The tension between economic policy and health policy is a longstanding dilemma, but one that was brought to the fore with the World Trade Organization’s Trade-Related Aspects of Intellectual Property Rights Agreement in 1994. The pharmaceutical industry has long argued that intellectual property protection is vital for innovation. At the same time, there are those who counter that strong IPP negatively impacts the affordability and availability of essential medicines in developing countries. However, actors on both sides of the debate were (...) in agreement that something needed to be done to address the HIV/AIDS crisis, especially in developing countries. In response to sustained and significant pressure from civil society groups, members of the World Trade Organization agreed to the Declaration on the TRIPS Agreement and Public Health in 2001. The Declaration clarified that countries unable to manufacture the needed pharmaceuticals could obtain more affordable generics elsewhere if necessary. (shrink)

This research replicates Bhattacharjee et al. :1167–1184, 2013) moral decoupling model and extends the original along the dimensions of theory, method, and context. Adopting a branding perspective and focusing on the corporate domain rather than the public figures investigated by Bhattacharjee and colleagues, this research examines the proposition that consumers dissociate judgments of morality from judgments of performance to justify purchasing from companies deemed to act immorally. The original study is further extended by applying the model in a different cultural (...) context and employing a more realistic stimulus to establish external and ecological validity. The results of the replication generally support the original findings, in particular, under conditions of higher product involvement, a theoretical extension. (shrink)

This article gives an overview of 4 important lacunae in political liberalism and identifies, in a preliminary fashion, some trends in the literature that can come in for support in filling these blind spots, which prevent political liberalism from a correct assessment of the diverse nature of religious claims. Political liberalism operates with implicit assumptions about religious actors being either ‘liberal’ or ‘fundamentalist’ and ignores a third, in-between group, namely traditionalist religious actors and their claims. After having explained what makes (...) traditionalist religious actors different from liberal and fundamentalist religious actors, the author develops 4 areas in which political liberalism should be pushed further theoretically in order to correctly theorize the challenge which traditional religious actors pose to liberal democracy. These 4 areas are: the context of translation; the politics of exemptions; the multivocality of theology; and the transnational nature of norm-contestation. (shrink)

This paper inquiries into the complex issue of informed consent applying artificial intelligence in medical diagnostic consultations. The aim is to expose the main ethical and legal concerns of the New Health phenomenon, powered by intelligent machines. To achieve this objective, the first part of the paper analyzes ethical aspects of the alleged right to explanation, privacy, and informed consent, applying artificial intelligence in medical diagnostic consultations. This analysis is followed by a legal analysis of the limits and requirements for (...) the explainability of artificial intelligence. In todays’ super-diverse societies, communication and interaction in clinical encounters are increasingly shaped by linguistic, cultural, social and ethnic complexities. It is crucial to better understand the difficulties patients with migration background and healthcare professionals experience in their shared clinical encounters and to explore ethical aspects involved. We accompanied 32 migrant patients during their medical encounters at two outpatient clinics using an ethnographic approach. Overall, data of 34 interviews with patients and physicians on how they perceived their encounter and which (...) difficulties they experienced are presented. We contrasted the perspectives on the difficult aspects and explore ethical questions surrounding the involved issues. Patients and physicians describe similar problem areas, but they have diverging perspectives on them. Two main themes were identified by both patients and physicians: >patients’ behaviour in relation to doctors’ advice relationship issues<. A deeper understanding of the difficulties and challenges that can arise in cross-cultural settings could be provided by bringing together healthcare professionals’ and patients’ perspectives on how a cross- cultural clinical encounter is perceived. Ethical aspects surrounding some of the difficulties could be highlighted and should get more attention in clinical practice and research. (shrink)

