The working class has been interpreted within various disciplines and conceptual frameworks, some pointing to the gap between the depiction of the working class as a potentially active social force in the neoliberal deregulated global market and its portrayal as a suffering class of the marginal and excluded. In this text, I move behind this dichotomy to explore the everyday experiences of working-class men and women. Based on ethnographic research at the Bata shoe factory in the Czech Republic, I examine (...) the meanings factory workers attach to their working classness. I investigate their sense of place in society in general. I argue that class matters in the workers’ perceptions of the self. On the one hand, the workers adopt the awareness of subalternity in relation to the educational and further the labor field that ranks them among the lowest positions. On the other hand, they take individual pride in their endurance of the hard work that shoemaking is believed to be. The committed work and emphasis on collectivity turn the microorganism of the factory into a place of mutual discipline, where the praised collectivity functions also as a tool for enhancing work effectivity, also in the interest of the management. By pointing to the concrete dimensions in which they balance the feelings of pride and shame, belonging, and symbolic displacement, I contribute to the sociological understanding of contemporary working classness. This paper focuses on compost use in overpasses and underpasses for wild animals over roads and other similar linear structures. In this context, good quality of compost may result in faster and more resistant vegetation cover during the year. Inter alia, this can be interpreted also as reduction of damage and saving lives. There are millions of tones of plant residue produced every day worldwide. These represent prospective business for manufacturers of compost additives called “accelerators”. The opinions of the sale (...) representatives’ with regards to other alternatives of biowaste utilization and their own products were reviewed. The robust analyzes of several “accelerated” composts revealed that the quality was generally low. Only two accelerated composts were somewhat similar in quality to the blank sample that was produced according to the traditional procedure. Overlaps between the interests of decision makers on future soil fertility were weighed against the preferences on short-term profit. Possible causes that allowed the boom of these underperforming products and the possible consequences are also discussed. Conclusions regarding the ethical concerns on how to run businesses with products whose profitability depends on weaknesses in the legal system and customer unawareness are to follow. (shrink)

Sound-symbolism is the nonarbitrary link between the sound and meaning of a word. Japanese-speaking children performed better in a verb generalization task when they were taught novel sound-symbolic verbs, created based on existing Japanese sound-symbolic words, than novel nonsound-symbolic verbs (Imai, Kita, Nagumo, & Okada, 2008). A question remained as to whether the Japanese children had picked up regularities in the Japanese sound-symbolic lexicon or were sensitive to universal sound-symbolism. The present study aimed to provide support for the latter. In (...) a verb generalization task, English-speaking 3-year-olds were taught novel sound-symbolic verbs, created based on Japanese sound-symbolism, or novel nonsound-symbolic verbs. English-speaking children performed better with the sound-symbolic verbs, just like Japanese-speaking children. We concluded that children are sensitive to universal sound-symbolism and can utilize it in word learning and generalization, regardless of their native language. (shrink)

Hutto and Satne, Philosophia propose to redefine the problem of naturalizing semantic content as searching for the origin of content instead of attempting to reduce it to some natural phenomenon. The search is to proceed within the framework of Relaxed Naturalism and under the banner of teleosemiotics which places Ur-intentionality at the source of content. We support the proposed redefinition of the problem but object to the proposed solution. In particular, we call for adherence to Strict Naturalism and replace teleosemiotics (...) with autopoietic theory of living beings. Our argument for these adjustments stems from our analysis of the flagship properties of Ur-intentionality: specificity and directedness. We attempt to show that the first property is not unique to living systems and therefore poses a problem of where to place a demarcation line for the origin of content. We then argue that the second property is a feature ascribed to living systems, not their intrinsic part and therefore does not form a good foundation for the game of naturalizing content. In conclusion we suggest that autopoietic theory can not only provide a competitive explanation of the basic responding of pre-contentful organisms but also clarify why Ur-intentionality is attributed to them in such an intuitive manner. The past decade has seen