In this essay, I attempt to measure various prevailing democratic theories against an argument that Carl Schmitt advances in the first chapter of his ‘Crisis of Parliamentary Democracy’. In practice, he claims there, democratic politics is compelled to introduce a distinction between ‘the will of the people’ and the behaviour of the empirical people, thus justifying the bracketing and unlimited suspension of the latter in the name of the former, even to the point of dictatorship. I argue that no contemporary (...) approach to democracy as a fundamental value is able to mount a compelling response to this critique and that we should therefore reconsider the status of democracy as a normative commitment. I proceed by carefully and closely reading Schmitt’s chapter and then by juxtaposing various currents of democratic theory (including liberal, deliberative, epistemic and various hybrids thereof) with the trajectory of Schmitt’s argument. This essay is therefore less of a contribution to Schmitt scholarship, in the sense that it does not take a panoramic view of his corpus to determine his final stance on democracy, and more of an intervention into contemporary democratic theory using Schmitt’s argument as a kind of lever. This paper offers a critique of sustainability reporting and, in particular, a critique of the modern disconnect between the practice of sustainability reporting and what we consider to be the urgent issue of our era: sustaining the life-supporting ecological systems on which humanity and other species depend. Tracing the history of such reporting developments, we identify and isolate the concept of the ‘triple bottom line’ (TBL) as a core and dominant idea that continues to pervade business reporting, and business engagement (...) with sustainability. Incorporating an entity’s economic, environmental and social performance indicators into its management and reporting processes, we argue, has become synonymous with corporate sustainability; in the process, concern for ecology has become sidelined. Moreover, this process has become reinforced and institutionalised through SustainAbility’s biennial benchmarking reports, KPMG’s triennial surveys of practice, initiatives by the accountancy profession and, particularly, the Global Reporting Initiative (GRI)’s sustainability reporting guidelines. We argue that the TBL and the GRI are insufficient conditions for organizations contributing to the sustaining of the Earth’s ecology. Paradoxically, they may reinforce business-as-usual and greater levels of un-sustainability. (shrink)

Beginning with the premise that the principal function of a criminal trial is to find out the truth about a crime, Larry Laudan examines the rules of evidence and procedure that would be appropriate if the discovery of the truth were, as higher courts routinely claim, the overriding aim of the criminal justice system. Laudan mounts a systematic critique of existing rules and procedures that are obstacles to that quest. He also examines issues of error distribution by offering the (...) first integrated analysis of the various mechanisms - the standard of proof, the benefit of the doubt, the presumption of innocence and the burden of proof - for implementing society's view about the relative importance of the errors that can occur in a trial. It has been over a decade and half since Christof Koch and the late Francis Crick first advocated the now popular NCC project, in which one tries to find the neural correlate of consciousness for perceptual processes. Here we critically take stock of what have actually been learned from these studies. Many authors have questioned whether looking for the neural correlates would eventually lead to an explanatory theory of consciousness, while the proponents of NCC research maintain that focusing on correlates (...) is a strategically sensible first step, given the complexity of the problem. My point here is not to argue whether studying the NCC is useful, but rather, to question whether we are really studying the NCC at all. I argue that in hoping to sidestep the difficult conceptual issues, we have sometimes also missed the phenomenon of perceptual consciousness itself. (shrink)

