One of the most influential methodological contributions of twentieth‐century philosophy was the approach known as conceptual analysis. The majority of experimental philosophy papers are doing cognitive science. They are revealing surprising new effects and then offering explanations those effects in terms of certain underlying cognitive processes. The best way to get a sense for actual research programs in experimental philosophy is to look in detail at one particular example. This chapter considers the effect of moral considerations on intuitions about intentional (...) action, as an example. Working in conceptual analysis aimed to develop analyses of concepts, and in that context, the obvious proposal would be that people should be aiming for simple analyses of concepts. The chapter also focuses on the study of intuitions about knowledge. Experimental philosophy has sought to capture the patterns in people's intuitions through theories about underlying cognitive processes. (shrink)

Recent studies point to a surprising divergence between people's use of the concept of _intention_ and their use of the concept of _acting intentionally_. It seems that people's application of the concept of intention is determined by their beliefs about the agent's psychological states whereas their use of the concept of acting intentionally is determined at least in part by their beliefs about the moral status of the behavior itself (i.e., by their beliefs about whether the behavior is morally good (...) or morally bad). These findings raise a number of difficult questions about the relationship between the concept of intention and the concept of acting intentionally. The present paper addresses those questions using a variety of different methods, including conceptual analysis, psychological experimentation, and an examination of people's use of certain expressions in other languages. Consider the following explanation: (1) George took his umbrella because it was just about to rain. This is an explanation of a quite distinctive sort. It is profoundly different from the sort of explanation we might use to explain, say, the movements of a bouncing ball or the gradual rise of the tide on a beach. Unlike these other types of explanations, it explains an agent’s behavior by describing the agent’s own _reasons_ for performing that behavior. Explanations that work in (...) this way have a number of distinctive and important properties, and we will refer to them here as _reason explanations_. Looking at the use of reason explanations with a philosophical eye, one is apt to experience a certain puzzlement. One wants to know precisely what makes a given reason explanation true or false. So, for example, the explanation given above seems to be saying that George’s reason for taking his umbrella was that it was just about to rain. But what exactly makes it the case that this is George’s reason? Does he have to actually be. (shrink)

Leftwing critiques of philanthropy are not new and so it is unsurprising that the Effective Altruism movement, which regards philanthropy as one of its tools, has been a target in recent years. Similarly, some Effective Altruists have regarded anti-capitalist strategy with suspicion. This essay is an attempt at harmonizing Effective Altruism and the anti-capitalism. My attraction to Effective Altruism and anti-capitalism are motivated by the same desire for a better world and so personal consistency demands reconciliation. More importantly however, I (...) think Effective Altruism will be less effective in realizing its own ends insofar as it fails to recognize that capitalism restricts the good we can do. Conversely, insofar as anti-capitalists fail to recognize the similarity in methods which underlie Effective Altruism thinking about the world, it too risks inefficiency or worse, total failure in replacing capitalism with a more humane economic system. I first argue that Effective Altruism and anti-capitalism are compatible in principle by looking at similarities between Effective Altruist theory and some Marxist writing. I then go on to show that the theoretic compatibility can be mirrored in practice. I demonstrate this by considering and replying to objections to anti-capitalism as they might be raised by Effective Altruists and by replying to objections to Effective Altruism as they might be raised by anti-capitalists. I conclude by suggesting that their reconciliation would lead to better outcomes from the perspective of a proponent of either view. In short, an “Anti-Capitalist Effective Altruism” is not just possible, it’s preferable. (shrink)

Terry Horgan and Mark Timmons have recently presented a series of papers in which they argue against what has come to be called the ‘new wave’ moral realism and moral semantics of David Brink, Richard Boyd, Peter Railton, and a number of other philosophers. The central idea behind Horgan and Timmons’s criticism of these ‘new wave’ theories has been extended by Sean Holland to include the sort of realism that drops out of response-dependent accounts that make use of an analogy (...) between moral properties and secondary qualities. This paper argues that Holland’s extension depends crucially on the fact that his target is a direct response-dependent account of moral value. His argument does not work against such accounts of more basic normative notions such as ‘harm’ or ‘benefit’. And these more basic notions may then serve as the basic normative building blocks for an indirectly response-dependent moral theory. (shrink)