extensive research carried out on the systematic causes of research misconduct. Simultaneously, less attention has been paid to the variation in academic misconduct between research fields, as most empirical studies focus on one particular discipline. We propose that academic discipline is one of several systematic factors that might contribute to academic misbehavior. Drawing on a neo-institutional approach, we argue that in the developing countries, the norm of textual originality has not drawn equal support across different (...) research fields depending on its level of internationalization. Using plagiarism detection software, we analyzed 2,405 doctoral dissertations randomly selected from all dissertations defended in Russia between 2007 and 2015. We measured the globalization of each academic discipline by calculating the share of publications indexed in the global citation database in relation to overall output. Our results showed that, with an average share of detected borrowings of over 19%, the incidence of plagiarism in Russia is remarkably higher than in Western countries. Overall, disciplines closely follow the pattern of higher globalization associated with a lower percentage of borrowed text. We also found that plagiarism is less prevalent at research-oriented institutions supporting global ethical standards. Our findings suggest that it might be misleading to measure the prevalence of academic misconduct in developing countries without paying attention to variations at the disciplinary level. (shrink)

Phenotypic plasticity is a crucial feature of aggressive cancer, providing the means for cancer progression. Stochastic changes in tumor cell transcriptional programs increase the chances of survival under any condition. I hypothesize that unstable chromatin permits stochastic transitions between transcriptional programs in aggressive cancers and supports non‐genetic heterogeneity of tumor cells as a basis for their adaptability. I present a mechanistic model for unstable chromatin which includes destabilized nucleosomes, mobile chromatin fibers and random enhancer‐promoter contacts, resulting in stochastic transcription. I (...) suggest potential markers for “unsettled” chromatin in tumors associated with poor prognosis. Although many of the characteristics of unstable chromatin have been described, they were mostly used to explain changes in the transcription of individual genes. I discuss approaches to evaluate the role of unstable chromatin in non‐genetic tumor cell heterogeneity and suggest using the degree of chromatin instability and transcriptional noise in tumor cells to predict cancer aggressiveness. Cognitive and emotional processes are now known to be intertwined and thus the limbic system that underlies emotions is important for human brain evolution, including the evolution of circuits supporting language. The neural substrates of limbic functions, like motivation, attention, inhibition, evaluation, detection of emotional stimuli and others have changed over time. Even though no new, added structures are present in the human brain compared to nonhuman primates, evolution tweaks existing structural systems with possible functional implications. Empirical comparative neuroanatomical evidence (...) is presented here in support of such changes in the limbic system, including the amygdala and the orbitofrontal cortex. Given their possible functional significance, these alterations may further enable and enhance human interest and motivation to communicate beyond what is seen in other primates living in complex social groups. The argument here is that even though emotion processing is likely needed for increased social complexity independent of language, the reason why humans want to talk may be related in part to the enhancement of socioemotional processes resulting from the reorganization and rewiring of underlying neural systems some of which are interconnected to the language areas. This paper, located in the traditions of Interactional Sociolinguistics (Gumperz 1982) and Social Constructionism (Berger and Luckmann 1966), explores code-switching and identity practices amongst British-born Greek-Cypriots. The speakers, members of a Greek-Cypriot youth organization, are fluent in English and (with varying levels of fluency) speak the Greek-Cypriot Dialect. Qualitative analyses of recordings of natural speech during youth community meetings and a social event show how a new ‘third space’ becomes reified through code-switching practices. By skillfully manipulating languages and styles, speakers (...) draw on Greek-Cypriot cultural resources to accomplish two inter-related things. First, by displaying knowledge of familiar Greek-Cypriot cultural frames, they establish themselves as different from mainstream British society and establish solidarity as an in-group. Secondly, by using these frames in non-serious contexts, and at times mocking cultural attitudes and stereotypes, they challenge and re-appropriate their inherited Greek-Cypriot identity, thereby constructing the identity of British-born Greek-Cypriot youth. The opposition between