This paper develops the argument that the acquisition of responsible organizations can be a source of competitive advantage for acquiring firms. We arguethat corporate responsibility identity is a tacit and strategic resource because it is valuable, rare, non-imitable and non-substitutable. We postulate that organizational identity is a useful framework to better understand corporate responsibility identity. Finally, we argue that to capitalize on the acquisition of responsible organizations, acquiring firms must engage in critical self-reflexivity and be willing to modify their organizational (...) identity. The argument from multiple realization is currently considered the argument against intertheoretic reduction. Both Little and Kincaid have applied the argument to the individualism-holism debate in support of the antireductionist holist position. The author shows that the tenability of the argument, as applied to the individualism-holism debate, hinges on the descriptive constraints imposed on the individualist position. On a plausible formulation of the individualist position, the argument does not establish that the intertheoretic reduction of social theories is highly unlikely. Within the political economy of informational capitalism, commercial surveillance practices are tools for resource extraction. That process requires an enabling legal construct, which this essay identifies and explores. Contemporary practices of personal information processing constitute a new type of public domain—a repository of raw materials that are there for the taking and that are framed as inputs to particular types of productive activity. As a legal construct, the biopolitical public domain shapes practices of appropriation and use of personal information in (...) two complementary and interrelated ways. First, it constitutes personal information as available and potentially valuable: as a pool of materials that may be freely appropriated as inputs to economic production. That framing supports the reorganization of sociotechnical activity in ways directed toward extraction and appropriation. Second, the biopolitical public domain constitutes the personal information harvested within networked information environments as raw. That framing creates the backdrop for culturally situated techniques of knowledge production and for the logic that designates those techniques as sites of legal privilege. (shrink)

In this paper the authors argue that the exploration of the nature of needs and rights should begin with the actually existing organization of care and of justice in society. The authors raise two key concerns with this organization: 1) the invisibility of care to some, and 2) the inaccessibility of rights to others. Recent work by care scholars has called attention to the ways the current organization of care work perpetuates the myth of self-sufficiency for some, while reducing others (...) to mere dependents. Law and Society scholars have demonstrated the problems of uneven access to legal remedies within the current organization of the legal system. Addressing these concerns simultaneously reveals both the problems of the current organization of needs and rights as well as illuminating alternative possibilities. The authors argue, first, that a justice perspective, based on rights is inadequate because its presumed universality is belied by the reality of the inaccessibility of rights to many. Second, the authors argue that a care perspective, currently formulated upon the assumption that only some people have needs, is also flawed because its presumed particularity distorts the human experience and subsequent policies. Instead, the authors need to conceive of care in a public way that permits both rights and needs to be understood as applicable to all. The authors propose some initial thoughts about how to create such a public concept of care. (shrink)

In this paper, I examine a heretofore ignored critic of Descartes on the heterogeneity problem: Anton Wilhelm Amo. Looking at Amo’s critique of Descartes reveals a very clear case of a thinker who attempts to offer a causal system that is not a solution to the mind-body problem, but rather that transcends it. The focus of my discussion is Amo’s 1734 dissertation: The Apathy [ἀπάθεια] of the Human Mind or The Absence of Sensation and the Faculty of Sense in the (...) Human Mind and their Presence in our Organic and Living Body. Amo’s discussion of the interaction, or lack thereof, of the mind and body hinges on the essential feature he identifies for the human mind—apathy, that is, impassivity. In this work, Amo engages explicitly with Descartes’s writing, which allows us to more precisely see the nature of his agreement and disagreement with the Cartesian metaphysics of mind. I proceed by treating Amo’s five stated criteria for spirit-hood which, in turn, reveal the kinds of causal connections that are possible for embodied spirits on his view. My aim is threefold: To lay out what I take to be Amo’s view of and arguments for the five criteria he takes to be required for a substance to be spirit. To locate Amo’s agreement and disagreement with Descartes. To suggest that Amo’s view on mind-body interaction involves a kind of occasional causation. (shrink)

This Article examines the regulatory state through the lens of evolving political economy, arguing that a significant reconstruction is now underway. The ongoing shift from an industrial mode of development to an informational one has created existential challenges for regulatory models and constructs developed in the context of the industrial economy. Contemporary contests over the substance of regulatory mandates and the shape of regulatory institutions are most usefully understood as moves within a larger struggle to chart a new direction for (...) the regulatory state in the era of informational capitalism. A regulatory state optimized for the information economy must develop rubrics for responding to three problems that have confounded existing regulatory regimes: platform power — the power to link facially separate markets and/or to constrain participation in markets by using technical protocols; infoglut — unmanageably voluminous, mediated information flows that create information overload; and systemic threat — nascent, probabilistically-defined harm to be realized at some point in the future. Additionally, it must develop institutions capable of exercising effective oversight of informationera activities. The information-era regulatory models that have begun to emerge are procedurally informal, mediated by networks of professional and technical expertise that define relevant standards, and financialized. Such models, however, also have tended to be both opaque to external observation and highly prone to capture. New institutional forms that might ensure their legal and political accountability have been slow to develop. (shrink)

By examining the central queries from a broad range of perspectives, the authors presented here draw upon years of rich investigations to generate a framework that will be instructive for researchers across a wide spectrum of areas of inquiry.

