Nous voulons mieux comprendre les lois circonscrivant le rôle social de l’Évaluation des technologies en santé (ETS) et les raisons empêchant l’inclusion de l’éthique en ETS. Nous avons ciblé un débat qui est au coeur du rôle perçu du droit réglementaire dans le développement de technologies en santé : l’opposition entre les enjeux environnementaux, sécuritaires et sanitaires (EHSI) et les enjeux éthiques, légaux et sociaux (ELSI), issus de la gouvernance technologique. La collecte de données est basée sur une revue de (...) la littérature issue de travaux antérieurs, et sur une analyse de cas où trois agences d’ETS ont été sélectionnées en utilisant différentes catégories d’obligation légale selon leur degré de force contraignante. La revue de littérature a révélé cinq thèmes relatifs au rôle social de l’ETS et une distinction entre le rôle/utilisation du droit dur et du droit souple dans le droit réglementaire, permettant ainsi de comprendre comment les agences ont utilisé le droit pour intégrer (ou non) l’éthique en ETS. Les deux approches ont démontré que le débat, EHSI/ELSI observé initialement dans la gouvernance et l’évaluation de technologies est reproduit en ETS. La principale tendance confirmée par ces analyses est la présence d’un pacte entre la science et le droit réglementaire. La demande sociale d’intégrer les ELSI, particulièrement l’évaluation éthique en ETS, n’est pas prise en compte par le droit réglementaire traditionnel régissant l’ETS et doit plutôt être considérée par le droit souple. Les difficultés d’intégration de l’éthique en ETS démontrent la nécessité de repenser la gouvernance juridique de l’ETS. (shrink)

An examination of the fundamental role cybernetics played in the birth of cognitive science and the light this sheds on current controversies. The conceptual history of cognitive science remains for the most part unwritten. In this groundbreaking book, Jean-Pierre Dupuy—one of the principal architects of cognitive science in France—provides an important chapter: the legacy of cybernetics. Contrary to popular belief, Dupuy argues, cybernetics represented not the anthropomorphization of the machine but the mechanization of the human. The founding fathers (...) of cybernetics—some of the greatest minds of the twentieth century, including John von Neumann, Norbert Wiener, Warren McCulloch, and Walter Pitts—intended to construct a materialist and mechanistic science of mental behavior that would make it possible at last to resolve the ancient philosophical problem of mind and matter. Jean-Pierre Faye analyse la conférence méconnue de Carl Schmitt : « Economie saine dans un Etat fort », tenue le 23 novembre 1932 devant les membres de « L’Union au Long Nom » (ou « Union pour la conservation des intérêts économiques communs en Rhénanie et Westphalie »). Schmitt y énonce la nécessité pour l’Allemagne d’un « Etat total », équivalent allemand à ses yeux de « l’État totalitaire » de l’Italie fasciste. Cette prise de parole aura un (...) effet décisif : trente-cinq représentants de la finance et de l’industrie allemandes, auditeurs de la conférence, adresseront une pétition à Hindenburg, président du Reich. Ils l’inciteront à appeler le « chef du grand mouvement » au poste de chancelier du Reich. Ce « mouvement » est le déjà criminel NSDAP : le Parti national-socialiste ouvrier allemand, le parti « nazi ». Le 30 janvier 33, Hitler sera chancelier. En neuf semaines, la conférence de Schmitt aura eu pour effet d’abattre tous les obstacles à l’avènement du Troisième Reich. La formule de « l’Etat total » a donc su transmettre aux temps et aux langages une charge à l’énergie insoupçonnée, porteuse des plus grands crimes. Ainsi est révélée la responsabilité centrale de Schmitt dans la mise en place du nazisme. Ce juriste, qui étrangement apparaît pour beaucoup aujourd’hui comme un penseur politique de référence, n’a d’abord avancé qu’une seule carte d’un jeu mortifère. Mais c’était une carte maîtresse, elle était dangereusement efficace pour faire passer le pire dans l’Histoire. Il était intéressant de lire en parallèle les « Journaux » de Schmitt et de mesurer l’attention portée par le juriste aux événements, dans les semaines qui précèdent et suivent l’arrivée d’Hitler à la chancellerie du Reich. Ce qui frappe est cependant la banalité quotidienne qui transparaît dans ces notes. Si ce n’est, peut-être, qu’un mot va lui paraître acquérir un poids nouveau : « Jude », « juif ». C’est son propre rôle, dans le nazisme, à lui Carl Schmitt, qu’il va découvrir par là... (shrink)

