This article examines the continuing use of problematic sexual stereotypes at appellate level in the English and Welsh legal system. Using five cases as illustrations, it argues that, notwithstanding professional training and guidance on sexual equality matters, certain senior judges in this jurisdiction still at least sometimes openly employ crude and problematic sexual stereotypes in their judgments or fail to deal appropriately with the use of these stereotypes by trial judges. Jesse Prinz argues that recent work in philosophy, neuroscience, and anthropology supports two radical hypotheses about the nature of morality: moral values are based on emotional responses, and these emotional responses are inculcated by culture, not hard-wired through natural selection. In the first half of the book, Jesse Prinz defends the hypothesis that morality has an emotional foundation. Evidence from brain imaging, social psychology, and psychopathology suggest that, when we judge something to be right or wrong, we are (...) merely expressing our emotions. Prinz argues that these emotions do not track objective features of reality; rather, the rightness and wrongness of an act consists in the fact that people are disposed to have certain emotions towards it. In the second half of the book, he turns to a defense of moral relativism. Moral facts depend on emotional responses, and emotional responses vary from culture to culture. Prinz surveys the anthropological record to establish moral variation, and he draws on cultural history to show how attitudes toward practices such as cannibalism and marriage change over time. He also criticizes evidence from animal behavior and child development that has been taken to support the claim that moral attitudes are hard-wired by natural selection. Prinz concludes that there is no single true morality, but he also argues that some moral values are better than others; moral progress is possible. Throughout the book, Prinz relates his views to contemporary and historical work in philosophical ethics. His views echo themes in the writings of David Hume and Friedrich Nietzsche, but Prinz supports, extends, and revises these classic theories using the resources of cutting-edge cognitive science. Gut Reactions is an interdisciplinary defense of the claim that emotions are perceptions of changes in the body.

In Furnishing the Mind, Jesse Prinz attempts to swing the pendulum back toward empiricism.

There are two major perspectives on the origin of emotions. According to one, emotions are the products of natural selection. They are evolved adaptations, best understood using the explanatory tools of evolutionary psychology. According to the other, emotions are socially constructed, and they vary across cultural boundaries. There is evidence supporting both perspectives. In light of this, some have argued both approaches are right. The standard strategy for compromise is to say that some emotions are evolved and others are constructed. (...) The evolved emotions are sometimes given the label “basic,” and there is considerable agreement about a handful of emotions in this category. My goal here is to challenge all of these perspectives. I don’t think we should adopt a globally evolutionary approach, nor indulge the radical view that emotions derive entirely from us. I am equally dissatisfied with approaches that attempt to please Darwinians and constructivists by dividing emotions into two separate classes. I will defend another kind of ecumenicalism. Every emotion that we have a name for is the product of both nature and nurture. Emotions are evolved and constructed. The dichotomy between the two approaches cannot be maintained. This thesis will require making some claims that would be regarded as surprising to many emotion researchers. First, while there is a difference between basic emotions and nonbasic emotions, it is not a structural difference. All emotions are fundamentally alike. Second, the standard list of basic emotions, though by many to be universal across cultures, are not basic after all. We don’t have names for the basic emotions. All emotions that we talk about are culturally informed. And finally, this concession to constructivism does not imply that emotions are cognitive in any sense. Emotions are perceptual and embodied. They are gut reactions, and they are not unique to our species.. (shrink)

The Emotional Construction of Morals is a book about moral judgements – the kinds of mental states we might express by sentences such as, ‘It's bad to flash your neighbors’, or ‘You ought not eat your pets’. There are three basic questions that get addressed: what are the psychological states that constitute such judgements? What kinds of properties do such judgements refer to? And, where do these judgements come from? The first question concerns moral psychology, the second metaethics and the (...) third is best construed as belonging to a domain that has been neglected in analytic value theory: the genealogy of morals. These are all separate branches of ethics, but they are interconnected. The thesis of the book is that moral judgements are emotional attitudes that refer to response-dependent properties, and that these responses have been shaped by cultural history. I call the view Constructive Sentimentalism. The first half of the book deals with sentiments, and the second half with construction. The second half also deals with relativism, because I argue that moral values are constructed differently across cultures and across individuals.Thus described, The Emotional Construction of Morals is a conventional contribution to analytic moral philosophy, taking on some of the core questions in that field and defending positions that have a long philosophical pedigree. Indeed, the theory I defend has roots in Hume and Nietzsche, though it departs from both in various ways. What makes the book somewhat unusual is that it seeks to defend traditional theories by appeal to recent work in psychology, neuroscience, anthropology and related fields. It is an exercise in methodological naturalism and committed to the view that we can answer traditional philosophical questions while treating ethics as a social science. The moral domain is broader than the empathy and justice concerns assessed by existing measures of moral competence, and it is not just a subset of the values assessed by value inventories. To fill the need for reliable and theoretically grounded measurement of the full range of moral concerns, we developed the Moral Foundations Questionnaire on the basis of a theoretical model of 5 universally available sets of moral intuitions: Harm/Care, Fairness/Reciprocity, Ingroup/Loyalty, Authority/Respect, and Purity/Sanctity. We present evidence for the (...) internal and external validity of the scale and the model, and in doing so we present new findings about morality: Comparative model fitting of confirmatory factor analyses provides empirical justification for a 5-factor structure of moral concerns; convergent/discriminant validity evidence suggests that moral concerns predict personality features and social group attitudes not previously considered morally relevant; and we establish pragmatic validity of the measure in providing new knowledge and research opportunities concerning demographic and cultural differences in moral intuitions. These analyses provide evidence for the usefulness of Moral Foundations Theory in simultaneously increasing the scope and sharpening the resolution of psychological views of morality. (shrink)

