Natural law has long been considered the traditional source of Roman Catholic canon law. However, new scholarship is critical of this approach as it portrays the Catholic Church as static, ahistorical, and insensitive to cultural change. In its attempt to stem the massive loss of effectiveness being experienced by canon law, the church has to reconsider its theory of legal foundation, especially its natural law theory. Church Law in Modernity analyses the criticism levelled at the church and puts forward solutions (...) for reconciling church law with modernity by revealing the historical and cultural authenticity of all law, and revising the processes of law making. In a modern church, there is no way of thinking of the law without the participation of the faithful in legislation. The connection between economics and ethics is as old as economics itself, and central to both disciplines. It is an issue that has recently attracted much interest from economists and philosophers. The connection is, in part, a result of the desire of economists to make policy prescriptions, which clearly require some normative criteria. More deeply, much economic theory is founded on the assumption of utility maximization, thereby creating an immediate connection between the foundations of economics and the philosophical literature on (...) utilitarianism and reasons for action. In fact, some influential contemporary approaches to ethics advocate decision-theoretic or game-theoretic foundations of some sort for moral principles, while several economic theorists are now prepared to take into account the ethical dimensions of rational decisions. As a result, it appears that economics and ethics are somehow inextricably linked through theories of rational decision-making. Most of us would probably find it disturbing to concede that there are contradictions between the prescriptions of rationality and the requirements of moral `rightness'. The essays included in the present volume provide a detailed analysis of the connections between ethics and economics as viewed from several different - sometimes conflicting - perspectives. This book, the outcome of a joint meeting of philosophers and economists, has three main themes: the validity of utilitarianism much used by economists, the notion of fairness and equity, and the coherence of the rationality postulate of economics. The book does not reach any final conclusions, but it greatly illuminates the exact areas of possible disagreement and indeed the open-ended nature of ethical reasoning. There is much that economists, and especially welfare economists, can learn from these papers - not least circumspection. (shrink)

This paper contributes data from Paraguayan Guaraní (Tupí-Guaraní) to the discussion of how temporal reference is determined in tenseless languages. The empirical focus of this study is on finite clauses headed by verbs inflected only for person/number information, which are compatible only with non-future temporal reference in most matrix clause contexts. The paper first explores the possibility of accounting for the temporal reference of such clauses with a phonologically empty non-future tense morpheme, along the lines of Matthewson’s (Linguist Philos 29:673–713, (...) 2006 ) analysis of a similar phenomenon in St’át’imcets (Salish). This analysis is then contrasted with one according to which temporal reference is not constrained by tense in Paraguayan Guaraní, but only by context and temporal adverbials. A comparison of the two analyses, both of which are couched in a dynamic semantic framework, suggests empirical and theoretical advantages of the tenseless analysis over the tensed one. The paper concludes with a discussion of cross-linguistic variation of temporal reference in tensed and tenseless languages. (shrink)

There has been much interest in group judgment and the so-called 'wisdom of crowds'. In many real world contexts, members of groups not only share a dependence on external sources of information, but they also communicate with one another, thus introducing correlations among their responses that can diminish collective accuracy. This has long been known, but it has-to date-not been examined to what extent different kinds of communication networks may give rise to systematically different effects on accuracy. We argue that (...) equations that relate group accuracy, individual accuracy, and group diversity are useful theoretical tools for understanding group performance in the context of research on group structure. In particular, these equations may serve to identify the kind of group structures that improve individual accuracy without thereby excessively diminishing diversity so that the net positive effect is an improvement even on the level of collective accuracy. Two experiments are reported where two structures are investigated from this perspective. It is demonstrated that the more constrained network outperforms the network with a free flow of information. She addresses the need for the left to reappropriate the forthright critique of the State and its violence and to examine the way minorities are produced. To do so, her analysis starts from the question of immigrant persons. She highlights the issues and the difficulties which are involved, if there is to (...) be a productive critique of the State, the aim of which is to contest it. As part of a dynamic political perspective, she proposes the creation of coalitions. She outlines the main lines of such a coalition, its dynamics and singularities, its articulation with the subject, but also its limits. In conclusion, she examines the issue of revolution and her relation to Marxist thought, indicating the outlines of her current thinking. (shrink)

