The privilege of having three sets of extensive and hard-hitting comments on one's work is as welcome as it is rare, and especially so on this occasion as the lectures were, for me, but thefirst (well, not entirely first) stab at a subject I hope to explore at greater length. The reflectionsthat follow will respond to some of the criticisms, but will not be a point by point reply. I will use the occasion to clarify some obscurities in the lectures, (...) and to contrast my view with some of my critics' own positions. I will proceed thematically, starting with some observations about method and about ontology, proceeding to explore several questions about the relations between social dependence and relativism, between genre, value, and normativity, and concluding with a fewwords on pluralism and liberal values. What is special about legal reasoning? In what way is it distinctive? How does it differ from reasoning in medicine, or engineering, physics, or everyday life? The answers range from the very ambitious to the modest. The ambitious claim that there is a special and distinctive legal logic, or legal ways of reasoning, modes of reasoning which set the law apart from all other disciplines. Opposing them are the modest, who claim that there is nothing special to legal reasoning, that (...) reason is the same in all domains. This paper presents a simple mathematical model that shows how economic inequality between social groups can arise and be maintained even when the only adaptive learning process driving cultural evolution increases individuals’ economic gains. The key assumptions are that human populations are structured into groups and that cultural learning is more likely to occur within than between groups. Then, if groups are sufficiently isolated and there are potential gains from specialization and exchange, stable stratification can sometimes result. This model predicts (...) that stratification is favored, ceteris paribus, by (1) greater surplus production, (2) more equitable divisions of the surplus among specialists, (3) greater cultural isolation among subpopulations within a society, and (4) more weight given to economic success by cultural learners. Few theories have influenced Western thought as much as psychoanalysis has, even in the absence of empirically confirmatory evidence. The raw data of psychoanalysis are the words and actions of the patient and their interpretation by the analyst. The psychoanalytic session has excluded other observers and, until very recently, even a tape recorder. The only evidence of what transpired between patient and therapist was supplied by the memories, accounts, and records each of them might have kept. The degree to which (...) each could be objective and veridical in recording the events in treatment is not known, but given the intense, emotional nature of the clinical interaction, it is likely that systematic distortions, omissions, and inventions occurred. Various writers have called attention to the lack of scientific investigation of psychodynamic propositions. This series is intended to describe the best and most current experimental work inspired by psychoanalytic theories. A scientific theory is expected to generate data that will force it to be revised and ultimately discarded. The paper offers a new account of the rule of law, revising my previous view, and criticising some alternatives. It focuses on the rule of law's aim to avoid arbitrary government, and on its relation to the essential functions of government. The rule of law requires that government action will manifest an intention to protect and advance the interests of the governed. The present version, 3.1, differs only cosmetically from 3.0, but the latter does involve a substantial expansion from version 2.0.

This paper discusses the relationship between Kantian idealism and Marxian materialism. Part I examines the reasons this relationship is misconstrued to be predominantly a matter of practical philosophy and turns to the neglected works of Alfred Sohn-Rethel and Richard Seaford to outline the importance of money for understanding Kant’s theoretical work. Part II considers an objection that Kant confuses the commodity form for the transcendental object of experience. I am ultimately concerned with defusing the accusation that the identity of the (...) commodity with a Kantian thing renders Kantian idealism “bourgeois” in the pejorative sense. Money is implicated, historically and conceptually, in the very intelligibility of metaphysics. In that case, Kantian idealism and Marxian materialism are two sides of the same coin. (shrink)

Thorstein Veblen is perhaps best thought of as America’s answer to Karl Marx. This is sometimes obscured by the rather unfortunate title of his most important work, The Theory of the Leisure Class (1899), which misleading, insofar as it suggests that the book is just a theory of the “leisure class.” What the book provides is in fact a perfectly general theory of class, not to mention property, economic development, and social evolution. It is, in other words, a system of (...) theory that rivals Marx’s historical materialism with respect to scope, generality and explanatory power. Furthermore, it is a system of theory whose central predictions, with respect to the development of capitalism and the possibilities for emancipatory social change, have proven to be essentially correct. When stacked up against Marx’s prognostications, this success clearly provides the basis for what might best be described as an invidious comparison. (shrink)

Arthur Fine has recently argued that standard realist and anti-realist interpretations of science should be replaced by "natural ontological attitude" (NOA). I ask whether Fine's own justification for NOA can meet the standards of argument that underlie his criticisms of realism and anti-realism. Fine vacillates between two different ways of advocating NOA. The more minimalist defense ("why not try NOA?") begs the question against both realists and antirealists. A stronger program, based on Fine's arguments for a "no-theory" of truth, has (...) promise, but the arguments must be developed in a stronger, more general form if they are to justify NOA. (shrink)

This book argues that the philosophical significance of Kant’s aesthetics lies not in its explicit account of beauty but in its implicit account of intentionality. Kant’s account is distinct in that feeling, affect, or mood must be operative within the way the mind receives the world. Moreover, these modes of receptivity fall within the normative domain so that we can hold each other responsible for how we are "struck" by an object or scene. Joseph Tinguely composes a series of (...) investigations into the philosophically rich but regrettably neglected topics at the intersection of Kant’s aesthetics and epistemology, such as how we orient ourselves in the world, whether tonality is a property of the subject or object, and what we hope to accomplish when we quarrel about taste. Taken together, these investigations offer a robust and defensible picture of mind, which not only resolves tensions in a Kantian account of intentionality but also offers a timely intervention into contemporary debates about the "aesthetic" nature of the way the mind is in touch with the world. The correlations between distant systems in typical quantum situations, such as Einstein-Podolosky-Rosen experiments, strongly suggest that the quantum realm involves curious types of non-Iocal influences. In this paper, I study in detail the nature of these non-Iocal influences, as depicted by various quantum theories. I show how different quantum theories realise non-Iocality in different ways, whichreflect different ontological settings.

Countering the common assumption in affect theory that deconstruction is incompatible with studies of affect, this essay theorises a deconstructive approach to reading for affect in texts and examines the role affect has always played in deconstructive reading. It reads Derrida alongside Deleuze who has been influential in affect theory in order to explicate what deconstruction adds to existing poststructural theories of affect: namely, how affect functions at the scene of reading, shaping the reading itself and coming into view through (...) textual forms. In its second half, the essay turns to Cixous' ‘Savoir,’ demonstrating through a reading of that text what a deconstructive reading of affect looks like in practice and exploring the ethics of such an approach.
