This paper defends moral realism against Sharon Street’s “Darwinian Dilemma for Realist Theories of Value” (this journal, 2006). I argue by separation of cases: From the assumption that a certain normative claim is true, I argue that the first horn of the dilemma is tenable for realists. Then, from the assumption that the same normative claim is false, I argue that the second horn is tenable. Either way, then, the Darwinian dilemma does not add anything to realists’ epistemic worries.

Ethical notions such as good and bad, are often treated as though they were ?symmetric? in the sense of having the same moral ?weight?, one in a positive the other in a negative sense. I argue that they are in fact ?asymmetric? and that the negative members of such pairs of notions are more fundamental and definite, logically speaking, and operationally more important than the positive members. Detailed arguments are given to show this for some non?moral notions, such as life (...) and death, health and illness; some semi?moral notions such as pleasure and pain; and finally for the moral notions of happiness, benevolence, right, and good and their negative counterparts. One of the intentions of the article is to show that a systematic view of such asymmetries may have consequences for one's view of the proper or desirable structure of a general theory of ethics: norms stating prohibitions and norms stating permissions will be seen to be, in a sense defined in the text, more fundamental and important than norms stating ('positive') obligations. Throughout the ages writers have been concerned with contemporary problems. Their reflection became part of their literary works. By tracing and interpretating mathematical references in literature information can be obtained: on the attitude towards mathematics, on its prestige in society, its cultural recognition and its significance for education. This article analyses the implication of mathematics in some exemplary novels, essays and theoretical writings on literature of authors from the 17th to the 20th century.

Contrary to popular opinion, non-natural realism can explain both why normative properties supervene on descriptive properties, and why this pattern is analytic. The explanation proceeds by positing a subtle polysemy in normative predicates like “good”. Such predicates express slightly different senses when they are applied to particulars (like Florence Nightingale) and to kinds (like altruism). The former sense, “goodPAR”, can be defined in terms of the latter, “goodKIN”, as follows: x is goodPAR iff there is a kind K such that (...) x is a token of K, and K is goodKIN. Now if x and y are descriptively exactly similar, then they are tokens of exactly the same kinds, so x is a token of a goodKIN kind if and only if y is. Therefore, by the definition, x is goodPAR if and only if y is. Supervenience just falls out of the definition of “goodPAR”. (shrink)

Researchers sometimes engage in various forms of dishonesty and unethical behavior, which has led to regulatory efforts to ensure that they work according to acceptable standards. Such regulation is a difficult task, as research is a diverse and dynamic endeavor. Researchers can disagree about what counts as good and acceptable standards, and these standards are constantly developing. This paper presents and discusses recent changes in research integrity and ethics regulation in Norway, Denmark, and Sweden. Recognizing that research norms are developed (...) through practice and are therefore unsuited for comprehensive national regulation, the Scandinavian countries focus on empowering the research community to regulate itself instead, except for the most severe cases of misconduct. This empowerment takes the form of giving research institutions tools and investigatory powers while also holding them responsible for ensuring that both the institution and individual researchers are up to date on relevant norms. In this way, the Scandinavian governments seek to avoid some of the challenges found in more legalistic approaches, which risk lagging behind the continuous development of research norms and can be insensitive to the fact that different disciplines have different norms. While the new approach in Scandinavian has several potential benefits, it also involves potential trade-offs and limitations. The new laws can create confusion about what researchers are allowed to do. Another issue is that it only addresses the fundamental drivers of misconduct to a limited extent. (shrink)

The article defends a mild form of pessimism about moral deference, by arguing that deference is incompatible with authentic interaction, that is, acting in a way that communicates our own normative judgment. The point of such interaction is ultimately that it allows us to get to know and engage one another. This vindication of our intuitive resistance to moral deference is upheld, in a certain range of cases, against David Enoch’s recent objection to views that motivate pessimism by appealing to (...) moral autonomy or understanding. Enoch is right to point out that the value of autonomy or understanding cannot provide reason not to defer, if deferring would reduce the risk of treating others wrongly. But in the kind of case where we would want other people to act authentically towards us, even at the cost of a greater risk of wrongdoing, we should do the same towards them. (shrink)

In Norway, research ethics committees in medicine are organized as interdisciplinary regional committees. Since 1999, Norway requires that one member of each ethics committee be a psychologist. Competence in psychology is considered relevant not only when evaluating psychology projects. As discussed in this article, a competence in psychology is also relevant for evaluating a number of issues common to all research involving human subjects as well as in the evaluation of protocols where other professionals have employed psychological methodologies.

