he relationship between metaphysics and science has recently become the focus of increased attention. Ladyman and Ross, in particular, have accused even naturalistically inclined metaphysicians of pursuing little more than the philosophy of A-level chemistry and have suggested that analytic metaphysics should simply be discontinued. In contrast, we shall argue, first of all, that even metaphysics that is disengaged from modern science may offer a set of resources that can be appropriated by philosophers of physics in order to set (...) physics within an interpretational framework. Secondly, however, we shall urge that insofar as metaphysics is intended to be more than just a toolbox it needs to accommodate the implications of physics if many of its core claims are to be sustained. We shall illustrate this last point with a discussion of the nature of laws and modality in the context of modern physics. (shrink)

The doxastic view (DV) of trust maintains that trust essentially involves belief. In a recent paper, Arnon Keren (Citation2020) gestures toward a new objection to the view, labeled Trust’s Meno Problem (TMP), which calls into question the DV’s ability to explain the widely held intuition that trust has distinct and indispensable value. As of yet, there has been no attempt to take up TMP on behalf of DV. This paper aims to fill precisely this lacuna. I do so in three (...) main stages. In §1 I contextualize and elucidate the problem, to which Keren gestures but does not address in detail. In §2 I disambiguate multiple possible interpretations of TMP, seeking to identify the most philosophically challenging. Finally, in §3, I argue that DV can solve even this interpretation. In order to do so, I make use ofthe highly plausible claim we find in the work of Katherine Hawley (Citation2012, 2019): that trust pays a compliment to the trustee. The payoffs of exploring the doxastic view in the context of Trust’s Meno Problem are twofold: we better understand the nature of the problem itself, and we see that the doxastic view can give a satisfying answer. Until recently, Albert Einstein's complaints in his later years about the intelligibility of Quantum Mechanics often led philosophers and physicists to dismiss him as, essentially, an old fool in his dotage. Happily, this kind of thing is now coming to an end as philosophers and mathematicians of the caliber of Karl Popper and Roger Penrose conspicuously point out the continuing conceptual difficulties of quantum theory [cf. Penrose's searching discussion in The Emperor's New Mind, chapter 6, "Quantum magic and quantum mystery," (...) Oxford 1990]. The Paradox of Schrödinger's Cat is sometimes now even presented, not as a wonderful exciting implication of the theory, but for what it originally was: a reductio ad absurdum argument against the "new" quantum mechanics of Heisenberg and Bohr. Introduction and Discussion of a Special Issue in philosophy of law "Philosophical Dimensions of the Trial" -/- .

The nature of craft creativity has often been ignored in research which focuses on innovative and novel ideas and thought processes. This view of creativity casts the repetitive nature of craft as antithetical to the disruptive nature of genuine creativity. Drawing on combined enactivist and pragmatist accounts of habits and on a focused cognitive ethnography of a wooden bowl turner, this paper explores the nature of the constraints wrought by habitual action. Habitual action will be shown to be less repetitive (...) than may be initially assumed because of the uncertainty inherent in working with both the wood which forms the initial material and the tools necessary to transform it. Rather, this paper proposes habitual learned movements as an important concept in a pragmatist-informed theory of creativity since they mark the skilled co-ordination of material, tool and maker, at once constraining and enhancing the creative craft process. In a period of high definition, photorealism, and postmodern deconstruction the experience of art making, its theory, and its art itself have drifted away from some understandable connection to the process of art creation as a connection to some psychologically deep inspiration. Abstract art as conceived and practiced by Wassily Kandinsky, which included in his later stage beyond representation or abstractions of representation jumbled gatherings of biomorphs with no connection to representation may be compared to the White Shaman rock art (...) panel with its gathering of seemingly abstract geometric images as well as transformed representational imagery, much like the related Fate Bell Shelter rock art and Three Rivers Petroglyphs. Kandinsky would claim his expressed abstractions are prompted by his psyche. The artist or artists of the White Shaman panel of the lower Pecos River operated under transformed consciousness and Shamanism. Kandinsky’s “unconscious, spontaneous expression” and “expression... of inner feeling” may be compared to the probably hallucinogenic connection to the other world in the White Shaman panel. Such connections and abstractions and transformations could be related to the “total theater” of Diaghilev and the contemporary rave dances in which consciousness is heightened by sensory overload. The cybernetic capacity of the computer age has worked in another direction and even “objectified” consciousness itself. (shrink)

