Artykuł opisuje widzenie praw i wolności w Kazaniach sejmowych Piotra Skargi. We wstępie ukazano dzieło jezuity w kontekście innych traktatów społeczno-politycznych XVI wieku. We właściwej części artykułu przedstawiono rozumienie praw przez kaznodzieję. Zaprezentowano różne ich kategorie. Następnie dowiedziono konieczności istnienia ustaw państwowych. Kolejno przybliżono cechy dobrych praw, czyli: sprawiedliwość, krzewienie cnoty i obronę czci Boskiej. Ukazano błędy w polskim prawodawstwie, wśród których na plan pierwszy wysuwa się zniesienie jurysdykcji sądów duchownych oraz pobłażliwe traktowanie morderców. Zobrazowano zależność praw od obyczajów. Podkreślono (...) znaczenie odpowiedniej władzy wykonawczej i przedstawiono kilka uwag w sprawie sądownictwa. W następnej części pracy przybliżono wizję wolności w dziele Skargi. Ukazano więc wartość złotej wolności szlacheckiej ze wskazaniem nieprawidłowości w jej pojmowaniu. Podniesiono złe traktowanie chłopów. Zwrócono uwagę na zagrożenia płynące ze strony innowierców. Kolejno przedstawiono cztery rodzaje wolności. Potem dowiedziono istnienia związku praw i wolności. Wykazano, że do zniewolenia często prowadzi grzech i dlatego należy zapewnić prawne wsparcie religii. Zobrazowano, że rolą praw jest ograniczenie sprawujących władzę — by nie naruszali autonomii innych. Stwierdzono, iż sprawiedliwe prawa mają chronić wszystkich członków narodu. Na końcu dowiedziono, iż posłuszeństwo prawu współgra z koncepcją wolności chrześcijańskiej — w jej tradycyjnym rozumieniu. (shrink)

What is the proper unit of analysis in the psycholinguistics of dialog? While classical approaches are largely based on models of individual linguistic processing, recent advances stress the social coordinative nature of dialog. In the influential interactive alignment model, dialogue is thus approached as the progressive entrainment of interlocutors' linguistic behaviors toward the alignment of situation models. Still, the driving mechanisms are attributed to individual cognition in the form of automatic structural priming. Challenging these ideas, we outline a dynamical framework (...) for studying dialog based on the notion of interpersonal synergy. Crucial to this synergetic model is the emphasis on dialog as an emergent, self-organizing, interpersonal system capable of functional coordination. A consequence of this model is that linguistic processes cannot be reduced to the workings of individual cognitive systems but must be approached also at the interpersonal level. From the synergy model follows a number of new predictions: beyond simple synchrony, good dialog affords complementary dynamics, constrained by contextual sensitivity and functional specificity. We substantiate our arguments by reference to recent empirical studies supporting the idea of dialog as interpersonal synergy. (shrink)

This entry summarizes an emerging subdiscipline of both empirical bioethics and experimental philosophy (“x-phi”) which has variously been referred to as experimental philosophical bioethics, experimental bioethics, or simply “bioxphi”. Like empirical bioethics, bioxphi uses data-driven research methods to capture what various stakeholders think (feel, judge, etc.) about moral issues of relevance to bioethics. However, like its other parent discipline of x-phi, bioxphi tends to favor experiment-based designs drawn from the cognitive sciences – including psychology, neuroscience, and behavioral economics – to (...) tease out why and how stakeholders think as they do. In the paper we discuss criticisms against David Armstrong’s general theory of truthmaking by Gonzalo Rodriguez-Pereyra, Peter Schulte and Benjamin Schnieder, and conclude that Armstrong’s theory survives these criticisms. Special attention is given to the problems concerning Entailment Principle, Conjunction Thesis, Disjunction Thesis and to the notion of explanation.

This chapter examines the relevance of the cognitive science of morality to moral epistemology, with special focus on the issue of the reliability of moral judgments. It argues that the kind of empirical evidence of most importance to moral epistemology is at the psychological rather than neural level. The main theories and debates that have dominated the cognitive science of morality are reviewed with an eye to their epistemic significance.