Scrupulosity is a form of OCD where patients obsess about morality and sometimes compulsively confess or atone. It involves chronic doubt and anxiety as well as deviant moral judgments. This chapter argues that Scrupulosity is a mental illness and that its distortion of moral judgments undermines, or at least reduces, patients’ moral responsibility. The authors go on to argue that this condition challenges popular deep-self theories of responsibility, which assert that one is only blameworthy or praiseworthy for actions that arise (...) from one’s deep self, from what one truly values. Patients with ego-syntonic Scrupulosity, however, identify with their condition and seem to have cares that reflect their deep selves, yet do not seem fully responsible for their actions or their consequences, such as neglecting the needs of their loved ones. Other theories, particularly reasons-responsiveness theories, better capture the ways in which responsibility in Scrupulosity is reduced. (shrink)

Hubert Dreyfus once noted that it would be difficult to ascertain whether Edmund Husserl had a computational theory of mind. I provide evidence that he had one. Both Steven Pinker and Steven Horst think that the computational theory of mind must have two components: a representational-symbolic component and a causal component. Bearing this in mind, we proceed to a close-reading of the sections of “On the Logic of Signs” wherein Husserl presents, if I’m correct, his computational theory of mind embedded (...) in a language of thought. My argument goes like this: the computational theory of mind is the idea, following Haugeland, that the mind comes prepackaged as, or is endogenously constrained to be, an automatic formal system; this explains, according to Husserl, why automatic trains of thought without logical intent resemble arguments exhibiting deductive structure with logical intent. In general, an automatic formal system yields true results provided that the syntactic symbols with which they compute are univocal and are semantically evaluable, and the mechanized inferences they perform are valid and preserve truth. These two conditions describe a computational cognitive process: the first condition connects representations to syntax, and the second condition uses the syntax, in inauthentic judging, to arrive at true conclusions through blind causality. Now, in point of textual fact, these are the conditions which Husserl attributes to our “natural psychological mechanism of symbolic inference” which typically yields true results. Since a formal system attributed to the “internal structure” of the mind, and guided by blind causality, just is the computational theory of mind, it follows, I think, that Husserl had a computational theory of mind. This computational theory is, moreover, embedded in a language of thought, since Husserl attributes a language-like form to our thoughts so that they may be mechanically processed. Abstrak: Kitab Suci merupakan Sabda Allah yang menjadi tumpuan hidup dan sumber kebenaran bagi umat beriman. Posisinya begitu agung dan penting. Sayangnya, banyak umat Kristiani yang kesulitan untuk memahami isi Kitab Suci. Artikel ini bertujuan untuk memperkenalkan salah satu metode menafsirkan Kitab Suci yang relatif mudah untuk digunakan oleh semua kalangan, yakni metode Analisis Naratif. Dalam artikel ini, metode tersebut akan digunakan untuk menganalisis perikop tentang “Kelahiran Samuel” (1 Samuel 1:1-28). Melalui analisis atas teks ini pula, hendak dipaparkan beberapa pesan (...) teologis yang dapat meng- inspirasi kehidupan umat beriman. Secara praktis, artikel ini berikhtiar menunjukkan bahwa metode analisis naratif cukup berjasa dalam mem- permudah umat Kistiani menafsirkan atau menggali pesan-pesan teologis dari teks-teks alkitabiah. It is the foundation of life and the source of truth for the faithful. Its position is very great and important, but unfortunately, many Christians find it difficult to understand the content of Scripture. This article would like to introduce one method of interpreting Scripture that is relatively easy to be used by all circles, the method of Narrative Analysis. In this article, the method will be used to analyze the passage about “Birth of Samuel” (1 Samuel 1:1-28). Through the analysis of this text, the writer also offers some theological messages that can inspire the life of faith. Practically, it can be argued that the method of narrative analysis is meritorious in facilitating Christian people to interpret or explore theological messages of biblical texts. We seem to have strong intuitions that many visual representations -- such as descriptions, depictions and diagrams -- can be classified into different types. But how should we understand the differences between these representational types? On a standard view, the answer is assumed to lie in the presence or absence of a single property. I argue first that this assumption is undermotivated, and offer a particular two-property analysis, which can be used both to differentiate the various types and to understand (...) better what factors affect changes in classification. This in turn can also be used to capture a core idea of perspicuity, and to ground an argument for the general perspicuity of diagrams as a representational type. Finally, I suggest that two complementary and independently plausible theories bearing on the nature of diagrammatic representation can be located within the suggested two-property approach. When part of a person's body is separated from them, or when a person dies, it is unclear what legal status the item of bodily material is able to obtain. A 'no property rule' which states that there is no property in the human body was first recorded in an English judgment in 1882. Claims based on property rights in the human body and its parts have failed on the basis that the human body is not the subject of property. (...) Despite a recent series of exceptions to the 'no property rule', the law still has no clear answer as to the legal status of the body or its material. In this book, Wall examines the appropriate legal status of bodily material, and in doing so, develops a way for the law to address disputes over the use and storage of bodily material that, contrary to the current trend, resists the application of property law. Wall assesses when a person ought to be able to possess, control, use, or profit from, his or her own bodily material or the bodily material of another person. Bodily material may be valuable because it retains a functional unity with the body or is a material resource that is in short supply. With this in mind, Wall measures the extent to which property law can represent the rights and duties that protects the entitlement that a person may exercise in bodily material, and identifies the limits to the appropriate application of property law. An alternative to property law is developed with reference to the right of bodily integrity and the right to privacy. (shrink)