the climactic thought of René Descartes and that of Blaise Pascal, although not very explicitly expressed at the time, is considered to be some kind of dispute between “reason and the heart.” An attempt at the relativization of these compartmentalizing poles brings the author of the study to a starting point that is common to Descartes’ Meditations on First Philosophy and Pascal’s Pensées (Thoughts): the act of skepticism and radical doubt. Despite the differences in their skeptical pathways (...) and their goals, the roots of the “systems” of thought of both philosophers grow from this act. The paper attempts to outline how the role of doubt can shape the problem of human knowledge, both on a general level and on the level of the highest, concrete knowledge of Divine Existence. This paper considers the systematic relationship between faith and reason in Kant’s grounding and limiting of moral faith in the Canon of Pure Reason in the Critique of Pure Reason. The first section addresses the interrelationship between Kant’s critique of knowledge and his critique of faith. The second section defines the complex interplay of theoretical and practical issues in Kant’s critical question of what a morally acting agent may hope for regarding the overall outcome of his actions. The third section (...) investigates Kant’s positioning of faith in relation to the epistemic modi of opining and knowing, and defines the specific status of moral faith in Kant. The textually based systematic analyses focus on the complementary relationship in Kant’s work between the way rational critique limits theoretical knowledge in favor of moral faith and the way this critique limits religious faith through moral consciousness. Moral judgements usually concern the moral responsibility of an acting person. Someone is considered praiseworthy or blameworthy for an action based on whether that action is in accordance with or against moral norms. On a Kantian account, the essential issue is the motivation of the acting person, as this is a criterion for being a moral cause of the action i.e. for intending it. Only moral causation permits the moral imputation of the action to the acting person, and moral motivation (...) always implies the use of practical reason as the capacity of acting in accordance with rules (categorical or hypothetical). Giving priority to one of these leads to either moral merit or moral guilt. The morally guilty person treats himself or others merely as a means rather than respecting himself or others as persons, i.e. as individuals able to act according to their own aims. We find such an account in Johann Christoph Hoffbauer’s interpretation of Kant’s theory of free will. While Kant is occasionally accused of inconsistency in claiming both that evil actions are real and imputable and that only good actions are free (and therefore imputable), Hoffbauer offers a consistent version of Kant’s theory of free will. In this paper, I analyze his interpretation, first sketching its pre-Kantian theoretical context and then discussing Hoffbauer’s Kantian interpretation of the concepts of will and the faculty of choice, using the case of a lie as an illustration. The paper introduces the notion of size of countable sets, which preserves the Part-Whole Principle. The sizes of the natural and the rational numbers, their subsets, unions, and Cartesian products are algorithmically enumerable as sequences of natural numbers. The method is similar to that of Numerosity Theory, but in comparison it is motivated by Bolzano’s concept of infinite series, it is constructive because it does not use ultrafilters, and set sizes are uniquely determined. But as with all things, especially during medical school, there is never a "right time" to be doing anything. It was fortunate that I attended the conference anyway because I met an incredible doctor (...) there. She had given a talk called "The Myth of Physician Wellness," and somewhere in our lengthy discussion, she asked me this:"Have you ever considered that since entering medical school, you've never been able to stop and really grieve the loss of what you thought medicine would be?"I am writing this in the downtime during my surgery rotation, regretting that I didn't wait until I got home to fully feel the feelings of writing this because I cannot cry here in front of others. At the same time, I feel guilty spending time writing at all; I should instead be doing UWorld practice questions for my upcoming exam. I can feel it in my body, the feeling of being plugged up—I have allowed tears to leak out too many times this year.The first time was in Internal Medicine, after seeing an elderly patient with a terminal rectal cancer that was so far along you could see it grossly. The bulging mass was so obvious during the patient's digital rectal exam that the senior resident was able to take off his still-clean gloves mere seconds after putting them on. The patient had come in for abdominal pain and difficulty defacating; the [End Page E20] only management he'd been able to receive for his known cancer was multiple hospitalizations in the last few months