Deleuze has suggested that Spinoza and Foucault share common concerns, particularly the notion of immanence and their mutual hostility to theories of subjective intentionality and contract-based theories of state power. This article explores these shared concerns. On the one hand Foucault's view of governmentality and its re-theorization of power, sovereignty and resistance provide insights into how humans are constituted as individualized subjects and how populations are formed as subject to specific regimes or mentalities of government. On the other, Spinoza was (...) concerned with how humans organized themselves into communities capable of self-government. In particular, his idea of immanent causality was crucial because central to his ideas of freedom and power. We argue that Spinoza's approach to power and causality prefigures ideas developed by Foucault in his theory of governmentality, especially with respect to his biopolitical rethinking of power and resistance. Weber and Keynes were working on similar problems-the psychological and historical contexts of modern capitalism-although Weber concentrated on origins and Keynes on the contemporary period. Their premises and theoretical styles are quite similar and complementary, for the most part, but they differ on whether the investment decision is a rational act. This paper reexamines the perceived ethical issues and roles of employment managers based on their responses to a recent "Ethical Issues in Human Resource Management Survey." This research addresses five major questions including: 1) Whether employment managers' perceptions of the factors influencing unethical behavior vary according to gender, job position, and company size, 2) What are the perceived frequency and seriousness of misconduct among HR functional areas, 3) Whether groups of employment managers (i.e., males and females) vary significantly in their (...) perceptions of the seriousness of unethical events, 4) Whether gender and organizational level influence how often particular ethics roles are played, and 5) What particular roles are being played by employment managers as they respond to ethical dilemmas. The findings show that regardless of gender, position, or company size, employment managers' ethical behavior is influenced most by the behavior of senior managers and their immediate supervisors. In addition, the respondents believe that ethical misconduct occurs more often and is most serious in specialties such as employment, health, safety, and security, and compensation. Gender, industrial category, and company size have a significant impact on how serious unethical practices were perceived to be. Finally, seven of the eight ethics roles were matched with the ethical dilemmas submitted by the survey respondents. (shrink)

