James E. Fleming’s new contribution to the interpretive debate successfully exposes “new originalist” failures to find defensible middle ground between a Dworkinian approach to constitutional interpretation and the now widely discredited originalism of Raoul Berger. Fleming also exposes the irony of “new originalist” efforts to vindicate democracy and the rule of law. Less persuasive are Fleming’s reasons for optimism about the future of constitutional theory and fidelity to a constitution that seems increasingly beyond reform.

In recent years, two important books by Yoram Cohen and Matthew Rutz have marked significant progress in research on the archives of Late Bronze Age Emar in northwestern Syria. Both of them approach Emar by way of its scribes. Cohen undertakes a systematic review of all named scribes identified in texts associated with Emar, while Rutz narrows his object to the building that yielded by far the largest number of excavated tablets. Wagering contingent on a previous decision, or post-decision wagering, has recently been proposed to measure conscious awareness. Whilst intuitively appealing, it remains unclear whether economic context interacts with subjective confidence and how such interactions might impact on the measurement of awareness. Here we propose a signal detection model which predicts that advantageous wagers placed on the identity of preceding stimuli are affected by loss aversion, despite stimulus visibility remaining constant. This pattern of predicted results was evident in a psychophysical task (...) where we independently manipulated perceptual and economic factors. Changes in wagering behaviour induced by changes in wager size were largely driven by changes in criterion, consistent with the model. However, for near-threshold stimuli, a reduction in wagering efficiency was also evident, consistent with an apparent but potentially illusory decrease in awareness of the stimulus. These findings challenge an assertion that post-decision wagering provides a direct index of subjective awareness. (shrink)

In his new book, Constitutional Essentials, Frank Michelman provides a splendid elaboration and defense of ‘the constitutional theory of political liberalism’ implicit in John Rawls’s classic work, Political Liberalism. In this essay, we make some observations about what a difference 30 years makes, comparing the political and constitutional climate in which Rawls wrote and published Political Liberalism in 1993 with the climate in which Michelman wrote and published this exegesis of it. We focus on (1) changes in our circumstances of (...) pluralism, including the accentuation of polarization and unreasonable views, and (2) the simultaneous breakdown of trust in the Supreme Court authoritatively to resolve disputes concerning constitutional essentials. Throughout, we acknowledge and seek to reckon with the possibility that Michelman may have given Rawls’s liberal principle of legitimacy its fullest, most coherent account just at the moment when the possibility of realizing it seems to be passing. This paper offers an introduction to the philosophy and science of embodied learning, conceived as both the stabilizing and expansionary process that sustains order and novelty within learners’ worlds enacted through observing and describing. Embodied learning acknowledges stability and change as the purposeful conjoined characteristics that sustain learners. It is, in many respects, a composite theory that represents work from various disciplines. This ‘naturalized epistemology’ conceives a world of fact inevitably imbued with the values that our own structural histories guarantee (...) us observers, whether acknowledged or not within our reflective awareness. These values, however, are not simple sets of preferences, for they are constituted in our individual learning histories that, for good or bad, influence the course of future learning. This conservational element of our condition is only half the story, however. The more radical aspect resides in the expansionary capacity of embodied observers to change, to enact worlds that are not pre‐given but, rather, brought forth by learners as observers and describers. Furthermore, embodied learning seeks a grounding for understanding in the often‐unexplored epistemological terrain between positivist absolutism or its mirrored polar opposite, postmodern nihilism. Its epistemological stance derives from its ontology, which is grounded in the profound obviousness that ‘everything said is said by someone’. (shrink)

The problem with reductionism in biology is not the reduction, but the implicit attitude of determinism that usually accompanies it. Methodological reductionism is supported by deterministic beliefs, but making such a connection is problematic when it is based on an idea of determinism as fixed predictability. Conflating determinism with predictability gives rise to inaccurate models that overlook the dynamic complexity of our world, as well as ignore our epistemic limitations when we try to model it. Furthermore, the assumption of a (...) strictly deterministic framework is unnecessarily hindering to biology. By removing the dogma of determinism, biological methods, including reductive methods, can be expanded to include stochastic models and probabilistic interpretations. Thus, the dogma of reductionism can be saved once its ties with determinism are severed. In this paper, I analyze two problems that have faced molecular biology for the last 50 years—protein folding and cancer. Both cases demonstrate the long influence of reductionism and determinism on molecular biology, as well as how abandoning determinism has opened the door to more probabilistic and unconstrained reductive methods in biology. This paper presents a modified random network model to illustrate how groups can form in the absence of evolutionary forces, assuming groups are collections of entities at any level of organization. This model is inspired by the Zero Force Evolutionary Law, which states that there is always a tendency for diversity and complexity to increase in any evolutionary system containing variation and heredity. That is, in the absence of evolutionary forces, the expectation is a continual increase in diversity and complexity (...) at any level of biological hierarchy. I show that, when modeled, this expectation of increasing variation results not only in the formation of groups, but also in a higher probability of group formation than is found in a model that is purely random. Here is a simple counterexample to David Lewis’s causal influence account of causation, one that is especially illuminating due to its connection to what Lewis himself writes: it is a variant of his trumping example.

