Should society intervene to prevent the risky behavior of precocious teenagers even if it would be impermissible to intervene with adults who engage in the same risky behavior? The problem is well illustrated by the legal case of the 13-year-old Dutch girl Laura Dekker, who set out in 2009 to become the youngest person ever to sail around the world alone, succeeding in January 2012. In this paper we use her case as a point of entry for discussing the fundamental (...) question of how to demarcate childhood from adulthood. After summarizing the case, we identify a ‘demarcation dilemma’ that frames much of the public and expert debate. On the one hand, it seems morally imperative ‘to treat like alike’, which means that both children and adults should be allowed to undertake all actions for which they have the relevant competences. On the other hand, requiring proportional treatment of children and adults seems to neglect the special nature of childhood as a distinct stage in life that ends at a specific age. We introduce the notion of a ‘regime of childhood’ to deal with this problem. This regime includes several dimensions, including the limited liability for children, the supervisory responsibilities of parents, the role of age-based thresholds, and the overarching purpose of childhood as a context for developing autonomy. We argue that, all things considered, there are good reasons not to shift to a regime that offers individual children the option of qualifying for adulthood on the basis of age-neutral criteria. Many problems of inequality in developing countries resist treatment by formal egalitarian policies. To deal with these problems, we must shift from a distributive to a relational conception of equality, founded on opposition to social hierarchy. Yet the production of many goods requires the coordination of wills by means of commands. In these cases, egalitarians must seek to tame rather than abolish hierarchy. I argue that bureaucracy offers important constraints on command hierarchies that help promote the equality of workers in (...) bureaucratic organizations. Bureaucracy thus constitutes a vital if limited egalitarian tool applicable to developing and developed countries alike. (shrink)

The “new natural lawyers” (NNLs) are a prolific group of philosophers, theologians, and political theorists that includes John Finnis, Robert George, Patrick Lee, Gerard Bradley, and Germain Grisez, among others. These thinkers have devoted themselves to developing and defending a traditional sexual ethic according to which homosexual sexual acts are immoral per se and marriage ought to remain an exclusively heterosexual institution. The sterility objection holds that the NNLs are guilty of making an arbitrary and irrational distinction between same-sex couples (...) and sterile heterosexual couples. The NNLs believe that it is a necessary condition for two people’s being morally and legally entitled to get married that they be able to perform sexual acts that are “suited to procreating.” But sterile heterosexual couples are incapable of performing such acts. Therefore, it should follow from the NNLs’ own premises that sterile heterosexual couples are not entitled to marry. But the NNLs do not draw this conclusion. Instead, they maintain that sterile heterosexuals can marry while denying that the same is true of same-sex couples. The sterility objection claims the NNLs are being inconsistent in treating the two kinds of couples differently. Although the sterility objection has been endorsed by recent critics, I don’t think it has yet been adequately defended. The NNLs have responded by arguing that there is a sense in which the sex acts of sterile heterosexual couples are as suited to reproduction as those of fertile heterosexuals. Thus they maintain that the distinction they draw between the two kinds of couple has a rational basis. A successful defense of the sterility objection must show that this response on the part of the NNLs fails. Such is the task I undertake in this paper. I argue that the NNLs’ response fails because acts of penile-vaginal intercourse between sterile heterosexuals lack the actual causal power to produce conception that sexual acts need to be considered truly reproductive, and because their assumption that penile-vaginal intercourse always functions reproductively is bad biology. There is a growing interest among scientists and the lay public alike in using the South American psychedelic brew, ayahuasca, to treat psychiatric disorders like depression and anxiety. Such a practice is controversial due to a style of reasoning within conventional psychiatry that sees psychedelic-induced modified states of consciousness as pathological. This article analyzes the academic literature on ayahuasca's psychological effects to determine how this style of reasoning is shaping formal scientific discourse on ayahuasca's therapeutic potential as a treatment for (...) depression and anxiety. Findings from these publications suggest that different kinds of experiments are differentially affected by this style of reasoning but can nonetheless indicate some potential therapeutic utility of the ayahuasca-induced modified state of consciousness. The article concludes by suggesting ways in which conventional psychiatry's dominant style of reasoning about psychedelic modified states of consciousness could be reconsidered. (shrink)