This paper aims to connect philosophy of chemistry, green chemistry, and moral philosophy. We first characterize chemistry by underlining how chemists: co-define chemical bodies, operations, and transformations; always refer to active and context-sensitive bodies to explain the reactions under study; and develop strategies that require and intertwine with a molecular whole, its parts, and the surroundings at the same time within an explanation. We will then point out how green chemists are transforming their current activities in order to act upon (...) the world without jeopardizing life. This part will allow us to highlight that green chemistry follows the three aforementioned characteristics while including the world as a partner, as well as biodegradability and sustainability concerns, into chemical practices. In the third part of this paper, we will show how moral philosophy can help green chemists: identify the consequentialist assumptions that ground their reasoning; and widen the scope of their ethical considerations by integrating the notion of care and that of vulnerability into their arguments. In the fourth part of the paper, we will emphasize how, in return, this investigation could help philosophers querying consequentialism as soon as the consequences of chemical activities over the world are taken into account. Furthermore, we will point out how the philosophy of chemistry provides philosophers with new arguments concerning the key debate about the ‘intrinsic value’ of life, ecosystems and the Earth, in environmental ethics. To conclude, we will highlight how mesology, that is to say the study of ‘milieux’, and the concept of ‘ecumeme’ proposed by the philosopher and geographer Augustin Berque, could become important both for green chemists and moral philosophers in order to investigate our relationships with the Earth. The aim of this paper is to clarify the role of category theory in the foundations of mathematics. There is a good deal of confusion surrounding this issue. A standard philosophical strategy in the face of a situation of this kind is to draw various distinctions and in this way show that the confusion rests on divergent conceptions of what the foundations of mathematics ought to be. This is the strategy adopted in the present paper. It is divided into 5 (...) sections. We first show that already in the set theoretical framework, there are different dimensions to the expression foundations of. We then explore these dimensions more thoroughly. After a very short discussion of the links between these dimensions, we move to some of the arguments presented for and against category theory in the foundational landscape. We end up on a more speculative note by examining the relationships between category theory and set theory. (shrink)

La plaidoirie ou le requisitoire reorganisent les faits, creant des fables qui s'eloignent quelquefois de la realite et qui tendent a transformer la verite en mensonge et le mensonge en verite. Ces ressorts sont aussi ceux de la fiction qui exploite toutes les ressources de la probation ou preuve et signe (...) viennent a se confondre. Dans d'autres domaines, pour assurer le passage de liaisons necessaires entre des elements divers qui conduisent a la certitude, a l'analyse morale qui s'appuie sur des relations probables pour etablir l'innocence ou la culpabilite, il faut s'etre approprie un art de la demonstration qui, ayant traverse la metaphysique et les mathematiques, parvient au droit. Ce passage-la marque le role historiquement grandissant de la probabilite dans la prise de decision et dans la conception de la verite. Le present volume interroge les lineaments semantiques et les usages de la notion de preuve, du XVIe au XVIIIe siecle, essentiellement en France et en Grande-Bretagne. Les etudes qui le composent suggerent que ces divers usages constituent l'un des aspects du long processus de division des savoirs. Jean-Pierre Schandeler est charge de recherche CNRS a l'IRCL. Ses travaux portent sur les rapports entre l'histoire et les sciences morales et politiques au XVIIIe siecle. Nathalie Vienne-Guerrin est professeur a l'universite Paul-Valery Montpellier 3, specialiste de Shakespeare. Definition of the problem: Stem cell transplantations from umbilical cord blood, especially if from autologous origin, are often treated with distrust. Not only are the therapeutic effects controversial, but the question of ownership is also hard to answer from an ethical point of view. Furthermore, the extraction of umbilical cord blood is already related to information about the factual and potential health condition of the child and its parents. Arguments and conclusion: The three problems will be discussed separately. Despite certain (...) uncertainties, there are no weighty ethical arguments against the extraction of umbilical cord blood for autologous purposes. The owner of the umbilical cord blood should be the mother. The question of information is not at all typical for this problem area and does not carry more weight here than in other relevant medical situations. (shrink)

Transhuman, or trans-human, is the concept of an intermediary form between human and posthuman. In other words, a transhuman is a being that resembles a human in most respects but who has powers and abilities beyond those of standard humans. These abilities might include improved intelligence, awareness, strength, or durability. Transhumans sometimes appear in science-fiction as cyborgs or genetically-enhanced humans. This book will look into the question "Can machines think?" followed by "Can humans extend their lifespan and keep up with (...) machines?" In other words, do we (humans) have to modify ourselves to be bionic humans, to co-exist and make the most of machines in future? (shrink)