“Ontario and its Universities” embodies the views, on several central issues in higher education in Ontario, of members of a seminar which met regularly in the autumn of 1973 and early winter of 1974. The seminar was initiated by a group of professors from the University of Toronto and York University. They invited a number of their academic colleagues and several interested and informed persons from the wider public to discuss with them the responsibilities and essential requirements of the contemporary (...) university in Ontario. Theorists of human evolution are interested in understanding major shifts in human behavioural capacities (e.g. the creation of a novel technological industry, such as the Acheulean). This task faces empirical challenges arising both from the complexity of these events and the time-depths involved. However, we also confront issues of a more philosophical nature, such as how to best think about causation and explanation. This article considers such fundamental questions from the perspective of a prominent theory of causation in the philosophy (...) of science literature, namely, the interventionist theory of causation. A signature feature of this framework is its recognition of a family of distinct types of causes. We set out several of these causal notions and show how they can contribute to explaining transitions in human behavioural complexity. We do so, first, in a preliminary way, and then in a more detailed way, taking the origins of behavioural modernity as our extended case study. We conclude by suggesting some ways in which the approach developed here might be elaborated and extended. (shrink)

Systemic existential conditions are indelible aspects of a client's reflective and nonreflective modes of consciousness, and therefore fall within the purview of philosophical counseling. This paper focuses on the experience of the dehumanization that is a function of the monetization of all aspects of post-modern neoliberal society. Monetization demands radical self-abandonment, self-anesthesia, auto-aggressive self-exploitation and addiction for functionality within the system. The bankrupt logic of pandemic terrorism confirms that monetization has become the preeminent measure of value. Monetization distorts both reason (...) and value, concealing a covert nihilism masquerading as the new metaphysics. The symbiotic natural world evidences a level of cooperation and coexistence that escapes monetization. Therefore, a monetized society is a society at odds with the world ecosystemand life itself. Caught in a labyrinth ofmonetized dehumanization, clients often participate in the fictional metanarrative of belief in unlimited individual possibility as a hedge against anxiety, depression, powerlessness, anomie, and the logical loop of cognitive dissonance. Our response to Sara Fry's paper focuses on the difficulty of understanding her insistence on the fundamental character of caring in a theory of nursing ethics. We discuss a number of problems her text throws in the way of making sense of this idea, and outline our own proposal for how caring's role may be reasonably understood: not as an alternative object of value, competing with autonomy or patient good, but rather as an alternative way of responding toward that which (...) is of value. Institutional investors, policy makers, and researchers have advocated for greater director independence in hopes of improving corporate governance and discouraging unethical behaviors such as corporate frauds, accounting irregularities, and other organizational failures. However, increasing demands upon directors and sitting CEOs, as well as constraints on the number of boards on which they can serve, has resulted in a dramatic increase in the use of retired independent directors. Compared to other directors with full-time job demands, we argue that RIDs have lesser (...) time constraints and greater attentional capacities with which to discharge their responsibilities, thereby improving overall board “bandwidth.” Using S&P 1500 firms for the period of 2000–2012, we find that enhanced board bandwidth associated with an increased proportion of RIDs on the board relates to greater resource provisioning through reducing costs of capital, improved monitoring through reducing disclosure-related weaknesses, and better accounting and market performance. We thereby advance traditional board bandwidth research by contemplating the available time that independent directors would have by virtue of being retired and relating this to board effectiveness. Protein synthesis inhibitors prolong the half‐lives of most mRNAs at least fourfold in the somatic cells of higher eukaryotes and in yeast cells. Some mRNAs are stabilized because the inhibitors affect mRNA‐specific regulatory factors; however, hundreds or thousands of other mRNAs are probably stabilized by a common mechanism. We propose that mRNA stabilization in cells treated with a translation inhibitor reflects a physiological process that occurs during each mitosis and is important for cell survival. Transcription and translation rates decline drastically (...) during a 1–2 hour interval of mitosis. We hypothesize that translational repression during this interval somehow inactivates a critical component of the mRNA degradation machinery. As a result, mRNA half‐lives are prolonged during the interval when transcription is repressed. If labile mRNAs were not stabilized during mitosis they, and perhaps also the labile proteins they encode, would be depleted as the cell entered G1 phase, with deleterious consequences. Stabilization during mitosis, or in response to translation inhibitors, thus preserves the capacity of the cell to synthesize essential proteins as it enters G1 or recovers from inhibitor treatment. mRNA stabilization might serve a similar purpose during starvation or any stress negatively affecting translation. Clark expresses reservations about Friston's reductive interpretation of action-oriented predictive processing (AOPP) models of cognition, but he doesn't link these reservations to specific alternatives. Neuroeconomic models of sub-cognitive reward valuation, which, like AOPP, integrate attention with action based on prediction error, are such an alternative. They interpret reward valuation as an input to neocortical processing instead of reducing it.