Obstetricians face difficult decisions when the interests of fetus and mother conflict. An example is the problem of choosing the delivery method when labour begins prematurely and the fetus is breech. Vaginal delivery involves risks for the breech fetus of brain damage or death caused by umbilical cord compression and head entrapment. Caesarean section might avoid these dangers but involves risks for the mother, including infection, haemorrhage and even death in a small percentage of cases. If a caesarean section is (...) performed the infant might die anyway, due to complications of prematurity. Thus, decisions about delivery method involve balancing the risks to mother and fetus. Uncertainty about the frequency of fetal injuries in vaginal breech deliveries adds to the difficulty of these decisions. (shrink)

Representational art, when it first emerges in the archaeological record between 30,000-40,000 years ago, is seen as a watershed. It is upheld as one of the defining characteristics that makes us 'human', argued as the 'gold standard'by which cultural modernity is measured and identified and intimately linked with the development of language. In the past decade it has been suggested that the emergence of representational art in prehistory and the concomitance of language are assumptions that may need reviewing. This enquiry (...) looks to recent neuroscientific research, particularly in the area of neural connectivity that may provide some valuable insights between drawing and language. The significance of neural interconnectivity in this enquiry is that the emotional content of our lives may lie at the core of what makes us unique in the animal world and a significant contributory factor to our cognitive evolution, particularly in terms of cultural development. Zetemata 110. Munich: C. H. Beck, 2001. 206 pp. Paper, fi49.90. In mid-February 2001 at the University of Freiburg, a symposium was held under the aegis of Professor Eckard Lefèvre on the theme "Lucilius, Identity, and Alterity." Moving with lightning speed, Gesine Manuwald edited fifteen of the papers given (...) there and had them ready in June so that Beck could publish them in record time. This is the swiftest production of the doings of such a symposium that I have come across. If only there had been some really new things to say about Lucilius, it would make this monograph invaluable. Unfortunately, no new fragments have appeared, and the identity of Lucilius remains shrouded in mystery for lack of new historical evidence. As for alterity, most of the participants in the project did not feel comfortable with addressing that aspect of Lucilius, probably again for lack of useful data on the satirist and his period.Nine of the fifteen papers come from the hands of students and faculty at the University of Freiburg. In addition, there are contributions from Johannes Christes of Berlin, C. J. Classen of Göttingen, Ursula Gärtner of Leipzig, Severin Kostner of Erlangen, Werner Krenkel of Rostock, and Eckart Olshausen of Stuttgart. All of the titles try to link Lucilius with a genre like epic, with a specific poet like Callimachus or Aristophanes, or with a cultural or historical phenomenon like the city of Rome or the times in which the poet lived. One essay alone addresses a specific satire, predictably the Trip to Sicily in Book 3, which provides enough surviving lines to allow a discussion of fifteen pages.Several of the essays illustrate the difficulty of putting a confident hand on the "identity" of Lucilius. Even the famous disclaimer of ambition to become a [End Page 153] publican in the new province of Asia, though firmly linked to Lucilius' name in its text, does not necessarily justify the conclusion that the poet is expressing personal pride as Manuwald claims. A pose is certainly struck, but what exactly is Lucilius proud of, and what does he propose instead? The statement could be the opening to his artistic creed as satirist, but it has other possibilities, e.g., the choice of an Epicurean existence or an attack on equestrian operators, and we need to advance every inference very tentatively. It is indeed quite possible that the lines came from a fictional dramatic situation.The first paper, by Ulrike Auhagen, deals with Lucilius and comedy, an important and difficult topic. In his early poems of the first edition, Lucilius wrote a number of scenes in comic meters. Before he completed that edition, he seems to have decided permanently against those meters, senarius and septenarius, and he confined himself to hexameters in Book 30, the last book of that edition. Did he also abandon the way he used the comic meters? That is, in his early satirical experiments, did he produce little comic vignettes on fictional situations, familiar in Plautus and Terence, or did he use comedy to make satiric commentary on the Rome of his day? If the former, which I had hoped Auhagen would consider, then we can infer the variety of the satura that the poet was exploring. If the latter, then Lucilius is already from his earliest works the hard-hitting moralist that Auhagen imagines, ready to turn any meter and any situation into an arena for his polemics. I would plead for more openness to alterity.Various papers deal with Lucilius' interest in other genres or writers. Thus, Andreas Bagordo downplays the connection with Callimachus, which Puelma Piwonka daringly argued. Bernhard Zimmermann considers Horace's apparent belief that Lucilius depended greatly on Aristophanes, and he puts it rightly into perspective. Manuwald shows how little the satirist admired the Greek and Roman tragedians, but she could have spent more time on the programmatic relevance of his disapproval: he was, after all, staking... It is conjectured that a suitably modified Bondi-type expansion of the gravitational field in the radiation zone is a rapidly convergent series. It is also conjectured that the source behavior in the inner zone is insensitive to the initial conditions imposed on the gravitational field in solving the initial-value problem in this zone. Consequences of these conjectures for the problem of relating source motion to the Bondi news function are discussed.