The 2010 English-language edition of Christian Marazzi's The Violence of Financial Capitalism made a groundbreaking work on the global financial crisis available to an expanded readership. This new edition has been updated to reflect recent events, up to and including the G20 summit in July 2010 and the broad consensus to reduce government spending that emerged from it. Marazzi, a leading figure in the European postfordist movement, argues that the processes of financialization are not simply irregularities between the traditional categories (...) of wages, rent, and profit, but rather a new type of accumulation adapted to the processes of social and cognitive production today. The financial crisis, he contends, is a fundamental component of contemporary accumulation and not a classic lack of economic growth. Marazzi shows that individual debt and the management of financial markets are actually techniques for governing the transformations of immaterial labor, general intellect, and social cooperation. The financial crisis has radically undermined the very concept of unilateral and multilateral economico-political hegemony, and Marazzi discusses efforts toward a new geomonetary order that have emerged around the globe in response. Offering a radically new understanding of the current stage of international economics as well as crucial post-Marxist guidance for confronting capitalism in its newest form, The Violence of Financial Capitalism is a valuable addition to the contemporary arsenal of postfordist thought. One can remember events and one can remember facts: to remember an event (e.g. the barista's pouring my coffee this morning), one needs to have personally witnessed this event. To remember a fact (e.g. that the barista was trained in Italy), it suffices to have learned this fact from some other source. The distinction between event-directed (i.e. experiential) and fact-directed (or propositional) attitudes is an established distinction in philosophy, psychology, and cognitive science that is also exemplified by other attitudes (incl. (...) seeing, imagining, and dreaming). Until recently, semantics and the philosophy of language have assumed that experiential attitudes can be more or less straightforwardly reduced to propositional attitudes. However, new work has identified some key properties of experiential attitudes that cast doubt on this reducibility. The present paper discusses the most notable of these properties, focusing on experiential attitude reports. It links these properties to recent developments in formal and philosophical semantics in an effort to foster the development of a rigorous, empirically adequate account of experiential attitudes. In this book, Kristina Musholt offers a novel theory of self-consciousness, understood as the ability to think about oneself. Traditionally, self-consciousness has been central to many philosophical theories. More recently, it has become the focus of empirical investigation in psychology and neuroscience. Musholt draws both on philosophical considerations and on insights from the empirical sciences to offer a new account of self-consciousness—the ability to think about ourselves that is at the core of what makes us human. -/- Examining theories (...) of nonconceptual content developed in recent work in the philosophy of cognition, Musholt proposes a model for the gradual transition from self-related information implicit in the nonconceptual content of perception and other forms of experience to the explicit representation of the self in conceptual thought. A crucial part of this model is an analysis of the relationship between self-consciousness and intersubjectivity. Self-consciousness and awareness of others, Musholt argues, are two sides of the same coin. -/- After surveying the philosophical problem of self-consciousness, the notion of nonconceptual content, and various proposals for the existence of nonconceptual self-consciousness, Musholt argues for a non-self-representationalist theory, according to which the self is not part of the representational content of perception and bodily awareness but part of the mode of presentation. She distinguishes between implicitly self-related information and explicit self-representation, and describes the transitions from the former to the latter as arising from a complex process of self–other differentiation. Current education paradigms were informed by the classical Newtonian worldview of brain functioning in which the mind is simply the physical activity of the brain, and our thoughts cannot have any effect upon the physical world. However, researchers in the field of quantum mechanics found that the outcomes of certain subatomic experiments are determined by the consciousness of the observer, leading philosophers to propose that the observed and the observer are linked. Quantum mechanics also demonstrates that distant minds may behave (...) in simultaneous correlational ways, in the absence of being linked through any known energetic signal. Further, researchers in this field propose that an external memory space is operating in the human brain, suggesting that this proposed external memory space may be a quantum field surrounding the brain and interacting with other fields, generating a global mental field of information flow. This article proposes that current education paradigms, which have been informed by a classical Newtonian physics worldview may need to be expanded to include a quantum mechanics worldview. The author seeks to understand if, and how, quantum mechanics could inform education practices, theories and paradigms and invites discussion, debate and speculation on the implications this would have for education systems. Sandra Harding's feminist standpoint epistemology makes two claims. The thesis of epistemic privilege claims that unprivileged social positions are likely to generate perspectives that are “less partial and less distorted” than perspectives generated by other social positions. The situated knowledge thesis claims that all scientific knowledge is socially situated. The bias paradox is the tension between these two claims. Whereas the thesis of epistemic privilege relies on the assumption that a standard of impartiality enables one to judge some perspectives as (...) better than others, the situated knowledge thesis seems to undermine this assumption by suggesting that all knowledge is partial. I argue that a contextualist theory of epistemic justification provides a solution to the bias paradox. Moreover, contextualism enables me to give empirical content to the thesis of epistemic privilege, thereby making it into a testable hypothesis. (shrink)

