One of the most important and famous historical documents from the English legal and constitutional legacy is the Magna Carta Libertatum. Signed and sealed in the year 1215 the Magna Carta is further on viewed as the sole inception of the idea of limiting the power of the ruler trough legal rules. That limitation is to be made with legal rules that are binding for everyone, even the monarch. Therefore, the Great Charter is viewed as the first document signed by (...) a monarch with which, the principle of supremacy of the law is set out. That supremacy of the law has been further on developed by eminent scholars and practitioners, eventually leading to the development of the concept of rule of law. Rule of law, as a concept, means that the royal authority is going to be inferior to the law. However, this concept means a lot more than simply that. Unlike the principle of legal state, the rule of law is closely linked to justice, separation of powers and legal certainty. All of these concepts are actually prerequisites for its existence. That is why each of them is separately examined and elaborated. Furthermore, as one of the most important principles the rule of law had a great influence on the constitutional systems around the world. Since the Republic of Macedonia strives to become a democratic state where the rule of law is established and developed it is important to elaborate the influence of this principle in it. Therefore, the research gravitates over the principle of rule of law in the Republic of Macedonia. (shrink)

Konstantin Pollok offers the first book-length analysis of Kant's theory of normativity that covers foundational issues in theoretical and practical philosophy as well as aesthetics. Interpreting Kant's 'critical turn' as a normative turn, he argues that Kant's theory of normativity is both original and radical: it departs from the perfectionist ideal of early modern rationalism, and arrives at an unprecedented framework of synthetic a priori principles that determine the validity of our judgments. Pollok examines the hylomorphism in Kant's theory (...) of normativity and relates Kant's idea of our reason's self-legislation to the 'natural right' tradition, revealing Kant's debt to his predecessors as well as his relevance to contemporary debates on normativity. The article describes two approaches to modeling the concept system of science – the thematic and paradigm ones. The re­search represents a case study of the two corpuses of abstracts: abstracts of projects supported by the Department of Humanities and Social Sciences of the Russian Federal Property Fund in lin­guistics, as well abstracts of articles by authors (and their co-au­thors) who have received multiple support from this foundation. Thematic modeling was carried out within the frameworks of two approaches: сcorpus based (...) approach (modeling the system of concepts as a holistic entity of term fields network), and single text approach (singling out compositions of term fields steadily present in the texts of projects which can be treated as separate branches of linguistics). The method of semantic graph modeling realized in the “Semograph” Information system (corpus based approach) and the K-means clustering method (single text based approach) were applied. Arrays of keywords (those that occurred in the abstracts of projects supported by the Foundation) grouped into term fields served as operational units. Paradigmatic model­ing was based on the analysis of network interaction of research­ers (created on the basis of the information on joint publications). After the hypergraph of researchers (2,108 state points) had been created, it was divided into subgraphs (network communities) by means of the modularity method (analogue of cluster analysis). Each cluster can be considered as a model of a scientific commu­nity that actualize a certain scientific paradigm; a set of clusters represents a model of the concept system of a certain subject domain from the point of view of representation and interrela­tion of several paradigms. The synthesis of thematic and paradig­matic models appears to be the direction for future research that involves modeling the concept system of science. The considered models can be applied as an effective means of monitoring, fore­casting and managing scientific research, i.e. as an instrument of state and/or department policy. (shrink)

Against the well-established critical rejection of rights a growing literature in the tradition of agonistic democracy asserts their emancipatory role in the struggles for social change. However, agonistic theorists, invested as they are in the idea of democratic innovation as a process of gradual ‘augmentation’ of existing rules, institutions and practices, fail to account for the ruptural capacity, and hence for the full radical potential, of rights. Using the performative approach, I develop a conception of rights claiming as a defiant (...) practice to express the ruptural dimension of certain forms of rights politics. I demonstrate how defiant rights claiming articulates immanent critique by declaring the incapacity of putative duty-bearer institutions and governments to uphold the claimed right due to structural constraints, thereby generating inevitable contradictions within the extant order and creating the necessity for an alternative one. Moreover, in order to fully capture the emancipatory potential and creative capacity of rights, this article argues for understanding certain forms of rights politics both as augmentation and rupture, taking the two to be different dimensions of the same radical democratic practice. I present the creative use of rights discourse by the Landless Workers’ Movement in Brazil and the transnational network of agrarian movements, La Via Campesina, as precisely such a combination of the practice of augmentation and defiant claims, which has led to the transformation of the right to food and land into the right to food sovereignty, demonstration of the structural embeddedness of rights violations in the existing global regime of food production and distribution, and authorisation of an alternative vision of the future. The article attempts to compare personalist aspects in the works of Vasily Zenkovsky and Vladimir Lossky. It is shown that two types of philosophical personalism (metaphysical and existentialist) in the history of Russian thought set the framework for two types of theological personalism presented respectively by Zenkovsky and Lossky. The philosophy of Lev Lopatin was the important source for the principles of Zenkovsky’s personalist vision. The relevant philosophical background on Lossky’s personalism is provided by Nikolai Berdyaev’s works. The article considers (...) the deep criticism by the French theologian Jean-Claude Larchet, who seeks to demonstrate philosophical and existentialist sources of Lossky’s theological personalism, rather than patristical ones. It is noted that the criticism addressed to Lossky’s theory may slide to challenging the very possibility of an Orthodox theological personalism as a line of thought. It is shown that Zenkovsky’s works, presenting a nonexistentialist type of personalism, do not provoke such criticism. It’s concluded that whereas Lossky’s legacy in its personalistic aspect is challenged, Zenkovsky’s personalism enables another way of conceiving “Orthodox theological personalism.”. (shrink)