Bhabha; 285 pp. New York: Routledge, 1994, $49.95.This book assembles several of Homi Bhabha’s most significant essays, allowing for an examination of his contribution to contemporary literary theory. As a self-described postcolonial critic, often compared with Edward Said or Gayatri Spivak, Bhabha is perhaps most well-known for his theory of cultural hybridity, which he develops in “Signs (...) Taken For Wonders” and several other essays included in this collection. Bhabha argues that hybridity results from various forms of colonization, which lead to cultural collisions and interchanges. In the attempt to assert colonial power in order to create anglicized subjects, “[t]he trace of what is disavowed is not repressed but repeated as something different—a mutation, a hybrid” (p. 111). This hybrid trace contradicts both the attempt to fix and control indigenous cultures and the illusion of cultural isolation or purity. His project thus adapts poststructuralist challenges to stable or fixed identities, attempting to “rename” postmodernism from a postcolonial perspective (p. 175), and allowing sustained attention to the ways in which race, gender, community, and nationality converge. One of his major contributions to theories of cultural production and identity is that he examines these various intersections closely, and avoids simply listing them or elevating one aspect of his analysis over others.Eight of the twelve chapters in this volume have been published previously, though some contain significant revisions. Throughout, Bhabha provides a nonteleological series of readings from the Enlightenment to the present. He draws most often upon psychoanalytic approaches, with particular attention to Frantz Fanon, in his focus upon documents from British missionaries and colonial administrators in India, and upon such writers as Salman Rushdie, Nadine Gordimer, Toni Morrison, Joseph Conrad, and E. M. Forster. Paraphrasing his arguments risks simplifying them, and also requires translating some of his frequent neologisms. Though Bhabha’s narrative is at times opaque, at their best these terms convey a new framework for describing cultures and their productions. Bhabha emphasizes what he describes as culture’s “in-between,” for instance, the interstitial spaces within and among individuals and cultures, which do not maintain a single position but form identities in an on-going process.One of Bhabha’s significant stances is his defense of the ways theory may be transformative. Rather than viewing theory as only an élite Occidental production or as apolitical, in Chapter One, “The Commitment to Theory,” he suggests that politics work with and through theory and that theory and politics cannot be separated. He endeavors to establish a “committed theoretical perspective,” accounting for postcolonial positions, while evading “the politics of polarities” that deny hybrid cultures and histories (p. 21, 39). The entire collection expands upon these claims, and three essays in particular—“Sly [End Page 196] Civility,” “Signs Taken for Wonders,” and “Articulating the Archaic”—develop the most extended discussions of agency on the part of the colonized, suggesting that culture’s “in-between” can be employed in ways that reveal contradictions within narratives that would uphold a linear, progressive model of Western history and civilization.In this way, his discussion of contact between cultures revises the narrative of progress or modernity, associated particularly with the Enlightenment. Bhabha reads the atrocities that were knowingly committed and sanctioned in the colonies as the “contramodernity” that belies traditional arguments about increasing civility and development of modernity. “The Postcolonial and the Postmodern” and “By Bread Alone,” in particular, confront teleological versions of history with a recognition of the colonial involvement and complicity of modernity.His argument can be extended to evaluate divergent movements within modernity and postmodernity and to revise the major models of both by revealing their stakes in colonial practices. Bhabha’s work suggests that the process of making modernity and the past is continual and partial, and that political action (which would include writing theory, in his argument), can be effective if not total. In June 2012, New York City Mayor Michael Bloomberg announced his plans for a ban on the sale of sugary beverages in containers larger than 16 ounces. Shortly thereafter, the Center for Consumer Freedom took out a full-page ad in the New York Times featuring Bloomberg photo-shopped into a matronly dress with the tag line “New Yorkers need a Mayor, not a Nanny.” On television, the CATO Institute's Michael Cannon declared, “This is the most ridiculous sort of nanny state-ism; [i]t’s (...) none of the mayor's business how much soda people are drinking.” And in newspapers around the country, editorial pages featured headlines such as “Gulp! Yet Another Intrusion of the Nanny State.” Just like that, the public debate about this measure became focused on government overreach, while the public health problem of obesity faded into the background. The evolutionary advantage of psychological phenomena can be gleaned by comparing them with physical traits that have proven adaptive in other organisms. The present article provides a novel evolutionary explanation of suicide in humans by comparing it with aposematism in insects. Aposematic insects are brightly colored, making them conspicuous to predators. However, such insects are equipped with toxins that cause a noxious reaction when eaten. Thus, the death of a few insects conditions predators to avoid other insects of similar coloration. (...) Analogously, human suicides may increase the credibility of future suicide threats and attempts from others, conveying an evolutionary advantage to the phenotypic expression of suicidal behavior in low-fitness contexts. Mind uploading speculation and debate often concludes that a procedure described as gradual in-place replacement preserves personal identity while a procedure described as destructive scan-and-copy produces some other identity in the target substrate such that personal identity is lost along with the biological brain. This paper demonstrates a chain of reasoning that establishes metaphysical equivalence between these two methods in terms of preserving personal identity.