Humeans take reality to be devoid of ‘necessary connections’: things just happen. Laws of nature are to be understood in terms of what ‘just happens’, not vice versa. Here the Humean needs some conception of what it is that ‘just happens’ – a conception of the Humean mosaic. Lewis’s Humeanism incorporates such a conception in the form of a Lewis-style metaphysics of objects, properties, and modality. Newer versions of Humeanism about laws of nature, such as the Better Best Systems approach, (...) typically reject such a Lewisian metaphysics, but it remains unclear what they can offer in its place. By exploring different candidate conceptions, this paper sheds light on the limits of Humeanism about laws of nature: not all conceptions of the Humean mosaic form a suitable basis for a Humean theory of laws. In fact, only a metaphysics roughly in line with Lewis’s will do. The paper ends with a tentative generalization of this result, thus pointing to the ‘limit’ of Humeanism in general: taking the Humean way of thinking to its limit results in a rejection of the whole idea of such a mosaic – and hence of Humean mosaic-based accounts of anything. It is generally agreed that dispositions cannot be analyzed in terms of simple subjunctive conditionals (because of what are called “masked dispositions” and “finkish dispositions”). I here defend a qualified subjunctive account of dispositions according to which an object is disposed to Φ when conditions C obtain if and only if, if conditions C were to obtain, then the object would Φ ceteris paribus . I argue that this account does not fall prey to the objections that have been raised (...) in the literature. (shrink)

Although contemporary powers metaphysics largely understands itself as a metaphysical realist undertaking, recently powers have come to the surface also within an idealist context. This paper aims to characterize and motivate an absolute idealist conception of powers. I compare realist and idealist powers metaphysics in their respective responses to Humean scepticism concerning powers, thereby motivating the claim that the very idea of a power is actually best understood as an idealist idea. I continue to characterize the absolute idealist’s understanding of (...) power, for which it is necessary to see that the content of her power notion is inseparable from the way in which she arrives at that notion. I close with a brief reflection on the absolute idealist’s understanding of the power of thought, which is where idealist and realist powers metaphysics diverge most radically. (shrink)

Recent work in cognitive science provides overwhelming evidence for a link between emotion and moral judgment. I review findings from psychology, cognitive neuroscience, and research on psychopathology and conclude that emotions are not merely correlated with moral judgments but they are also, in some sense, both necessary and sufficient. I then use these findings along with some anthropological observations to support several philosophical theories: first, I argue that sentimentalism is true: to judge that something is wrong is to have a (...) sentiment of disapprobation towards it. Second, I argue that moral facts are response-dependent: the bad just is that which cases disapprobation in a community of moralizers. Third, I argue that a form of motivational internalism is true: ordinary moral judgments are intrinsically motivating, and all non-motivating moral judgments are parasitic on these. (shrink)

Empathy can be characterized as a vicarious emotion that one person experiences when reflecting on the emotion of another. So characterized, empathy is sometimes regarded as a precondition on moral judgment. This seems to have been Hume's view. I review various ways in which empathy might be regarded as a precondition and argue against each of them: empathy is not a component, a necessary cause, a reliable epistemic guide, a foundation for justification, or the motivating force behind our moral judgments. (...) In fact, empathy is prone to biases that render it potentially harmful. Another construct—concern—fares somewhat better, but it is also of limited use. I argue that, instead of empathy, moral judgments involve emotions such as anger, disgust, guilt, and admiration. These, not empathy, provide the sentimental foundation for morality. (shrink)