for emergency blood transfusions when his Hemoglobin level, indicating blood loss from the cancer, got too low. As I was taught to do, I gave a summary statement: "So you're here because you had a primary care appointment for a regular checkup, but they wouldn't see you because they didn't take your insurance? And they sent you to the county hospital, but even though they take uninsured patients, you are technically insured, just under a terrible plan … so they transferred you here. Is that right?" Unfortunately, the man's sí of affirmation was enough to make me lose composure, and I had to step out to let the resident finish the interview.After that, all it takes recently for the tears to well up is for an attending to pull me aside for feedback and ask, "How is third year going for you?" or even "What do you feel you've done well?"I almost wonder if holding in tears is like constipation. In medical school, we learn that sometimes what we think is diarrhea in patients is actually constipation—the stool is so impacted that the only thing that can leak past the plug is liquid. We see the leakage and first interpret that as diarrhea. I have to wonder if people interpret the same about me—emotional lability? Or is my inability to prevent the tears from leaking out simply a product of all the plugging up I have been doing all along? My inability to properly grieve the loss of what medicine was going to be? Maybe the first step in processing that loss is identifying it:I thought medicine meant caring for patients. Why am I going through 7+ years of training if insurance companies are allowed to undermine us so easily?I thought medicine meant connecting with patients. Why am I spending 30 minutes seeing my patients and 2 hours writing notes?I thought medicine meant leadership. Why are others bypassing two-thirds of my time in training and ending up with almost the same job … but the only "leadership" left is that their liability falls on physicians?I thought one must be well to take care of others. The article presents the German philosopher G. W. Leibniz as a key precursor of the First Law of Thermodynamics. In this way, Leibniz tried to oppose Newton, who seems to have completely rejected the First Law of Thermodynamics, while at the same time remarkably anticipating the Second. Based on his polemics not only with Newton, from whose Laws of Motion thermodynamics originates, and with his advocate Samuel Clarke, but also with René Descartes, whose conception Leibniz partially followed, Leibnizʼs reasoning turns (...) out to be the most convincing. It is certainly no coincidence that the later founders of thermodynamics frequently acknowledged him. (shrink)

Katerina Deligiorgi offers a contemporary defence of autonomy which is Kantian but engages closely with recent arguments about agency, morality, and practical reasoning.

This paper examines the concept of hope in the epistemology and psychology of Immanuel Kant and Johann Christoph Hoffbauer (1766-1827). The decisive question is how according to Kant hope can impair the objectivity of judgements about future and what are the positive and negative effects of this impairment. While for Kant hope is not essentially considered as an affect, he admits that it could transform into an affect and in this way it can impair the mood and its cognitive faculties (...) negatively. In my paper I examine this argumentations of Kant and their reception in the psychology and psychopathology of Hoffbauer, where hope as affect is even considered as a cause of madness and where Hoffbauer seems to suggest that the clinical state of madness can be effect of inappropriate use of the cognitive faculties of the soul. The paper explores the relationships and distinctions between pictorial and linguistic symbolic systems. It addresses the issue of the interplay between these media and symbolic systems. The paper explains why we cannot speak of any “pure” approaches and why it is necessary to be familiar with these mixed strategies. The central hypothesis is based on the idea of mutual "lending" of strategies and influences, leading to the emergence of a "new homogeneity," or a new semanticity and conceptualization. The main question (...) posed is: How does the linguistic symbolic system influence images, and how does the image symbolic system, in turn, influence language under contextual pressures? The first objective is to identify and analyze suitable examples of these pressures and “borrowings” to determine the domains of language and imagery. The analysis seeks to understand when these symbolic systems are most effective in their functions, when they exchange strategies, and what new meanings arise from this exchange. The second objective, derived from the first, is to defend the irreplaceability of the unique “message of the samples” (images) and how they symbolically create their version of the world in an irreplaceable way through words. Additionally, the paper aims to define a functional and irreplaceable space for words within the realm of visual art. (shrink)

