There is nothing like an overwhelming consensus of opinion to encourage a less than rigourous approach to analyzing complex ethical issues. Unfortunately, this is nowhere more apparent than in the discussion of human reproductive cloning contained in the federal House of Representatives Standing Committee on Legal and Constitutional Affairs’ report on human cloning, released last August The report may well fulfil the first half of its project, namely the empirical task of adequately summarizing and categorizing the various submissions made to (...) the Committee. However, it is clearly inadequate as a discussion of the ethical and legal permissibility of human reproductive cloning. (shrink)

Epistemology orthodoxy is a purist one in the sense that it separates out the epistemic from the practical. What counts as evidence is independent of what we care about. Which beliefs count as justified and which count as knowledge are independent of our practical concerns. In recent years, many epistemologists have abandoned such purist views and embraced varying degrees of pragmatic encroachment on the epistemic. I survey a variety of these views and explore the main arguments that proponents of pragmatic (...) encroachment have offered in addition to the main criticisms of the pragmatic approach. (shrink)

Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

An observation of Hume’s has received a lot of attention over the last decade and a half: Although we can standardly imagine the most implausible scenarios, we encounter resistance when imagining propositions at odds with established moral (or perhaps more generally evaluative) convictions. The literature is ripe with ‘solutions’ to this so-called ‘Puzzle of Imaginative Resistance’. Few, however, question the plausibility of the empirical assumption at the heart of the puzzle. In this paper, we explore empirically whether the difficulty we (...) witness in imagining certain propositions is indeed due to claim type (evaluative v. non-evaluative) or whether it is much rather driven by mundane features of content. Our findings suggest that claim type plays but a marginal role, and that there might hence not be much of a ‘puzzle’ to be solved. (shrink)

In this paper I will revisit an argument that I have called “the supervenience argument”; it is sometimes called “the exclusion argument” in the literature. I want to reconsider several aspects of this argument in light of some of the criticisms and comments it has elicited, clarifying some points and offering a slightly reformulated—and improved—version of the argument. My primary aim, however, is to discuss and respond to Ned Block’s edifying and challenging critique of the argument in his “Do Causal (...) Powers Drain Away?”—in particular, his claim that the argument has the consequence that if there is no bottom microphysical level, causal powers will “drain away”, leaving us with no causation anywhere. The supervenience argument was designed to show that on a certain popular and influential view of mentality and its relationship to the physical, mental properties turn out to be epiphenomenal, that is, without causal powers of their own. In this article, I present a substantive proposal about the timing and nature of the final stage of the evolution of full human language, the transition from so-called “protolanguage” to language, and on the origins of a simple protolanguage with structure and displaced reference; a proposal that depends on the idea that the initial expansion of communicative powers in our lineage involved a much expanded role for gesture and mime. But though it defends a substantive proposal, the article also defends (...) and illustrates a methodological proposal too. I argue that language is a special case of a more general phenomenon—cumulative cultural evolution—and while we rarely have direct information about communication, we have more direct information about the cumulative cultural evolution of technical skill, ecological strategies, and social complexity. These same factors also enable us to make a reasonable estimate of the intergenerational social learning capacities of these communities and of the communicative demands these communities face. For example, we can, at least tentatively, identify forms of cooperation that are stable only if third party information is transmitted widely, cheaply, and accurately. So we can use these more direct markers of information accumulation to locate, in broad terms, the period in our evolutionary history during which we became lingual. (shrink)

Until relatively recently, it was often supposed that changes in the material record of hominin life indexed advances in hominin cognitive sophistication in a relatively direct way. In particular, the “Upper Paleolithic Transition”—an apparently abrupt increase in the complexity and disparity of our material culture—was thought to signal the arrival of the fully human mind. While the idea of a direct relationship between material complexity and cognitive sophistication still has some defenders, this view has largely been abandoned. It is now (...) widely appreciated that aspects of ancient hominins’ demographic and social organization have a powerful influence both on the material culture they need and the material culture they can sustain. But if this more nuanced view is right, what does the deep material record tell us about the evolution of hominin cognition? I explore that question in this article. (shrink)