PA is Peano Arithmetic. Pr(x) is the usual Σ1-formula representing provability in PA. A strong provability predicate is a formula which has the same properties as Pr(·) but is not Σ1. An example: Q is ω-provable if PA + ¬ Q is ω-inconsistent (Boolos [4]). In [5] Dzhaparidze introduced a joint provability logic for iterated ω-provability and obtained its arithmetical completeness. In this paper we prove some further modal properties of Dzhaparidze's logic, e.g., the fixed point property and the Craig (...) interpolation lemma. How careful one must be to draw out every possibility and nuance from every little piece of textual evidence can be seen in the following case. In this paper I discuss the ways in which the early Christian writer Arnobius of Sicca used rhetoric to shape religious identity inAduersus nationes. I raise questions about the reliability of his rhetorical work as a historical source for understanding conflict between Christians and pagans. The paper is intended as an addition to the growing literature in the following current areas of study: the role of local religion and identity in the Roman Empire; the presence of pagan elements in Christian (...) religious practices; the question of how to approach rhetorical works as historical evidence. Creativity is an emerging field of research for philosophy. A diachronic cultural value and fundamental human ability, creativity poses a host of questions that challenge us both on a theoretical and practical level. In this paper we explore creativity through the use of problem-solving lateral thinking techniques, as part of the C2Learn European Community research program. Lateral thinking is defined and then classified into three distinct kinds: conceptual, diagrammatic and emotive. Each kind is then explicated and its basic principles examined, (...) in an effort to shed light on the different ways the space of possible solutions is affected by each kind of lateral thought. In the article, I analyze Georg Simmel’s essay on individual law and summarize his criticism of the concept of a universal moral law, which was developed by Immanuel Kant. Simmel identifies two ways of conceptualizing the concept of a moral law: as universal, referring to the regulation of the actions of all rational beings, and as individual, including a specific acting person in his integrity and connection with the world, which is, at the same time, absolute only for him. Kant (...) became the personification of the first method for Simmel; Simmel put forward the second method as an alternative to the first. The central characteristic of law for Simmel is its integrity and individuality, not rationality and universality. If Kant understands the moral law through a distraction from personal characteristics and inclinations in favor of impersonal norms that operate for all rational beings, then, for Simmel, the moral law manifests itself as an integral and individual human act, in which the flow of life manifests itself in the whole. Simmel insists that the idea of Kant’s universal law overlooks the very es-sence of moral obligation, which can only be individual, since only in an individual form life manifests itself – a single source of both the real and the proper. The article ends with a criticism of Simmel’s example of an individual law, which, as I show, not only contradicts a number of Simmel’s statements made earlier, but also demonstrates the undeveloped nature of his concept as a whole, namely: Simmel’s insensitivity to the distinction between integrity and totality as well as disregard for the figure of the Other. This article focuses on Alexei Losev’s literary texts that embrace his mythology of music: “I was 19 years old,” “A meteor,” “A woman-thinker,” “The Tchaikovsky trio,” and “An encounter.” It is shown that Losev’s musical mythology developed from his early musical-critical works—through the artistic-mythological episodes of his philosophical works per se —to his fiction of the 1930s. Losev’s intentionally abstract philosophy of music required to be complemented by the artistic, emotional, socially and historically specific expression. The main idea of Losev’s (...) musical myth in its historical-cultural aspect is to reflect the relevant self-consciousness of an individual. The epoch of religious super-individualism and “prayerful delight” is replaced by the epoch of “musical delight” and professed idealization of an individual. This change was a reason of the extreme ambivalence of music, which, on the one hand, expresses the highest order and harmony and, on the other, is a continuous evolvement and chaos, a substantive uncertainty. The novelty of the article consists, firstly, in the analysis of correspondence between musical ambivalence and drama in the lives of the heroes, especially heroines symbolizing music itself; and secondly, in identifying the constant features of Losev’s musical myth, as well as its specific features that emerge at different stages. In this paper, we tackle the widely held view that practice-oriented approaches to ethics are conservative, preserving the moral status quo, and, in particular, that they do not promote any (fundamental) change in our dealings with animals or formulate clear principles that help us to achieve such change. We shall challenge this view with reference to Wittgensteinian ethics. As a first step, we show that moral thought and action rest on basic moral certainties like: equals are to be treated equally (...) and unequals unequally. We then explore the relations between this insight and the notion of the difficulty of reality elaborated by Cora Diamond. Our goal is to show that a Wittgensteinian-Diamondian approach to animal ethics is not necessarily morally conservative. Indeed, it offers a profound practice-oriented approach to animal ethics that is capable of promoting change in human dealings with animals because it is compatible with radical critique. (shrink)