The article focuses on a method for collecting qualitative data. The method is the asynchronous email interview. The authors assess the advantages, challenges and best practices of the asynchronous email interview method. They base their assessment on the academic literature and their own experiences using this data collection method in qualitative research on women who had experienced perinatal loss. The asynchronous email interview will never fully replace traditional face-to-face interviews, but it could gain a solid position as a qualitative research (...) method thanks to its unique benefits. Metaforickou exemplifikaci, expresi člení průhledem poznávacími perspektivami 1. a 3. osoby na prožitkovou a empatickou komponentu, opírá se tak o teorii artefiletiky. Otevírá a řeší tak problém vztahu relativních objektivních (...) daností díla, jeho intersubjektivně kotvené interpretace a subjektivně vnímaného prožitku z díla. Tvorbu chápe jako způsob poznání. International law lacks many of the standard features of domestic law. There are few legislative or judicial bodies with exclusive authority over particular jurisdictions or subject matters, the subjects regulated by international law typically must affirmatively consent to be bound by it, and supranational authorities with the power to coerce states to comply with international obligations are rare. How can a legal system with these features generate changes in state behavior? For many theories, the ability of international law to inform (...) and change individual preferences provides the answer. When voters care that treaty commitments be kept, or that international norms be honored, the theory goes, leaders are more likely to be able to make choices consistent with international obligations. Over the last decade, a literature has emerged testing these theories using surveys and experiments embedded in surveys. Multiple U.S. studies find that international law and international norm arguments shift public opinion in the direction of greater compliance by 4 to 20 percentage points. However, studies in foreign contexts are more mixed, with some backlash reported in countries in which international law is highly politicized. This Article describes the state of current knowledge about whether international law actually does change preferences, explains the limitations with existing research, and proposes avenues for future study. Claude Perrault, a founding member of the Académie des sciences and architect of the Louvre, is a figure emblematic of architecture’s transformation by the so-called scientific revolution, representing a radical break with tradition. This article will address Perrault’s scientific challenge to architecture as one that harks back to both ancient and modern sources. It explores some ways in which Perrault integrated the analogy between medicine and architecture into his approach to this art and assimilated medical concepts, particularly observation, into an (...) empirical medical approach. This notion of observation was at the heart of the practical aspect of ancient philosophy as a care of the soul which articulated the ancient comparison of the charismatic orator to a doctor. Thus, Perrault’s remarks on Vitruvius’s authority can be broadened beyond architecture to the quest for a guide to living, transcending disciplinary boundaries between natural science and art. Further, Perrault’s claims for naturalness in observation share a double perspective: observation as a new form of learned experience reflects the ethos of the scientist, while, as a traditional activity of peasants, it reflects a raw empirical knowledge about rules of life condensed into habit and custom, enabling common people to be the physicians of themselves. Growth mixture models are regularly applied in the behavioral and social sciences to identify unknown heterogeneous subpopulations that follow distinct developmental trajectories. Marcoulides and Trinchera recently proposed a mixture modeling approach that examines the presence of multiple latent classes by algorithmically grouping or clustering individuals who follow the same estimated growth trajectory based on an evaluation of individual case residuals. The purpose of this article was to conduct a simulation study that examines the performance of this new approach for determining (...) the number of classes in growth mixture models. The performance of the approach to correctly identify the number of classes is examined under a variety of longitudinal data design conditions. The findings demonstrated that the new approach was a very dependable indicator of classes across all the design conditions considered. (shrink)