This paper has two aims. One is to defend an incrementalist view of the evolution of language, not from those who think that syntax could not evolve incrementally, but from those who defend a fundamental distinction between Gricean communication or ostensive inferential communication and code-based communication. The paper argues against this dichotomy, and sketches ways in which a code-based system could evolve into Gricean communication. The second is to assess the merits of the Sender–Receiver Framework, originally formulated by David Lewis, (...) and much elaborated and set into an evolutionary context by Brian Skyrms and colleagues, as a framework for thinking about the evolution of language. Despite the great strengths of that framework, and despite the great value of a framework that is both general and formally tractable, I argue that there are critical features of language that it fails to capture. In this paper, I argue that the adaptive fit between human cultures and their environment is persuasive evidence that some form of evolutionary mechanism has been important in driving human cultural change. I distinguish three mechanisms of cultural evolution: niche construction leading to cultural group selection; the vertical flow of cultural information from parents to their children, and the replication and spread of memes. I further argue that both cultural group selection and the vertical flow of cultural information have been (...) important. More conjecturally, I identify a potential role for meme-based cultural evolution in the explanation of the ‘human revolution’ of the last 100 000 or so years, and defuse an important objection to that explanation. In the last few years, nativist, modular views of moral cognition have been influential. This paper shares the view that normative cognition develops robustly, and is probably an adaptation. But it develops an alternative view of the developmental basis of moral cognition, based on the idea that adults scaffold moral development by organising the learning environment of the next generation. In addition, I argue that the modular nativist picture has no plausible account of the role of explicit moral judgement, and (...) that no persuasive version of the ‘poverty of the stimulus' applies to moral cognition. Hitherto, the contribution of philosophers to Neuroscience and Education has tended to be less than enthusiastic, though there are some notable exceptions. Meanwhile, the pervasive influence of neuromyths on education policy, curriculum design and pedagogy in schools is well documented. Indeed, philosophers have sometimes used the prevalence of neuromyths in education to bolster their opposition to neuroscience in teacher education courses. By contrast, this article views the presence of neuromyths in education as a call for remedial action, including philosophical action. (...) The empirical basis of this article is a survey, conducted over a period of three years, involving a total of 1144 first-year pre-service student teachers, which revealed alarming levels of belief in five common neuromyths related to children and learning. This study also attempted to probe the origins of these mistaken beliefs and why they gain traction. The findings suggest an urgent need in teacher education to address the problem of neuromyths, not simply because they are mistaken, they often misdirect valuable resources and mislabel children. The article calls for a compulsory unit on neuroscience and education in all courses of teacher education. Moreover, teaching neuroscience in education cannot be left to specialist neuroscientists, philosophers must be involved. (shrink)

This research was focused on investigating why some consumers might support cause-related marketing campaigns for reasons other than personal benefit by examining the influence of moral emotions and cultural orientation. The authors investigated the extent to which moral emotions operate differently across a cultural variable (US versus Korea) and an individual difference variable (self-construal). A survey method was utilised. Data were collected from a convenience sample of US ( n = 180) and Korean ( n = 191) undergraduates. Moral emotions (...) significantly influenced purchase intention for a social-cause product. The influence of an ego-focused moral emotion (i.e., pride) on purchase intention was greater for US than Korean participants. The influence of another-focused moral emotion (i.e., guilt) on purchase intention was greater for high-interdependent participants than for low-interdependent participants. The findings of this research provide important and relevant implications to marketers and policy makers in developing persuasive messages and customer relationship programmes. (shrink)

In introgressive hybridization (the repeated backcrossing of hybrids with parental populations), Edgar Anderson found a source for variation upon which natural selection could work. In his 1953 review article “Introgressive Hybridization,” he asserted that he was “bringing taxonomy to the service of genetics” whereas distinguished colleagues such as Theodosius Dobzhansky and Ernst Mayr did the precise opposite. His work as a geneticist particularly focused on linkage and recombination and was enriched by collaborations with Missouri Botanical Garden colleagues interested in taxonomy (...) as well as with cytologists C.D. Darlington and Karl Sax. As the culmination of a biosystemtatic research program, Anderson’s views challenged the mainstream of the Evolutionary Synthesis. -/- . (shrink)

Measuring Chinese character recognition ability is essential in research on character learning among learners of Chinese as a second language. Three methods are typically used to evaluate character recognition competence by investigating the following properties of a given character: pronunciation, meaning, and pronunciation and meaning. However, no study has explored the similar or dissimilar outcomes that these three measurements might yield. The current study examined this issue by testing 162 CSL learners with various L1 backgrounds and Chinese proficiency levels. Participants' (...) performance in character recognition measured using a phonological method, a semantic method, and a PS method was compared, which led to two major findings. In terms of similarity, participants' performance in character recognition and the influence of L1 background and Chinese proficiency level on character recognition was similar across the three methods. As for differences, the semantic method could yield a character recognition test with better quality than the other two methods, and the three methods yielded different best fitting models and showed different predictions for Chinese proficiency across different L1 groups. Theoretical and practical implications of these findings are proposed. (shrink)