Various publications claim that medical AI systems perform as well, or better, than clinical experts. However, there have been very few controlled trials and the quality of existing studies has been called into question. There is growing concern that existing studies overestimate the clinical benefits of AI systems. This has led to calls for more, and higher-quality, randomized controlled trials of medical AI systems. While this a welcome development, AI RCTs raise novel methodological challenges that have seen little discussion. ArgumentPost-Stalinist reforms resulted in dramatic changes in the ways of operation of Soviet science: one can say that they altered the very understanding of what science was, or should be, in the socialist society. A new vision came about as a result of political and rhetorical efforts of scientists, who pushed forward their various, often conflicting, agendas acting in accordance with specific rules of Soviet polity. The most visible part of the reform came with the 1961 administrative reorganization of the (...) USSR Academy of Sciences. The related series of changes, however, was much broader and comprehensive, modifying the relationships between science and ideology, politicians and academic researchers, and establishing the very division between fundamental and applied research, which had been strongly rejected during the preceding Stalinist period. This article is a commentary on ChatGPT and LLMs (Large Language Models) in general. It argues that this technology has matured to the point where calling systems such as ChatGPT “stochastic parrots” is no longer warranted. But it also argues that these systems continue to have serious limitations when it comes to reasoning. These limitations are much more severe than commonly thought. A large array of examples are given to support these claims.

We say that two arithmetical formulas A, B have the Σ1-interpolation property if they have an ‘interpolant’ σ, i.e., a Σ1 formula such that the formulas A→σ and σ→B are provable in Peano Arithmetic PA. The Σ1-interpolability predicate is just a formalization of this property in the language of arithmetic.Using a standard idea of Gödel, we can associate with this predicate its provability logic, which is the set of all formulas that express arithmetically valid principles in the modal language with (...) two modal operators, □ for provability in PA and for Σ1-interpolability. In this paper we determine this provability logic .It turns out that this problem appears to be quite similar to the problem of such modal description of relative interpretability, a problem, solved by Berarducci and Shavrukov. However, the present case is sometimes easier. In particular, we prove in this paper the fixed point property and the Craig interpolation property for our modal system ELH. (shrink)

This article is an overview of the evolution of Islamic radicalism during the 19 th - 21 st centuries. It demonstrates that nineteenth century Islamic radicalism is based on the ideas of pan-Islamism, whose main representatives are J. al-Din al-Afghani and M. Abduh. In turn, Islamic radicalism of the twentieth to twentyfirst centuries is based on the ideas of Islamic fundamentalism. Its main representatives are H. Al-Banna, S. Qutb, the Deoband movement, al-Maududi and R. Khomeyni. Pan-Islamic theories of the 19 (...) th -20t h centuries are based on the thesis that people who seek liberation from colonial oppression should merge. However, scholars have different views on the union of the Muslim world. It was, once, regarded as a combination of historical circumstances and the political realities of the nineteenth century. These were further shaped by the basic idea of Islamic fundamentalism in the twentieth to twentyfirst centuries, which is Salafiyya, or a return to “pure Islam”, a revival of active faith traditions and the union of all walks of life under the Sharia law and strict interpretation and application of its rules. The instruments used by Islamic fundamentalists and radicals to implement it have been the Islam-related slogans for Takfir and Jihad. But in the 21st century, integration and globalization have started playing a significant role. Various geopolitical forces are using various tools, including the idea of Islamic radicalism. (shrink)
