Many experimental found footage films base their meanings and effects on an interaction between the figurative content of the image and its material-technological underpinnings. Can this interaction arise accidentally without artistic appropriation? A recently digitised film by the Czech cinema pioneer Jan Kříženecký, Opening Ceremony of the Čech Bridge (1908), presents such an exercise in accidental aesthetics. At one point, the horizontal and vertical trembling of the cinematograph – obtained from the Lumière brothers – translates into a trembling of the (...) figures on the bridge so precisely that the figurative and material spheres appear to cooperate towards a common aesthetic goal. To account for such phenomena, film theory, found footage filmmaking, and archival practice need to join forces with philosophy. More specifically, Gilbert Simondon's notion of transduction, a process based on the intersection of diverse realities within a domain, allows us to conceptualise the paradoxical interaction between the figurative and material dimensions and the unintentional meanings that arise out of it. Transduction enables the distribution of elements between these heterogeneous spheres while maintaining a certain stability within a system. In the case of archival films in which transduction occurs without prior intention or expectation, transduction can be foregrounded and prolonged. The connection between transduction and the “trembling meaning” of Opening Ceremony, understood within the wider context of camera instability in experimental found footage, will uncover the aesthetic potentialities held by the autonomous creativity of film matter and its interferences with the figurative content. In its jurisprudence relating to Article 267 TFEU, the Court of Justice of the European Union seems to oscillate between two different approaches. According to the jurisprudential mainstream, the preliminary ruling is an instrument of dialogue between national courts and the Court of Justice. This constant dialogue can fulfill the role assigned to the Court to ensure consistency of interpretation and application of Union law. Another line of cases, however, seems to make preliminary rulings means for individuals to ensure their (...) rights which derive from EU law. These two visions of the preliminary references recently have been opposed in discussions about a particular aspect of the preliminary procedure, which is the late withdrawal of the question referred by the national court. In fact, when the national court considered that the response of the Court of Justice was not “necessary to render judgment,” it could, at any time, including both before and after the deliberate publication, date the judgment to the parties and remove this issue. Therefore, the jurisdiction of the Court of Justice became dependent on matters of procedure (dealings between the parties, amicable agreements, etc.) that occurred in extremis before the national court, which sometimes cast doubt on a possible manipulation of the Court by the parties to the main proceedings. It became necessary to find a solution to solve this problem. The two different visions were then compared. If the preliminary ruling is conceived as an additional instrument for the rights that individuals derive from EU law, there is no need for the Court of Justice of the European Union to make a decision when the dispute is resolved before the national court and the defendant has obtained satisfaction. Conversely, if the preliminary ruling is conceived as an instrument to ensure the uniform application and interpretation of EU law, this judgment may be necessary. In fact, without deciding in abstracto, the Court in its judgement will anchor an interpretation that should be applied in all similar cases in the courts of the 27 Member States. In this case, a judgment may still be necessary, even if the dispute before the national court ended off. In order to preserve this approach, the new Rules of Procedure now contain a provision in Article 100 (1) which reads as follows: “The Court shall remain seised of a request for a preliminary ruling for as long as it is not withdrawn by the court or tribunal which made that request to the Court. The withdrawal of a request may be taken into account until notice of the date of delivery of the judgment has been served on the interest persons referred to in Article 23 of the Statute”. Thus, the late withdrawal of a request for a preliminary ruling is clearly limited in time and, even if such removal would occur in extremis, the judgment of the Court will be delivered in the interest of interpretation and uniform application of Union law. The successful early acquisition of reading literacy represents a crucial learning process determining the further course of academic development (Stanovich, 2009). During this process, interactions between children and their proximal social environment are of utmost importance. Therefore, we introduce a systemic framework for the development of learning potential (e.g., Mudrak et al., 2015, 2019, 2019b; Ziegler & Stoeger, 2017) and explore the interactions between the social and motivational processes associated with reading literacy development in school-age children. We base our analysis (...) on a representative Czech sample of fourth-grade pupils involved in the Progress in International Reading Literacy study (PIRLS, Martin et al., 2016). On the basis of the systemic framework, we hypothesized hierarchical relationships among family socioeconomic status, related developmental resources (including parental support, expectations, and reading resources), children’s reading motivation (including reading engagement and reading confidence), and manifested learning outcomes (including school grades and reading competence). We implemented three structural equation models to test the hypothesized relationships. The first model tested the direct effect of developmental resources on reading competence. The second model included the motivational variables as mediators between resources and competence. The third model included school grades as mediators between resources and motivational variables. Our analyses indicated the good fit of the proposed models. The final model explained 37.8 % of the variance in children’s school grades and 46.5 % of the variance in reading literacy test scores (compared to 34.8 % in the first model). Moreover, parental socioeconomic status was strongly associated with parental expectations, which were associated with reading confidence, partially through the effect of parental expectations on children’s school grades. Reading confidence was the main predictor of reading literacy within the model, followed by the direct effects of parental resources. The results illustrate complex processes through which the family environment affects the development of learning competencies such as reading literacy by providing children with the relevant social and material resources associated with their motivation and school outcomes. We discuss some of the reasons that these relationships may take place and consider their implications for educational practice. (shrink)