This article uses an account of dwelling to interrogate the concept of curriculum making. Tim Ingold’s use of dwelling to understand culture is productive here because of his implicit and explicit interest in intergenerational learning. His account of dwelling rests on a foundational ontological claim—that mental construction and representation are not the basis upon which we live in the world—which is very challenging for the kinds of curriculum making with which many educators are now familiar. It undermines assumptions of propositional (...) knowledge and of the use of mental schemas to communicate and share. At the level of critique, then, dwelling destabilizes contemporary ideas of curriculum as textual, pre-specified content for transmission or pre-defined objectives or standardized activity. The positive claims of dwelling are equally challenging, for these are that the world is a domain of relational entanglement in which an organism can be no more than a point of growth for an emergent ‘environment’, and meaning only inheres in these relations. The paper articulates how differentiation (of learner, salient meanings, knowledge, skill and place) are possible in such an ontology, and how curriculum making can be understood from this perspective as being the remaking of relationships between these. Causal selection has to do with a distinction between mere background conditions and the "true" causes of some outcome of interest. Mainstream philosophical views claim that causal selection is "groundless" in the sense that it lacks any type of principled rationale. I argue against this position in the context of biochemistry where causal factors are selected in explanations of metabolic processes. These factors are selected on the basis of a principled rationale, which is best understood in terms of the causal (...) control that they provide over an outcome of interest. (shrink)

I discuss implications of Tomasello et al's hypothesis that humans exhibit distinctive collective intentionality for game-theoretic approaches to modeling human evolution. Representing the hypothesis game-theoretically forces a question about whether it implies only distinctively human motivations or both distinctive motivations and distinctive cognitive capacities for representation of intentions. I also note that the hypothesis explains uniquely human ideological conflict and invites game-theoretic modeling of this.

Scholars who compare common law and civil law countries have long argued that civil law legal systems such as Germany do not employ formal rules of evidence comparable to those which govern American courtrooms. Civil law systems that commit fact-finding to mixed panels of lay and professional judges are said to have less need for formal rules of evidence that withhold information from decision makers. This article challenges this widely held view. Scholars have failed to recognize that evidentiary rules can (...) restrict not only the presentation of evidence at trial but also the manner of its acquisition during the pre-trial investigation. For this reason, existing scholarship overlooks a rich source of evidentiary norms in the criminal process of civil law countries such as Germany. I argue that German regulation of police interrogation—particularly its prohibition of deceptive stratagems—plays an important role in shaping the factual record on which the legal system assesses guilt or innocence. The article identifies a number of institutional factors on which this system of pre-trial evidentiary regulation depends. (shrink)

This paper critically discusses Amartya Sen’s case for broadening the basket of wellbeing indicators in development policy beyond income and consumption expenditure. I first argue that, contrary to what Sen has suggested, the theoretical and practical motivations that he gives for this do not form a mutually complementary set. In the second, policy-focused, part of the paper I present problems Sen’s approach to measurement raises in the context of a case study from rural South Africa. I conclude by suggesting that (...) development indicators should be regarded as narrower – in particular, that we should give privileged attention to women’s incomes – rather than broader. Lehar argues that a simple Neuron Doctrine cannot explain perceptual phenomena such as size constancy but he fails to discuss existing, more complex neurological models. Size models that rely purely on scaling for distance are sparse, but several models are also concerned with other aspects of size perception such as geometrical illusions, relative size, adaptation, perceptual learning, and size discrimination.