If such a thing as nanoethics is possible, it can only develop by confronting the great questions of moral philosophy, thus avoiding the pitfalls so common to regional ethics. We identify and analyze some of these pitfalls: the restriction of ethics to prudence understood as rational risk management; the reduction of ethics to cost/benefit analysis; the confusion of technique with technology and of human nature with the human condition. Once these points have been clarified, it is possible to take up (...) some weighty philosophical and metaphysical questions which are not new, but which need to be raised anew with respect to nanotechnologies: the artificialization of nature; the question of limits; the role of religion; the finiteness of the human condition as something with a beginning and an end; the relationship between knowledge and know-how; the foundations of ethics. Erasme l'avançait : «On ne naît pas humain, on le devient.» Mais comment peut-on le devenir? Quelles évolutions, quelles contraintes doit-on accepter, dès l'enfance puis tout au long de son existence, pour pouvoir vivre véritablement comme un homme? Et en quoi la société dans laquelle nous vivons favorise-t-elle ou empêche-t-elle ce parcours vers l'humanisation? Autant de questions que Jean-Pierre Lebrun travaille à clarifier depuis de très nombreuses années. Refusant à la fois la nostalgie d'un passé idéalisé et d'être (...) aveuglé par les sirènes du «progrès», il se demande si nous sommes encore capables, voire soucieux, de désirer. Sachant que le désir, le propre de l'homme, a affaire au langage et au manque. Et qu'il se différencie de la jouissance, comblante et par là même mortifère. Or notre société dite néolibérale, imposant la recherche éperdue de ladite jouissance, confondant égalité et égalitarisme, affaiblissant la fonction paternelle au nom du rejet, certes légitime, du patriarcat, tend à dévaloriser tout ce qu'implique la condition humaine. Ce qui a des conséquences majeures, et très concrètes, qu'explore ici Jean-Pierre Lebrun, dans tous les domaines de la vie individuelle et collective : la politique, l'éducation, la culture, le psychisme et ses pathologies, mais aussi la vie conjugale ou les modes de consommation. Une réflexion profonde mais accessible, du point de vue de la psychanalyse, sur les problèmes cruciaux que doit affronter l'homme contemporain. (shrink)

RésuméCet article explore les liens entre le recours à la véracité de Dieu et les notions de certitude «métaphysique» et «morale» chez Descartes. Pour cela, je montre le rôle qu'elles jouent dans sa preuve de l'existence du monde extérieur, sa position sur l'existence d'autres esprits et celle sur l'«animal-machine». Descartes se sert de la véracité de Dieu dans le premier cas, maispas dans le deuxième ni le troisième. Je suggere que c'est parce que faire à nouveau appel à la véracité (...) de Dieu dans le cas des autres esprits aurait mis en péril sa doctrine de l'animal-machine. Je conclus en me penchant sur des passages de Descartes qui pourraient sembler incompatibles avec l'inter prétation que je fais du rôle important quejoue la certitude morale dans sa philosophic. In this paper, we try to establish that some mathematical theories, like K-theory, homology, cohomology, homotopy theories, spectral sequences, modern Galois theory (in its various applications), representation theory and character theory, etc., should be thought of as (abstract) machines in the same way that there are (concrete) machines in the natural sciences. If this is correct, then many epistemological and ontological issues in the philosophy of mathematics are seen in a different light. We concentrate on one problem which immediately follows (...) the recognition of the particular status of these theories: the demarcation problem between ‘natural kinds’ and ‘artefacts’. (shrink)

A formalism is introduced to represent the connective organization of an evolving neuronal network and the effects of environment on this organization by stabilization or degeneration of labile synapses associated with functioning. Learning, or the acquisition of an associative property, is related to a characteristic variability of the connective organization: the interaction of the environment with the genetic program is printed as a particular pattern of such organization through neuronal functioning. An application of the theory to the development of the (...) neuromuscular junction is proposed and the basic selective aspect of learning emphasized. (shrink)

Chemists do not aim at testing preconceptions or theoretical hypotheses only; they first and foremost produce and determine the object of chemical investigation: they learn through making. They never cease to create and stabilize heterogeneous devices, methods, models, and theories in order to act upon the world. Chemical bodies cannot be studied in isolation; their properties constitutively depend on what surrounds and acts upon them. Starting from the specificity of chemical practices, this paper investigates the meaning of consistency, inconsistency, and (...) that of the ceteris paribus clause, in this domain of science. In so doing, it defends the idea that studying what we call ‘a lack of consistency’ should always include the scrutiny of: the way a particular scientific practice is stabilized, and the ontological or pragmatic assumptions about the entities and processes upon which this practice revolves. Dans cette longue lettre à Benoît Peeters, Jean-Pierre Faye revient sur les péripéties de la fondation du Collège international de philosophie, sous l’égide de Jean-Pierre Chevènement alors ministre de la recherche, dans les années 1981-1982. Il laisse entendre quel rôle ambigu – et relativement peu élégant - a joué Derrida dans cette affaire de fondation. Mais la lettre pousse plus loin. Ces circonstances relatives à la création du Collège international de philosophie ne sont qu’un cadre narratif. (...) Il s’agit en fait de questionner l’origine des fameux concepts derridiens de « déconstruction » et de « logocentrisme ». En ce qui concerne « déconstruction », qui traduit l’usage du mot « Abbau » chez Heidegger, Jean-Pierre Faye en montre le contexte inquiétant : la pensée féroce de la « race » sous le Reich nazi. Quant au « logocentrisme », le nom et l’idée d’un combat à mener contre les prétentions de la raison (« logos ») naissent dans les feuilles d’un certain Ludwig Klages, psychiatre désigné par Goering lui-même comme « Reichsführer der Psychotherapie ». In this respect, I will envisage science as both a system of propositions and a set of engaged practices. The scrutiny of chemical innovations will allow me to query the concepts of paradigm and that of scientific community .