As to what distinguishes music from other sound, some investigators in both philosophy and cognitive scientists have answered “tonality.” It seems subservient even to rhythm. Tonality is considered to be the central factor around which the piece is oriented; it gives a sense of home, expectation, and completeness. Most important, much of this inquiry builds on naturalistic, evolutionary explanation to account for human nature and behavior. The conclusion of such line of thought is that sounds missing tonality or tonal focus (...) cannot be music. This article challenges such sort of naturalistic criteria distinguishing music from nonmusic. Permitting certain sets of sounds to be considered music does not necessitate denial or approval of naturalistic explanations but does allow nontonal music to serve a part of human and musical evolution. Thanks to mounting discussion about projected technologies’ possibly altering the species mentally and physically, philosophical investigation of what human beings are proceeds robustly. Many thinkers contend that whatever we are has little to do with how we should behave. Yet, tampering with what the human being is may tread upon human rights to be whatever one is. Rights given in widely recognized documents such as the U.N. Declaration of the Rights of Indigenous Peoples assume what humans are and need depends (...) upon ontological assumptions about human existence. Godman turns to human ontology—just what kind of beings humans are (from an angle distinct from the other two books) and how these play into rights. She is concerned with how well the social sciences accord with what we are. Gunkel homes in on a more specific moral topic than Godman's general concern with identity’s role in rights: automata moral status and rights. He enjoins us to inquire into what human rights are before we take on the new technologies’ challenge to it. Schneider’s Artificial You, while not explicitly about rights, poses a rights quandary. Certain individuals with reputable resources and practical backing explicitly seek to evolve the species as they see fit. The urgency among these works concerns how we need a sharper idea of what we are, how we should act and be treated, and how our rights fare among potential human improvements. (shrink)

Taking a schizoanalytic approach to audio-visual images, this article explores some of the radical potentia for deterritorialisation found within David Fincher's Fight Club (1999). The film's potential for deterritorialisation is initially located in an exploration of the film's form and content, which appear designed to interrogate and transcend a series of false binaries between mind and body, inside and outside, male and female. Paying attention to the construction of photorealistic digital spaces and composited images, we examine the actual (and possible) (...) ways viewers relate to the film, both during and after screenings. Recognising the film as an affective force performing within our world, we also investigate some of the real-world effects the film catalysed. Finally, we propose that schizoanalysis, when applied to a Hollywood film, suggests that Deleuze underestimated the deterritorialising potential of contemporary, special effects-driven cinema. If schizoanalysis has thus been reterritorialised by mainstream products, we argue that new, ‘post-Deleuzian’ lines of flight are required to disrupt this ‘de-re-territorialisation’. (shrink)

ABSTRACTHow much control do we have over our reasons for action? Not much, but some. We all have reasons to avoid pain and not to inflict it on others. What explains our shared reasons? On an externalist account, reasons are grounded in values. All reasons are external to agency. This ensures that reasons are universal, so it is an attractive feature of moral and prudential reasons. However, when our reasons differ this is less attractive. In some cases, it seems like (...) something internal to the agent makes all the difference. There are many valuable things, but an agent can only come to care about a small set of those things. Consider your reasons that stem from your love of philosophy or punk rock. Here it seems we make some reasons our reasons by becoming committed to them. I call these our agential reasons. We express our agency by coming to care about some things in ways not required by rationality. Unlike, matters of taste though, these are not bare preferences we just find ourselves having. Rather these concerns are cultivated over time. We express rational agency by incorporating particular values into our lives. (shrink)

In this article I explore the pedagogical value of Gilles Deleuze and Félix Guattari’s philosophical concepts for helping make an ‘event’ of thought, with a view towards fostering deep learning in Chinese students' learning theory and criticism in a second language. Paying attention to the qualitative role of bodies, humour and creativity alongside an expanded trans-personal concept of ‘educational life forms’ that stretches out to include an affective assemblage of inhuman elements (such as art and technology), I explore how Deleuze (...) and Guattari’s philosophical models provide a ethical alternative to corporate, Confucian and Cartesian models otherwise inhibiting students and teachers in the modern Sino-international university context. ABSTRACT The ubiquity of social media usage has led to exciting new technologies such as machine learning. Machine learning is poised to change many fields of health, including psychology. The wealth of information provided by each social media user in combination with machine-learning technologies may pave the way for automated psychological assessment and diagnosis. Assessment of individuals’ social media profiles using machine-learning technologies for diagnosis and screening confers many benefits ; however, the implementation of these technologies will pose unique challenges (...) to the professional ethics of psychology. Namely, psychologists must understand the impact of these assessment technologies on privacy and confidentiality, informed consent, recordkeeping, bases for assessments, and diversity and justice. This paper offers a brief review of the current applications of machine-learning technologies in psychology and public health, provides an overview of potential implementations in clinical settings, and introduces ethical considerations for professional psychologists. This paper presents considerations which may aid in the extension of the current Ethical Principles of Psychologists and Code of Conduct to address these important technological advancements in the field of clinical psychology. This paper argues that it can be morally wrong to be friendly to strangers. More specifically, the paper argues there is a salient pro tanto moral reason against being friendly to strangers in virtue of the structure of interaction. By ‘a salient pro tanto reason’ I mean a reason that is not always decisive, but it is often significant enough that it ought to factor in moral deliberation. My argument is perfectly general, but it is presented to shed light on (...) one specific practical problem. By considering this issue I think we will be able to see what is distinctly wrong with street harassment. I hope to explain why this sort of behavior is morally problematic. Basically, even in its most benign cases, street harassment attempts to place a moral burden on a stranger to respond in kind. The stranger may not wish to bear this burden and that is why there are reasons against creating this burden. It is wrong because it involves treating others as if they owe you attention and acknowledgment, which is to treat strangers as friends. (shrink)
