Does a global economy render the traditional nation-state obsolete? Does globalization threaten democratic life, or offer it new forms of expression? The German philosopher and social theorist Jurgen Habermas addresses these and other questions in this work.

Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three features (...) that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies. These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. The intuitive Variety of Evidence Thesis states that, ceteris paribus, more varied evidence for a hypothesis confirms it more strongly than less varied evidence. Recent Bayesian analyses have raised serious doubts in its validity. Claveau suggests the existence of a novel type of counter-example to this thesis: a gradual increase in source independence can lead to a decrease in hypothesis confirmation. I show that Claveau’s measure of gradual source independence suffers from two unsuspected types of inconsistencies. I hence put forward (...) a more natural measure of gradual source independence which is not plagued by inconsistencies. Claveau’s counter-examples to the variety of evidence thesis disappear with the measure I suggest. I hence argue that my measure is preferable and that this thesis does at least not seem to be troubled by Claveau’s arguments. (shrink)

In a case study Kuhn's morphology of scientific revolutions is put to the test in confronting it with the contemporary developments in physics. It is shown in detail, that Kuhn's scheme is not compatible with the situation in physics today.

Methodenstreit in Economics. This essay offers an account of the Methodenstreit in economics between first Menger and Schmoller and later Max Weber and again Schmoller. It is argued that, for Schmoller, two issues were central; to use economics (widely conceived) as an instrument for economic policy and notably social policy: and to base the science empirically with all the modern methods available. In den letzten Jahren wird intensiv darüber diskutiert, ob und in welcher Weise das Gewissen im Kontext der Apotheke zu schützen ist. Der Status quo in Deutschland und Österreich sieht keine gesetzliche Regelung für dieses Problem vor. Der ethische Rahmen für eine Bewältigungsstrategie im Umgang mit dem Problem der Gewissensfreiheit in der Apotheke wird deutlich gemacht. Unter Anwendung des rechtsethischen Verhältnismäßigkeitsprinzips wird das Problem mit Berücksichtigung des deutschen und österreichischen Verfassungsrechts sowie der Europäischen Menschenrechtskonvention auf individueller, korporativer und gesellschaftlicher Ebene (...) analysiert. Auf individueller Ebene sind die berechtigten Interessen und Güter des Apothekers einerseits und der Patientin andererseits durch eine grundrechtliche Verhältnismäßigkeitsprüfung zu einem schonenden Ausgleich zu bringen. Auf korporativer Ebene legitimiert das auf der Religions- und Weltanschauungsfreiheit basierende Selbstbestimmungsrecht die ideologisch profilierte Apotheke als Organisation und kann in der Binnenbeziehung der Apotheke einen Loyalitätskonflikt verursachen. Auf gesellschaftlicher Ebene stehen vier Optionen der proaktiven rechtspolitischen Gestaltung der Gewissensproblematik zur Verfügung: sozialstaatlich, libertär, professionsbezogen und kommunitär. Wie Konflikte auf individueller oder korporativer Ebene gelöst werden können, hängt von den Optionen ab, die auf gesellschaftlicher Ebene gewählt werden. Für den Fall einer Änderung des Status quo wird für zwei Lösungsansätze argumentiert: a) die Einführung einer qualifizierten Gewissensklausel für Apotheker (mit Beratungs-, Verweis-, Notfall- und Verständigungspflicht); b) die auf einen Kompromiss zwischen ideologisch profilierter pharmazeutischer Korporation (Apotheke oder Apothekervereinigung) und Sozialstaat abzielende „weiche“ kommunitäre Option. The texts of Diogenes of Oinoanda (2nd century AD) who invited his readers to an Epicurean life is the largest ancient inscription ever discovered. Over 70 new finds have increased the number of known wall blocks and fragments to nearly 300, offering new insights into Diogenes' distinctive presentation of philosophy. This collection of essays discusses the philosophical significance of these discoveries and is the first of this kind (...) entirely devoted to Diogenes of Oinoanda. Particular attention is paid to his philosophical aims and polemical strategies. Diogenes was apparently well aware of still ongoing philosophical debates, engaging in polemics against Presocratic philosophers, Platonics, and especially Stoics. His views about important issues like happiness, fear, old age, and the afterlife are explained on the bases of Epicurean physics and theology, ethics, politics, theory of knowledge, and psychology. In 1924, not quite two years after receiving his doctorate from the University of Vienna, Eric Voegelin was named a Laura Spelman Rockefeller Memorial Fellow and thus given the opportunity to pursue postdoctoral studies in the United States. For the next twenty-four months, Voegelin worked with some of the most creative scholars in America and at several of the country's great universities, an experience that undoubtedly influenced his scholarly and personal perspectives throughout his life. A more immediate result was the (...) publication in 1928 of _On the Form of the American Mind,_ the young philosopher's first major work, in which his acute perceptions and analyses combine with a conceptual vocabulary struggling to find its own coherence and form. Voegelin begins his inquiry into the form of the American mind with a complex discussion of the concepts of time and existence in European and American philosophy and continues with an extended interpretation of George Santayana, a study of the Puritan mystic Jonathan Edwards, a presentation on Anglo-American jurisprudence, and a consideration of the historian, economist, and political scientist John R. Commons. Although admitting that this diversity of themes seems only loosely connected," Voegelin demonstrates the actual overall unity of these various subjects: each concerns linguistic expressions of a theoretical nature. Analysis of _On the Form of the American Mind_ indicates that Voegelin integrated the approaches of _Lebensphilosophie_ into what Georg Misch called the "philosophical combination of anthropology and history," which characterized contemporary trends within the discourse of the _Geisteswissenschaften_ and finally resulted in a theoretical paradigm of philosophical anthropology. Jürgen Gebhardt and Barry Cooper provide access to this brilliant study with their two-part introduction. The first part considers _On the Form of the American Mind_ in the context of methodological debates ongoing in Germany at the time Voegelin was writing the book; the second describes Voegelin's American experience and compares his work with similar studies written during the post-World War I period. We consider QED processes in the presence of an infinitely thin and infinitely long straight string with a magnetic flux inside it. The bremsstrahlung from an electron passing by the magnetic string and the electron-positron pair production by a single photon are reviewed. Based on the exact electron and positron solutions of the Dirac equation in the external Aharonov-Bohm potential we present matrix elements for these processes. The dependence of the resulting cross sections on energies, directions, and polarizations of the (...) involved particles is discussed for low energies. (shrink)