Can the straight line be analysed mathematically such that it does not fall apart into a set of discrete points, as is usually done but through which its fundamental continuity is lost? And are there objects of pure mathematics that can change through time? Mathematician and philosopher L.E.J. Brouwer argued that the two questions are closely related and that the answer to both is "yes''. To this end he introduced a new kind of object into mathematics, the choice sequence. The two main domains of high culture - the arts and the sciences - seem to be completely different, simply unrelated. Is there any sense then in talking about culture in the singular as a unity? A positive answer to this question presupposes that there is a single conceptual scheme, in terms of which it is possible to articulate both the underlying similarities and the basic differences between these domains. This article argues that - at least in respect of ‘classical’ (...) modernity - there is such a framework: the normatively conceived Author-Work-Recipient relation. It allows the disclosure of the paradoxical unity of culture: its two main realms are constituted as polar opposites and thus as strictly complementary. Through such an organization, culture could fulfil an affirmative, compensatory role. At the same time however, it also allowed culture to acquire the character of social critique, a function realized through the antagonistically opposed projects of Enlightenment and Romanticism - projects whose illusions are now evident. There is a rich tradition within game theory, decision theory, economics, and philosophy correlating practical rationality with impartiality, and spatial and temporal neutrality. I argue that in some cases we should give priority to people over both times and places, and to times over places. I also show how three plausible dominance principles regarding people, places, and times conflict, so that we cannot accept all three. However, I argue that there are some cases where we should give priority to times (...) over people, suggesting that there is impersonal value to the distribution of high quality life over different times. Working memory resources are needed for processing and maintenance of information during cognitive tasks. Many models have been developed to capture the effects of limited working memory resources on performance. However, most of these models do not account for the finding that different individuals show different sensitivities to working memory demands, and none of the models predicts individual subjects' patterns of performance. We propose a computational model that accounts for differences in working memory capacity in terms of a quantity called (...) source activation, which is used to maintain goal‐relevant information in an available state. We apply this model to capture the working memory effects of individual subjects at a fine level of detail across two experiments. This, we argue, strengthens the interpretation of source activation as working memory capacity. (shrink)

In recent years, there has been a growing groundswell of support for the idea that universal health coverage should be provided even in the developing world. While I wholeheartedly agree with the eventual goal of attaining universal health coverage globally, and the sooner the better, I have worries as to whether the world's rich countries, or institutions like the World Health Organization, should be pushing the world's poorest countries to take whatever steps are necessary to achieve that goal. My fear (...) is that universal health coverage in the developing world is an intoxicating, but potentially dangerous, idea whose time may not yet have come. This article's aim is not to settle the question of whether the developing world should be urged, or pushed, to adopt policies of universal health coverage. It is merely to explore some worries about the wisdom of such a tack. The article is divided into eight sections. In Section 1, I give a brief introduction. In Section 2, I provide some background for my topic. In Section 3, I discuss the notion of universal health coverage, and what the push for such a goal in the developing world seemingly involves. In Section 4, I raise some general worries I have about the push for universal health coverage in the developing world. In Section 5, I present a wide range of possible justifications for universal health coverage in the developing world. In Section 6, I discuss whether any of the purported justifications of universal health coverage in the developing world actually do so. In Section 7, I consider some comments, objections, and responses. Finally, in Section 8, I offer a brief conclusion. (shrink)

We investigate peer influence on managerial honesty under varying levels of transparency. In a laboratory experiment, managers report their costs to a superior to request budget. We manipulate whether the managers learn each other’s report and cost or the report but not the cost. The results show, first, that managers are susceptible to peer influence, as they join peers in reporting honestly and dishonestly both under full and partial transparency. Second, however, the effect of peer influence is asymmetric. While managers’ (...) dishonesty increases much when peers’ reports are higher than they have expected, the opposite is not true. Third, partial transparency reinforces this asymmetry in peer influence. Unlike full transparency, it allows managers to substitute self-serving assumptions for missing information and to thus justify their own dishonesty more easily. The contribution of this study is twofold: It provides evidence for the interaction between transparency and peer influence and it highlights the role of expectations in fueling dishonesty. Our findings warn firms that especially partial transparency may spread dishonesty more than honesty. Transparency may also hurt firms that push honesty norms but fail to enforce compliance, thus raising and disappointing managers’ expectations. (shrink)

The subjective experience of schizophrenia, its cause, and its course have been consistent topics of interest within the phenomenological tradition since its inception. After 80 years of study and the efforts of many investigators, however, phenomenological contributions have so far had only a modest impact on current understandings of this disorder. In this article, the author reviews the methodological and theoretical issues involved in the development of a phenomenological approach to understanding schizophrenia. Drawing examples from his own empirical research, the (...) author illustrates the three steps of description, understanding, and explanation required by an application of the phenomenological method to this empirical domain. He then considers obstacles to the acceptance of insights generated through this method by the mainstream psychiatric community. In conclusion, he suggests that the promise offered by a phenomenological approach will most likely be fulfilled when investigators appeal to the phenomenological conviction in intentionality to provide the guidelines for an empirical science of subjective life. This paper is about two topics: 1. systems of explicit mathematics with universes and a non-constructive quantification operator $\mu$; 2. iterated fixed point theories with ordinals. We give a proof-theoretic treatment of both families of theories; in particular, ordinal theories are used to get upper bounds for explicit theories with finitely many universes.