This essay explores a theory of panoramas put forward by the experimental postwar German novelist and translator Arno Schmidt. Schmidt claims that panoramas were so pervasive in the visual culture of the nineteenth century that they unconsciously influenced writers of the period, so that when they wanted to describe vast landscapes they unthinkingly framed their descriptions by drawing on experience with specific panoramas. He primarily expounds the theory in his longest work of fiction, Zettel’s Traum (1970), translated as Bottom’s Dream (...) (2016), where he supports it with evidence from Edgar Allan Poe and Jules Verne. He also promoted the theory in later interviews, and regarded it not just as part of his fiction but as a significant discovery in its own right. This essay extracts Schmidt’s theory from its fictional context and illustrates how he thought it could be used hermeneutically to uncover submerged panoramas in the works of nineteenth century authors. We conclude by locating the theory as part of the contemporary reception history of panoramas. (shrink)

This paper treats a heretofore-unnoticed concept in the history of the philosophical discussion of human freedom, a kind of freedom that is not defined solely in terms of the causal power of the agent. Instead, the exercise of freedom essentially involves the non-occurrence of something. That being free involves the non-occurrence, that is, the absence, of an act may seem counterintuitive. With the exception of those specifically treated in this paper, philosophers tend to think of freedom as intimately involved with (...) volition, the judging or deciding activity of the will that votes in favor of or against a proposed action. However, there are two thinkers who endorse a view where not willing constitutes human freedom. Our analysis focuses on the views of Malebranche and Locke. Both invoke a notion dubbed here as ‘absential suspension.’ On this view, freedom is associated not with the power of volition, but rather with this kind of suspension. (shrink)

Since the last issue of Feminist Legal Studies, we editorial board members have had lots of conversations about comfort, displacement and alienation. As we developed the programme for #FLaK2016 we thought about it as a kind of pulling ourselves out of our comfort zone, if academic events and journals ever have a comfort zone. Drawing on a mix of feminist live performance methods and a science and technology studies-type curiosity for objects of experimentation, we tried out a kitchen table method (...) of hosting a live research conversation with activists, artists and academics over two days. But we had not fully anticipated the way that the Brexit result would contribute to and complicate discomfort. A fuller analysis of FLaK awaits a later moment, but here we pick out this one aspect of our gathering—feelings of discomfort – as they animate the contributions to this issue in interesting ways. This article proposes that the French performance artist Orlan, has, by undertaking a series of surgical interventions on her face and body, radically challenged current standards of beauty. By engaging with Judeo-Christian iconography, Greek mythology and French literature in her operations/performances, she has established an oeuvre that aligns her not only with corporeality and the abject body through images of the sacrificial, but also with aberrant body forms associated with the carnival. Although seduced by the rhetoric that surrounds the body (...) in technology, she has turned to excess as a strategy against the benign and controlled nature of the screen, and the media's homogenization of body images. Her new identity, although not extreme, is a site of resistance in a society bent on eliminating forms that threaten the status quo. (shrink)

Since the mid-1990s, there has been a rise in the number of deaths of undocumented Mexican migrants crossing the U.S./Mexican border. Who is responsible for these deaths? This article examines the culpability of (1) migrants, (2) humanitarian volunteers, (3) the Mexican government, (4) the U.S. government, and (5) U.S. businesses. A significant portion of the blame is assigned to U.S. free trade policies and U.S. businesses employing undocumented immigrants.

