It is the case of a 66-year-old man in a permanent vegetative state which his family is blocked due to suffering. A process and a document of a shared decision-making between the family and the professional team allowed giving emotional support, unlocking the situation and preventing complicated grief.

Several political theorists argue that states have rights to self-determination and these rights justify immigration restrictions. Call this: the self-determination argument for immigration restrictions. In this article, I develop an objection to the self-determination argument. I argue that if it is morally permissible for states to restrict immigration because they have rights to self-determination, then it can also be morally permissible for states to deport and denationalize their own citizens. We can either accept that it is permissible for states to (...) deport and denationalize their own citizens or reject the self-determination argument. To avoid this implication, we should reject the self-determination argument. Political philosophy in the last decades has turned away from universal narratives of progress, on grounds that these narratives produce exclusion and justify domination. However, the universal values that underlie emancipatory political projects seem to presuppose universal history, which explains its persistence in some contemporary political philosophers committed to such projects. In order to find a response to the paradox according to which universal history is inherently exclusionary and yet necessary to uphold universal values, I examine the contrast between Adorno’s (...) and Lyotard’s perspectives on the problem of writing history ‘after Auschwitz’. For both philosophers, Auschwitz interrupts our fundamental normative and cognitive values, because any attempt to identify the meaning of the camps by means of these values misunderstands the suffering that took place in them. Yet this interruption produces a feeling that calls for the institution of new universal normative values. For Adorno, this value is a purely negative command to act in such a way that Auschwitz does not repeat itself. For Lyotard, by contrast, it is the demand to invent new idioms that make it possible to find meaning in Auschwitz. (shrink)

The fact that the permeability between family and work scopes produces work-family conflict (WFC) is well established. As such, this research aims to check whether the unequal involvement in household chores between men and women is associated with increased WFC in women and men, interpreting the results also from the knowledge that arise from gender studies. A correlational study was carried out by means a questionnaire applied to 515 subjects (63% men) of two independent samples of Spanish men and women (...) without emotional relationship, who lived with their heterosexual partner. As expected, results firstly show unequal involvement in household chores by women and men as it is higher in women that in men, and the perception of partner involvement is lower in women that in men. Secondly, those unequal involvements relate differently to men and women on different ways of work-family interaction. They do not increase WFC in women comparing to men, although there are tangentially significant differences in work conflict (WC) and statistically significant in family conflict (FC). However, perception of partner involvement on household chores increases WFC both in men and in women but not WC nor FC. Nevertheless, increase on marital conflict (MC) by domestic tasks neither affect in a significant way WFC in women nor in men, but increase WC in both women and men and FC only in women. Results also confirm that subject involvement on household chores is not a significant predictor of WFC in women nor in men, and that MC by domestic tasks is a statistically significant predictor in women of WFC and FC, but not in men. Thus, results show that traditional gender roles still affect the way men and women manage the work and family interaction, although the increased WFC due to involvement in housework is not exclusive to women, but also occurs in men. The paper reads Kant’s notion of radical evil as anticipating and clarifying problematic aspects of what Arendt called ‘the banality of evil’. By reconstructing Arendt’s varied analyses of this notion throughout her later writings, I show that the main theoretical challenge posed by it concerns the adjudication of responsibility for evil deeds that seem to lack recognisable evil intentions. In order to clarify this issue, I turn to a canonical text in which the relationship between evil and responsibility plays a (...) central role: Kant’s Religion within the Boundaries of Mere Reason. Relying on an interpretation of this writing by Arendt’s mentor Karl Jaspers published in 1935, in evident connection to National Socialism, I challenge Arendt’s own interpretation of Kant’s notion of radical evil, which, I argue, represents an antecedent, rather than a contrast, to ‘the banality of evil’. Lyotard’s diagnosis of a ‘postmodern condition’ has been repeatedly interpreted as a disavowal of the universal aspiration of political action and judgment. This article challenges this interpretation by showing that postmodernity involves an attempt to reconsider universality in such a way that it involves dissensus rather than consensus. I proceed by reconstructing Lyotard’s critique of the idea of consensus as a ground of political action and judgment, which in his view is based on a certain model of production of scientific (...) knowledge. Then, I analyse Lyotard’s turn to Kant’s judgment of the sublime as an alternative to a consensus-based conception of universal judgments. In the judgment of the sublime, universality stems from the disagreement between the faculties, which arouses respect for universal ideas. Analogously, political judgments stem from the disagreement between heterogeneous discourses, which produces a universal call to invent new languages that make communication possible. (shrink)

