and the pluralistic Muslim community requests diverse halal standards. Therefore, adaptive governance arrangements are needed in the halal food market. Globalization and industrialization have complicated the governance of halal food. A complex network of halal governors has developed from the local to the global level. In this paper, we analyze to what extent halal certification bodies in the Netherlands (...) address the needs of the Muslim community and how they are influenced by international halal governance. The Netherlands serves as a case study with its growing Muslim community and its central position in international trade. The data comes from literature review and eleven qualitative semi-structured interviews with the most prominent actors in the Dutch halal governance system. Our analysis shows that the halal governance system in the Netherlands is weakly institutionalized and hardly adaptive to the needs of a heterogeneous Muslim community. Improvements are needed concerning stakeholder engagement, transparency, accessibility, impartiality and efficiency. (shrink)

This article is intended as a critique of recent theorizations of sexuality and desire, which have led performative theorists to contend that gender is an effect of discourse, and sex an effect of gender. It results from informal discussions between the three authors on the mechanisms through which sexuality gets objectified in modernity. The ideas of influential Western thinkers (in particular Georges Bataille) are confronted with field data on sexuality - as lived and imagined - that the authors have been (...) gathering in Amazonian societies, Trinidad, and on the Internet. Ethnographic data and Western theories about the nature of eroticism are used to argue that the utopian definition of sexuality as sexual desire and will to identity is too divorced from the mundane - love, domesticity and reproduction in a broad sense - and based on a too limited sphere of social experience. Consequently, to apply this definition to how and why humans engage in sexual activity leads to erroneous generalizations. For when encountered ethnographically, sexuality consists of practices deeply embedded in relational contexts. The article concludes with the proposition that debates about the possibilities of human sexuality and of its political intervention will make no significant progress unless we stop repeating that `sexuality is socially constructed', and start looking at the ways in which it is lived as part of everyday social life. Recent studies show that psychiatry residents express a relatively greater need for ethics curricula than their colleagues in other specialties. Such studies have been limited in their generalizability because they were conducted at one site. This study of 151 psychiatry residents at seven U.S. psychiatry programs aims to address that limitation. Residents were surveyed on issues pertaining to ethics and professionalism education. Participants were found to support such curricula during training and to value its relevance to the practice of psychiatry. (...) This paper demonstrates the value of embracing digital technology in order to effect positive change in a non-governmental charity organisation, in this case the Irish Charity Crosscause. The outcome of the research was the creation of a charity video, Crosscause: Making a Difference, to showcase humanitarian work in Ireland and Romania with a view to inspiring others to contribute in some capacity to this cause. Video is an important medium to provide connections with a wider audience, as it gives humanitarian (...) workers and marginalised communities an opportunity to tell their story by making a compelling and evocative case to others. Visual media not only makes connections with an audience, but can also positively challenge people to consider what is happening in the world around them. The research process incorporated an entrepreneurial methodology - an Educational Entrepreneurial approach to action research-with four steps: Exploring, Understanding, Creating and Transforming, which is designed to guide practitioner-researchers as they embrace digital technology to resolve an identified need in a workplace context, including people in disadvantaged settings. In this research, there was an identified need for a charity video to link the giving in Ireland to the receiving in Romania, so that viewers could see the tangible effects of their contributions. A further aim of the research was to illustrate how volunteering can inspire solidarity among Irish and Romanian communities. (shrink)

This article presents a new classroom experiment in order to illustrate and initiate discussion on the public good provision of prevention of dangerous anthropogenic climate change. The classroom game aids students’ understanding of the difficulty associated with funding public goods; the role of fairness in climate change negotiations; the risks associated with catastrophic climate change impact; and the free riding concept. Examining the health of the population of the industrial world, the authors conclude that it is no healthier than it used to be, rather that diseases have been substituted, not eliminated. They suggest an alternative approach to health care which derives from a philosophy of nature.

The burden of this piece is to draw together into a coherent whole the somewhat diverse strands of Israel Scheffler's thought on the philosophy of religion. Extrapolating from personal discussions with Professor Scheffler, various of his books, articles, and other unpublished materials authored and kindly provided by him, I contend that he adumbrates a post-empiricist rendering of religious belief which masterfully avoids some philosophical problems, while unwittingly giving rise to others. Committed to the view that the methodology of science – (...) in one or other of its more acceptable guises – provides the most reliable measure of the content and structure of reality. Scheffler is bound conceptually to redefine Jewish belief in such a way that the traditional conflict between religion and science never emerges. Consistent with this end, he is concerned to divest traditional Judaism of its metaphysical garb, so that what remains are simply the matters of living to which religion ought properly on his view address itself. The Bible is thus reconceptualized as a piece of rich literature, of no real difference in logical kind to any other piece of rich literature, except that it defines uniquely, along with the Torah and other relevant Jewish literature, the history of the particular community whose perception of human values and meaningfulness forms the core of what it is to be Jewish. This article reflects on the ‘Philosophy and Gender’ project, which introduced the pedagogical technique known as the ‘Community of Inquiry’ into an undergraduate Gender and the Law course at the University of Western Australia. The Community of Inquiry is a pedagogy developed by Matthew Lipman in the discipline of Philosophy that facilitates collaborative and democratic philosophical thinking in the context of teaching philosophy in schools. Our project was to see if this pedagogy could advance two objectives in Gender and the (...) Law at undergraduate level: ‘reflexive thinking’ and ‘standpoint thinking’. We conclude that the Communities of Inquiry had a significant influence on the development of ‘reflexive thinking’ but appeared to have limited influence on the development of ‘standpoint thinking’. Here we provide a practitioner reflection on an exploratory new approach to teaching in a tertiary setting, with a view to setting an agenda for more systematic research in the future. (shrink)