Background Parental refusal of routine childhood vaccination remains an ethically contested area. This systematic review sought to explore and characterise the normative arguments made about parental refusal of routine vaccination, with the aim of providing researchers, practitioners, and policymakers with a synthesis of current normative literature. Methods Nine databases covering health and ethics research were searched, and 121 publications identified for the period Jan 1998 to Mar 2022. For articles, source journals were categorised according to Australian Standard Field of Research (...) codes, and normative content was analysed using a framework analytical approach. Results Most of the articles were published in biomedical journals (34%), bioethics journals (21%), and journals that carry both classifications (20%). Two central questions dominated the literature: (1) Whether vaccine refusal is justifiable (which we labelled ‘refusal arguments’); and (2) Whether strategies for dealing with those who reject vaccines are justifiable (‘response arguments’). Refusal arguments relied on principlism, religious frameworks, the rights and obligations of parents, the rights of children, the medico-legal best interests of the child standard, and the potential to cause harm to others. Response arguments were broadly divided into arguments about policy, arguments about how individual physicians should practice regarding vaccine rejectors, and both legal precedents and ethical arguments for vaccinating children against a parent’s will. Policy arguments considered the normative significance of coercion, non-medical or conscientious objections, and possible reciprocal social efforts to offset vaccine refusal. Individual physician practice arguments covered nudging and coercive practices, patient dismissal, and the ethical and professional obligations of physicians. Most of the legal precedents discussed were from the American setting, with some from the United Kingdom. Conclusions This review provides a comprehensive picture of the scope and substance of normative arguments about vaccine refusal and responses to vaccine refusal. It can serve as a platform for future research to extend the current normative literature, better understand the role of cultural context in normative judgements about vaccination, and more comprehensively translate the nuance of ethical arguments into practice and policy. We review here the data indicating a role for epidermal growth factor receptor (EGF receptor) signalling in early mouse development. Embryonic development of the metazoan embryo generally begins with the formation of a cystic structure and epithelial layers that subsequently form anlagen of the definitive body parts and organs. For the mammalian embryo, this cystic structure is a blastocyst whose wall consists of trophectoderm, the first epithelium to develop during mammalian embryogenesis. The onset of expression and function of EGF receptors (...) is coincident with the onset of trophectoderm development. Modulating EGF receptor expression and function modulates trophectoderm differentiation, leading to the hypothesis that functional EGF receptors participate in the induction of trophectoderm development and perhaps of other embryonic epithelial derivatives such as nervous tissues. Health justice is both a community-led movement for power building and transformational change and a community-oriented framework for health law scholarship. Health justice is distinguished by a distinctively social ethic of care that reframes the relationship between health care, public health, and the social determinants of health, and names subordination as the root cause of health inequities.

In coming decades, enhanced global health governance will be crucial to achieving international health and development objectives in the face of a number of challenges; this article focuses on one of them. Climate change, which is now widely recognized as the defining challenge of the 21st century, will make the work of ensuring the conditions in which people can be healthy more difficult in a myriad of ways. Scientists from both the health and climate communities have been highlighting the significant (...) interaction between climate and health for decades and have made significant strides in integrating health and environmental research. Those of us in the law and policy community have been a bit slow to catch up, and have only just begun to call for better integration of our responses to health and environmental concerns. Environmental health specialists at the World Health Organization have recently pointed to a mandate for better integration of health and environmental concerns within the United Nations system. The Millennium Development Goals interweave health, environmental, and development concerns. (shrink)

It is common in the literature on classical electrodynamics (ED) and relativity theory that the transformation rules for the basic electrodynamical quantities are derived from the hypothesis that the relativity principle (RP) applies to Maxwell’s electrodynamics. As it will turn out from our analysis, these derivations raise several problems, and certain steps are logically questionable. This is, however, not our main concern in this paper. Even if these derivations were completely correct, they leave open the following questions: (1) Is the (...) RP a true law of nature for electrodynamical phenomena? (2) Are, at least, the transformation rules of the fundamental electrodynamical quantities, derived from the RP, true? (3) Is the RP consistent with the laws of ED in a single inertial frame of reference? (4) Are, at least, the derived transformation rules consistent with the laws of ED in a single frame of reference? Obviously, (1) and (2) are empirical questions. In this paper, we will investigate problems (3) and (4). First we will give a general mathematical formulation of the RP. In the second part, we will deal with the operational definitions of the fundamental electrodynamical quantities. As we will see, these semantic issues are not as trivial as one might think. In the third part of the paper, applying what J. S. Bell calls “Lorentzian pedagogy”—according to which the laws of physics in any one reference frame account for all physical phenomena— we will show that the transformation rules of the electrodynamical quantities are identical with the ones obtained by presuming the covariance of the equations of ED, and that the covariance is indeed satisfied. As to problem (3), the situation is much more complex. As we will see, the RP is actually not a matter of the covariance of the physical equations, but it is a matter of the details of the solutions of the equations, which describe the behavior of moving objects. This raises conceptual problems concerning the meaning of the notion “the same system in a collective motion”.. (shrink)