Se argumenta que el inmoralismo que confronta Platón en República I y II, lejos de presentar un solo desafío, tiene en realidad cuatro niveles de exigencia progresiva. Esta estructura escalonada del desafío inmoralista pone de manifiesto el hecho de que el desafío oficial, formulado por Adamanto en República II, corresponde a una peculiar interpretación que Platón hace del inmoralismo. Esto se debe a que los dos primeros niveles del desafío no introducen la novedosa posibilidad de suplantación de la realidad moral (...) por la reputación moral, característica de la interpretación platónica. Se argumenta también que la interpretación platónica acarrea ciertos problemas, y para los cuales se ofrecen soluciones tentativas. Entre estos problemas destaca la famosa objeción según la cual la noción de justicia como armonía síquica que Platón propone como respuesta, en República IV, parece cambiar de tema. Se argumenta, finalmente, que la estructura escalonada del desafío inmoralista permite hacer frente a esta objeción, pues sus últimos dos niveles ya determinan la forma que deberá tomar la respuesta ofrecida en República IV. The aim of the paper is to clarify what is properly common to the common good and to support its irreducibility as a guarantee of overcoming an atomistic conception of civil society. We begin by addressing the notion of individual freedom and the questioning of the selfish condition of the human being. Then, we delve into the normative possibilities offered by an ethical interpretation of the common good. The difference of the common good from other notions used in late-modern discourses (...) is key in determining the intrinsic commonality of social relations. In concluding, we argue for a conception of the common good that accommodates individual freedom, understanding it no longer in isolation, but as part of intersubjectivity. (shrink)

Pricing policies and fair-trade practices are critical for sustaining commercial relationships between firms and customers. Nevertheless, in current business practices, fairness has been mistakenly reduced to a minimalistic ethic wherein justice only demands legal and explicit norms to which commercial parties voluntarily agree. Aimed at giving a different explanation of commercial agreements, this paper will introduce a Virtue Ethics (VE) explanation of the relationship between pricing and the common good by taking up classical concepts related to justice in commerce. In (...) particular, we will explore three principles associated with the notion of fairness in commerce as defined in Neo-Aristotelian ethics towards a relationship between a common good and justice in pricing, i.e., proportionality, benevolence and well-being. Por un lado, mostraremos su carácter más problemático, al reducir toda actividad del hombre americano como parte de la categoría «culturas naturales», aun cuando se registraron noticias de las civilizaciones azteca e inca. Por otro lado, también se revalorará a las civilizaciones aludidas, especialmente la andina, teniendo en cuenta la concepción hegeliana de la historia. Dicha reconsideración encuentra suficiente sustento para afirmar, contrario a lo propuesto por Hegel, que los incas fueron un (...) imperio, o, en otras palabras, una civilización semejante a las que existieron en Asia, África y Europa. El propósito de este artículo es ofrecer una reconstrucción de la teoría ética presentada por Calicles en el Gorgias de Platón, con el apoyo de otros textos de la época que contribuyen a explicardicha teoría y a refinarla. El primer paso de esta reconstrucción es mostrar que Calicles ofrece una teoría perspectivista de los juicios morales, de acuerdo a la cual los juicios morales pueden emitirsedesde dos perspectivas radicalmente distintas – la perspectiva contractual, y la natural. El segundo esmostrar que (...) Calicles emplea un peculiar concepto de naturaleza que le permite sostener que ciertosderechos y prerrogativas naturales provenientes de una perspectiva natural, han de imperar por sobrelos que se derivan de la perspectiva contractual. El resultado es una teoría que además de tener un altovalor filosófico, parece no ser vulnerable a varias de las dificultades fundamentales señaladas por las interpretaciones dominantes, ni estar tampoco afecta al implausible hedonismo burdo que Platón leatribuye a Calicles en el diálogo. In recent years, democratic theorists have inquired into the aesthetic dimension of contemporary politics. Influenced by Hannah Arendt and Jacques Rancière, these scholars claim that there is an analogy between democratic politics and aesthetic experiences, since both involve the confrontation of an indeterminacy that cannot be overcome by means of rational argumentation. Contributing to this perspective, but challenging some of Rancière’s insights, this article shows the importance of Jean-François Lyotard’s writings on aesthetics for understanding what I call ‘democratic aesthetics’. This (...) aesthetics, I argue, consists in works of art that bring representation to its limits, thus arousing an experience of the unpresentable. Influenced by Immanuel Kant’s analysis of the sublime, Lyotard claims that avant-garde art, by disrupting the rules of representational art, put representation as such into question. This experience of the unpresentable contributes to cultivating a readiness to listening to voices that are not yet heard, because they lack a discourse by which to express themselves. Given that politics in postmodernity, following Lyotard, consists in shifting the dividing line between the sayable and the unsayable, avant-garde art is conductive to a postmodern politics – which, I argue, is analogous to democratic politics. De Monarchia representa una de las obras de Dante que más influjo político ha ejercido. Probablemente movido a escribirla, hacia 1313. Con ella, Dante quiere contribuir a erradicar la anarquía imperante de su época, en Italia y, concretamente, en su ciudad florentina. Sueña con un orden social que establezca la paz universal. El tono de la obra, netamente gibelino, muestra a un Dante que ha evolucionado intelectualmente. Dante se muestra aquí como un intelectual a caballo entre la escolástica y el (...) florecimiento de un estilo nuevo. Hay en él toda una serie de giros, expresiones, alegorías, imágenes y simbolismos claramente medievales, pero también un conjunto de ideas que, contra corriente, contribuyeron a cambiar el modo de interpretar el mundo. Su De Monarchia ha de considerarse una obra innovadora porque, aunque el texto ciertamente recogió tradiciones legales, jurídicas, políticas y teológicas precedentes, su mayor mérito radicó en la elaboración de una densa, brillante y novedosa teoría, según la cual, el emperador no sólo debía su poder a la elección directa de Dios —con lo que su investidura no devenía un mero oficio de la Iglesia— sino que, además, la institución imperial resultaba superior a la pontificia. Por tanto, hay que plantearse si «De Monarqchia» es una obra que precederá algunas de las principales tesis que posteriormente defenderá la Reforma protestante en cuestiones políticas. (shrink)