Un des problèmes persistants pour la philosophie pratique est de découvrir un procédé adéquat pour justifier des lois dont la finalité est de réguler le fonctionnement des démocraties constitutionnelles. Les libéraux partisans de la raison publique nient que cette justification puisse provenir de doctrines substantielles, étant donné que les lois doivent pouvoir être justifiées par tous les citoyens (raisonnables). La tradition de la loi naturelle offre un test utile quant à la plausibilité de cette thèse. L’article montre comment les deux (...) versions du libéralisme de la raison publique diffèrent quant à leur acceptation de raisons tirées du droit naturel, et pourquoi, étant donné l’influence de leurs points de départs disparates sur les critères normatifs par lesquels elles évaluent les lois, les partisans du droit naturel ont de bonnes raisons de les rejeter toutes les deux. We study search problems and reducibilities between them with known or potential relevance to bounded arithmetic theories. Our primary objective is to understand the sets of low complexity consequences of theories Si2 and Ti2 for a small i, ideally in a rather strong sense of characterization; or, at least, in the standard sense of axiomatization. We also strive for maximum combinatorial simplicity of the characterizations and axiomatizations, eventually sufficient to prove conjectured separation results. To this end two techniques based on (...) the Herbrand's theorem are developed. They characterize/axiomatize Σb1-consequences of Σb2-definable search problems, while the method based on the more involved concept of characterization is easier and gives more transparent results. This method yields new proofs of Buss' witnessing theorem and of the relation between PLS and Σb1, and also an axiomatization of Σb1. (shrink)

Cílem této studie je představení základních tezí sociálně-politické filosofie Karla Raimunda Poppera (jak je zachycena zejména v dílech Bída historicismu a Otevřená společnost a její nepřátelé) a dále kritické zhodnocení aplikace těchto tezí při výkladu Platónovy filosofie. Je probíráno zejména Popperovo obvinění Platóna z tzv. „biologického historicismu“, dále jeho označení platónské teorie spravedlnosti jako „totalitní“ a v neposlední řadě jeho interpretace dialogu Ústava jakožto Platónova „politického programu“ určeného k přímé implementaci v praxi vyvoleným filosofem-králem. V druhé polovině této studie je (...) pak nabídnuto alternativní čtení, v němž se Platónova Ústava vyjeví ve zcela odlišném světle, než v jakém ji vidí Popper. (shrink)

In Fechner's psychophysics, the 'mental' and the 'physical' were conceived as two phenomenal domains, connected by functional relations, not as two ontologically different realms. We follow the path from Fechner's foundational ideas and Mach's radical programme of a unitary science to later approaches to primary, psychophysically neutral experience (phenomenology, protophysics). We propose an 'integral psychophysics' as a mathematical study of law-like, invariant structures of primary experience. This approach is illustrated by a reinterpretation of psychophysical experiments in terms of perceptual situations (...) involving a constructed apparatus and an instructed subject. The problematic notion of 'measurement of sensation' is thus eliminated: 'sensations' are merely indices for classes of perceptually equivalent configurations (states of the apparatus) specified by the instruction. The locus of the measured is in the inter-subjectively shared, communicable world—not inside the subject's mind. Finally we discuss the role of integral psychophysics as a scientia prima , logically and methodically preceding physics and psychology. (shrink)

Během nedávno započaté hospodářské krize se paralelně s aplikací netradičních hospodářských politik zvýšil tlak na potlačení ortodoxních ekonomických teorií hlavního proudu a po několika desetiletích se v ekonomii znovu otevírá prostor pro nové teorie, metodologie, paradigmata. Cíle této práce jsou tři. Cílem prvním je obecná sumarizace základních východisek post keynesiánské ekonomické metodologie. Cílem druhým je pak jasné vymezení této heterogenní teorie vůči neoklasické metodologii s ambicí zcela od základů alternovat tuto starou metodologii. A konečně cílem třetím je analýza architektury post (...) keynesiánské makroekonomické metodologie včetně její primární metody zkoumání. Ta je spojena zejména s kritikou absence realismu v neoklasické ekonomii. (shrink)

Pavel Materna proposed valuable explications of concept and conceptual system. After their introduction, we contrast conceptual systems with (a novel notion of) derivation systems. Derivation systems differ from conceptual systems especially in including derivation rules. This enables us to show close connections among the realms of objects, their concepts, and reasoning with concepts.

