Does a global economy render the traditional nation-state obsolete? Does globalization threaten democratic life, or offer it new forms of expression? The German philosopher and social theorist Jurgen Habermas addresses these and other questions in this work.

Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three (...) features that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies. These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. The intuitive Variety of Evidence Thesis states that, ceteris paribus, more varied evidence for a hypothesis confirms it more strongly than less varied evidence. Recent Bayesian analyses have raised serious doubts in its validity. Claveau suggests the existence of a novel type of counter-example to this thesis: a gradual increase in source independence can lead to a decrease in hypothesis confirmation. I show that Claveau’s measure of gradual source independence suffers from two unsuspected types of inconsistencies. I hence put forward (...) a more natural measure of gradual source independence which is not plagued by inconsistencies. Claveau’s counter-examples to the variety of evidence thesis disappear with the measure I suggest. I hence argue that my measure is preferable and that this thesis does at least not seem to be troubled by Claveau’s arguments. (shrink)

Ingenieur- und Naturwissenschaften sind Knoten eines engen Beziehungsgeflechts, in dem Mensch und Gesellschaft, Natur und Kultur weitere Knoten sind. Entwicklungen in diesen beiden Bereichen haben somit stets Auswirkungen sowohl auf die anderen Knoten als auf das Beziehungsgeflecht als Ganzes. Ingenieur- und Naturwissenschaften sind als ars humana zudem stets eine Form menschlicher Handlung. Damit werden sie zu einem Schlüsselproblem der theoretischen und praktischen Philosophie. Denn der Mensch, seine Handlungen und seine Eingliederung in die Gesellschaft stehen ebenso wie die Natur und die (...) Kultur seit jeher im Zentrum philosophischer Untersuchungen. Die Philosophie vermag diese beiden Wissenschaftsbereiche zu fundieren und kritisch zu begleiten. Philosophie, Ingenieur- und Naturwissenschaften haben das Vermögen, sich gegenseitig zu befruchten. In Anbetracht der humanen, sozialen und ökologischen Probleme des 21. Jhds. ist die fachbereichsübergreifende und partnerschaftliche Zusammenarbeit dieser drei Schlüsselbereiche unabdingbar. Sie ist eine nicht hintergehbare Grundbedingung aller Entwicklungen, die den Anspruch erheben, nachhaltig zu sein und damit dem normativen Leitziel folgen, heutigen und zukünftigen Generationen bedingungslos ein menschenwürdiges Leben zu ermöglichen. Ingenieure und Naturwissenschaftler können dabei einen wesentlichen Beitrag leisten. Die folgenden zehn Thesen begründen die Bedeutung einer an Nachhaltigkeit orientierten philosophischen Grundbildung von Ingenieuren und Naturwissenschaftlern. (shrink)

In diesem Essay wird es aber nicht um die Kunst im Allgemeinen gehen, sondern um die abstrakte Kunst und die abstrakte Malerei im Besonderen. Was zeichnet sie aus und was ist ihr Wesen? Ist es die Freiheit?

In den letzten Jahren wird intensiv darüber diskutiert, ob und in welcher Weise das Gewissen im Kontext der Apotheke zu schützen ist. Der Status quo in Deutschland und Österreich sieht keine gesetzliche Regelung für dieses Problem vor. Der ethische Rahmen für eine Bewältigungsstrategie im Umgang mit dem Problem der Gewissensfreiheit in der Apotheke wird deutlich gemacht. Unter Anwendung des rechtsethischen Verhältnismäßigkeitsprinzips wird das Problem mit Berücksichtigung des deutschen und österreichischen Verfassungsrechts sowie der Europäischen Menschenrechtskonvention auf individueller, korporativer und gesellschaftlicher Ebene (...) analysiert. Auf individueller Ebene sind die berechtigten Interessen und Güter des Apothekers einerseits und der Patientin andererseits durch eine grundrechtliche Verhältnismäßigkeitsprüfung zu einem schonenden Ausgleich zu bringen. Auf korporativer Ebene legitimiert das auf der Religions- und Weltanschauungsfreiheit basierende Selbstbestimmungsrecht die ideologisch profilierte Apotheke als Organisation und kann in der Binnenbeziehung der Apotheke einen Loyalitätskonflikt verursachen. Auf gesellschaftlicher Ebene stehen vier Optionen der proaktiven rechtspolitischen Gestaltung der Gewissensproblematik zur Verfügung: sozialstaatlich, libertär, professionsbezogen und kommunitär. Wie Konflikte auf individueller oder korporativer Ebene gelöst werden können, hängt von den Optionen ab, die auf gesellschaftlicher Ebene gewählt werden. Für den Fall einer Änderung des Status quo wird für zwei Lösungsansätze argumentiert: a) die Einführung einer qualifizierten Gewissensklausel für Apotheker (mit Beratungs-, Verweis-, Notfall- und Verständigungspflicht); b) die auf einen Kompromiss zwischen ideologisch profilierter pharmazeutischer Korporation (Apotheke oder Apothekervereinigung) und Sozialstaat abzielende „weiche“ kommunitäre Option. Beide Ansätze werden einem schonenden Ausgleich berechtigter Güter gerecht. (shrink)