There is general agreement among ecofeminists regarding the desirability of a variety of expressions of ecofeminism, but this pluralism is under threat with the emergence of an approach that emphasizes the primacy of a philosophical ecofeminism which claims the authority to prescribe what ecofeminism should be. The recent anthology Ecological Feminism is symptomatic of this trend, with contributors who affirm the philosophical significance of ecological feminism by privileging philosophers’ voices over those of other ecofeminists, rather than by engaging in critical (...) dialogue with, and exploring connections between, different ecofeminist discourses. This colonizing strategy actively excludes many women’s voices from the creation of an environmental ethic, including those of activist, spiritual, and “Third World” ecofeminists, but fails to offer any adequate philosophical grounds for doing so. Assessments of an action done intentionally, as we might expect, influence judgments of moral responsibility. What we don't expect is the converse--judgments of moral responsibility influencing assessments of whether an action was done intentionally. Yet this is precisely how people decide, according to Knobe (2003, 2004) and Mendlow (2004) and Nadelhoffer (2004a). I evaluate whether the studies actually support this biasing effect. I argue that the studies are at best inconclusive and that even if they demonstrated that people fall under (...) the biasing effect, such tendencies ought to have no bearing upon philosophical analyses of the concept of intentional action. One of the driving questions in philosophy of mind is whether a person can be understood in purely physical terms. In this presentation, I wish to continue the project initiated by Donald Davidson, whose subtle position on this question has left many more perplexed than enlightened. The main reason for this perplexity is Davidson’s rather obscure pronouncements about the normativity of intentionality and its role in supporting psychophysical anomalism – the claim that there are no laws bridging our intentional states (...) with states of our brain. Insofar as Davidson’s thesis is an ontological one – about the existence of laws or otherwise modally significant connections between the mental and the physical – I think his critics are correct: Davidson has not provided us with a successful argument for psychophysical anomalism. There is, however, a different argument, also based upon considerations about the normativity of intentionality that lead to an equally important conclusion. The conclusion is not ontological but rather epistemic: if thoughts do indeed display normativity, it is hard to understand how they would arise out of mere mechanical occurrences in the brain. To borrow a well-worn phrase, there is an “explanatory gap” between the mental and the physical. Originally coined to capture the epistemic darkness we confront in our attempt to understand phenomenal experiences in purely physical terms, the idea has yet to be explored in the area of contentful mental states or intentionality in general. My argument shall be this: considerations about the normativity of intentionality demonstrate that there is an explanatory gap between the intentional and the physical. In fact, if there were laws of the kind Davidson denies, then the world be more mysterious than if no such laws existed. The presence of an explanatory gap explains why this is so. (shrink)

Jaegwon Kim has argued that this view is unstable – to honor one thesis, one must abandon the other. In this paper, I present an account of property realization that addresses Kim’s criticism and that explains how the two theses are indeed comfortably compatible.

The Supreme Court’s Dobbs v. Jackson Women’s Health Organization decision, first leaked to the public on 2 May 2022 and officially released on 24 June 2022, overturned Roe v. Wade and thereby determined that abortion is no longer a federally protected right under the Constitution. Instead, the decision gives individual states the right to regulate abortion. Since the Dobbs decision first leaked, our institution has received numerous requests for permanent contraception from individuals stating that their motivation to pursue permanent contraception (...) was influenced by the Dobbs decision and concerns about their reproductive autonomy. Discussions with patients seeking permanent contraception since the Supreme Court’s leaked decision have led us to ask ourselves, is legislative anxiety an indication for surgery? This article presents a case series consisting of a convenience sample of 17 young, nulliparous individuals who sought out permanent contraception in the six months following the leak of the Dobbs decision. Healthcare professionals often feel discomfort in offering permanent contraception to young and nulliparous individuals. Accordingly, we discuss pertinent legal issues, review relevant ethical considerations, and offer a framework for these discussions intended to empower the consulting healthcare professional to center the bodily autonomy of every patient regardless of age, parity, or indication for permanent contraception. Shared decision making has become the standard of care, yet there remains no consensus about how it should be conducted. Most accounts are concerned with threats to patient autonomy, and they address the dangers of a power imbalance by foregrounding the patient as a person whose complex preferences it is the practitioner's task to support. Other corrective models fear that this level of mutuality risks abdicating the practitioner's responsibilities as an expert, and they address that concern by recovering a nuanced (...) but genuinely directive clinical role. Cribb and Entwistle helpfully categorize models of shared decision making as ‘narrower’ and ‘broader’ and praise the latter's ‘open‐ended and fully dialogical ways of relating’. However, they stop short of providing a philosophical account of how that dialogue works. In this paper, a nurse–midwife and a philosopher collaborate to argue that the Socratic model of dialogue offers a solution to the practitioner–patient dilemma. In the Theaetetus, Socrates compares dialogical reasoning to ‘midwifery with all its standard features’. By means of a three‐way analogy, elements of midwifery practice are used to illuminate features of Socrates' claim that his dialogue is like midwifery; those features are then translated into an approach to shared decision making as the ‘midwifery of good thinking’ which both midwives and physicians would do well to adopt. A key concept that emerges is the need for practitioners to make a risk‐confidence assessment of the particular content of any decision to appropriately modulate their role in the practice of shared decision making. The population of older adults worldwide is growing, with an urgent need for approaches that develop and maintain intrinsic capacity consistent with healthy aging. Theory and empirical research converge on feeling safe as central to healthy aging. However, there has been limited attention to resources that cultivate feeling safe to support healthy aging. Nostalgia, “a sentimental longing for one’s past,” is established as a source of comfort in response to social threat, existential threat, and self-threat. Drawing from extant theory and (...) research, we build on these findings to position nostalgia as a regulatory resource that cultivates feeling safe and contributes to intrinsic capacity to support healthy aging. Using a narrative review method, we: characterize feeling safe as a distinct affective dimension, summarize the character of nostalgia in alignment with feeling safe, propose a theoretical account of the mechanisms through which nostalgia cultivates feeling safe, highlight the contribution of nostalgia to feeling safe and emotional, physiological, and behavioral regulatory capabilities in healthy aging, and offer conclusions and direction for research.
