It has been three years since we held the Feminism, Legality and Knowledge seminar to respond to our developing frustrations and excitement around feminist legal studies and academic publishing. In the wake of our 25th anniversary in 2018, we critically reflect further on our original intention to stock up on decolonising techniques to mix feminism, legality and knowledge whilst building on previous consideration of our self-proclaimed ‘international’ status. These reflections are prompted by editorial board members’ experiences as participants in the (...) Cardiff Law and Global Justice Centre’s British Academy-funded Global South Socio-Legal Writing Workshops in Accra, Nairobi and Recife in 2018. Following an explanation of the concerns with academic publishing that have prompted this reflection, we provide a narrative of our experiences in each of the three workshops exploring the lessons learned and their impact on our practice as editors and scholars in feminist legal studies. We finish with a renewal of our commitment to decolonise our minds and practices by continuing to struggle to earn the label ‘international’ for the journal now and in future. Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

This book provides practical and research-based chapters that offer greater clarity about the particular kinds of teacher reflection that matter and avoids talking about teacher reflection generically, which implies that all kinds of reflection are of equal value.

This paper presents a methodology to design and implement programs intended to decide cases, described as sets of factors, according to a theory of a particular domain based on a set of precedent cases relating to that domain. We useDialectical Frameworks, a recent development in AI knowledge representation, as the central feature of our design method. ADFs will play a role akin to that played by Entity–Relationship models in the design of database systems. First, we explain how the factor hierarchy (...) of the well-known legal reasoning system CATO can be used to instantiate an ADF for the domain of US Trade Secrets. This is intended to demonstrate the suitability of ADFs for expressing the design of legal cased based systems. The method is then applied to two other legal domains often used in the literature of AI and Law. In each domain, the design is provided by the domain analyst expressing the cases in terms of factors organised into an ADF from which an executable program can be implemented in a straightforward way by taking advantage of the closeness of the acceptance conditions of the ADF to components of an executable program. We evaluate the ease of implementation, the performance and efficacy of the resulting program, ease of refinement of the program and the transparency of the reasoning. This evaluation suggests ways in which factor based systems, which are limited by taking as their starting point the representation of cases as sets of factors and so abstracting away the particular facts, can be extended to address open issues in AI and Law by incorporating the case facts to improve the decision, and by considering justification and reasoning using portion of precedents. The indispensability argument is sometimes seen as weakened by its reliance on a controversial premise of confirmation holism. Recently, some philosophers working on the indispensability argument have developed versions of the argument which, they claim, do not rely on holism. Some of these writers even claim to have strengthened the argument by eliminating the controversial premise. I argue that the apparent removal of holism leaves a lacuna in the argument. Without the holistic premise, or some other premise which facilitates the (...) transfer of evidence to mathematical portions of scientific theories, the argument is implausible. (shrink)

This paper points out a tension between Agustín Rayo's criteria for singulartermhood and his explicit views on the status of Hybrid Identities, that is, identity statements that use singular terms from two different Systems of Representation, such as "7=Julius Caesar" or more suggestively "I am b" where "b" is a singular term referring to my brain. It argues that non-trivial Hybrid Identities are common and important in philosophy and elsewhere, and it suggests a friendly alternative that involves treating Hybrid Identities (...) on the model of Rayo's "Just Is" statements. The last section of the paper points out that even this friendly alternative has counterintuitive consequences when combined with the metaphysical conventionalism that Rayo finds attractive, when it comes to questions of personal identity over time. The third of Berman and Hafner’s early nineties papers on reasoning with legal cases concerned temporal context, in particular the evolution of case law doctrine over time in response to new cases and against a changing background of social values and purposes. In this paper we consider the ways in which changes in case law doctrine can be accommodated in a recently proposed methodology for encapsulating case law theories, and relate these changes the sources of change identified by Berman and (...) While the ethics of technology is analyzed across disciplines from science and technology studies, engineering, computer science, critical management studies, and law, less attention is paid to the role that firms and managers play in the design, development, and dissemination of technology across communities and within their firm. Although firms play an important role in the development of technology, and make associated value judgments around its use, it remains open how we should understand the contours of what firms owe society (...) as the rate of technological development accelerates. We focus here on digital technologies: devices that rely on rapidly accelerating digital sensing, storage, and transmission capabilities to intervene in human processes. This symposium focuses on how firms should engage ethical choices in developing and deploying these technologies. In this introduction, we, first, identify themes the symposium articles share and discuss how the set of articles illuminate diverse facets of the intersection of technology and business ethics. Second, we use these themes to explore what business ethics offers to the study of technology and, third, what technology studies offers to the field of business ethics. Each field brings expertise that, together, improves our understanding of the ethical implications of technology. Finally we introduce each of the five papers, suggest future research directions, and interpret their implications for business ethics. (shrink)