This essay argues that feminist legal theory offers an important, and underutilized, perspective to examine health law and policy. We use several theoretical frameworks developed by feminist legal theorists including relational autonomy, intersectionality, vulnerability theory, and the feminist critique of the public-private divide to demonstrate the utility of these theories to health law analysis. These frameworks provide insights relevant not only to issues that obviously relate to gender, but also to matters of choice, quality, and access that are less obviously (...) gender-related. We map three key areas of existing scholarship and future inquiry at the intersection of health law and feminist legal theory: patient choice and relational autonomy, patriarchy, power and patient safety, and access to health care and healthy living conditions at the public-private divide. Uniting these areas of inquiry is a nagging question central to the relationship between critical legal scholarship and pragmatic action to combat injustice: Can we use legal rights to achieve our aims even as we recognize them as tainted tools that have propped up oppressive social structures? A feminist agenda for health law and policy must grapple with this dilemma. (shrink)

More recently, network dynamics and alliances as complex and evolving arrangements are emerging areas for investigation. Thus far, little research has been undertaken that integrates these emerging themes in the context of the impact of deteriorating exogenous environments on network alliances. -/- The ICT industry provides such a context, with the rapid deterioration of fortunes in the industry as a result of equity market moves since early 2000. This research (...) looks at the Bluetooth consortium, a loosely framed network of firms involved in the development and commercialization of wireless technical applications for information technology based products. It finds that matters related to intellectual property ownership and inter-firm coordination in complex product development have been problematic, with the deterioration of environmental munificence driving a slowing of network investment and product development success. The idea that thinking is a form of talking to oneself was discussed in classical Greece, analyzed by the Medievals and treated as a central issue by the American pragmatists. But whether inner speech is a language unto itself, distinct from outer language, has not been determined. To this end I ask how Saussure's defining ideas about language apply to inner speech. I show that Saussure's ideas, while partly usable, are mainly a poor fit. Inner speech is a variety of (...) language, or perhaps of dialect, with its own unique structure. Given that it is a unique window into human consciousness, I briefly discuss some of the research areas on which it sheds light. (shrink)

Restructured health care reimbursement systems and new requirements for nonprofit hospitals are transforming the U.S. health system, creating opportunities for enhanced integration of public health and health care goals. This article explores the role of public health practitioners and lawyers in this moment of transformation. We argue that the population perspective and structural strategies that characterize public health can add value to the health care system but could get lost in translation as changes to tax requirements and payment systems are (...) rapidly implemented. We urge public health leaders to take a more active role in hospital assessments of community health needs and evaluation of the patient outcomes for which providers are accountable. (shrink)

The ethical foundation of the medical profession, which values service above reward and holds the doctor-patient relationship as inviolable, continues to be challenged by the commercialization of health care. This article contends that a realigned leadership framework - one that distinguishes being a leader as the ontological basis for what leaders know, have, and do - is central to safeguarding medicine's ethical foundation. Four ontological pillars of leadership - awareness, commitment, integrity, and authenticity - are proposed as fundamental elements that (...) anchor this foundation and the basic tenets of professionalism. Ontological leadership is shaped by and accessible through language; what health care leaders create in language "uses" them by providing a point of view (a context) within and from which they orient their conversations, decisions, and conduct such that they are ethically aligned and grounded. This contextual leadership framework exposes for us the limitations imposed by our mental maps, creating new opportunity sets for being and action (previously unavailable) that embody medicine's charter on professionalism. While this leadership methodology contrasts with the conventional results-oriented model where leading is generally equated with a successful clinical practice, a distinguished research program, or a promotion, it is not a replacement for it; indeed, results are essential for performance. Rather, being and action are interrelated and their correlated nature equips leaders with a framework for tackling health care's most complex problems in a manner that preserves medicine's venerable ethical heritage. In the 4 1/2 to 5 days between fertilization and implantation, the mouse conceptus must gain the abilities to implant and produce an embryo. Each of these is the sole developmental responsibility of one of two cell types forming the blastocyst, trophectoderm and inner cell mass (ICM), respectively. Trophectoderm is a polarized transporting epithelium while the ICM is an aggregate of non‐epithelial pluripotent stem cells. These two cell types originate from the division of polar blastomeres when their cleavage furrows parallel (...) their apical surfaces. Blastomeres polarize in response to asymmetric cell–cell contact, and understanding the mechanism of this induction is regarded as the key to understanding the origin of trophectoderm and ICM. Here we propose a model based on transcellular ion current loops for the induction of cell polarity during the development of the first epithelium, trophectoderm. (shrink)