As I read Paula Casal's excellent paper, ‘Sexual Dimorphism and Human Enhancement,’1 three thoughts kept circulating through my mind. First, I found myself largely in agreement with virtually everything she wrote. In particular, if Casal was being accurate and fair in writing that ‘Robert Sparrow alleges that those who…advocate biomedical welfare enhancements are committed to selecting only female embryos because women live longer than men,’1 then she has given compelling reasons for believing that that claim is, on reflection, as ludicrous (...) as it first sounds! In fact, I can think of many additional reasons to those which Casal forcefully adduced for rejecting the view in question, but I do not see the need to present them here, given the abundance of sufficiently compelling reasons Casal already presented.Second, I confess that as I read Casal's article a strong feeling of shame washed over me in virtue of my being a man! Indeed, I found myself thinking that Jonathan Glover's important and chilling book Humanity: A Moral History of the Twentieth Century2 was misleadingly, and somewhat unfairly, titled. Heretofore, when I have read Glover's powerful book, which details many of the twentieth century's worst instances of large-scale crimes against humanity, I have often been overcome by a sense of shame of the actions of my species, homo sapiens; but Casal's article suggests that perhaps the scope of my shame has been too wide, and grossly unfair to the distaff members of our species! In the well-worked expression ‘man's inhumanity to man,’ the second use of the word ‘man’ undoubtedly extends to all humans, but the first use overwhelming picks out men insofar as it denotes the actual flesh and blood perpetrators of the horrific actions in question . Kant wrote in the Only Possible Argument in Support of a Demonstration of the Existence of God, that existence is not a predicate of things. In this paper I argue that his thinking is based on the same view already in the New Elucidation, written in 1755. In this early text, Kant carefully distinguishes the grounds of existence from grounds of knowledge and argues that contingent existence always has an antecedently determining ground. I examine how Kant thinks that God contains (...) the extralogical grounds that are required for things not only to exist but also to undergo change and interact with other things. I also consider briefly how the New Elucidation could help us to understand Kant’s mature view on the grounds of existence. (shrink)

Zu den wichtigen Bedeutungsfacetten gehören: wach sein, auf etwas aufmerksam sein, etwas mit Absicht tun, sich seiner selbst bewusst sein, eine Empfindung verspüren. Daraus ergibt sich folgende Unterteilung :Vigilanzbewusstsein Kognitives Bewusstsein Handlungsbewusstsein Selbstbewusstsein Phänomenales Bewusstsein Menschen verfügen über alle sechs Arten Bewusstsein. Es ist eine offene Frage, ob dies auch auf Tiere zutrifft. Bei Säugern und Vögeln scheint es nahe zu liegen, dass sie über Bewusstsein im Sinne von, und verfügen. Offen bleibt, ob bestimmte (...) Vögel oder Säugetiere etwas mit Absicht tun können und ob sie über Selbstbewusstsein im Sinne eines Zugangs zu den eignen psychischen Zuständen verfügen. Es gibt bei Menschenaffen, Walen oder Rabenvögeln deutliche Hinweise darauf, dass sie in der Kommunikation bestimmte Absichten mitteilen wollen und möchten, dass die Rezipienten diese Absichten richtig verstehen. Bei Delfinen finden sich Hinweise aus dem Bereich der Forschung zur ›Metakognition‹, die besagen, dass bestimmte Tiere Zugang zu ihren psychi­schen Zuständen haben und dies in der Entscheidungsfindung miteinbeziehen. Verlässt man diese beiden Tierklassen wird einiges unklar. Bei Fischen oder Insekten etwa stellt sich die Frage, inwiefern sie überhaupt über einen Schlaf-Wach-Zyklus verfügen. Man kann durchaus die Auffassung vertreten, dass die Unterscheidung von Schlaf- und Wachphasen eine Voraussetzung dafür ist, bei einem Tier überhaupt von Bewusstsein zu sprechen, denn die Fähigkeit aufzuwachen scheint die basalste Form von Bewusstsein zu sein. The concept of human dignity plays an important role in the public discussion about ethical questions concerning modern medicine and biology. At the same time, there is a widespread skepticism about the possibility to determine the content and the claims of human dignity. The article goes back to Kantian Moral Philosophy, in order to show that human dignity has in fact a determinable content not as a norm in itself, but as the principle and ground of human rights and any (...) deontological norms in biomedical ethics. When it comes to defining the scope of human dignity, i.e., the question which entities are protected by human dignity, Kant clearly can be found on the “pro life”-side of the controversy. This, however, is the result of some specific implications of Kant’s transcendental approach that may be put into question. (shrink)