Přehledová studie sleduje a analyzuje proměny pojmu sociální inovace. Na základě silné společenské poptávky se z původně dílčí, teoreticky nediskutované a nefixované kategorie stává kategorie obecná. Pokrývá širokou oblast nemateriálních inovací a zároveň se profiluje jako aktivita normativní a intencionální, zaměřená na obecně uznávané sociální cíle. Co do ideově-hodnotových orientací současných koncepcí sociálních inovací studie identifikuje kromě mainstreamu, který zůstává u otevřených hodnotových charakteristik, ještě směr emancipačně-mobilizační a sociálně-tržně odpovědný. V epistemologické rovině se teoretici sociálních inovací hlásí především k praktickému (...) experimentování, pragmatismu, teorii komplexnosti a principům transdisciplinarity. (shrink)

Model-theoretic concepts of saturation and categoricity are studied in the context of accessible categories. Accessible categories which are categorical in a strong sense are related to categories of $M$-sets ($M$ is a monoid). Typical examples of such categories are categories of $\lambda$-saturated objects.

The claim that the having of aesthetic properties supervenes on the having of non-aesthetic properties has been widely discussed and, in various ways, defended. In this paper, I will show that even if it is sometimes true that a supervenience relation holds between aesthetic properties and the 'subvenient' non-aesthetic ones, it is not the interesting relation in the neighbourhood. As we shall see, a richer, asymmetric and irreflexive relation is required, and I shall defend the claim that the more-and-more-popular relation (...) of grounding does a much better job than supervenience. In his book The Metaphysics of Beauty Nick Zangwill argues for the claim that aesthetic properties metaphysically necessarily depend on sensory properties. This claim plays a role in his argument against physicalist aesthetic realism as well as in the formulation of his own response- dependence view. In this article, I offer reasons to resist the aesthetic/ sensory dependence claim by a discussion of the case of theories, theorems, proofs, and similar theoretical objects, which do possess genuinely aesthetic properties, while these (...) do not depend on any sensory properties. I argue against Zangwill’s claim that such attributions of aesthetic properties are merely metaphorical. (shrink)

The paper deals with the problematic of concept and image as independent forms of mediating the thought. A specific role in incorporating the media of concept and image into the system of thought is played by the mediality itself, which operates as an entity mediating between heterogeneous worlds. The symbolized messages of the concept and image thus represent using the dispositive of representation between the visual and intellectual worlds. The author takes the concept as the initial form of thought, which (...) describes the object from the perspective of its being without making any propositions about it; the image, on the other hand, is taken as a sensory representation of the object. However, each of them is only a particular form of mediation. Representing a concept thus means taking the thought as a conceptual representation. (shrink)

The author argues that Hegel in his early manuscript The German Constitution and in the later Elements of the Philosophy of Right develops the theory of the ethical (sittlicher) state. This reading of Hegel's theory of the state challenges wide-spread criticism of Hegel's political theory as, e.g., put forward by Karl Popper in his book The Open Society and its Enemies. (edited).

The study discusses Kant’s doctrine of lasting peace contained in his essay Toward Perpetual Peace (1795). First, the historical-political circumstances surrounding the genesis of Kant’s essay are described. Kant’s preliminary measures, which in his opinion must be accepted if lasting peace is to be ensured, are also discussed. Great attention is paid to the very core of Kant’s essay: his proposal for a comprehensive reform of law, which should apply to state, international, and cosmopolitan law. This is followed by an (...) exposition of Kant’s reflections on the feasibility of his doctrine of lasting peace in history. And finally, Kant’s view of the public as an institution is summarized. The originality of Kant’s approach is seen by the author above all in the fact that, from the point of view of the philosophy of law, the doctrine of lasting peace in Toward Perpetual Peace is connected with a consideration regarding its realizability in history. He also draws attention to the fact that though this detail is known, it is often marginalized in secondary literature. (shrink)

