: In a short and much-neglected passage in the second Critique, Kant discusses the threat posed to human freedom by theological determinism. In this paper we present an interpretation of Kant’s conception of and response to this threat. Regarding his conception, we argue that he addresses two versions of the threat: either God causes appearances directly or he does so indirectly by causing things in themselves which in turn cause appearances. Kant’s response to the first version is that God cannot (...) cause appearances directly because they depend essentially on the passive sensibility of finite beings. Kant’s response to the second version is that human beings are endowed with transcendental freedom, which blocks the causal transitivity that is presupposed by this version. The U.S. Supreme Court declared procreation to be a fundamental right in the early twentieth century in a case involving Oklahoma's Habitual Criminal Sterilization Act, an act that permitted unconsented sterilization of individuals convicted of certain crimes. The right that the Court articulated in that case is a negative right: it requires that the government not place unjustified roadblocks in the way of people seeking to procreate, but it does not require the government to take positive steps to help people (...) procreate if they wish to. I argue that a positive legal right is morally necessary in the United States, given the profound significance of procreation, the current barriers to access to care, and the related issues of individual and societal justice. I assume at the outset that the right to procreate should be expansive enough to include a right to noncoital reproduction. The absence of a positive right to procreate reflects not just constitutional tradition but also a governmental and societal commitment to a longstanding set of reproductive hierarchies by which those who fall outside of the traditional framing of family too frequently find their procreative dreams hindered. Reconceiving procreative rights to include a positive right would create greater opportunities to argue and lobby for increased access to technologies that are out of reach for many. (shrink)

The book will take instances of 'justice' in one jurisdiction and use global examples to illustrate how ambiguous the concept of 'justice' can be.

Stand your ground laws (SYG) allow an individual to use deadly force against a perceived attacker anywhere that he or she has a legal right to be, without the requirement to attempt retreat before using deadly force. This article offers an analysis of SYG laws through a Sartrean existentialist lens. Drawing off existing empirical research and case examples, I make three claims: First, SYG laws have existential import to the extent that they influence individuals’ beliefs, behavior, and judgments. Second, this (...) existential import makes individuals more likely to perceive situations as threatening and find reasons to be afraid. Third, the phenomenological experience of negative emotions such as fear and anger affects our ability to make careful and reasoned judgments regarding the amount of threat we face. I build my case for these three claims using Sartre’s concept of fundamental project, or the image of self used to organize one’s existential possibilities. I also use Sartre’s phenomenological account of emotion and Robert Solomon’s account of emotion, which has Sartrean roots. I argue that, based on my analysis, the right to use self-defense should include the duty to retreat when possible. (shrink)

Smith argues that liberalism properly understood can recognize the moral status and social meaning of animals and provides guidance in fashioning animal policy.

The purpose of this paper is to challenge what is often called the “Uniqueness” thesis. According to this thesis, given one’s total evidence, there is a unique rational doxastic attitude that one can take to any proposition. It is sensible for defenders of Uniqueness to commit to an accompanying principle that: when some agent A has equal epistemic reason both to believe that p and to believe that not p, the unique epistemically rational doxastic attitude for A to adopt with (...) respect to whether p is the suspension of judgment. In this paper, I offer a case wherein the agent has equal epistemic reason both to believe that p and to believe that not p, but the agent is not epistemically required to suspend judgment about whether p. Furthermore, the case is such that there seems to be no uniquely rational attitude for the agent to adopt. (shrink)

Amid the current mental health crisis, the limited perspectives of psychology and medicine fail to adequately explain and treat generalized anxiety and depression. Viewing these phenomena simply as illnesses to cure conceals what underlying issue their occurrence might indicate, which I argue is the failure to properly assume moral responsibility for oneself. Borrowing from the ethical accounts of both Aristotle and Simone de Beauvoir, I suggest that the core of responsibility is the discernment of the truth of reality for oneself, (...) so that one may choose how to act and what to believe. I propose that exploring the link between generalized anxiety and depression, and moral responsibility understood this way is a fruitful avenue for philosophy to enter the mental health discussion. If this link is viable, then the further development of one’s reasoning skills with a philosophical consultant would seem a viable alternative intervention to medication. (shrink)