In recent years, sport entities have begun to prioritise environmental sustainability initiatives in their business strategies with the aim of minimising their environmental impact and engaging stakeholders within the ES movement. There has been minimal academic consideration of the ES movement in professional sport, particularly outside of North America and Europe. The aim of the present study is to provide an overview of the type and profile of ES initiatives being undertaken and communicated to stakeholders in the Asia-Pacific region by (...) the industry bodies. Further, the study offers a conceptual model of the global-, country-, industry- and organisational-level forces impacting these sporting organisations’ ES practices. Various communication mediums of 114 professional sport teams from seven countries—Australia, India, New Zealand, Japan, China, Taiwan and Korea—were evaluated using content analysis. The results reveal low communication of ES practices by professional sport teams in the Asia-Pacific region compared to North America. Extended findings on the existing global profile of ES engagement provide a descriptive understanding of the ES movement in the Asia-Pacific region, and contribute to the identification of possible antecedents and correlatives to be evaluated in future research. Counselling acts consist in indicating useful activities, remedying human deficiencies. Counselling acts are guided by practical cognition. Since counselling activities are oriented towards the future, their crucial element is foresight. It is cognitive reflection foreseeing the implementation of counselling acts. Counselling acts are actualised in rhetorical and communicational context which is associated with persuasive delivery of counselling content. Belonging to the rhetorical canon, invention disposes of factors that influence the justifying formulation of advisory content. Invention factors introduce the anticipatory determinations (...) and concretisations of counselling content. At rhetorical level, inventive methodology plays anticipatory functions which are convergent with tasks of foresight in practical cognition. (shrink)

We study a new formal logic LD introduced by Prof. Grzegorczyk. The logic is based on so-called descriptive equivalence, corresponding to the idea of shared meaning rather than shared truth value. We construct a semantics for LD based on a new type of algebras and prove its soundness and completeness. We further show several examples of classical laws that hold for LD as well as laws that fail. Finally, we list a number of open problems. -/- .

Qualitative Reasoning (QR) is an area of research within Artificial Intelligence that automates reasoning and problem solving about the physical world. QR research aims to deal with representation and reasoning about continuous aspects of entities without the kind of precise quantitative information needed by conventional numerical analysis techniques. Order-of-magnitude Reasoning (OMR) is an approach in QR concerned with the analysis of physical systems in terms of relative magnitudes. In this paper we consider the logic OMR_N for order-of-magnitude reasoning with the (...) bidirectional negligibility relation. It is a multi-modal logic given by a Hilbert-style axiomatization that reflects properties and interactions of two basic accessibility relations (strict linear order and bidirectional negligibility). Although the logic was studied in many papers, nothing was known about its decidability. In the paper we prove decidability of OMR N by showing that the logic has the strong finite model property. In the paper I describe John MacFarlane’s version of relativism about truth. I begin by discussing Twardowski’s (1900) and Kokoszynska’s (1948; 1951) arguments against relativism. They think — just as Haack does (see 2011) — that sentences may be relatively true, if they are incomplete, but once they are completed they become true (or false) absolutely. MacFarlane distinguishes between nonindexical contextualism (which was anticipated by Kokoszynska (sic!)) and relativism which requires the introduction of the context of assessment. According to him (...) only the view which postulates double-indexed (to contexts of utterance and to contexts of assessments) truth is able to explain disagreement in subjective domains and contradicting intuitions about the truth-value of future-contingents. The book presents logical foundations of dual tableaux together with a number of their applications both to logics traditionally dealt with in mathematics and philosophy (such as modal, intuitionistic, relevant, and many-valued logics) and to various applied theories of computational logic (such as temporal reasoning, spatial reasoning, fuzzy-set-based reasoning, rough-set-based reasoning, order-of magnitude reasoning, reasoning about programs, threshold logics, logics of conditional decisions). The distinguishing feature of most of these applications is that the corresponding dual tableaux are built in a (...) relational language which provides useful means of presentation of the theories. In this way modularity of dual tableaux is ensured. We do not need to develop and implement each dual tableau from scratch, we should only extend the relational core common to many theories with the rules specific for a particular theory. (shrink)