Warren Samuels has suggested that the Pareto Principle, when being used in policy analysis, is (1) limited, (2) selective, and (3) displays a conservative bias. In contrast to this view, in this note it is argued that the Pareto Principle is much less limited than was initially perceived (e.g. by Pareto himself) or is generally believed to be the case, that it tends to emphasize inclusiveness instead of selectivity, and that it is more likely to have an innovative instead of (...) a conservative bias. Mit dem Aufsatz wird der Versuch unternommen, eine beginnende interdisziplinäre Diskussion zwischen praktischer Philosophie und (politischer) Ökonomie fortzuführen und durch das Angebot einer synoptischen Interpretation auch zu vertiefen. Sowohl politische Ökonomie als auch praktische Philosophie sehen sich mehr und mehr der Anforderung ausgesetzt,zur Lösung praktischer Probleme beizutragen. Dies erscheint unmöglich, solange nicht auch normative Sätze Ergebnis wissenschaftlicher Analyse sein können; dazu bedarf es aber eines Begründungsbegriffes, der einerseits normativen Sätzen Raum gibt, andererseits die Anforderungen, die an die Begründung normativer Sätze (...) zu stellen sind, so scharf faßt, daß Normatives, statt wie bisher beliebig, nunmehr nachprüfbar wird. Ein solcher Begründungsbegriff wurde von Friedrich Kambartel über die Beschreibung eines Verfahrens (sokratischer Dialog), in dem die Begründung stattfindet, erarbeitet und für die Ökonomie vorgeschlagen. Dagegen wird in dieser Abhandlung, ausgehend von der These, daß Begründungsmängel in aller Regel Verfahrensmängel sind, eine Kritik des sokratischen Dialogverfahrens im Wege der politisch-ökonomischen vergleichenden Analyse alternativer Verfahren der Konsensbildung (hier: Markt, Abstimmung, Dialog) vorgetragen. The purpose of the paper is a discussion of the meaning and relevance of the Pareto principle in economics. To begin with, the principle is briefly retraced in Pareto’s own writings. Its contemporary meaning was, however, developed in the context of the “New Welfare Economics”. While Pareto technically employed the principle in order to describe an equilibrium situation, Kaldor and Hicks developed it somewhat differently as a yardstick for economic policy formulation. Sometimes, the principle is also discussed as a decision (...) rule, and in this context some critics - though not the present author - believe it to have a conservative bias. Finally, recent discussions center around the incompatibility of the Pareto principle and “liberal” values. This conflict might be of limited relevance, only, due to a misconstrued formalism. ZusammenfassungDie öffentliche Wahrnehmung der Forschung mit extrakorporalen Embryonen bildet den Kern des vorliegenden Beitrags. Hierzu wurden über 400 Personen schriftlich befragt. Die Art der Embryonengewinnung (künstliche Erzeugung vs. überzählige Embryonen) wird als bedeutsam für die Bewertung der Forschung angesehen. Mehrheitlich besteht der Wunsch nach rechtlich klaren Grenzen. Die größte Ambivalenz zeigt sich hinsichtlich der Frage nach einer gesetzlichen Erlaubnis der Embryonenforschung. Umgekehrt hat die Bevölkerung eine eindeutigere Meinung zum Verbot von Embryonenforschung und zur Einführung strikter rechtlicher Regelungen. Die Wahl der (...) Mittelkategorie bei der Untersuchung der Einstellung ist durch das Ausmaß der Ambivalenz mitbestimmt. Es konnte nachgewiesen werden, dass Laien das Dilemma der Embryonenforschung ähnlich bewerten wie Experten. Der Wunsch nach einer Freigabe der Forschung mit Embryonen besteht bei einer Teilgruppe, jedoch ist dieser Wunsch von einem hohen Ausmaß an Ambivalenz begleitet. (shrink)