Bertolt Brecht is internationally known as one of the most influential dramatists, directors, and theater theorists of the twentieth century and also, within German culture, as one of its most innovative modern poets and prose stylists. Whereas Brecht’s contributions to a Marxist aesthetics of drama, theater, poetry, and prose are widely acknowledged, he is less well known as a major thinker on ethical issues, mostly because of his materialist orientation, which conflicts with ethical traditions rooted in metaphysics. Against these traditions, (...) Brecht envisioned an “ethics for the satisfaction of needs”1 and claimed that “material needs as ethical, ethical ones as material, this is not grasped.”2 This.. This chapter briefly discusses the history of the notion of "cure" in relation to serious mental illnesses from Pinel to the present day, including both theories on the nature of the illnesses and the nature of presumed therapeutic agents and mechanisms. The chapter then gives a brief overview of the notion of "recovery" in relation to serious mental illnesses, also from Pinel to the present day, and describes various definitions and forms of recovery as they have emerged over time. With (...) this historical and conceptual background in place, the chapter then takes up the present state-of-the-art in psychiatry in relation to both concepts of cure and recovery, considers the empirical and neuroscientific evidence available relative to each concept, and then suggests several directions for research and philosophical reflection as the field continues to evolve. Two guiding principles that shape this discussion are that mental illnesses are not one-dimensional phenomena, but may be made up of several loosely related components which each have their own natural course, and that mental illnesses do not typically take over the entirety of a person's functioning, but also leave other aspects of functioning relatively intact. The combination of these principles suggests that cure and recovery are not likely to be binary functions in relation to serious mental illnesses, but will more likely be more a matter of degree across multiple domains. Schizophrenia has historically been considered a severe psychiatric disorder with a chronic and progressive course; an assumption that has shaped both clinical research and public policy. Recent studies have suggested, however, that many people recover from this disorder to varying degrees, prompting new research approaches that focus on factors influencing improvement as well as pathology. An empirical-phenomenological approach appears especially promising as an avenue to investigating the active role the person may play in improvement. The dimensions of everyday life that (...) are discussed as providing a conceptual framework for investigations of the active role of the person are intentionality, temporality, and meaning. Within this framework a four-step process of recovering and reconstructing the self in schizophrenia is then delineated, with concrete illustrations of each step drawn from interviews with one young woman with schizophrenia. The findings are taken to represent the kinds of valuable insights that may be garnered from an empirical-phenomenological approach to research built upon a recognition of the importance of the dimensions of intentionality, temporality, and meaning in the everyday life of those afflicied with severe mental illness. In this article I suggest that we should understand symbolic art not as some kind of wonderous prequel to classical art, but as a theory of the advent of spiritual self-reflection on a collective scale. Symbolic art is the first form of what Hegel calls ‘absolute spirit’. I understand absolute spirit as the realm of reflective social practices through which humans discuss and reflect on what it is to be human. Symbolic art is thus the first form in which spirit (...) generates genuine self-knowledge. I argue that symbolic art should be understood as the unprecedented beginning of asking what it is to be human, without having a picture of what it is to be human preceding it. The advantage of understanding Hegel's symbolic art in this way is that we are able to go beyond the narrow conception of symbolic art as existing only in the oriental world and arrive at an understanding of symbolic art which includes social practices from the deep history of our species.