Soren Kierkegaard’s Lutheran existentialism represents a distinctively postmetaphysical philosophy of religion, focused in particular on a Christian vision of ethical authenticity. His philosophy continues to pose challenging questions for postmetaphysical philosophers in contemporary pluralistic settings. Focusing on specific works of Kierkegaard, this essay develops three such questions: (1) Can philosophy in a postmetaphysical vein still give advice for the pursuit of the good life, today’s diversity of life styles and values notwithstanding? (2) How can a postmetaphysical philosophy relate to the (...) ethical teachings and truth claims of religious doctrines? Recently, Brass and Dix showed 143–165) that the well founded semantics WFS can be defined as a confluent calculus of transformation rules. This led not only to a simple extension to disjunctive programs 167–213), but also to a new computation of the well-founded semantics which is linear for a broad class of programs. We take this approach as a starting point and generalize it considerably by developing a general theory of Confluent LP-systems CS . Such a system CS is a (...) rewriting system on the set of all logic programs over a fixed signature L and it induces in a natural way a canonical semantics. Moreover, we show four important applications of this theory: most of the well-known semantics are induced by confluent LP-systems , there are many more transformation rules that lead to confluent LP-systems , semantics induced by such systems can be used to model aggregation , the new systems can be used to construct interesting counterexamples to some conjectures about the space of well-behaved semantics. Partiendo de una crítica al tipo de renovación del “republicanismo” que representa Frank Michelman, desarrolla un concepto procedimental de política deliberativa. Afirma el autor que la diferencia decisiva entre las dos concepciones consiste en la comprensión del papel del proceso democrático. First collection of essays entirely devoted to the inscription of Diogenes of Oinoanda. The texts of Diogenes of Oinoanda (2nd century AD) who invited his readers to an Epicurean life is the largest ancient inscription ever discovered. Over 70 new finds have increased the number of known wall blocks and fragments to nearly 300, offering new insights into Diogenes' distinctive presentation of philosophy. This collection of essays discusses the philosophical significance of these discoveries and is the first of this kind (...) entirely devoted to Diogenes of Oinoanda. Particular attention is paid to his philosophical aims and polemical strategies. Diogenes was apparently well aware of still ongoing philosophical debates, engaging in polemics against Presocratic philosophers, Platonics, and especially Stoics. His views about important issues like happiness, fear, old age, and the afterlife are explained on the bases of Epicurean physics and theology, ethics, politics, theory of knowledge, and psychology. The purpose of this note is to make quite clear the relationship between two variants of the general notion of a preferential model for nonmonotonic inference: the models of Kraus, Lehmann and Magidor (KLM models) and those of Makinson (MAK models).On the one hand, we introduce the notion of the core of a KLM model, which suffices to fully determine the associated nonmonotonic inference relation. The present article critically examines three aspects of Graham Priest's dialetheic analysis of very important kinds of limitations (the limit of what can be expressed, described, conceived, known, or the limit of some operation or other). First, it is shown that Priest's considerations focusing on Hegel's account of the infinite cannot be sustained, mainly because Priest seems to rely on a too restrictive notion of object. Second, we discuss Priest's treatment of the paradoxes in Cantorian set-theory. It is shown that (...) Priest does not address the issue in full generality; rather, he relies on a reading of Cantor which implicitly attributes a very strong principle concerning quantification over arbitrary domains to Cantor. Third, the main piece of Priest's work, the so-called “inclosure schema”, is investigated. This schema is supposed to formalize the core of many well-known paradoxes. In 1924, not quite two years after receiving his doctorate from the University of Vienna, Eric Voegelin was named a Laura Spelman Rockefeller Memorial Fellow and thus given the opportunity to pursue postdoctoral studies in the United States. For the next twenty-four months, Voegelin worked with some of the most creative scholars in America and at several of the country's great universities, an experience that undoubtedly influenced his scholarly and personal perspectives throughout his life. A more immediate result was the (...) publication in 1928 of _On the Form of the American Mind,_ the young philosopher's first major work, in which his acute perceptions and analyses combine with a conceptual vocabulary struggling to find its own coherence and form. Voegelin begins his inquiry into the form of the American mind with a complex discussion of the concepts of time and existence in European and American philosophy and continues with an extended interpretation of George Santayana, a study of the Puritan mystic Jonathan Edwards, a presentation on Anglo-American jurisprudence, and a consideration of the historian, economist, and political scientist John R. Commons. Although admitting that this diversity