In dispensing with this sanitized illusion, the book adopts a healthier and more honest relationship with sex; in order to have a productive discussion about the ethics of any human activity, that discussion should represent the human activity faithfully. Part of the reason that Epstein-Levi takes this approach is to distinguish Jewish ethics' discussion of sex, which regards sex, and therefore sexual ethics, "as an empirical, lived, and granular phenomenon" (3).Discussions in Jewish sexual ethics should treat sex as a lived social experience and be responsive to the messiness of that experience. Epstein-Levi argues that sanitizing sex through appeal to a nebulous notion of how historical [End Page 99] religious traditions must have been puritanical is ahistorical, chauvinistic, and inconsistent with scholarship on rabbinic texts.This is a striking and perhaps subversive view in our present context. Centrally, many associate "religious views" (especially in sexual ethics) with politically Conservative and purity-driven views characteristic of some Christian traditions. The term "Judeo-Christian" in American political discourse is often used evocatively of the heteronormative, sanitized, idealized posture toward sex that Levi explicitly rejects. Epstein-Levi's book recognizes that rabbinic scholarship underrepresents marginalized communities, including women, LGBTQ+ people, and disabled people. This is the major moral and practical focus of Epstein-Levi's analysis; historical traditions in which dominant moral views are shaped by a particular group often have glaring blind spots. When we recognize those blind spots, as members of that tradition, need to be updated simply to address sex as it exists, not as we idealize it.The book centers Jewish texts and methods of thought, but (in my view) readers who will benefit most from reading Epstein-Levi's book are non-Jewish readers thinking about sex. Epstein-Levi's book illustrates methodological differences in Jewish ethics from other approaches. In some popular and political discourse, ‘compassion’ is commonly conceived as a simple or ‘given’ aspect of the world. And yet public discussion also focusses on whether ‘compassion' has gone wrong in some way, suggesting that there might be various more or less satisfactory versions of compassion. At the same time, some thinkers doubt whether compassion should any longer be expected of those working in healthcare. This article draws on philosophical and theological resources to argue that the conceptual context which (...) forms compassion is crucial for determining the ethos of healthcare. The discussion explores three themes – politics, suffering and responsibility – which must be addressed in order to understand what is wrong with compassion, to identify lines of future investigation and to develop possible remedies. The topic of murder was among Elizabeth Anscombe’s central preoccupations. Drawing on both her published writings and newly available archival resources, this paper reconstructs Anscombe’s theory of murder. I show that Anscombe was concerned to deny the semantic thesis that “murder” means “killing that is unjustified or impermissible” and I show how her theory surmounts three challenges that seem to support the semantic thesis. In doing so, I discuss her views on responsibility, the significance of the distinction between intention and (...) foresight, and the concept of a title to kill. (shrink)

This discussion examines two of the central notions at work in Sterba’s From Rationality to Equality: question-beggingness, and the notion of a rational requirement. I point out that, against certain unreasonable positions, begging the question is a perfectly reasonable option. I also argue that if we use the sense of “rational requirement” that philosophers ought to have in mind when defending the idea that morality is rationally required, then Sterba has not succeed in defending this idea. Rather, he has at (...) most demonstrated the rational preferability of morality over two other positions: an extreme egoism, and a very particular form of altruism. But another position exists: one that holds altruistic reasons to exist, and to be capable of justifying sacrifices, but that also holds that they do not require us to sacrifice our interests in the way that morality sometimes does require. In “ A Light Theory of Color”, Walter Sinnott-Armstrong and David Sparrow argue that color is neither a primary quality of objects, nor a disposition that objects have, nor a property of our visual fields. Rather, according to the view they present, color is a property of light. The present paper aims to show, first, that the light theory is vulnerable to many of the very same objections that Sinnott-Armstrong and Sparrow raise against rival views. Second, the paper argues that (...) the strategies that Sinnott-Armstrong and Sparrow use to avoid certain objections are also available to proponents of rival accounts. This might only seem to show that the light theory is in the same shaky boat as other theories: suffering from the same problems but having the same tools for solving them. The paper concludes with a suggestion as to why this is not the case, but why the existence of the light theory is nevertheless likely to bring increased clarity to the debate about color realism. In the early nineteenth century, authoritative treatise writers such as James Kent and Joseph Story represented Anglo-American trust law as a seamless web. But the transplantation of trust law from England to America was not a simple process of adherence. Rather, American courts and legislatures came to discard fundamental English trust doctrines. Restraints on anticipation and on alienation were embraced, and in key state jurisdictions bare trusts were abolished, or else displaced from the core of trust law. Irreducible settlor power (...) over beneficiaries and the strong protection of beneficiaries from creditors under spendthrift trusts were two strikingly original American creations, which flowed from these basic doctrinal choices. The changes made to American trust doctrine yield a paradox for the legal, social and economic historian, namely that republican America ended up with a more dynastic property law, more wedded to dead hand control and more hostile to commercial creditors, than did aristocratic England with its unreformed system of common law and equity rooted in the feudal property system. The American abandonment of free alienability of beneficial interests and the corresponding reduction of the beneficiary’s powers over trust assets may have been rooted in the volatility of credit in America and the desire of the wealthy to escape from the pressures of the market, though disparities between jurisdictions remain to be explained. Joshua Matthan Brown contrasts the concept of God assumed by most analytic philosophers, what he refers to as theistic personalism, with that of the apophatic conception of God endorsed by Eastern Christian thinkers. He maintains that the most powerful and economical response to contemporary arguments for atheism is to reject theistic personalism and adopt apophatic theism. Apophatic theists believe there is a lot we cannot say about God, taking the divine nature to be completely ineffable. Brown develops a coherent (...) account of divine ineffability and provides reasons for adopting this oft misunderstood view. Importantly, he draws upon apophatic theology, and its commitment to divine ineffability, to proffer an undercutting defeater for virtually every contemporary argument for the nonexistence of God. This paper presents a sustained critique of Colin McGinn’s aesthetic theory of virtue. The critique is twofold. First, I demonstrate that there are a number of theoretical flaws which suggest that McGinn’s theory is unable to properly evaluate racist literature. Then, using the novel Frankenstein, I show that, practically, McGinn’s theory incorrectly evaluates problematically racist characters, such as Victor Frankenstein.

