Background and aim Child and adolescent forensic psychiatry is fraught with complex medical, legal, and social tensions. The ethical challenges this entails for inhospital treatment have hardly been investigated, and specific support for health care professionals is lacking. This study identifies ethical issues and problems in this area and develops a tool for early detection and intervention of ethical problems in clinical practice. Methods A systematic literature search and an observational study in adolescent forensics at the University Psychiatric Clinics Basel (...) are conducted. The observation data are evaluated using a qualitative content analysis. The instrument is developed based on the results using a new method. Results In the literature search, 14 valid publications were identified that mainly address ethical conflicts in legal psychiatry, such as professional role conflicts, ethical problems in diagnostics and assessment, or confidentiality issues. Empirical or empirical–normative studies are missing. In the observational study, 24 ethical issues and specific conflicts were identified. Ethical questions about moral competencies of the adolescents, the quality of treatment, the handling of rules and sanctions, and freedom and privacy are particularly common. The Instrument for Early Detection and Intervention of Ethical Problems (FIEP) contains the four core elements risk factors, indicators, intervention planning and decision-making. Conclusions Inhospital treatment in forensic child and adolescent psychiatry reveals a broad spectrum of ethical issues with specific ethical problems, which are hardly investigated in literature so far. The FIEP instrument developed here supports health care practitioners in recognizing ethical problems at an early stage and addressing them efficiently. (shrink)

Appraisal theories of emotion have had a strong impact on the development of theory and experimental research in the domain of the affective sciences. While there is generally a high degree of convergence between theorists in this tradition, some central issues are open to debate. In this contribution three issues have been chosen for discussion: (a) varieties of relevance detection, (b) varieties of valence appraisal, and (c) sequential-cumulative effects of appraisal results. In addressing these issues, new theoretical ideas are suggested (...) and an update of recent research on the sequence of appraisal processes is provided. Special emphasis is placed on nonverbal signatures of appraisal processes. (shrink)

Hegel's Encyclopaedia Logic constitutes the foundation of the system of philosophy presented in his Encyclopaedia of the Philosophical Sciences. Together with his Science of Logic, it contains the most explicit formulation of his enduringly influential dialectical method and of the categorical system underlying his thought. It offers a more compact presentation of his dialectical method than is found elsewhere, and also incorporates changes that he would have made to the second edition of the Science of Logic if he had lived (...) to do so. This volume presents it in a new translation with a helpful introduction and notes. It will be a valuable reference work for scholars and students of Hegel and German idealism, as well as for those who are interested in the post-Hegelian character of contemporary philosophy. Zusammenfassung Spitzensport zu betreiben und gleichzeitig ein Hochschulstudium zu absolvieren, scheint unter den derzeitigen Umständen nahezu unmöglich. Der Artikel konstruiert dieses Phänomen der Unvereinbarkeit zweier Karrieren zunächst gesellschaftstheoretisch als Inklusionsproblem. Da eine merkliche Verbesserung der Situation der Athleten letztlich nur auf Seiten der Hochschule erwartet werden darf, werden anschließend aus organisationstheoretischer Perspektive die dortigen Möglichkeiten und Grenzen interner Strukturveränderungen reflektiert. Schließlich wird diskutiert, wie Hochschulen mit den Erwartungen des Spitzensports umgehen können und in welcher Weise sich im Rahmen von Netzwerken (...) womöglich doch Kooperationsbeziehungen zwischen den beteiligten Organisationen zugunsten studierender Spitzensportler aufbauen lassen. The contributions to this volume offer a rich, detailed, and in some respects innovative and remarkable account of that uniquely fecund and philosophically revolutionary epoch known as German Idealism. The epoch’s historical context, its driving ideas, its post-Kantian development, and its repercussions in post-Hegelian philosophy are all presented competently and concisely. The editor also included essays on some of the philosophical ideas underlying the parallel phenomenon of German Romanticism, for good reasons, since some of the foremost poets and literary theorists (...) of the age were philosophers in their own right, whose influence on the development of German Idealism was not insignificant. What emerges from this collection is the picture of a multifaceted philosophical movement embedded in and influenced by and in turn influencing a complex intellectual and literary environment. The reader of this volume will be in no danger of reducing German Idealism to a linear development that started with Kant and that was preordained to culminate in Hegel’s system. (shrink)

A pragmatic (communication-discursive) cognitive sociology beyond observationism (Luhmann, Turner, Conein) and individualistic reductionism (Esser, Boudon) as a way to do sociology as a critical theory and as a positive science is proposed, drawing on the Habermasian theory of communicative action and its radical continuation in Luhmann's concept of the (cognitive) autopoiesis of social systems.