Political communities across the world have recently sought to tackle rising rates of vaccine hesitancy and refusal, by implementing coercive immunization programs, or by making existing immunization programs more coercive. Many academics and advocates of public health have applauded these policy developments, and they have invoked ethical reasons for implementing or strengthening vaccine mandates. Others have criticized these policies on ethical grounds, for undermining liberty, and as symptoms of broader government overreach. But such arguments often obscure or abstract away from (...) the diverse values that are relevant to the ethical justifications of particular political communities’ vaccine‐mandate policies. We argue for an expansive conception of the normative issues relevant to deciding whether and how to establish or reform vaccine mandates, and we propose a schema by which to organize our thoughts about the ways in which different kinds of vaccine‐mandate policies implicate various values. Previous accounts of how people develop expertise have focused on how deliberate practice transforms the cognitive and perceptual representations and processes that give rise to expertise. However, the likelihood of developing expertise with a particular tool may also depend on the degree to which that tool fits pre‐existing perceptual and cognitive abilities. The present studies explored whether the abacus—a descendent of the first human computing devices—may have evolved to exploit general biases in human visual attention, or whether developing expertise with (...) the abacus requires learning special strategies for allocating visual attention to the abacus. To address this question, we administered a series of visual search tasks to abacus experts and subjects who had little to no abacus experience, in which search targets and distractors were overlaid atop abacus “beads.” Across three studies, we found that both experts and naïve subjects were faster to detect targets in semantically relevant components of the abacus, suggesting that abacus training is not required to exhibit attentional biases toward these components of the abacus. This finding suggests that the attentional biases that scaffold numerical processing of the abacus may emerge from general properties of visual attention that are exploited by the design of the abacus itself. While we are familiar with socialist and fascist aesthetics, liberalism is not usually thought to permit a political role for literature. Nussbaum has attempted to fill this lacuna. She sketches a “liberal aesthetics” by linking three aspects of literature to her normative proposal. The representation of suffering is connected to the capability approach; the presentation of ethical dilemmas to political liberalism; and the reaction of pity to legal and political judgment. Literature is thus hoped to contribute to the stability of (...) liberal democracies. For over 25 years, individual works by Nussbaum on the value of literature have been critiqued on aesthetic grounds: for not dealing with form, for denying the polyphony of texts, for having a limited conception of readerly identification, and for using an elitist and generically limited selection of material. As of yet, no criticisms have, however, considered the full oeuvre of Nussbaum’s defense of literature, and none have examined this aspect of her work in light of her political philosophy. By placing the aesthetic and political aspects of Nussbaum’s work in conversation, this article investigates the proposed relationship between literature and liberalism. It argues that each component of Nussbaum’s liberal aesthetics contains a political danger: foreclosing discussion of intergenerational responsibility; obscuring questions about which doctrines are permissible in the public sphere; and encouraging stereotypes of marginalized people. Literature, understood like this, may risk exacerbating present tensions within liberalism, rather than bolstering its stability. (shrink)

As a work of philosophically grounded literary criticism in the tradition of Stanley Cavell's ordinary language philosophy, Kenneth Dauber's The Logic of Sentiment: Stowe, Hawthorne, and Melville will be an altogether welcomed book among those for whom it is more instructive to think sentimentality alongside literary authors than to merely historicize—to "archeologize" or "genealogize"—it from an all-too-safe critical distance. Though primarily a book on sentiment, its theoretical through line is to think skepticism outside of the epistemological, to think it in (...) "nonepistemological terms". John Muir can be interpreted to have employed a similar strategy in his earliest conservation advocacy writings as the strategy Ralph Waldo Emerson employed to overcome the public futility of his personal ideals. Like Emerson, Muir came to offset the despair he felt at the political impotence of his conscience with a positive outlook on his potential to embody his subjective ideals both in his personal character and in his contributions to concrete forms of social practice. Muir thus can be (...) shown to have standing in the environmental virtue ethics tradition by dint of his appreciation for the necessity of virtuous political participation in movements for social reform. Maternal grandmothers play a key role in allomaternal care, directly caring for and provisioning their grandchildren as well as helping their daughters with household chores and productive labor. Previous studies have investigated these contributions across a broad time period, from infancy through toddlerhood. Here, we extend and refine the grandmothering literature to investigate the perinatal period as a critical window for grandmaternal contributions. We propose that mother-daughter co-residence during this period affords targeted grandmaternal effort during a period of heightened vulnerability (...) and appreciable impact. We conducted two focus groups and 37 semi-structured interviews with Himba women. Interviews focused on experiences from their first and, if applicable, their most recent birth and included information on social support, domains of teaching and learning, and infant feeding practices. Our qualitative findings reveal three domains in which grandmothers contribute: learning to mother, breastfeeding support, and postnatal health and well-being. We show that informational, emotional, and instrumental support provided to new mothers and their neonates during the perinatal period can aid in the establishment of the mother-infant bond, buffer maternal energy balance, and improve nutritional outcomes for infants. These findings demonstrate that the role of grandmother can be crucial, even when alloparenting is common and breastfeeding is frequent and highly visible. Situated within the broader anthropological and clinical literature, these findings substantiate the claim that humans have evolved in an adaptive sociocultural perinatal complex in which grandmothers provide significant contributions to the health and well-being of their reproductive-age daughters and grandchildren. Mortal and Others shows the serious and non-serious side of Russell's personality and work. It provides a lively and revealing introduction to Russell's thought for all readers. First published in 1975, Mortals and Others is at last available in paperback with a new introduction by John Slater.