We approach law with deep ambivalence. On the one hand, we take immense pride in living under the rule of law. On the other hand, we often catch ourselves lamenting the existence of law. When we lament the existence of law, we are not just saying that there is too much of it. We are not just complaining about the amount of law. Rather, our complaint goes to the very nature of law itself. We complain that its rules are constraining, (...) that its generality ignores the particularity of each situation, that its coercive force rides roughshod over our autonomy, and the list goes on. However, notwithstanding the frustration with law, it is not that we want to get rid of it. This paper seeks to express and explain our conflicting sentiments about law – why we sometimes view law as a monumental moral achievement and why we are sometimes so frustrated with it. The answer, as this paper will argue, lies in the nature of norms. The value and limit of law is traceable to the value and limit of norms. Kierkegaard helps us see that. This paper will argue that our ambivalence about law mirrors Kierkegaard’s ambivalence about ethics. (shrink)

It has become a popular view in jurisprudence that the law exists to guide us. I argue in this article that it is plausible to think that the law does not necessarily exist to guide us. I do this while accepting that the law is necessarily normative. The upshot of the argument is significant. Viewing an attempt to provide guidance as a necessary feature of the law gives rise to a distinctive mode of operating that some think has inherently valuable (...) qualities. We get to say, for example, that the rule of law provides some necessary constraints on how laws should be designed. These valuable aims and constraints become external aims and constraints once guidance is jettisoned from the concept of law. It would not, for example, be true just in virtue of the very nature of law that it should not be secret or oppress people into conformity. (shrink)

This justifiably provokes two questions in reaction: why is this question worth pursuing, and (...) why pursue it via a comparative reading of Aquinas and Confucian philosophy?As to the first of these, the question I pose here is a specification of the larger responsibilities that fall to Christians according to the Scriptures. Galatians 5:1–2 puts the matter this way: "Brothers, even if a person is caught in some transgression, you who are spiritual should correct that one in a gentle spirit, looking to yourself, so that you may also not be tempted. Bear one another's burdens and so you will fulfill the law of Christ."1 In the theological tradition, "bearing one another's burdens" has been neatly and aptly represented in the principle of fraternal correction. The question I am focused on here, then, is how is fraternal correction properly offered from laity to clerics.Ultimately, articulating the shape or form of virtuous lay correction of clergy is actually a rather knotty problem. This is because the manner of the relationship between laity and clergy is not simply understood in terms [End Page 1025] of the bonds of Christian fraternity. Certainly, all Christians are brothers and sisters in Christ, for through His grace we have been adopted into the inheritance of the Kingdom of God as children of God (see Eph 5:1–5; 1 John 3:1–3). Yet the Church also recognizes that priests and bishops possess not simply a fraternal but also a paternal relationship to laity. As St. Paul again puts it to the church in Corinth, "I became your father in Christ Jesus through the gospel. Therefore, I urge you, be imitators of me" (1 Cor 4:15–16).I propose here that, although fraternal correction is a still useful concept for understanding how laity can morally correct clergy, it has an obvious weakness in that it corresponds to a particular relational analogy, that of fraternity, within which the difference in authority is not as great as the parent–child bond. Thus, fraternal correction is exceptionally useful for understanding how relationships with more or less equal rank of authority can function in terms of moral remonstration, such as how a lay Christian might fraternally correct another lay Christian, or a cleric fraternally correct a cleric. However, when it comes to clergy–laity relations, the shape of fraternal correction is far less clear, for there is a just and genuine disparity between them in the order of ecclesial, magisterial authority underlying the relationship, even if there is equality in other important respects.I argue here that lay responsibilities for correcting clergy can be fruitfully understood in terms of filial remonstration as understood by the Confucian philosophical tradition. Of course, there is one tremendous dissimilarity between Confucian views on the responsibilities for filial remonstration and those pertaining to the laity–clergy relationship: the former occur within and flow from the natural foundation of the parent–child bond, while the latter are not based on blood relations and natural duties. Yet, the same can be said about the language of fraternal correction, which draws upon the analogous duties of blood-kin applied to the spiritual fraternity of the Christian life. And so, it must be admitted that although the father–child relationship is used only analogously to describe the priest–laity relationship, it also accurately depicts the reality of that relationship. As John Paul II observed, priestly celibacy entails "a singular sharing in God's fatherhood and in the fruitfulness of the Church."2 The call of the priest to the celibate life is thus a call to fatherhood, indeed, a call to imitate and participate in the paternity of the triune God in a special and spiritual way. According to socio-relational theory, men and women encountered different ecologies in their evolutionary past, and, as a result of different ancestral selection pressures, they developed different patterns of emotional expressivity that have persisted across cultures and large human evolutionary time scales. We question these assumptions, and propose that social-cognitive models of individual differences more parsimoniously account for sex differences in emotional expressivity.