It was about half a century ago that the mind–body problem, which like much else in serious metaphysics had been moribund for several decades, was resurrected as a mainstream philosophical problem. The first impetus came from Gilbert Ryle'sThe Concept of Mind, published in 1948, and Wittgenstein's well-known, if not well-understood, reflections on the nature of mentality and mental language, especially in hisPhilosophical Investigationswhich appeared in 1953. The primary concerns of Ryle and Wittgenstein, however, focused on the logic of mental discourse (...) rather than the metaphysical issue of how our mentality is related to our bodily nature. In fact, Ryle and Wittgenstein would have regarded, each for different reasons, the metaphysical problem of the mind-body relation as arising out of deplorable linguistic confusions and not amenable to intelligible discussion. There was C. D. Broad's earlier and much neglected classic,The Mind and Its Place in Nature, which appeared in 1925, but this work, although robustly metaphysical, failed to connect with, and shape, the mind–body debate in the second half of this century. It is shown that the jet mechanism derivable from the Lorentz deformation picture leads to a nearly constant average jet transverse momentum. It is pointed out that this is consistent with the high-energy experimental data. It is pointed out further that this result strengthens the physical basis for the minimal time-energy uncertainty combined covariantly with Heisenberg's space-momentum uncertainty relation.

A preference method probed infants` perception of object motion on an inclined plane. Infants viewed videotaped events in which a ball rolled downward (or upward) while speeding up (or slowing down). Then infants were tested with events in which the ball moved in the opposite direction with appropriate or inappropriate acceleration. Infants aged 7 months, but not 5 months, looked longer at the test event with inappropriate acceleration, suggesting emerging sensitivity to gravity. A further study tested whether infants appreciate that (...) a stationary object released on an incline moves downward rather than upward; findings again were positive at 7 months and negative at 5 months. A final study provided evidence, nevertheless, that 5-monthold infants discriminate downward from upward motion and relate downward motion in videotaped events to downward motion in live events. Sensitivity to certain effects of gravity appears to develop in infancy. (shrink)

This paper presents an original, ambitious, truth-directed transcendental argument for the existence of an ‘external world’. It begins with a double-headed starting-point: Stroud’s own remarks on the necessary conditions of language in general, and Hegel’s critique of the “fear of error.” The paper argues that the sceptical challenge requires a particular critical concept of thought as that which may diverge from reality, and that this (...) concept is possible only through reflection on situations of error, in which how things are thought to be diverges from how things really are with independent items in an objective world. The existence of such a world is therefore a necessary condition of the possibility of scepticism: such scepticism is therefore false. I defend the argument against objections from Stroud’s sceptic and others. Drawing on Heidegger, the paper concludes by indicating that the chain of necessary conditions includes practical engagement with the world. (shrink)

The concept of guilt in relation to conscience and anxiety is not referred to as a feeling or an emotion in existential philosophy. Rather, the phenomenon of guilt is analyzed through the structure of existence. In Being and Time, Heidegger interprets guilt in the context of Dasein’s understanding of its own Being. The nature of Dasein as a finite entity permeates the analysis of guilt, which is based on the analysis of negation and the time structure of Dasein. An existential (...) interpretation of guilt, conscience, and anxiety offers a new dimension of the study of emotions with regard to the understanding of human Being. (shrink)

This article investigates the liberal political implications of Michael Oakeshott’s political theory of civility and civil association by focusing on his judicious attempts to abate contingency. It argues that Oakeshott’s political theory can be best understood as ‘political pluralism’, aimed at the maximalist accommodation of abundant and fluctuating human pluralities, individual and associational. By reinterpreting Oakeshott as a defender of civil society, composed of numerous purposive associations, against state-imposed monism, it argues that in Oakeshott’s theory civil association is devised to (...) protect associational freedom, thereby keeping civil society as free as possible. It then discusses the distinctiveness of Oakeshott’s characteristically ‘liberal’ political theory by critically engaging it with two dominant strands of liberalism, namely, liberal pluralism and political liberalism. Special relativity has changed the fundamental view on space and time since Einstein introduced it in 1905. It substitutes four dimensional spacetime for the absolute space and time of Newtonian mechanics. It is believed that the validity of this theory has been fully confirmed empirically for the last one hundred years, and therefore, its status is considered canonical, underpinning all physical principles. However, the spacetime metric is a geometric approach to nature when interpreting natural phenomena. A geometric flaw will be (...) exhibited on this, and an alternative is suggested. The reasonable geometric model of space and time is a three-dimensional space that translates along the time direction. This model accurately represents the true characteristics of nature. (shrink)