The article focuses on the methodological specifics of qualitative sociological studies commissioned by public administration authorities (“the client”) which aim to provide solutions to specific problems defined by the client. In conducting this kind of study, the researcher is expected not only to describe and understand the existing state of affairs but also to provide a set of recommendations for amending it. The research terrain is not defined by the sociologist herself but basically by the client. This situation reveals a (...) series of methodological and epistemological issues. The article discusses some of them and proposes that the research strategy of heuristic investigation may be an answer to the associated dilemmas. The author argues that the correct use of reflexive methodology can help the researcher to overcome the limits imposed on the research by the client’s presence and even make the apparent disadvantages work for her. L’article examine trois types de temporalités patrimoniales. Le premier définit l’unité d’une salle muséale comme espace d’exposition cohérent et interroge la coexistence des objets dans son enceinte, en prenant comme exemple la salle 501 du Louvre. En se focalisant sur les objets-palimpsestes et l’art composite, il laisse ainsi entrevoir le mélange entre art latin et art byzantin, les remplois et les circulations de styles, que cette salle met en avant. Le second type évoque les interactions entre exposition permanente et exposition (...) temporaire et, plus particulièrement, la manière dont deux mosaïques byzantines rares, qui sont exposées dans la salle 501 de manière inadéquate, retrouvent une certaine visibilité grâce à un événement inattendu : la guerre en Ukraine et une opération d’urgence. The concept of professionalism is embedded into all aspects of nursing education and practice yet is rarely critically interrogated in nursing scholarship. This paper describes how professionalism in nursing is based on whiteness. When actualized, this oppressive construct homogenizes individuals' identities to assist nurses in building and wielding power against each other and against patients, and results in dehumanization and disconnection. Foregrounding an ethic of authenticity as a practice of resistance against white professionalism offers an alternative possibility for how nursing (...) could be taught, practiced and theorized. As such a practice must begin with oneself, the authors outline a reflexive process from which to begin this work. (shrink)

This paper examines the relevance and importance of the large number of examples which Aristotle uses in his "Prior Analytics." In the first part of the paper three preliminary issues are raised: First, it investigates what counts as an example in Aristotle's syllogistic, and especially whether only examples expressed in concrete terms should be considered as examples or maybe also propositions and arguments with letters of the alphabet. The second issue concerns the kinds of examples Aristotle actually uses from everyday (...) life as well as from various scientific and philosophical forms of discourse; among these, it seems that biological examples, rather than mathematical ones, have a predominant place. Finally, I discuss what Aristotle himself has to say about the use of examples, and in particular about the similarity between the use of an example and the use of induction. The second part of the paper focusses on the functions of Aristotle's logical examples. It is of course obvious that some of the examples in the Prior Analytics are used to illustrate, and thus to clarify, a definition, a logical rule, a type of argument. However, I think that Aristotle's logical examples have another function, which is philosophically more interesting, namely as integral parts of the procedure of proving something. To support this claim, I analyse three passages from the "Prior Analytics" in which examples are used either in order to prove that something is not the case, i.e. as counter-examples, or in order to prove positively that it is possible for something to be the case. At the end, I argue that for such uses of examples Aristotle uses the notion of 'ekthesis', which seems to have a wider sense than usually suggested; that is to say, it is used to refer to any proof by means of an example, and not only for the procedure which Aristotle uses to reduce imperfect to perfect syllogisms. While the emancipatory efforts of the Czech national revival culminated at the end of the 18th and in the 19th century, manifestations of national feeling in the 17th century Czech Lands were rather rare. The article focuses on the concept of nationality as it was treated by scholars from the monastic orders such as the German provincial of the Czech Franciscan province, Bernhard Sannig (1637–1704), or the Czech Jesuit Bohuslav Balbín (1621–1688), whose views are briefly compared with those of the (...) most significant representative of the Czech Protestant emigration – Johann Amos Comenius (1592–1670). By the means of analysis and comparison of several texts, the article investigates how the concept of nationality was gradually rationalized and moralized through the ethical categories of vice and virtue. These reflections on nation, nationality, and patriotism and their moral assessment demonstrate that their authors anticipated some elements of the later formulated doctrine of the natural law of nations, which theoretically justified the demands of the Czech national revival and formed the basis for the concept of Czech history. Departing from the premise that the poststructuralist paradigm still reigns supreme in feminist