While these debates, in their modern form, came into being several hundred years ago, many key words from them remain with us today. As a result, a number of culturally particular assumptions also remain as part of the semantic composition of these words. In the following, we examine such assumptions, particularly in (...) relation to sensoriality. We contrast the classic empiricist and rationalist views on sensation, including their broader epistemological stakes, and bring forth a third account through Peircean semiotics. We suggest that the classic debate between rationalists and empiricists can be re-examined by asking how repetition exists in the world. By thinking about the ontology of repetition, and by highlighting some of the basic semiotic principles of this, we suggest that sensoriality needs to be recognized as a dynamical system rather than a system that exists for the documenting of "what there is". In this account, neither sensoriality nor the nature of existence, including the physical world, are anchored toward absolutes on any level. This point, however, does not lead us toward rationalist claims about the non-importance of senses or the body, but toward recognition that while patterns and stability play a significant role in living systems, there is always room for plasticity and open-endedness. Many traditional agroecosystems found in Latin America constitute major in situ repositories of crop genetic diversity. This native germplasm is crucial to developing countries and industrialized nations alike. Native varieties expand and renew the crop genetic resources of developed countries while also performing well under the ecological and economic conditions of the traditional farms where they are grown. With agricultural modernization and environmental degradation, crop genetic diversity is decreasing in peasant agricultural systems. Research is urgently needed to document rates and (...) causes of genetic erosion in these systems and the role that peasants play in maintenance of crop genetic diversity. It is proposed that multi-disciplinary teams that work under the paradigms of ethnoecology and agroecology be assembled to integrate farmers’ knowledge with Western scientific approaches to design meaningful in situ crop genetic conservation strategies. Since the 1970s, sexual assault laws have evolved to include prohibitions of sexual acts with cognitively impaired individuals. The argument justifying this prohibition is typically as follows: A sex act that is forced (without the legally valid consent of) someone is sexual assault. Cognitively impaired individuals, because they lack certain intellectual abilities, cannot give legally valid consent. Therefore, cognitively impaired individuals cannot consent to sex. Therefore, sex acts with cognitively impaired individuals is sexual assault. The prohibition of sex with such (...) individuals is regarded by many as a significant advance. It certainly seems to be an improvement upon the days in which individuals could engage in sex with cognitively impaired adults with impunity regardless of the physical, emotional and psychological consequences such sex acts caused for those individuals. Yet, this legislation raises serious puzzles. For example, in the U.S., cognitively impaired individuals are routinely convicted for sexual assault with non-cognitively impaired minors. How should we think about the conviction of a cognitively impaired individual who has sex with an underage, non-cognitively impaired individual? Does this imply that cognitively impaired persons are capable of understanding the criminality of failing to obtain legal consent while being, nonetheless, incapable of giving such consent? Should the law address only those cases in which either both or neither of the individuals involved are cognitively impaired? If so, why? -/- In this paper, I claim that shifting the analysis to one based on harms (away from legal standards of consent) better captures our intuitions about sex acts involving cognitively impaired individuals. (Indeed, a review of case law reveals a focus within these cases on the harms experienced by the impaired individuals involved.) I close the paper by identifying the difficulties that plague any legislation concerning individuals with mental impairments. (shrink)

The second of these, number 405 in his cumulative list, is Bibl. Vallicelliana F 25. According to the description supplied to Munari and so quoted, the manuscript is a miscellany, 23Ox 142 mm., membr. fourteenth century, and the Ovidian material is the last or number 7 of the miscellaneous pieces, fols. 117–34.