Human behavior is frequently described both in abstract, general terms and in concrete, specific terms. We asked whether these two ways of framing equivalent behaviors shift the inferences people make about the biological and psychological bases of those behaviors. In five experiments, we manipulated whether behaviors are presented concretely (i.e. with reference to a specific person, instantiated in the particular context of that person’s life) or abstractly (i.e. with reference to a category of people or behaviors across generalized contexts). People (...) judged concretely framed behaviors to be less biologically based and, on some dimensions, more psychologically based than the same behaviors framed in the abstract. These findings held true for both mental disorders (Experiments 1 and 2) and everyday behaviors (Experiments 4 and 5) and yielded downstream consequences for the perceived efficacy of disorder treatments (Experiment 3). Implications for science educators, students of science, and members of the lay public are discussed. (shrink)

Being robustly committed to state neutrality which does not permit the promotion of liberal-perfectionist ideals and denying that there is anything normatively relevant or ‘special’ about religion leaves liberal-egalitarians embroiled in a paradox. If religion is not special, how and why do liberal states afford it differential treatment (in comparison with non-religious analogues like secular doctrines or deeply-held beliefs of individual conscience)? This paper explores liberal-egalitarian strategies for resolving this paradox with predominant reference to the disaggregation strategy advanced by Cécile (...) Laborde. After discussing the novelty and advantages of disaggregation relative to other liberal-egalitarian strategies, the paper distinguishes between the coverage and the basis in justification of differential treatment to argue that disaggregation does not ultimately succeed in solving the latter. Despite this, reflecting on the clarifications achieved through disaggregation and the deeper issues of justification and justice emerging therefrom, the paper concludes by proposing the need to consider a lateral solution to the paradox and speculating on what this might look like. Patient participation is one of the most prevalent focus areas in the Danish healthcare debate. Patient participation is generally presented as a fundamental democratic right, and is stated in an objective language with legal requirements for healthcare professionals to ensure that patients systematically participate in their own courses of care and treatment. In the research literature, it is not clear what is meant by ‘patient participation’, and several discourses on patient participation exist side by side. This study explores how discourses (...) of patient participation unfold and are at play in the articulations in official legal and political documents and patient records relating to a Danish psychiatric context. The documents and patient records have been analyzed using a Fairclough‐inspired critical discourse approach which is concerned with how power is exercised through language. The research findings show that patient participation within Danish psychiatric healthcare is governed within a neoliberal discourse where underlying discourses; discourse of biomedicine, paternalism, management, evidence and ethics of care are embedded, and a discourse that seems to ascribe stigmatizing traits to mentally ill patients. This article addresses the exclusivism–inclusivism debate about religious reasons in law within a justificatory liberal framework. The question of whether religious reasons have justificatory capacity for attaining public justification has increasingly been seen as a matter of how public justification is understood between two rival models: the consensus model being aligned with exclusivism, the convergence model with inclusivism. More recently, however, that alignment has been challenged with attempts to show that consensus can reach an equivalent degree of inclusivism as convergence. (...) Against this, I contend that the purported equivalence is misplaced. First, I identify a crucial ambiguity about public justification and two corresponding domains. Upon demonstrating these to be mutually independent and severable, I conclude that the moves to equalize the models are confined within the more narrow domain while, in the more fundamental domain, the choice of model continues to prove determinative as to the exclusivist or inclusivist valence of justificatory liberalism. ABSTRACTThis study assessed the knowledge and perception of human biological materials and biorepositories among three study groups in South Korea. The relationship between the knowledge and the perception among different groups was also examined by using factor and regression analyses. In a self‐reporting survey of 440 respondents, the expert group was found more likely to be knowledgeable and positively perceived than the others. Four factors emerged: Sale and Consent, Flexible Use, Self‐Confidence, and Korean Bioethics and Biosafety Action restriction perception. The (...) results indicate that those who are well aware of the existence of biobanks were more positively inclined to receive the Sale and Consent perception. As a result of the need for high quality HBMs and the use of appropriate sampling procedures for every aspect of the collection and use process, the biorepository community should pay attention to ethical, legal, and policy issues.