of themes seems only loosely connected," Voegelin demonstrates the actual overall unity of these various subjects: each concerns linguistic expressions of a theoretical nature. Analysis of _On the Form of the American Mind_ indicates that Voegelin integrated the approaches of _Lebensphilosophie_ into what Georg Misch called the "philosophical combination of anthropology and history," which characterized contemporary trends within the discourse of the _Geisteswissenschaften_ and finally resulted in a theoretical paradigm of philosophical anthropology. Jürgen Gebhardt and Barry Cooper provide access to this brilliant study with their two-part introduction. The first part considers _On the Form of the American Mind_ in the context of methodological debates ongoing in Germany at the time Voegelin was writing the book; the second describes Voegelin's American experience and compares his work with similar studies written during the post-World War I period. El artículo examina la concepción neopragmatista desde la cual Rorty defiende una concepción antirrcalista del conocimiento. A fin de evaluar si es correcta la radicalización del «signo lingüístico) emprendida por el autor estadounidense, se compara la problemática contextualista con la duda epistemológica del escéptico moderno y se analiza el problema -tradicionalrnente ligado a las concepciones de la verdad como coherencia que subyacen a los planteamientos contextualistas-> de cómo distinguir la verdad de la aceptabilidad racional. Ante esta cuestión las opiniones se (...) dividen: mientras que Rorty asimila verdad y justificación al precio de sacrificar la intuición realista cotidiana, otros autores intentan dar cuenta de esta intuición desde dentro del paradigma lingüístico, ya sea mediante una deflación de la problemática de la verdad o mediante una idealización del proceso de justificación mismo. El autor reacciona frente a ambas posiciones: por un lado, contra un deflacionismo que se apoya en el concepto semántico de verdad, hace valer aquí una posición pragmática; por otro, desde esta misma óptica, crítica un tipo de epistemologizacíón del concepto de verdad que él mismo había defendido hasta el momento. Por esta vía se articula unaalternativa frente a la liquidación de las pretensiones de verdad incondicionales que ha llevado a Rorty a una naturalización de la razón lingüística muy problemática. For the first time during evolution of life on this planet, a species has acquired the ability to direct its own genetic destiny. Following 200,000 years of evolution, modern man now has the technologies not only to eradicate genetic disease but also to prolong life and enhance desired physical and mental traits. These technologies include preimplantation diagnosis, cloning, and gene therapy in the germline on native chromosomes or by adding artificial ones. At first glance, we should all be in favor (...) of eliminating genetic diseases and enhancing genetic traits. Evolutionary considerations, however, uncover hidden dangers and suggest caution against the total embracement of such actions. The first major concern is that the genome will never be a completely reliable crystal ball for predicting human phenotypes. This is especially true for predictions concerning the performance of alleles in future generations whose populations might be subjected to different environmental and social challenges. The second, and perhaps more important, concern is that the end result of germline intervention and genetic enhancement will likely lead to the impoverishment of gene variants in the human population and deprive us of one of our most valued assets for survival in the future, our genetic diversity. Al enviarnos el Espíritu Santo, Dios nos revela su aceptación de la vida; al experimentarla en el horizonte de la nueva creación, nos sentimos estimulados a colaborar con esta nueva creación de tres maneras: en primer lugar, con la renovación del pueblo de Dios, creando una comunidad; en segundo lugar, con la renovación de los vivientes, haciendo una ecología salvadora; finalmente, con la renovación de la tierra, recuperando el respeto y la santidad de la tierra de Dios, en lugar de destruirla con una mentalidad instrumental e interesada. ZusammenfassungIn der Debatte um die embryonale Stammzellenforschung führen die Verfechter der Würde des Embryos gerne eine Gemeinsamkeit von Embryonen und reversibel Komatösen an: Beide sind bloß potentiell Personen. Wenn aber Komatösen fraglos personale Würde zukommt, weshalb sollte man sie Embryonen absprechen? In ihrem AufsatzIn dubio pro embryone kombinieren G. Damschen und D. Schönecker diese Analogie mit einem Vorsichtsargument: Weil die Analogie zumindest gute Gründe für die Annahme biete, Embryonen komme eine menschliche Würde zu, sei angesichts der Schwere des möglichen Unrechts (...) die embryonale Stammzellenforschung nicht zu verantworten. Im Folgenden möchte ich darlegen, weshalb die Analogie nicht ausreicht, um ein solches Vorsichtsargument zu etablieren. In einem ersten Schritt soll gezeigt werden, wie man der Analogie begegnen kann, weshalb das entsprechende Argument also nicht zwingend ist. Um ein Vorsichtsargument zu begründen, würde es allerdings genügen, wenn die Analogie „hinlänglich plausible“ Gründe zugunsten der Würde von Embryonen liefert. In einem zweiten Schritt soll daher – aufbauend auf allgemeinen Überlegungen zum Vorsichtsargument – dargelegt werden, dass die Analogie selbst unter dieser Annahme nicht überzeugen kann. (shrink)