Defending this proposition will require the positing of three related claims: (i) that law is good, (ii) that the good of law is denied to the slave, and (iii) that the denial is wrong. This paper will defend the main proposition by defending its three constituent claims. On claim (i), the paper will relate the form of law to the formation (...) of freedom. What is the meaning of punishment today? Where is the limit that separates it from the cruel and unusual? Clearly, for the use of violence to be legitimate it must be subject to limitation. The difficulty is that the determination of this limit should be objective, but it is not. It is this contestability of the limit that this book addresses.

Arrian's account of Alexander's brief time at Ephesus (Anab. 1.17.10–12) is shot through with political and factional violence, but he nevertheless concludes that Alexander received acclaim for what he did in the city. But what did Alexander actually do at Ephesus? Arrian offers a list of events that historians have traditionally interpreted as connected to Macedonian intervention in Asia Minor before indicating that Alexander put an end to the violence. This article offers a new reading of this passage by situating (...) these events in the context of fourth-century Ephesus to show how Alexander's actions responded to the local conditions that he encountered. Corporations are increasingly engaging in corporate social advocacy (CSA) by communicating on social issues that are controversial and contemporary and not necessarily linked to the corporations' business activities. The purpose of this study is to understand the desirability of CSA: Should corporations be communicating on these debated social issues, and to what extent? Using the online sampling platform Qualtrics, participants (N = 699, located in the United States and 18–35 years old) responded to a survey asking them how they perceived (...) corporate communication on debated social issues. Findings indicate that participants view corporate communication on debated social issues as something that corporations should be engaging in, that this communication is helpful in solving these debated social issues, and that corporations should be the leaders in changing how society thinks about these debated social issues. At the same time, individuals do not trust the moral compass of corporations. Findings also show that certain corporate sectors (e.g., Health Care) should communicate more than other sectors (e.g., Chemicals), certain corporate characteristics (e.g., Reputation) matter more than other corporate characteristics (e.g., Size), and certain topics (e.g., Race Relations) should be discussed more than other topics (e.g., Confederate Flag Use). The National Health Service (NHS) was the first healthcare system globally to declare ambitions to become net carbon zero. To achieve this, a shift away from metered-dose inhalers which contain powerful greenhouse gases is necessary. Many patients can use dry powder inhalers which do not contain greenhouse gases and are equally effective at managing respiratory disease. This paper discusses the ethical issues that arise as the NHS attempts to mitigate climate change. Two ethical issues that pose a barrier to moving (...) away from metered-dose inhalers are considered: patients who decline an inhaler with a smaller carbon footprint and increased cost. I argue that while a patient is not morally justified in refusing a more environmentally sustainable inhaler due to the expected harms, a doctor may still prescribe a metered-dose inhaler if they believe that switching without consent might undermine trust or substantially worsen the patient’s health. Turning to cost, I argue that the imperative to combat climate change means the NHS should accept small increased financial costs for lower carbon inhalers, even though this provides no additional direct benefit for the patient. I then go on to consider the implications of the preceding analysis for policy and practice. I argue for a policy that minimises the impact of inhalers on the climate by advocating for a principle of environmental prescribing and explore decision-making in practice. While the arguments here pertain primarily to inhalers, the discussion has broader implications for debates around healthcare’s responsibility to be environmentally sustainable. (shrink)