Although it is not yet officially recognized as a clinical entity which is diagnosable, Internet Gaming Disorder (IGD) has been included in section III for further study in the DSM-5 by the American Psychiatric Association (APA, 2013). This is important because there is increasing evidence that people of all ages, in particular teens and young adults, are facing very real and sometimes very severe consequences in daily life resulting from an addictive use of online games. This article summarizes general aspects (...) of IGD including diagnostic criteria and arguments for the classification as an addictive disorder including evidence from neurobiological studies. Based on previous theoretical considerations and empirical findings, this paper examines the use of one recently proposed model, the Interaction of Person-Affect-Cognition-Execution (I-PACE) model, for inspiring future research and for developing new treatment protocols for IGD. The I-PACE model is a theoretical framework that explains symptoms of Internet addiction by looking at interactions between predisposing factors, moderators, and mediators in combination with reduced executive functioning and diminished decision making. Finally, the paper discusses how current treatment protocols focusing on Cognitive-Behavioral Therapy for Internet addiction (CBT-IA) fit with the processes hypothesized in the I-PACE model. In The Frontiers of Justice, Martha Nussbaum argues that social contract theory cannot accommodate political duties to animals because it requires the parties to the contract to enjoy rough physical and mental equality. Her interpretation of the social contract tradi­tion is unpersuasive; social contract theory requires only that the parties be equally free and deserving of moral consideration. Moreover, social contract theory is superior to her capabilities approach in that it allows us to limit the scope of the community of (...) justice to animals we are capable of recognizing as subjects of justice and with whom we have a political relationship. Georg Wilhelm Hegel’s dialectic plays a crucial role in some of the thought of the most prominent Black thinkers. The role it plays has received little attention. In this dissertation, I begin to fill this lacuna in Africana Philosophy by examining the arguments of William Edward Burghardt Du Bois in “The Conservation of Races,” Frantz Fanon in Black Skin, White Masks and The Wretched of the Earth, and Cyril Lionel Robert James in The Black Jacobins: Toussaint L’Ouverture and the San (...) Domingo Revolution and Notes on Dialectics: Hegel, Marx, Lenin. I argue that forms of praxis are the result of their engagement with Hegel’s dialectic: reflexive practice, absolute praxis, and organic praxis respectively. I show that in each of these cases Hegel’s dialectical approach to history (dialectical thinking) was essential to their own attempts to understand the possibility of a positive transformation of the pervasively racist world they inhabited. Martin Heidegger’s influence on the thought of Hannah Arendt has been frequently noted, but the precise nature of Arendt’s critique of her mentor is less understood. Kim Maslin argues that Arendt’s work attempted to transform fundamental ontology for responsible use in the public realm.

It has been argued that infants possess a rich, sophisticated theory of mind that is only revealed with tasks based on spontaneous responses. A mature theory of mind implies the understanding that mental states are person-specific. Previous studies on infants’ understanding of motivational mental states such as goals and preferences have revealed that, by 9 months of age, infants do not generalize these motivational mental states across agents. However, it remains to be determined if infants also perceive epistemic states as (...) person-specific. Therefore, the goal of the present study was to use a switch agent paradigm with the classic false belief violation-of-expectation task. Results revealed that 16-month-old infants attributed true and false beliefs to a naïve agent—they did not perceive beliefs as person-specific. These findings indicate that infants’ understanding of beliefs is not as sophisticated as the rich mentalistic view suggests. (shrink)

Kazimir Malevich’s style of Suprematist painting represents the inauguration of nothing less than a new form of culture premised upon a demolition of the Western tradition’s reifying habits of objective thought. In ridding his canvases of all objects and mimetic conventions, Malevich sought to reconfigure human perception in such a way as to open consciousness to alternative modes of organization and signification. In this paper, I argue that Malevich’s revolutionary aesthetic strategy can be illuminated by a return to the very (...) basis of this tradition, namely by a reconsideration of Aristotle’s account in De Anima III.2 of the initial possibility of objective perception as such. A closer look at the character of Odysseus in the opening passages of the Philoctetes reveals a more nuanced psychology of guilt and justification than commentators have thus far appreciated in the cunning hero’s role. This paper examines the relations of sympathy between Odysseus, Neoptolemus, and Philoctetes as a way of entering into the complicated political drama of the work. Conceiving politics in the Philoctetes as a hybrid construction of the demands of nature and the demands of the gods, this (...) study provides a reading of Sophocles’ play as an observation of the necessity for political regimes to efface the very conditions of sympathy that made them possible in the first place. On this reading, Sophocles’ tragedy is to be seen as an explorarion of the damage incurred by individuals when such effacement takes place. (shrink)