The Internet is a huge form of social capital that is not reducible in its characteristics to other forms of social capital, such as ordinary networks of people who more or less know each other. It enables us to do many things with radically greater efficiency than we could without it. It can do some things better but other things much less well than traditional devices can. At both extremes, the differences are so great as to be not merely quantitative (...) but also qualitative. The things it can do better include things that can readily be checked and verified. The things that it often cannot do include securing commitments for action. A brief history of the forms of social cooperation suggests that relationships on the Internet are typically too thin to back trust and cooperation among those who do not have fairly rich relations hips off-line. Continence is a key moment of care that can tell us about the wider care of people living with dementia within acute hospital wards. The spotlight is currently on the quality of hospital care of older people across the UK, yet concerns persist about their poor treatment, neglect, abuse, and discrimination within this setting. Thus, within hospitals, the care of people living with dementia is both a welfare issue and a human rights issue. The challenge of continence care for people (...) living with dementia can be seen as the ‘canary in the coal mine’ for the unravelling of dignity within the acute setting. This paper draws on an ethnographic study within five hospitals in England and Wales, selected to represent a range of hospital types, geographies and socio‐economic catchments. Observational fieldwork was carried out over 154 days in acute hospitals known to admit large numbers of people living with dementia. This paper starts to fill the gap between theory and data by providing an in‐depth ethnographic analysis examining the ways in which treatment as a person is negotiated, achieved or threatened. We examine how the twin assaults on agency of a diagnosis of dementia and of incontinence threaten personhood. The acute threats to this patient group may then act to magnify perils to treatment as a person. Our findings suggest that personal dignity and the social construction of moral personhood are both threatened and maintained in such a setting. We show how empirical ethnographic data can lend weight to, and add detail to, theoretical accounts of moral personhood and dignity. (shrink)

As described elsewhere on this journal’s website, The Journal of Evolution and Technology was founded in 1998 as The Journal of Transhumanism, and was originally published by the World Transhumanist Association. In November 2004, JET moved under the umbrella of the Institute for Ethics and Emerging Technologies , an organization that seeks to contribute to our understanding of the impact of emerging technologies on individuals and societies. Prior to my appointment, in January 2008, as JET’s editor-in-chief, I’d had four distinguished (...) predecessors – Nick Bostrom, Robin Hanson, Mark Walker, and James Hughes – who had established the journal as a leading forum for discussion of the future of the human species and whatever might come after it. Articles that they'd published in JET were – and are – frequently cited in discussions of the human or posthuman future. With a decade of history behind the journal as I commenced my watch this year, and with JET’s fifth year with IEET now underway, we have much to celebrate. I'm personally delighted to have taken up my position with a journal of ideas that has such a rich history and so much promise. JET is a scholarly, peer-reviewed journal. The material that it publishes may or may not be submitted by scholars and scientists currently working within the academy, but it must certainly meet the standards of well-established academic journals. Most submissions received are rejected because they don’t reach the required standard, but we are always looking for appropriate articles and reviews. We require only that they be relevant to the human or posthuman future and that they meet our high standards of scholarship, originality, and intellectual rigor. We welcome submissions on a wide range of relevant topics and from almost any academic discipline or interdisciplinary standpoint. Central to our thinking at JET is the idea – increasingly familiar and plausible – that the human species is about to commence, or has already commenced, a new form of evolution. This is something quite different from the slow Darwinian processes of survival, reproduction, and adaptation. It is powered, rather, by new technologies that increasingly work their way inwards, transforming human bodies and minds. According to this idea, technology can do more than merely giving us tools to manipulate the world around us; it can alter us far more comprehensively than by shaping our neurological pathways when we learn to handle new tools. This idea of a technologically-mediated process of evolution remains controversial, of course, and even if we grant it broad acceptance there is still much to debate. Just how the process might be manifested in the years to come, and just where it might take us or our successors, are both unclear. Nonetheless, the idea merits careful study from many viewpoints, whether scientific, philosophical, historical, sociological, anthropological, legal, artistic … or even theological. (shrink)