Self-consciousness can be defined as the ability to think 'I'-thoughts. Recently, it has been suggested that self-consciousness in this sense can (and should) be accounted for in terms of nonconceptual forms of self-representation. Here, I will argue that while theories of nonconceptual self-consciousness do provide us with important insights regarding the essential genetic and epistemic features of self-conscious thought, they can only deliver part of the full story that is required to understand the phenomenon of self-consciousness. I will provide two (...) arguments to this effect, drawing on insights from the philosophy of language and on structural differences between conceptual and nonconceptual forms of representation. Both arguments rest on the intuition that while self-consciousness requires explicit self-representation, nonconceptual content can at best provide implicit self-related information. I will conclude that in order to explain the emergence of self-conscious thought out of more basic forms of representations one has to explain the transition between implicit self-related information and explicit self-representation. ABSTRACTIn this article I examine Axel Honneth’s positive theory of recognition. While commentators agree that Honneth’s theory qualifies as a positive theory of recognition, I believe that the deeper reason for why this is an apt characterisation is not yet fully understood. I argue that, instead of considering only what it is to recognise another person and what it means for a person to be recognised, we need to focus our attention on how Honneth pictures the practice of recognition as (...) a whole, which according to him works to make societies into places of greater freedom. This conception of recognition as a freedom-enhancing practice is supposed to provide a solution to a key problem of Frankfurt School critical theory, namely of how to determine the emancipatory practice in which critical theory is rooted, which becomes apparent as soon as one turns to the context in which Honneth originally develops his theory of recognition. At the end of the article, I offer a few reasons for doubting the overly positive picture of the practice of recognition that Honneth provides us with. (shrink)

I argue that in epistemically well-designed scientific communities, scientists are united by mutual epistemic responsibilities, and epistemic responsibilities are understood not merely as epistemic but also as moral duties. Epistemic responsibilities can be understood as moral duties because they contribute to the well-being of other human beings by showing respect for them, especially in their capacity as knowers. A moral account of epistemically responsible behaviour is needed to supplement accounts that appeal to scientists’ self-interests or personal epistemic goals. This is (...) because neither the self-interest nor the epistemic account can always explain why it is rational for an individual scientist to be epistemically responsible. (shrink)

This paper distinguishes between implicit self-related information and explicit self-representation and argues that the latter is required for self-consciousness. It is further argued that self-consciousness requires an awareness of other minds and that this awareness develops over the course of an increasingly complex perspectival differentiation, during which information about self and other that is implicit in early forms of social interaction becomes redescribed into an explicit format.

I examine ramifications of the widespread view that scientific objectivity gives us a permission to trust scientific knowledge claims. According to a widely accepted account of trust and trustworthiness, trust in scientific knowledge claims involves both reliance on the claims and trust in scientists who present the claims, and trustworthiness depends on expertise, honesty, and social responsibility. Given this account, scientific objectivity turns out to be a hybrid concept with both an epistemic and a moral-political dimension. The epistemic dimension tells (...) us when scientific knowledge claims are reliable, and the moral-political dimension tells us when we can trust scientists to be socially responsible. While the former dimension has received a fair amount of attention, the latter is in need of analysis. I examine what it means for scientists to be socially responsible, that is, to follow “sound” moral and social values in different stages of scientific inquiry. Social responsibility is especially important when scientists function as experts in society. Members of the public and policymakers do not want to rely on scientific research shaped by moral and social values they have good reasons to reject. Moreover, social responsibility is important in social research in which moral and social values can legitimately play many roles. I discuss the strengths and weaknesses of different answers to the question of how social scientists can identify appropriate moral and social values to inform their research. I argue that procedural accounts of social responsibility, such as well-ordered science and deliberative polling, have limitations. (shrink)