and gender theory, that is, despite the niche efforts made in the past two decades to challenge it linked to the so called “speculative” turn or the materialisms (and realisms) emerging from the feminist field itself (such as the Utrecht School, inspired by Rosi Braidotti), we set the call for papers for the issue before you in terms that would invite authors ready to challenge the dominant epistemic (...) framework. We invited papers that engage with materialism(s), realism(s), sciences and projects engaged in rethinking the post-human beyond the poststructuralist (and, we dare say, postmodern/ist) norm. -/- . In his Foundations of a General Theory of Manifolds, Georg Cantor praised Bernard Bolzano as a clear defender of actual infinity who had the courage to work with infinite numbers. At the same time, he sharply criticized the way Bolzano dealt with them. Cantor’s concept was based on the existence of a one-to-one correspondence, while Bolzano insisted on Euclid’s Axiom of the whole being greater than a part. Cantor’s set theory has eventually prevailed, and became a formal basis of contemporary (...) mathematics, while Bolzano’s approach is generally considered a step in the wrong direction. In the present paper, we demonstrate that a fragment of Bolzano’s theory of infinite quantities retaining the part-whole principle can be extended to a consistent mathematical structure. It can be interpreted in several possible ways. We obtain either a linearly ordered ring of finite and infinitely great quantities, or a partially ordered ring containing infinitely small, finite and infinitely great quantities. These structures can be used as a basis of the infinitesimal calculus similarly as in non-standard analysis, whether in its full version employing ultrafilters due to Abraham Robinson, or in the recent “cheap version” avoiding ultrafilters due to Terence Tao. Serious doubts have been raised about the coherence of theories of the sublime and the usefulness of the concept. By contrast, the sublime is increasingly studied as a key function in Kant's moral psychology and in his ethics. This article combines methodological conservatism, approaching the topic from within Kant's discussion of aesthetic judgment, with reconstruction of a conception of human agency that is tenable on Kantian grounds. I argue that a coherent theory of the sublime is possible and useful, and (...) the experience of the sublime is significant for our self-conception as agents. However, the chief interest in the sublime is not moral. (shrink)

The potential of surveillance practices to undermine the presumption of innocence is a growing concern amongst critics of surveillance. This paper attempts to assess the impact of surveillance on the presumption of innocence. It defends an account of the presumption of innocence as a protection against wrongful criminalisation against alternatives, and considers both the ways in which surveillance might undermine that protection and the—hitherto overlooked—ways in which it might promote it. It draws on empirical work on the causes of erroneous (...) convictions to suggest that surveillance can be used in ways that prevent innocent people being erroneously charged and convicted with crimes, by providing a source of exculpatory evidence for use in police investigations. It is argued that surveillance practices do not necessarily undermine the presumption of innocence but can be reformed in ways that both reduce the risk that they will cause wrongful criminalisation and increase their power to protect those already under suspicion. Despite its historical focus on aberrant behavior, sexology barely dealt with sexual deviants in 1950s Czechoslovakia. Rather, sexologists treated only isolated instances of deviance. The rare cases that went to court appeared mostly because they hindered work or harmed the national economy. Two decades later, however, the situation was markedly different. Hundreds of men were labeled as sexual delinquents and sentenced for treatment in special sexological wards at psychiatric hospitals. They endangered society, so it was claimed, by being unwilling or (...) unable to conform to the family norm. The mode of subjection shifted from work to family. I analyse this change by using the tools of Gil Eyal’s sociology of expertise (2013), which focuses on shifts in institutional matrices that bring forth new groups of agents creating new expert networks. I argue that sexology became profoundly institutionalized in the early 1970s, which brought the discipline closer to psychiatry and forensic science. New inpatient facilities were opened that could admit sentenced sexual deviants. Also, demographic changes accelerated in the 1960s, especially skyrocketing divorce rates and plummeting birth rates, which made it imperative for the government to focus on cementing the family. After the failed attempts of the Prague Spring in 1968, the new pro-Soviet government of communist Czechoslovakia did just that. During the time dubbed as ‘normalization’ by the new elites, anyone who strayed from the family norm was suspected of deviance. (shrink)