Buddhism teaches that the diversity of living beings in the world is caused and upheld by intentional acts performed in this and previous lives by karmic trajectories, beings whose continuity through rebirths is not dependent on a transcendent substratum such as a self (ātman), and that the order of beings in the world exactly correlates with the consequences of acts (karrnan) operative for their present life. The central Buddhist doctrine of dependent co‐arising (pratītya‐samutpāda) shows how these karmic trajectories are sustained (...) by twelve conditions, the primary of which is ignorance. The goal of Buddhists is ultimately to transcend rebirth and attain nirvāṇa. This is possible because the world is both a rebirth realm and a realm in which awakening from ignorance can be attained. The natural world of living beings is a moral order and this moral order functions in a physical setting. The physical setting of the rebirth system is the cosmos as the abode of beings, and the beings participating in the rebirth system constitute the world of living beings. These together constitute the world of rebirth (saṃsāra). By nature in this article is understood that part of the cosmos that constitutes the physical setting of humans and the world of non‐human beings also living there – that is, animals and plants. This is, one should note, only a very small part of the Buddhist cosmos, which consists of a huge number of world systems, and which is immense in time and space and eternally manifests and dissolves. In general, pluralism characterises the religious traditions and religious life in South Asia, ancient, medieval, modern as well as contemporary. Openness for the greatest possible plurality is therefore often a good way to approach religion in South Asia. This is the case also with the study of Kapila. Abstract This paper analyses the uses of the word ?nature? (in P?li pakati, Sanskrit prakrti) in the P?li scripture. In the P?li scripture pakati is never used as a concept of nature considered as a unity or an entity, or as a material cause, as in the S?mkhya and Yoga, but it describes acts which are considered natural, regular and usual. The article tries to answer three questions. 1. What is the meaning of the term pakati in the P?li scripture? (...) 2. What is the relation between the term pakati in the P?li scripture and the Sanskrit term prakrti in general and as a technical term in the S?mkhya and Yoga schools, in the Medical schools and in the Jain scriptures? 3. It is a common mistake, especially, perhaps, among students of the religions and philosophies of India, to assume that the word prakṛti, best known as the ultimate material principle in the Sāṃkhya and Yoga systems of religious thought, the material cause of the world in Hindu theologies and, as such, an epithet of the goddesses in Hinduism, always refers to an ultimate principle. Even in Sāṃkhya and Yoga texts the word prakṛti is used in various ways. Prakṛti does not always (...) refer to the ultimate principle. Translators often leave the word prakṛti untranslated and mislead the reader to assume that the ultimate principle is referred to, when it is not. This article discusses the use of prakṛti in the Sāṃkhya-Yoga texts the Yogasūtra and the Vyāsabhāṣya and criticises some translation practices. (shrink)

This article is concerned with the role of experientia in medieval law. This could take a number of forms, three of which are treated by way of example. In the first part of the essay, the author discusses how experience first came to serve as a source for the creation and legitimisation of new law since Late Antiquity. Henceforth, it became an important principle within Canon Law that served not only to create legal regulations supplementary to traditional law but also (...) to overwrite and replace it. The second part of the essay is concerned with the role of expert reports (consilia) by men learned in the ius commune which were requested to help rule cases under local law. Being dispersed in collections after their use in court, consilia made a significant impact on common and local law. In the final section the author discusses the use of expert witnesses (from areas as diverse as medicine, agriculture, the arts and crafts etc.). Expert opinions were recognised by court as high-value evidence. (shrink)