Rather than focus on effects, the isolatable and measureable outcomes of events and interventions, the papers assembled here offer different perspectives on the affective dimension of the meaning and politics of human/non-human relations. The authors begin by drawing attention to the constructed discontinuity between humans and non-humans, and to the kinds of knowledge and socialities that this discontinuity sustains, including those underpinned by nature-culture, subject-object, body-mind, individual-society polarities. The articles presented track human/non-human relations through different domains, including: humans/non-humans in history (...) and animal welfare science (Fudge and Buller); the relationship between the way we live, the effects on our natural environment and contested knowledges about ‘nature’ (Whatmore); choreographies of everyday life and everyday science practices with non-human animals such as horses, meerkats, mice, and wolves (Latimer, Candea, Davies, Despret). Each paper also goes on to offer different perspectives on the human/non-human not just as division, or even as an asymmetrical relation, but as relations that are mutually affective, however invisible and inexpressible in the domain of science. Thus the collection contributes to new epistemologies/ontologies that undercut the usual ordering of relations and their dichotomies, particularly in that dominant domain of contemporary culture that we call science. Indeed, in their impetus to capture ‘affect’, the collection goes beyond the usual turn towards a more inclusive ontology, and contributes to the radical shift in the epistemology and philosophy of science’s terms of engagement. Unprecedented advances in medicine, genetic engineering, and demographic forecasting raise new questions that strain the categories and assumptions of traditional ethical theories. Heyd's approach resolves many paradoxes in intergenerational justice, while offering a major test case for the profound problems of the limits of ethics and the nature of value.

How leaders and managers respond to not knowing is highly relevant given the complex, ambiguous, and chaotic business environment of the twenty-first century. Drawing on the literature from a variety of disciplines, the paper explores the dominant, unfavorable conceptualization of not knowing. The authors present some potential ethical implications of a negative view of not knowing and suggest how organizations would benefit from identifying any unhelpful aspects of the culture that may encourage unethical, undesirable, and/or hasty actions in situations of (...) not knowing. The paper specifically illustrates how patience, courage, honesty, integrity, and humility are integral to negative capability in the contexts of not knowing. Finally, the paper calls for deeper inquiry into the role of virtue ethics in preparing managers and leaders for not knowing and urges organizations to embrace negative capability in not knowing rather than engaging in damaging delusion. Everyone knows what is feels like to be in pain. Scraped knees, toothaches, migraines, giving birth, cancer, heart attacks, and heartaches: pain permeates our entire lives. We also witness other people - loved ones - suffering, and we 'feel with' them. It is easy to assume this is the end of the story: 'pain-is-pain-is-pain', and that is all there is to say. But it is not. In fact, the way in which people respond to what they describe as 'painful' has (...) changed considerably over time. In the eighteenth and nineteenth centuries, for example, people believed that pain served a specific (and positive) function - it was a message from God or Nature; it would perfect the spirit. 'Suffer in this life and you wouldn't suffer in the next one'. Submission to pain was required. Nothing could be more removed from twentieth and twenty-first century understandings, where pain is regarded as an unremitting evil to be 'fought'. Focusing on the English-speaking world, this book tells the story of pain since the eighteenth century, addressing fundamental questions about the experience and nature of suffering over the last three centuries. How have those in pain interpreted their suffering - and how have these interpretations changed over time? How have people learnt to conduct themselves when suffering? How do friends and family react? And what about medical professionals: should they immerse themselves in the suffering person or is the best response a kind of professional detachment? (shrink)