The article examines recent theories of legal and constitutional pluralism, especially their adoption of sociological perspectives and criticisms of the concept of sovereignty. The author argues that John Griffiths's original dichotomy of “weak” and “strong” pluralism has to be reassessed because “weak” jurisprudential theories contain useful sociological analyses of the internal differentiation and operations of specific legal orders, their overlapping, parallel validity and collisions in global society. Using the sociological methodology of legal pluralism theories and critically elaborating on Teubner's societal (...) constitutionalism, the author subsequently reformulates the question of sovereignty as a sociological problem of complex power operations communicated through the constitutional state's organization and reconfigured within the global legal and political framework. The classical liberal approach to deregulation is based on the consecutive elimination of state regulatory activities and their substitution by competitive market structure. Increasing competition accompanied with decreasing arbitrary state agencies’ interventions will undoubtedly cultivate the behaviour of market agents and bring benefits to consumers.The classical liberal approach to deregulation is incompatible with the EU deregulation model, which in case of network industries is still based on the permanent existence of regulatory agencies, Third-Party-Access, public service liability, centralized control of investments (...) and the negative reciprocity. The adoption of these principals will at least delay deregulation process in transition economies but will likely preserve the cartel structure on the utility markets.Economics of regulation and implicitly economics of deregulation is a product of the Chicago School of Economics. Since current “deregulation process” leads to tighter regulation, the adequate term for it should be the reregulation.L’approche libérale classique de la réglementation repose sur l’élimination de la réglementation étatique et leur substitution par des structures marchandes concurrentielles. Une concurrence accrue et une diminution des interventions arbitraires de l’état ne pourront que modifier le comportement des agents sur le marché et engendrer des bénéfices pour les consommateurs.L’approche de la déréglementation du libéralisme classique est incompatible avec le modèle de déréglementation de l’Union Européenne : dans le cas des industries en réseau, ce dernier demeure fondé sur l’existence continue d’agences de réglementation, la responsabilité du service public, le contrôle centralisé des investissements et la réciprocité négative. L’adoption de ces principes aura pour effet au moins de retarder le processus de déréglementation dans les économies en transition et probablement aussi de préserver la structure cartellisée des marchés de services publics.L’économie de la réglementation, et par implication, l’économie de la déréglementation est une contribution émanant de l’Ecole d’Economie de Chicago. In this paper, I examine various theories of persistence through time under presentism. In Part I, I argue that both perdurantist views (namely, the worm view and the stage view) suffer, in combination with presentism, from serious difficulties and should be rejected. In Part II, I discuss the presentist endurantist view, to see that it does avoid the difficulties of the perdurantist views, and consequently that it does work, but at a price that some may consider as being very high: (...) its ontological commitments to platonic universals and to the substratum theory, that as we shall see follow from the combination of endurantism with presentism, will perhaps not be to everyone's taste. [This paper is written in Czech language.] The aim of the article is to re-evaluate the still-surviving anthropological trope which, in reaction to an inquiry into the essence of man, compares humans with animals and points to culture as the means by which humans complete their “deficient” nature. This motif contrasting humans with animals has been extended by A. Gehlen who characterises humans as “beings of deficiencies”. In his view, the morphological-instinctive insufficiency of the human being must be stabilised by (...) cultural institutions, i.e. complexes of habitual actions. Merleau-Ponty, however, demonstrates that bodily beings always relate to their environment in an indirect way, on the basis of certain “standards” and “norms” of interaction, which exist by way of institution. The anthropological trope confronting humans and animals thus cannot produce, as in Gehlen, a contrast between an allegedly “direct” relationship to the world in animals, and a supposedly “indirect” relationship to the world in humans. It can be meaningfully retained only if it is interpreted in a Merleau-Pontyan way, that is, as an invitation to understand the transformation of the norms of indirect interaction with the world found in animals into those found in people, that is, if viewed as a comparison of their respective institutions. The aim of the article is to point out the problem that started in the 2018 US Open final between Naomi Osaka and Serena Williams. During this final match, there was a conflict between the player S. Williams and the chair umpire C. Ramos, which involved a violation of rules related to coaching during the match. Subsequently, C. Ramos was banned from officiating the Williams sisters' matches at the next 2019 US Open. The authors of the article believe that the (...) tennis organizations USTA and WTA did not judge the dispute between chair umpire C. Ramos and S. Williams in accordance with their rules, as the rules allow for the sanctioning of a player who is coached during a match. While the written rules and their application during play must be taken into consideration, so must the subjective interpretation and application of the rules by a particular umpire. If our arguments are correct, C. Ramos's application of the rules during this game was in no way inconsistent with his past practice or the rules themselves. Thus, C. Ramos was a victim of the entire incident, which was also influenced by the gender narrative after the match. (shrink)

