The boundaries of legal personhood: how spontaneous intelligence can problematise differences between humans, artificial intelligence, companies and animals.Jiahong Chen & Paul Burgess - 2019 - Artificial Intelligence and Law 27 (1):73-92.
In this paper, we identify the way in which various forms of legal personhood can be differentiated from one another by comparing these entities with a—not too farfetched—hypothetical situation in which intelligence spontaneously evolves within the internet: spontaneous intelligence. In these terms, we consider the challenges that may arise where SI as an entity: has no owner, no designer, and no controller; has evolved into existence as a non-human created intelligence; is autonomous; has no physical form; and, although it exists (...)

Technology scholars and journalists have recently called attention to digital platforms’ and devices’ ability to influence users based on their present moods, stress level, hunger, and other transient features. For them, such influence based on users’ present status – what the chapter calls “real-time profiling” – is not only a clear form of wrongful manipulation but also online manipulation’s future. The chapter aims to explain what makes real-time profiling wrong (when wrong) and discusses problems associated with its regulation. After explaining (...)

The incorporation of Moorean type information by introspective agents.Jiahong Guo - 2009 - Frontiers of Philosophy in China 4 (3):470-482.
The main task is to discuss the issue in belief dynamics in which philosophical beliefs and rational introspective agents incorporate Moorean type new information. First, a brief survey is conducted on Moore’s Paradox, and one of its solutions is introduced with the help of Update Semantics. Then, we present a Dynamic Doxastic Logic (DDL) which revises the belief of introspective agents put forward by Lindström & Rabinowicz. Next, we attempt to incorporate Moorean type new information within the DEL (DDL) framework, (...)

We provide new findings that add to the growing body of empirical evidence that important epistemic intuitions converge across cultures. Specifically, we selected three recent studies conducted in the US that reported surprising effects of knowledge attribution among English speakers. We translated the vignettes used in those studies into Mandarin Chinese and Korean and then ran the studies with participants in Mainland China, Taiwan, and South Korea. We found that, strikingly, all three of the effects first obtained in the US (...)

    About the Notion of Interpretation in Ludwig Wittgenstein's "Seeing-As".María Sol Yuan - 2022 - Ideas Y Valores 71 (179):161–180.

  21. An Interpersonal Form of Faith.Yuan Tian - forthcoming - Philosophy and Phenomenological Research.
An athlete has faith in her unathletic partner to run a marathon, a teacher has faith in her currently poor-performing students to improve in the future, and your friend has faith in you to succeed in the difficult project that you have been pursuing, even, and especially, when your chance of failing is non-trivial. This paper develops and defends a relational view of interpersonal faith by considering four interesting phenomena: first, in virtue of placing faith in someone, we stand in (...)

To address the need for a valid and reliable scale of youth leadership potential based on the development theory of leadership, the current study developed the Youth Leadership Potential Scale (YLPS) and investigated its factor structure and psychometric properties in a sample of 696 students (grades 7-9) in China. Exploratory structural equation modeling (ESEM) identified a five-factor solution comprising leadership information, leadership attitude, communication skills, decision-making skills, and stress management skills. ESEM within confirmatory factor analysis demonstrated an adequate fit for (...)

How to Keep Sustainable Development Between Enterprises and Employees? Evaluating the Impact of Person–Organization Fit and Person–Job Fit on Innovative Behavior.Yuan Tang, Yun-Fei Shao, Yi-Jun Chen & Yin Ma - 2021 - Frontiers in Psychology 12.
High-tech industries often regard workers as their main source of value creation. In order to stimulate their employees' willingness to innovate and their innovative behavior and reduce the turnover intention, companies are now seeking to establish employer–employee relationships in which their employee's willingness to stay is not simply driven by extrinsic motivations. Therefore, it is an important topic in human resources for companies to implement measures that encourage employees to willingly devote themselves to their jobs and consider organizational growth as (...)