Recently, scholars have described the emotional consequences of transnational motherhood on families. Research, however, has neglected to address the lives of migrant fathers and how they compare to those of migrant mothers. This article fills the gap by analyzing the experiences of Mexican transnational mothers and fathers residing in New Jersey. Ethnographic data and interviews show that parents behave in similar ways when internationally separated from children. However, their migration patterns and emotional responses to separation differ. I show that these (...) differences are tied to Mexican gender ideology in which women’s maternal roles are sacralized, whereas fathers’ roles are tied to financial provision. Although the contemporary Mexican transnational family structure challenges gender norms, the analysis of how parents understand their family roles when separated from their children proves gender ideals to be highly durable in the transnational context. Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. We (...) conclude that difficulties in holding “electronic persons” accountable when they violate the rights of others outweigh the highly precarious moral interests that AI legal personhood might protect. A CHOICE Outstanding Academic Title 2012! Contemporary picturebooks open up spaces for philosophical dialogues between people of all ages. As works of art, picturebooks offer unique opportunities to explore ideas and to create meaning collaboratively. This book considers censorship of certain well-known picturebooks, challenging the assumptions on which this censorship is based. Through a lively exploration of children's responses to these same picturebooks the authors paint a way of working philosophically based on respectful listening and creative and authentic interactions, rather (...) than scripted lessons. This dialogical process challenges much current practice in education. The authors propose that a courageous and critical practice of listening is central to the facilitation of mutually educative dialogue. This paper discusses strategic decision making in firms pursuing biotechnology innovation and the influence of risk regulation on firm strategy. Data from three research projects, involving interviews with over 60 managers from agricultural and food related biotechnology companies and also over 60 key participants in the regulatory process in the UK and EC, shows a diversity of strategy and opinion. While some industry representatives identified new risk regulations governing the release of genetically manipulated organisms (GMOs) as the primary constraint on (...) biotechnology innovation, the findings of the study painted a more complex picture. The controversies surrounding the issue of risk regulation and its impact on innovation are best understood if viewed in the context of other political and economic factors. We conclude that the actual impact of risk regulation on industry strategies is probably less than the rhetoric of industry lobbyists would suggest. At the same time, the very act of lobbying so forcefully could lead to a public backlash against industry that would be much more damaging than the regulation itself. (shrink)

One of the unmet challenges for risk–benefit assessment in biomedical research is whether there should be an upper limit of risk in non-beneficial studies involving competent and consenting participants, and if yes, how it should be defined. This chapter focuses on this second question. It examines the four dominant regulatory and conceptual approaches to setting a maximal risk threshold in research: no catastrophic harm/risk approach, pure procedural approach, numerical approach, and comparative approach. It then considers the pure procedural approach, which (...) leaves the judgment of risk acceptability to RECs discretion. The approach has significant advantages, but it is not free from certain shortcomings, such as unwarranted diversity and arbitrariness of RECs judgments. The chapter concludes by sketching the outlines of what is referred to as the “ELS procedural approach” that provides RECs with procedural recommendations for identifying an ethically, legally and socially acceptable upper limit of risk in non-beneficial research on volunteers. The ELS procedural approach is an improvement over the pure procedural approach. It is more standardized and accountable, but still context-sensitive and flexible. (shrink)

Reigning regulatory frameworks for biomedical research impose on researchers and research ethics committees an obligation to protect research participants from risks that are unnecessary, disproportionate to potential research benefits, and non-minimized. Where the research has no potential to produce results of direct benefit to the subjects and the subjects are unable to give consent, these requirements are strengthened by an additional condition, that risks should not exceed a certain minimal threshold. In this article, I address the question of whether there (...) should be limits of permissible risks in non-therapeutic research involving competent and healthy subjects. Some commentators argue that competent and informed individuals should have a right to participate even in extremely risky research and that research ethics committees should never reject studies because they are too dangerous. To use David Shaw's expression, competent volunteers should have ‘a right to participate in high-risk research’. I argue that this idea is ill-founded, as it does not take into account the social mission and complex collaborative nature of research practice as well as the inequity of power between researchers and subjects. Imposition of limits on permissible risks for healthy volunteers is justified by the need to protect research enterprise and the need to protect the weaker party, namely the subjects. Also, I suggest that the best way to set boundaries on research risks is to leave the judgment of risk acceptability to research ethics committees. (shrink)