This is the twenty-sixth volume in the Library of Living Philosophers, a series founded by Paul A. Schilpp in 1939 and edited by him until 1981, when the editorship was taken over by Lewis E. Hahn. This volume follows the design of previous volumes. As Schilpp conceived this series, every volume would have the following elements: an intellectual autobiography of the philosopher, a series of expository and critical articles written by exponents and opponents of the philosopher's thought, replies to (...) these critics and commentators by the philosopher, and as nearly complete a bibliography of the published work of the philosopher as possible. Moral theorists often say such things as “But surely A ought to do such and such,” or “Plainly it is morally permissible for B to do so and so,” and do not even try to prove that those judgments are true. Moreover, they often rest weight on the supposition that those judgments are true. In particular, they often rest theories on them: they take them as data. Others object. They say that nobody is entitled to rest any weight at all (...) on judgments such as those. They say, not that the judgments are false, but that there is no reason to believe them true. They say, more generally, that there is no reason to think of any moral judgment that it is true. I will call this The No Reason Thesis. Is there reason to think The No Reason Thesis true? There are lots of arguments for it in the literature, but I want to focus on one of them in particular. I think that the one I will focus on lies behind all the others, but no matter if it does not: I suggest that if this argument fails, they all fail. (shrink)

A compelling set of lectures on political obligation that contributes to ongoing debates in political theory and intellectual history This stimulating collection of lectures by the late Judith Shklar on political obligation is paired with a scholarly introduction that offers an overview of her life, illuminates the connections among her teaching, research, and publications, and explains why her lectures still resonate with us and contribute to current debates in political theory and intellectual history.

In this article I examine the relation between the philosophies of Maurice Merleau-Ponty and Gilles Deleuze by looking at the way in which they refer to Henri Bergson’s time theory. Although Merleau-Ponty develops some fundamental Bergsonian insights on the nature of time, he presents himself as a critical reader of the latter. I will show that although Merleau-Ponty’s interpretation of Bergson differs fundamentally from Deleuze’s interpretation, Merleau-Ponty’s “corrections” of Bergson’s theory fit Deleuze’s reading of Bergson very well. This indicates a (...) similarity with respect to what is at stake in the philosophies of Merleau-Ponty and Deleuze. Hence the critical reference that Deleuze makes to Merleau-Ponty’s conception of cinema and thus of movement is not justified, but is the result of a selective and prototypical reading of the early Merleau-Ponty. Critical (necessary or sufficient) features in categorisation have a long history, but the empirical evidence makes their existence questionable. Nevertheless, there are some cases that suggest critical feature effects. The purpose of the present work is to offer some insight into why classification decisions might misleadingly appear as if they involve critical features. Utilising Tversky's (1977) contrast model of similarity, we suggest that when an object has a sparser representation, changing any of its features is more likely to lead to (...) a change in identity than it would in objects that have richer representations. Experiment 1 provides a basic test of this suggestion with artificial stimuli, whereby objects with a rich or a sparse representation were transformed by changing one of their features. As expected, we observed more identity judgements in the former case. Experiment 2 further confirms our hypothesis, with realistic stimuli, by assuming that superordinate categories have sparser representations than subordinate ones. These results offer some insight into the way feature changes may or may not lead to identity changes in classification decisions. (shrink)

Diversity is both an unavoidable aspect of twenty-first century living and a powerful challenge to older philosophical traditions that still assume as normatively universal a set of values, ways of thinking, institutions, and habits of living that emerged within earlier eras of more homogeneous cultures, less developed technologies, and more accepted forms of linguistic, legal, religious, economic, political, and military domination. Within recent years, new styles of philosophical discourse, including deconstruction, postmodernism, feminism, post-colonialism, and critical race theory, have persuasively challenged (...) these universalistic assumptions to reveal the important human differences they marginalize. Experience-based appreciation of the mutually educative potential of diverse standpoints as well as sober concern about the perils of our present times have led many thinkers to look for contemporary forms of pragmatism and cosmopolitanism as hospitable intellectual gathering places for urgently needed cross-difference conversations that may reflect and give substance to shared visions of democratic diversity. The eight authors in this volume engage in cross-difference conversations with other thinkers from earlier periods and other philosophical traditions, as well as with each other, in order to reconstruct pragmatism and cosmopolitanism in ways that are more attuned to our lived experience of diversity as well as our hopes for a diversity-appreciating democratic future. During the past few years, feminist critics have approached writing by women with an "abiding commitment to discover what, if anything, makes women's writing different from men's" and a tendency to feel that some significant differences do exist.4 The most common answer is that women's experiences differ from men's in profound and regular ways. Critics using this approach find recurrent imagery and distinctive content in writing by women, for example, imagery of confinement and unsentimental descriptions of child care. The other (...) main explanation of female difference posits a "female consciousness" that produces styles and structures innately different from those of the "masculine mind." The argument from experience is plausible but limited in its applications: the argument from a separate consciousness is subject to mystification and circular evidence. In both cases, scholars tend to list a few characteristics of writing by women without connecting or explaining them.· 4.