For a set x, let S(x) be the set of all permutations of x. We prove by the method of permutation models that the following statements are consistent with ZF: (1) There is an infinite set x such that |p(x)|<|S(x)|<|seq^1-1(x)|<|seq(x)|, where p(x) is the powerset of x, seq(x) is the set of all finite sequences of elements of x, and seq^1-1(x) is the set of all finite sequences of elements of x without repetition. To What Extent Does the EU General Data Protection Regulation (GDPR) Apply to Citizen Scientist-Led Health Research with Mobile Devices?Edward S. Dove & Jiahong Chen - 2020 - Journal of Law, Medicine and Ethics 48 (S1):187-195.
In this article, we consider the possible application of the European General Data Protection Regulation to “citizen scientist”-led health research with mobile devices. We argue that the GDPR likely does cover this activity, depending on the specific context and the territorial scope. Remaining open questions that result from our analysis lead us to call for lex specialis that would provide greater clarity and certainty regarding the processing of health data by for research purposes, including these non-traditional researchers.

Multimodal discourse analysis offers a novel lens for the study of legal discourse. Within the closing arguments of a trial, prosecution and defense attorneys utilize various multimodal resources to present evidence, articulate opinions, and adopt stances to achieve their communicative goals. This research focuses on the closing arguments in the criminal trial concerning the death of George Floyd to analyze the multimodal representation of the closing arguments delivered by both prosecution and defense attorneys. It employs the analytical framework of the (...)

Coordinated Tracking for Nonlinear Multiagent Systems under Variable-Time Impulsive Control.Yuan Tian, Chuandong Li, Xujun Yang & Yiyan Han - 2019 - Complexity 2019:1-10.
This paper addresses variable-time impulsive control for coordinated tracking problem in nonlinear multiagent systems. To make followers coordinately track the leader, a variable-time impulsive controller is designed. Under some well-selected conditions, the comparison system of variable-time impulsive tracking control system is constructed by employing B-equivalence method. And we theoretically demonstrate that the two systems have the same stability property. Coordinated tracking criteria of multiagent systems are obtained by considering the comparison system. Numerical simulation is also provided to illustrate the correctness (...)

Ethical Issues in Using Behavior Contracts to Manage the “Difficult” Patient and Family.Autumn Fiester & Chase Yuan - 2021 - American Journal of Bioethics 23 (1):50-60.
Long used as a tool for medical compliance and adhering to treatment plans, behavior contracts have made their way into the in-patient healthcare setting as a way to manage the “difficult” patient and family. The use of this tool is even being adopted by healthcare ethics consultants (HECs) in US hospitals as part of their work in navigating conflict at the bedside. Anecdotal evidence of their increasing popularity among clinical ethicists, for example, can be found at professional bioethics meetings and (...)

Breaking with discriminatory views and segregated education for children with disabilities, regions often referred to as Confucian Heritage Regions (CHRs) have been moving towards inclusive education. Although some of these regions have been at the centre of attention in global education recently, there is a lack of research and information about how they ‘do’ inclusive education. Considering that reinforcing legislative foundations is of foremost importance for its fulfillment, this study examines legislation on the education of children with disabilities in four (...)

The extant pieces of literature on discretion has mainly focused on its effect on policy implementation and public service delivery, but few studies have looked at its influence on street-level bureaucrats' work behavior, such as taking charge behavior, which is of great importance for government reforms, especially in developing and transitional countries. Based on the self-determination theory, this study examines whether and how discretion promotes street-level bureaucrats' TCB. Two studies were conducted among street-level bureaucrats in China. The author of this paper argues that ancient Chinese thinkers practiced an alternative logic that is significantly different from Aristotelian logic. The paper has two objectives: 1) to clarify what Chinese logic looks like; 2) to re-evaluate the wisdom in classic texts with a clear understanding of Chinese logic. The author uses two major approaches in her reasoning: an etymological approach and logic of sets. An etymological study shows that Chinese pictographic characters were created according to sets - the collections (...)

This study examines the relation between a firm’s business strategy and its corporate social responsibility performance. Using a comprehensive measure of business strategy based on the Miles and Snow theoretical framework, we find that firms following an innovation-oriented strategy are associated with better CSR performance than those following an efficiency-oriented strategy. Specifically, compared with defenders, prospectors engage in more socially responsible activities, fewer socially irresponsible activities, and perform better in both stakeholder- and third-party-related CSR areas. Taken together, our results suggest (...)