In this article, we discuss epistemological limitations relating to the use of ethnoracial categories in biomedical research as devised by the Office of Management and Budget’s institutional guidelines. We argue that the obligation to use ethnoracial categories in genomics research should be abandoned. First, we outline how conceptual imprecision in the definition of ethnoracial categories can generate epistemic uncertainty in medical research and practice. Second, we focus on the use of ethnoracial categories in medical genetics, particularly genomics-based precision medicine, where (...) ethnoracial identity is understood as a proxy for medically relevant differences among individuals. Notably, extensive criticisms have been made already against the genetic interpretation of races, but, nonetheless, the concept of race remains a key element of contemporary genomics. This motivates us to explore possible reasons why such criticisms may have been ineffective in redirecting attention to other (non-race-based) ways of controlling for human variability. We contend that popular arguments against the idea that human races have a genetic basis, though convincing in many respects, are not sufficient to exclude the pragmatic use of race and ethnicity as proxies for genetic variability related to complex phenotypes. Finally, we provide two further arguments to support the idea that ethnoracial categories are unlikely to provide meaningful insights into medical genetics, which implies that even the interpretation of race as a useful tool to stratify disease risk is unwarranted. Absolute velocities in Newtonian mechanics are commonly regarded as unmeasurable. Roberts (Br J Philos Sci 59(2):143–168, 2008) provides a justification for this thesis which appeals to the observational indistinguishability of boost-related models of Newtonian mechanics. Middleton and Murgueitio Ramírez (Australas J Philos, 2020) criticise his argumentation by pointing out that his analysis of the notion of measurement is too restrictive, and that, under a weaker analysis (based on counterfactuals), absolute velocities are measurable. Jacobs (Australas J Philos, 2020) opposes their view, (...) arguing that, on a properly formulated counterfactual-based account of measurement, absolute velocities are unmeasurable. However, in his argument, observational indistinguishability plays no role, even though, intuitively, it is very relevant for the issue of (un)measurability. This paper’s aim is to bring observational indistinguishability back to this discussion. I build upon the observation that there is an analogy between possible views on knowledge and justification on the one hand, and on measurement on the other. In particular, I explore the distinction between externalist and internalist approaches. Counterfactual-based accounts are all externalist, whereas the observational indistinguishability of boost-related models becomes relevant if we are interested in an internalist concept of measurement. Hannah Arendt began her scholarly career with an exploration of Saint Augustine's concept of _caritas_, or neighborly love, written under the direction of Karl Jaspers and the influence of Martin Heidegger. After her German academic life came to a halt in 1933, Arendt carried her dissertation into exile in France, and years later took the same battered and stained copy to New York. During the late 1950s and early 1960s, as she was completing or reworking her most influential studies of (...) political life, Arendt was simultaneously annotating and revising her dissertation on Augustine, amplifying its argument with terms and concepts she was using in her political works of the same period. The disseration became a bridge over which Arendt traveled back and forth between 1929 Heidelberg and 1960s New York, carrying with her Augustine's question about the possibility of social life in an age of rapid political and moral change. In _Love and Saint Augustine_, Joanna Vecchiarelli Scott and Judith Chelius Stark make this important early work accessible for the first time. Here is a completely corrected and revised English translation that incorporates Arendt's own substantial revisions and provides additional notes based on letters, contracts, and other documents as well as the recollections of Arendt's friends and colleagues during her later years. Life typically becomes an object of reflection when it is seen to be under threat. In particular, humans have a tendency to engage in thinking about life (instead of just continuing to live it) when being confronted with the prospect of death: be it the death of individuals due to illness, accident or old age; the death of whole ethnic or national groups in wars and other forms of armed conflict; but also of whole populations, be they human or nonhuman. Even though Minimal Ethics for the Anthropocene is first and foremost concerned with life--understood as both a biological and social phenomenon--it is the narrative about the impending death of the human population (i.e., about the extinction of the human species), that provides a context for its argument. "Anthropocene" names a geo-historical period in which humans are said to have become the biggest threat to life on earth. However, rather than as a scientific descriptor, the term serves here primarily as an ethical injunction to think critically about human and nonhuman agency in the universe. Restrained in tone yet ambitious in scope, the book takes some steps towards outlining a minimal ethics thought on a universal scale. The task of such minimal ethics is to consider how humans can assume responsibility for various occurrences in the universe, across different scales, and how they can respond to the tangled mesh of connections and relations unfolding in it. PACs buy access to officeholders and their votes on important legislation. Despite broad acceptance of this morally suspect theory, the evidence upon which it is based is weak. An alternative perspective — what we call the principled approach — both fits the evidence and rejects the morally repugnant interpretation of the relationship between business (...) and politics that permeates the rational investment perspective.