ZusammenfassungIn der Debatte um die embryonale Stammzellenforschung führen die Verfechter der Würde des Embryos gerne eine Gemeinsamkeit von Embryonen und reversibel Komatösen an: Beide sind bloß potentiell Personen. Wenn aber Komatösen fraglos personale Würde zukommt, weshalb sollte man sie Embryonen absprechen? In ihrem AufsatzIn dubio pro embryone kombinieren G. Damschen und D. Schönecker diese Analogie mit einem Vorsichtsargument: Weil die Analogie zumindest gute Gründe für die Annahme biete, Embryonen komme eine menschliche Würde zu, sei angesichts der Schwere des möglichen Unrechts (...) die embryonale Stammzellenforschung nicht zu verantworten. Im Folgenden möchte ich darlegen, weshalb die Analogie nicht ausreicht, um ein solches Vorsichtsargument zu etablieren. In einem ersten Schritt soll gezeigt werden, wie man der Analogie begegnen kann, weshalb das entsprechende Argument also nicht zwingend ist. Um ein Vorsichtsargument zu begründen, würde es allerdings genügen, wenn die Analogie „hinlänglich plausible“ Gründe zugunsten der Würde von Embryonen liefert. In einem zweiten Schritt soll daher – aufbauend auf allgemeinen Überlegungen zum Vorsichtsargument – dargelegt werden, dass die Analogie selbst unter dieser Annahme nicht überzeugen kann. (shrink)

Dieses Buch widmet sich der ebenso alten wie aktuellen Frage, wie das Handeln des Menschen plausibel und nachvollziehbar erklärt werden kann. Es wird das Ziel verfolgt, dieses brisante und immer noch kontrovers diskutierte Problem der Handlungserklärung philosophisch zu bedenken und adäquate Losungen zu entwickeln. Dabei wird zunächst ein Umweg eingeschlagen, der sich jedoch als besonders lohnenswert erweist, nämlich den über die philosophische Handlungstheorie von Wilfrid Sellars, die untrennbar mit seiner weitbekannten Philosophie des Geistes verknüpft ist und, obgleich bereits zur traditionellen (...) Handlungstheorie gehörend, von bemerkenswerter Aktualität ist. Seine Handlungstheorie wird in diesem Buch erstmalig systematisch, vollständig und kritisch rekonstruiert. Über Sellars hinausgehend wird anschließend der anspruchsvolle Versuch unternommen, alternative Wege zur Lösung des Problems der Handlungserklärung aufzuzeigen, die sich besonders dadurch auszeichnen, dass sie die bekannten Unzulänglichkeiten traditioneller Grunde- und Kausalerklärungen von Handlungen überwinden. Das griechische Denken stellt nicht nur den Anfang der Philosophie im europäischen Sinne dar, es bestimmt auch bis heute hinsichtlich der Theorieform des Denkens die philosophische und wissenschaftliche Denkform. Schwerpunkte bilden (1) die konstruktiven Elemente in Wissenschaft (Beispiel: Kosmologie) und Philosophie (Beispiel: die geometrischen Wurzeln der platonischen Ideenlehre), (2) die Verbindung von Vernunft und Leben (z.B. im sokratischen Dialog), (3) die Metaphysik (platonische Ideenlehre, aristotelische Substanztheorie), (4) die Logik (im propädeutischen wie im technischen Sinne) und (5) die griechische Gegenwart (im (...) Hinblick auf den griechischen Rationalitätsbegriff und auf institutionelle Verhältnisse in Schule und Universität). Mit der Rekonstruktion der komplementären Konzeptionen von Platon und Aristoteles soll noch einmal die Idee der Einheit philosophischer und wissenschaftlicher Rationalität dargestellt werden.