The general recognition of the existence of atoms and molecules occurred only at the beginning of the twentieth century. Many researchers contributed to this, but the ultimate proof of the molecular nature of matter that convinced even the last sceptics was the confirmation of Albert Einstein’s statistical-fluctuation theory of Brownian motion, a part of his comprehension of interdisciplinary atomism, by Jean Perrin’s experiments on colloidal gamboge particles. Einstein noticed a difference between the values of Avogadro’s constant derived from Perrin’s experiments (...) and Planck’s calculation from black-body radiation. Einstein assumed the incorrectly evaluated size of the gamboge spherules to be a culprit of the difference and asked Perrin to check the assumption with additional experiments and using the viscosity formula introduced in his own dissertation. The result was a discrepancy that neither Einstein nor Perrin settled any further. In this communication, based on the survey of developments in colloid and polymer science and their comparison with relevant experiments, an explanation of the dilemma is given that now, after more than a century, proves Einstein correct. The comparison was de facto possible during his lifetime. (shrink)

David Lewis’ modal counterpart theory falls prey to the famous Saul Kripke’s objection, and this is mostly due to his ‘static’ ontology of possible worlds. This paper examines a genuinely realist but different, branching ontology of possible worlds and a new definition of the counterpart relation, which attempts to provide us with a better account of de remodality, and to meet satisfactorily Kripke’s claim, while being also ontologically more ‘parsimonious’.

We investigate the interactions of formula complexity in weak set theories with the axioms available there. In particular, we show that swapping bounded and unbounded quantification preserves formula complexity in presence of the axiom of foundation weakened to an arbitrary set base, while it does not if the axiom of foundation is further weakened to a proper class base. More attention is being paid to the necessary axioms employed in the positive results, than to the combinatorial strength of the positive (...) results themselves. (shrink)

Consistent application of dialectical materialism leads Marxism-Leninism to the assertion that matter is infinite in its properties. However, the history of physics shows that the various levels of matter possess geometric dimensions that originate at the lowest level and continue through the others. The search for absolute natural constants — which Planck called the most pleasant task of physics — shows the conviction of the physicists that there is a limit to the parameters, a limit beyond which matter is no (...) longer divisible. This article addresses several aspects of interaction between procedural and conflict rule regulation in private international law both of which are subject to unification process under the European Community law. They are interdependent of each other, and use the same or similar terms on many occasions. Problems with interpretation arise in application of these legal regulations. The European Court of Justice addresses them more or less successfully. As demonstrated in this article, the interpretation of procedural rules of regulation may contribute (...) to the clarification of the conflict rules and vice versa. It can be even said that the mutual interaction of conflict rules and procedural rules through interpretation is both unavoidable and desirable. (shrink)

Metaphysical theories are often counter‐intuitive. But they also often are strongly supported and motivated by intuitions. One way or another, the link between intuitions and metaphysics is a strong and important one, and there is hardly any metaphysical discussion where intuitions do not play a crucial role. In this article, I will be interested in a particular kind of such intuitions, namely those that come, at least partly, from experience. There seems to be a route from experience to metaphysics, and (...) this is the core of my interest here. In order to better understand such ‘arguments from experience’ and the kind of relationship there is between this type of intuitions and metaphysical theories, I shall examine four particular cases where a kind of experience‐based intuition seems to motivate or support a metaphysical theory. At the end of the day, I shall argue that this route is a treacherous one, and that in all of the four cases I shall concentrate on, phenomenological considerations are in fact orthogonal to the allegedly ‘corresponding’ metaphysical claims. An anti‐realist view of metaphysics will emerge. (shrink)

Metaphysical theories heavily rely on the use of primitives to which they typically appeal. I will start by examining and evaluating some traditional well-known theories and I will discuss the role of primitives in metaphysical theories in general. I will then turn to a discussion of claims of between theories that, I think, depend on equivalences of primitives, and I will explore the nature of primitives. I will then claim that almost all explanatory power of metaphysical theories comes from their (...) primitives, and so I will turn to scrutinize the notion of "power" and "explanatory". (shrink)
