The goal of this paper is to propose a unified approach to the split scope readings of negative indefinites, comparative quantifiers, and numerals. There are two main observations that justify this approach. First, split scope shows the same kinds of restrictions across these different quantifiers. Second, split scope always involves low existential force. In our approach, following Sauerland, natural language determiner quantifiers are quantifiers over choice functions, of type <<,t>,t>. In split readings, the quantifier over choice functions scopes above other (...) operators (such as intensional verbs like must or can). Determiner quantifiers leave a choice-function trace when they move and this trace combines with the noun restriction, which is interpreted low. That split scope always involves low existential force is derived, without stipulation, from Kratzer’s idea that low existential force can be achieved via binding (into the noun restriction). Das Referat zielt ab auf eine Beurteilung der Rolle zweckrationalen Argumentier ens für die Begründung von Handlungen und Normen. Der Sinn der Rede von Zweck und Wittel wird bestimmt als Angabe von Argumentationsstrategien, dies in Abhebung von inhaltlicher Begründung. Kritisiert wird die Bindung des Zweckbegriffs an die Wirkung von Handlungen, die Meinung, Zweck und Mittel seien verschiedene Arten von Gegenständen, die mangelnde Differenzierung zwischen Zweck und Ziel. Den Abschluß bildet eine Analyse des Begriffs der Zweckrationalität.

Using computer simulations I studied the simultaneous effect of variable environments, mutation rates, ploidy, number of loci subject to evolution and random and assortative mating on various reproductive systems. The simulations showed that mutants for sex and recombination are evolutionarily stable, displacing alleles for monosexuality in diploid populations mating assortatively under variable selection pressure. Assortative mating reduced excessive allelic variance induced by recombination and sex, especially among diploids. Results suggest a novel adaptive value for sex and recombination. They show that (...) the adaptive value of diploidy and that of the segregation of sexes is different to that of sex and recombination. The results suggest that the emergence of sex had to be preceded by the emergence of diploid monosexual organisms and provide an explanation for the emergence and maintenance of sex among diploids and for the scarcity of sex among haploid organisms. In what follows, I will concentrate on the type of temporality which structures Wittgenstein's method of a perspicuous representation, or of a synoptic overview (übersichtliche Darstellung). I will argue that the temporal order which applies to (giving) a perspicuous representation is best to be described as retroactivity, deferred action or afterwardness (Nachträglichkeit), a concept which calls into question the ordinary conception of time as a linear and irreversible process as well as of a clear break between present and past. First, (...) I will turn to Sigmund Freud and the way he developed the concept of Nachträglichkeit or retroactivity in some of his case-studies. The basic idea here is that the meaning or content of a past experience is constituted by repeating it in a different or disguised way. I will then argue that the relation between a perspicuous representation and what is made perspicuous is best interpreted as a relation of Nachträglichkeit. This interpretation also accounts for the involvement of the subject in the object made perspicuous—as it is stressed by Wittgenstein and illustrated by his discursive method. (shrink)

In the 21st century, digitalization is a global challenge of mankind. Even for the public, it is obvious that our world is increasingly dominated by powerful algorithms and big data. But, how computable is our world? Some people believe that successful problem solving in science, technology, and economies only depends on fast algorithms and data mining. Chances and risks are often not understood, because the foundations of algorithms and information systems are not studied rigorously. Actually, they are deeply rooted in (...) logics, mathematics, computer science and philosophy. Therefore, this book studies the foundations of mathematics, computer science, and philosophy, in order to guarantee security and reliability of the knowledge by constructive proofs, proof mining and program extraction. We start with the basics of computability theory, proof theory, and information theory. In a second step, we introduce new concepts of information and computing systems, in order to overcome the gap between the digital world of logical programming and the analog world of real computing in mathematics and science. The book also considers consequences for digital and analog physics, computational neuroscience, financial mathematics, and the Internet of Things (IoT). (shrink)

This book explores the constitutional, legally binding dimension to legisprudence in the light of the German Federal Constitutional Court's approach to rational lawmaking. Over the last decades this court has been remarkably active in applying legisprudential criteria and standards when reviewing parliamentary laws. It has thus supplied observers with a unique material to analyse the lawmakers' duty to legislate rationally, and to assess the virtues and drawbacks of this strand of judicial control in a constitutional democracy. By bringing together legislation (...) experts and public law scholars to elaborate on 'legisprudence under review', this contributed volume aspires to shed light on the constitutionalisation of rational lawmaking as a controversial trend gaining ground in both national and international jurisdictions. The book is divided into five parts. Part I frames the two key issues pervading the whole collection: the intricate relationship between judicial review and democracy, on the one hand, and the possibility of improving and rationalizing the task of legislation under the current circumstances of politics, on the other. Part II provides an overview of the judicial review of rational lawmaking, laying special emphasis on the duty of legislative justification imposed on lawmakers by the German Constitutional Court. Part III is devoted to the review of the systemic rationality of legislation, in particular to the requirements of legislative consistence and coherence as developed by this court. Contributions in Part IV revolve around the judicial scrutiny of the socio-empirical elements of rational lawmaking, with the control of legislative facts and impacts and the problem of symbolic laws being the central topics. Finally, Part V draws on the German case law to discuss the links between rational lawmaking, balancing and proportionality, and the interdependence between process review and substantive review of legislation.