Here I try a new synthesis of personalism and materialism leading to new concepts of sense. Beginnig with the analysis of the correlations between matter, personality, language, understanding, cognition, knowledge, and the problem of truth, followed by a critique of pragmatism, personalism and "new realism" as well as by ontological concretisations in different fields of philosophy, i.e. in logical order from cosmology to anthropology, ethics, history and political philosophy (including globalization, digital revolution amd ecocide), aesthetics, and philosophy of religion, leading (...) to new concepts of sense and value. Of immediate political relevance is my new concept of a democratic eco-socialism, drawing conclusions of the failure of the socialist experiences in the world up to nowadays. Not giving up the Marxian vision of a realm of Freedom, Justice and Solidarity, that of a "free association of free individuals". (shrink)

In contrast to the view of SHACKLETON BAILEY, the thesis is proposed here that Cic. Att. 12,3,2 does not refer to a debt certificate of Caesar, but one issued by Pompey in the spring of 48 BC. The debt was to be paid on Caesar’s orders from the proceeds of the auction of the confiscated property of Pompey, who had perished in the civil war.

Die Arbeiten der Künstler Paul Cézanne, Paul Klee und Wassily Kandinsky werden in diesem Band phänomenologisch betrachtet. Auf je eigene Weise vollzieht jeder von ihnen eine Wendung im Kunstverständnis. Bezeichnend dafür ist Klees berühmter Satz von 1920: »Die Kunst gibt nicht das Sichtbare wieder, sondern macht sichtbar.« Klaus Kienzler untersucht an exemplarischen Werken, auf welche Weise sich die drei Maler mit philosophischen Grundthemen wie Zeit und Bewegung auseinandergesetzt haben. An operationalist argument criticized. Operationism maintains that the relation between a quantity and its operational criteria is established by definition. The assertion that the relation holds cannot be an empirical hypothesis; it is neither falsifiable nor confirmable, since it is not even testable. With an example concerning the measurement of time it is shown that this argument rests upon an untenable presupposition.

Science, technology, commerce and consumerism have set humankind on a trajectory towards a catastrophe of inestimable proportions. To respond appropriately to this danger, theology must replace obsolete contextualisations of its message with currently relevant ones. ‘Creation out of nothing’ is a case in point. Will God create a new and perfect world ‘out of nothing’ after we have messed up the one we have? Probably not! In Part I, I show that ‘creation out of nothing’ is not a relevant issue (...) in the biblical tradition. In Part II, I argue that the concept is based on the unsupported metaphysical postulate of ‘divine perfection’. In Part III, I try to find an equivalent for the concept in science that theology could link up with. ‘Creation’ can be equated with a cosmic evolution proceeding in levels of emergence. But ‘out of nothing’ cannot be supported by science. Even at the most fundamental level, energy and the way it operates, are presupposed. At lower levels, the process is guided by causality and (embedded) contingency. Intentionality and agency only appear at the personal and social levels. Dealing with existential needs, faith (appropriately) intuits a personal transcendent Source and Destiny of reality, but (inappropriately) absolutizes the personal at the expense of the impersonal aspects of reality. The laws of nature are also of God; they are essential; they are valid. They leave sufficient space for novelty and agency, but God works as much through regularity as through contingency. Contribution: The dynamic nature of the biblical tradition demands constant re-contextualisations of its central message. ‘Creation out of nothing’ is part of the contextualisation of the message into the ancient Hellenistic worldview, which does not fit into the modern scientific worldview and must be replaced with a contemporarily more appropriate alternative. The hypothesis of two separate reasoning systems, one subserving individual goals and the other our genes, is theoretically implausible and not supported by the data. As an alternative, I propose a single system for analytical reasoning backed up by simple mechanisms for the selection of relevant information. This system can generate normative behavior as well as systematic deviations from it.