Executive compensation has long been a prominent topic in the management literature. A main question that is also given substantial attention in the business ethics literature—even more so in the wake of the recent financial crisis—is whether increasing levels of executive compensation can be justified from an ethical point of view. Also, the relationship of executive compensation to instances of unethical behavior or outcomes has received considerable attention. The purpose of this paper is to explore the social, ecological, and existential (...) costs of economic incentives, by discussing how relying on increasing levels of executive compensation may have an adverse effect on managerial performance in a broad sense. Specifically, we argue that one-dimensional economic incentives may destroy existential, social, and systemic values that influence the manager’s commitment to ensure responsible business conduct, and have negative spillover effects that may reduce the manager’s performance. There are well-documented findings that demonstrate that reliance on sources of extrinsic motivation (such as economic incentives) may displace intrinsic motivation. Our perspective is a holistic one, in the sense that we will explore the influence of sources of extrinsic motivation on the manager’s intrinsic commitment to different types of values. We will in particular investigate how it may influence the manager’s ethical reflection and behavior or lack thereof. (shrink)

From a tradition of discourse ethics, human dignity can be defined as “being an equal member in the realm of subjects and authorities of justification.” Additionally, “to act with dignity means being able to justify oneself to others; to be treated in accordance with this dignity means being respected as such an equal member.” Conversely, “to treat others in ways that violate their dignity means regarding them as lacking any justification authority”. The guidelines found in Habermas’s “ideal speech situation” are (...) essential to guarantee this notion of human dignity. Based on aspects of Habermas’s, as well as Rainer Forst’s theory of justice, this study analyzes efforts made by the late speaker of Deutsche Bank, Dr. Alfred Herrhausen, and the former CEO of Alcoa and United States Secretary of the Treasury, Paul H. O’Neill, to challenge the way debt crises in the developing world were handled. Both leaders understood indebted countries, the livelihoods and dignity of its citizens, not as an external entity but as an integral part of their agendas. The two agents included underrepresented groups in their considerations and discussions through a proxy or surrogate participation, giving them a greater voice and acknowledging their dignity. BackgroundThe Liverpool Care Pathway is an interdisciplinary protocol, aiming to ensure that dying patients receive dignified and individualized treatment and care at the end-of-life. LCP was originally developed in 1997 in the United Kingdom from a model of cancer care successfully established in hospices. It has since been introduced in many countries, including Norway. The method was withdrawn in the UK in 2013. This review investigates whether LCP has been adapted and validated for use in nursing homes and for dying (...) people with dementia.MethodsThis systematic review is based on a systematic literature search of MEDLINE, CINAHL, EMBASE, and Web of Science.ResultsThe search identified 12 studies, but none describing an evidence-based adaption of LCP to nursing home patients and people with dementia. No studies described the LCP implementation procedure, including strategies for discontinuation of medications, procedures for nutrition and hydration, or the testing of such procedures in nursing homes. No effect studies addressing the assessment and treatment of pain and symptoms that include dying nursing home patients and people with dementia are available.ConclusionLCP has not been adapted to nursing home patients and people with dementia. Current evidence, i.e. studies investigating the validity and reliability in clinically relevant settings, is too limited for the LCP procedure to be recommended for the population at hand. There is a need to develop good practice in palliative medicine, Advance Care Planning, and disease-specific recommendations for people with dementia. (shrink)

Dies ist eine Merkwürdigkeit, denn gerade die Aphoristiker, die das Antisystematische propagieren, den blitzartigen, schlagenden Einfall vor der konsequenten Entwicklung eines Gedankens favorisieren, sollten doch eigentlich mit dem zusammenhängenden, systematischen und konsequenten Denken more geometrico Spinozas wenig bis gar nichts anzufangen wissen. Die vorliegende Studie untersucht die Spinozarezeption ausgewählter Aphoristiker und analysiert das hier zum Ausdruck kommende Verhältnis von Aphorismus bzw. kleiner Form und System. Die Art und Weise, wie sich (...) aphoristisch bzw. in kleinen Formen operierende Autoren mit Spinoza befassen, wirft ein signifikantes Licht auf ihre Aphoristik selbst. Wer über eine Theorie der kleinen Form nachdenkt, ist gut beraten, sich um das Spinoza-Bild der Aphoristiker zu bemühen.
