In May 2021, the UK National Health Service (NHS) proposed a scheme—called General Practice Data for Planning Research (GPDPR)—for sharing patients’ data. Under that system, a patient who does not wish to participate must actively opt out of their data being shared with third parties for research and other purposes. In this paper, we analyse the lessons that can be learned for the responsible and ethical governance of health data from the NHS’ new scheme. More specifically, we explore the extent (...) to which the opt-out within the planned scheme complies with the requirements stemming from the General Data Protection Regulation (GDPR), particularly in relation to the principles of lawfulness and transparency. We then evaluate, from an ethical perspective, this opt-out ‘nudge’ and whether it is sufficiently resistible, reversible, and has appropriate goals. In light of the above, we then propose improvements for the scheme’s legal and ethical acceptability. (shrink)

Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. Theories of consciousness have a long and controversial history. One well-known proposal — integrated information theory — has recently been labeled as ‘pseudoscience’, which has caused a heated open debate. Here we discuss the case and argue that the theory is indeed unscientific because its core claims are untestable even in principle.

BackgroundCentral to ethically justified clinical trial design is the need for an informed consent process responsive to how potential subjects actually comprehend study participation, especially study goals, risks, and potential benefits. This will be particularly challenging when studying deep brain stimulation and whether it impedes symptom progression in Parkinson’s disease, since potential subjects will be Parkinson’s patients for whom deep brain stimulation will likely have therapeutic value in the future as their disease progresses.MethodAs part of an expanded informed consent process (...) for a pilot Phase I study of deep brain stimulation in early stage Parkinson’s disease, an ethics questionnaire composed of 13 open-ended questions was distributed to potential subjects. The questionnaire was designed to guide potential subjects in thinking about their potential participation.ResultsWhile the purpose of the study (safety and tolerability) was extensively presented during the informed consent process, in returned responses 70 percent focused on effectiveness and 91 percent included personal benefit as potential benefit from enrolling. However, 91 percent also indicated helping other Parkinson’s patients as motivation when considering whether or not to enroll.ConclusionsThis combination of responses highlights two issues to which investigators need to pay close attention in future trial designs: (1) how, and in what ways, informed consent processes reinforce potential subjects’ preconceived understandings of benefit, and (2) that potential subjects see themselves as part of a community of Parkinson’s sufferers with responsibilities extending beyond self-interest. More importantly, it invites speculation that a different paradigm for informed consent may be needed. (shrink)

Two major philosophical movements have sought to fundamentally rethink the relationship between humans and their environment(s): environmental ethics and enactivism. Surprisingly, they virtually never refer to or seek inspiration from each other. The goal of this analysis is to bridge the gap. Our main purpose, then, is to address, from the enactivist angle, the conceptual backbone of environmental ethics, namely the concept of intrinsic value. We argue that intrinsic value does indeed exist, yet its "intrinsicality" does not boil down to (...) being independent of the interests and needs of humans. Rather, it is brought forth by what we callshared enactionof an axiological domain. The latter is built upon such core posits of enactivism as autonomy, enaction, participatory sense-making as well as the most recent concept of loving as knowing proposed by Hanne De Jaegher. Konrad Feiereis (1931-2012) hat mit Glaubenden wie Nichtglaubenden über Religion und Gesellschaft diskutiert. Der Christliche Philosoph verfügte über die Gabe, selbst im kämpferischen Atheisten den suchenden Anderen, Nachbarn und Dialogpartner zu erkennen - dabei entwickelte er im Weltanschauungsstaat DDR herausragende hermeneutische Fähigkeiten. Die Herausgeber möchten an diesen bedeutenden katholischen Intellektuellen erinnern und laden dazu ein, Feiereis in seinen Texten zu begegnen.

The Values in Action (VIA) classification of character strengths and virtues has been recently proposed by two leading positive psychologists, Christopher Peterson and Martin Seligman as “the social science equivalent of virtue ethics.” The very possibility of developing this kind of an “equivalent,” however, is very doubtful in the light of the cogent criticism that has been leveled at modern moral theory by Alasdair MacIntyre as well as the well argued accusations that positive psychology, despite its official normative neutrality, is (...) pervaded by specifically Western individualism and instrumentalism. In order to evaluate whether the VIA project can be considered as substantially rooted in virtue ethical tradition, the classification was assessed against two fundamental features of the classical version of the latter: (1) the substantial interconnectedness of individual virtues, as expressed by the thesis of the unity of virtue, and (2) the constitutive character of the relationship between virtue and happiness. It turned out, in result, that the two above features are not only absent from but also contradicted by the VIA framework with the latter's: (1′) construal of individual virtues and character strengths as independent variables and (2′) official endorsement of the fact/value distinction. As soon as the arguments for the superiority of the classical virtue ethical perspective are provided, the potential responses available to the VIA's proponents are discussed. (shrink)

Cognitive approach towards the study of religion is a good and promising way. However, I think that this approach is too narrow and it would be better to use some basic concepts of CSR as a starting point for further, not cognitive explanation of religious. I suppose that religious beliefs should be explained also by their pragmatic functions because they were probably always associated with some pragmatic purposes at the group or at the individual levels. To develop further this last (...) approach, the good explanatory way is the evolutionary study of religion. (shrink)

Olga Tokarczuk’s masterpiece Flights highlights one of the most profound metaphysical, moral and religious conundrums – a tension, but also an intimate bond, between stability and structuredness, on the one hand, and the power of change, movement and transgression on the other. The paper is devoted to unveiling what I dub the paradox of embodied agency. In simple terms, structuredness makes the known world organized and predictable; yet, at the same time, these very structures are vehicles of change, movement, sometimes (...) even destruction. I make the case that this profound aspect of Flights deserves more recognition. (shrink)

Hugely controversial on publication, this is an insightful and characteristically entertaining survey of animal behaviour and the evolution of aggression throughout the animal world.

The paper discusses the concept of the cognitive niche and distinguishes the latter from the metabolic niche. By using these posits I unpack certain ideas that are crucial for the enactivist movement, especially for its original formulation proposed by Varela, Thompson and Rosh. Drawing on the ontology of location, boundaries, and parthood, I argue that enacting the world can be seen as the process of cognitive niche construction. Moreover, it turns out that enactivism—as seen through the lens of the conceptual (...) framework proposed in the paper—considers cognition as a kind of connection between the subject and the world. Typisch für die Generation der theologischen Ethiker, die in diesem Buch schreiben, ist das Studium in der Nachkonzilszeit, die Öffnung theologischer Berufstätigkeit, das Erleben von Umweltkrise, Mauerfall und europäischer Einigung. Doch auch der universitäre Kontext und die inhaltlichen Schwerpunkte der theologischen Ethik haben sich verändert. Was das für die Entwicklung des ethischen Denkens in Kirche, Wissenschaft und Gesellschaft bedeutet, wird hier im Spiegel exemplarischer Biografien geschildert und analysiert.

Based on a theoretical exploration in a previous article, this paper empirically analyzes which issues of SD are taken into account by corporations and stakeholders in what way, and to what extent the concept of sustainable development (SD) can be achieved through stakeholder relations management (SRM) on the corporate level. An important basis for this empirical analysis is a referential framework, which specifies 14 issues of SD. In a first empirical step, the literature-based framework has been operationalized for the business (...) world by analyzing sustainability reports. In a second empirical step, the operationalized framework served as the basis for a survey of selected MNCs. The analyses of the sustainability reports and the survey show how MNCs deal with particular issues of SD and what role they perceive particular stakeholders play. A key conclusion of the article is that SRM indeed promotes SD, but that it is no alternative to predictable government regulation. (shrink)