Much of the literature on values in science is limited in its perspective because it focuses on the role of values in individual scientists’ decision making, thereby ignoring the context of scientific collaboration. I examine the epistemic structure of scientific collaboration and argue that it gives rise to two arguments showing that moral and social values can legitimately play a role in scientists’ decision to accept something as scientific knowledge. In the case of scientific collaboration some moral and social values (...) are properly understood to be extrinsic epistemic values, that is, values that promote the attainment of scientific knowledge. The fashion industry needs to become more circular, given the unsustainable levels of waste it produces. Our research empirically explores and theoretically develops how adopting a virtue ethics approach can encourage and support second-hand clothing consumption as a form of reuse and a way of practicing sustainability. Based on ethnographic interviews with consumers who shop in UK charity shops, our grounded theory study focuses on how consumers experience second-hand clothing consumption as constitutive of sources of (in)action that encourage or inhibit (...) virtuous, sustainable behaviour. We find that pleasure and/or shame or guilt (pain) are key to enabling virtuous moral decision-making towards reuse and sustainability. We furthermore argue that seduction and conversion, hand in hand with pleasure, act as levers supporting such moral decision-making, mitigating aversions and wayward desires that obstruct good moral intentions to consume second-hand clothing. By engaging empirically with moral decision-making, our research theoretically advances scholarship on virtue ethics and second-hand clothing consumption, whilst contributing to an ethically informed vision of the circular economy. We conclude with implications for charity retail practices in support of circularity and sustainability informed by a virtue ethics perspective, as well as suggestions for future research. (shrink)

This chapter begins with a brief overview of the categories of subjective effects of alcohol, then considers the role of subjective effects from the context of prominent contemporary theories of alcohol use and misuse. Building on this conceptual foundation, it discusses important features of beverage and dose and characteristics of the setting that affect the subjective experience of drinking. It then considers what is known based on the various methodological approaches used to investigate subjective effects — including survey research on (...) alcohol expectancies and drinking motives, and ecological momentary assessment — with a particular emphasis on experimental research. Experiential knowledge is not often associated with research and organized inquiry, and even less often with the rigour of debating and honing research methods and methodology. However, many researchers in art and design and related fields perceive experiential knowledge or tacit knowledge as an integral part of their practice. The editorial article for the special issue on "Research Practice in Art and Design: Experiential Knowledge and Organised Inquiry" explores how research can recognise the relationship between creative practice, experience, and knowledge (...) generation in art and design in order to develop relevant approaches to organised inquiry. This discussion provides the backdrop against which the different articles of this special issue are introduced. The first section, "Experiential Knowledge and Organised Inquiry" addresses issues of integration and communication of experiential and tacit knowledge within the context of organised inquiry. The second section, "Experiential Knowledge in Doctoral Research" examines research practice options within doctoral research in art and design. (shrink)

The paper deals with the idea of cosmopolitanism in contemporary Anglo-American social and political philosophy. The aim of the paper is to introduce cosmopolitan theories as one of the components of the concept of global justice. Its basis is the clarification of the theoretical ground of cosmopolitanism. Attention is paid also to the problems of moral argumentation in contemporary Anglo-American social and political philosophy.

The subject matter of the essay is the autonomy of art, which will be analysed from a Jungian perspective. What Jung had in mind with his notion of the independence of the artistic process is its freedom from the conscious mind of an artist, rather than its independence from the current social, political or cultural conditions. Art, according to Jung, is autonomous if it comes from deeper levels of the human psyche, and that is unconsciousness. To test the validity of (...) Jung’s "autonomous complex", I will be checking the empirical reality of artistic creation, by providing professional artists’ accounts of the creative process. Also, I will challenge the categorically laid and the deeply rooted idea of a close link between artistic talent and mental illness, trying to see if the artistic process can be independent of an artist’s psychological state. In Jung’s view, art happens instead of and not because of potential illness of an artist. Additionally, I am going to contrast his view with Freud’s, for whom an artwork is a sublimation of sexual drive or a product of neurosis. This idea was not acceptable to Jung, as he believed in the existence of not only sexual but also art complex. Finally, I will try to argue that Jung’s view is more accurate in the depiction of artistic process than Freud’s and that his emphasis on the autonomy in art, although radical, deserves more attention from scholars in philosophy and psychology of art. There is widespread agreement among both supporters and opponents that affirmative action either must not violate any principle of equal opportunity or procedural justice, or if it does, it may do so only given current extenuating circumstances. Many believe that affirmative action is morally problematic, only justified to the extent that it brings us closer to the time when we will no longer need it. In other words, those that support affirmative action believe it is acceptable in nonideal theory, but (...) not ideal theory. This paper argues that affirmative action is entirely compatible with equal opportunity and procedural justice and would be even in an ideal world. I defend a new analysis of Rawlsian procedural justice according to which it is permissible to interfere in the outcomes of procedures, and thus I show that affirmative action is not morally problematic in the way that many have supposed. Much recent work in philosophy of memory discusses the question whether episodic remembering is continuous with imagining. This paper contributes to the debate between continuists and discontinuists by considering a previously neglected source of evidence for continuism: the linguistic properties of overt memory and imagination reports (e.g. sentences of the form 'x remembers/imagines p'). I argue that the distribution and truth-conditional contribution of episodic uses of the English verb 'remember' is surprisingly similar to that of the verb 'imagine' – even (...) when compared to the distribution of other experiential attitude verbs like 'see', 'hallucinate', or 'dream'. This holds despite the presence of some remarkable truth-conditional differences between 'remember' and 'imagine'. I show how these differences can be explained by a continuist account of remembering on which remembering is past-directed, referential, and accurate experiential imagining. (shrink)

An analysis of group justification enables us to understand what it means to say that a research group is justified in making a claim on the basis of evidence. I defend Frederick Schmitt's (1994) joint account of group justification by arguing against a simple summative account of group justification. Also, I respond to two objections to the joint account, one claiming that social epistemologists should always prefer the epistemic value of making true judgments to the epistemic value of maintaining consistency, (...) and another one claiming that the notion of joint commitment implicit in the joint account is epistemically unacceptable. First language attrition in adulthood offers new insight on neuroplasticity and the role of language experience in shaping neurocognitive responses to language. Attriters are multilinguals for whom advancing L2 proficiency comes at the cost of the L1, as they experience a shift in exposure and dominance. To date, the neurocognitive mechanisms underlying L1 attrition are largely unexplored. Using event-related potentials, we examined L1-Italian grammatical processing in 24 attriters and 30 Italian native-controls. We assessed whether attriters differed from non-attriting native speakers (...) in their online detection and re-analysis/repair of number agreement violations, and whether differences in processing were modulated by L1-proficiency. To test both local and non-local agreement violations, we manipulated agreement between three inflected constituents and examined ERP responses on two of these. Our findings revealed group differences in amplitude, scalp distribution, and duration of LAN/N400 + P600 effects. We discuss these differences as reflecting influence of attriters’ L2-English, as well as shallower online sentence repair processes than in non-attriting native speakers. ERP responses were also predicted by L1-Italian proficiency scores, with smaller N400/P600 amplitudes in lower proficiency individuals. Proficiency only modulated P600 amplitude between 650 and 900 ms, whereas the late P600 depended on group membership and amount of L1 exposure within attriters. Our study is the first to show qualitative and quantitative differences in ERP responses in attriters compared to non-attriting native speakers. Our results also emphasize that proficiency predicts language processing profiles, even in native-speakers, and that the P600 should not be considered a monolithic component. (shrink)

Obstetric ultrasound has become a significant tool in obstetric practice, however, it has been argued that its increasing use may have adverse implications for women’s reproductive freedom. This study aimed to explore Australian obstetricians’ experiences and views of the use of obstetric ultrasound both in relation to clinical management of complicated pregnancy, and in situations where maternal and fetal health interests conflict.

It is now recognized that relations of trust play an epistemic role in science. The contested issue is under what conditions trust in scientific testimony is warranted. I argue that John Hardwig's view of trustworthy scientific testimony is inadequate because it does not take into account the possibility that credibility does not reliably reflect trustworthiness, and because it does not appreciate the role communities have in guaranteeing the trustworthiness of scientific testimony.