El Romanticismo hizo aportes fundamentales en la teoría de la pintura: por un lado centró la atención en su visualidad como arle de la apariencia y su idealización: por el otro, la coaccionó con el significado, poniéndola al servicio de la religión y el poder, estimuló el goce y la crítica del arte, pero los condenó también en favor de una actitud reverencial ante él. La pintura de los Nazarenos representa la intención romántica de una nueva pintura cristiana, alemana y (...) patriótica que habría de reorientar el espíritu de la época. Hegel se opuso radicalmente a este proyecto: su tesis del fin del arte no tiene sólo una explicación sistemática, sino que responde igualmente a un debate histórico concreto. Intelligent Transportation Systems are expected to automate how parking slots are booked by trucks. The intrinsic dynamic nature of this problem, the need of explanations and the inclusion of private data justify an agent-based solution. Agents solving this problem act with a Believe Desire Intentions reasoning, and are implemented with JASON. Privacy of trucks becomes protected sharing a list of parkings ordered by preference. Furthermore, the process of assigning parking slots takes into account legal requirements on breaks and driving time (...) limits. Finally, the agent simulations use the distances, the number of trucks and parkings corresponding to the proportions of the current European Union data. The performance of the proposed solution is tested in these simulations with three different distances against an alternative with complete knowledge. The difference in efficiency, the number of illegal breaks and the traveled distances are measured in them. Comparing the results, we can conclude that the nonprivate alternative is slightly better in performance while both alternatives do not produce illegal breaks. In this way the simulations show that the proposed privacy protection does not impose a relevant handicap in efficiency. (shrink)

Este trabajo pretende detallar la concepción metafilosófica del socratismo y del aristotelismo precisando la interrelación entre teoría y praxis que ambos proyectos desarrollan. A partir de un diagnóstico común a Michel Foucault y Pierre Hadot, según el cual el saber filosófico era inseparable en la antigüedad de una “existencia filosófica”, se expone cómo concibieron tanto Sócrates como Aristóteles este peculiar “modo de vida”, concluyéndose que las raíces del “biós theoretikós” aristotélico se encuentran en la “vida examinada” defendida por el maestro (...) de Platón. En el transcurso de esta investigación, además, se pone de manifiesto que la dimensión teórica de la filosofía resulta prioritaria en ambos pensadores, si bien el descubrimiento de la verdad, propósito último de la teoría, acarrea consecuencias prácticas imposibles de alcanzar por una vía distinta de la contemplación filosófica. Se resuelve, por tanto, que la tensión entre la filosofía como “ciencia de la verdad” y como “ejercicio de vida” es un rasgo esencial del quehacer filosófico tal y como fue tematizado por estos dos grandes pensadores. En el ámbito del derecho procesal penal, particularmente en el contexto del tránsito, existe una carencia de disposiciones legales que regulen el aspecto probatorio para demostrar infracciones por parte de las autoridades competentes. Específicamente, la falta de regulación sobre el uso de fotografías o videos como evidencia dificulta el proceso de aplicación de la ley, ya que ni el COIP ni la LOTTTSV ni sus reglamentos abordan adecuadamente cómo deben obtenerse pruebas mediante medios digitales. Esta laguna normativa plantea interrogantes sobre (...) qué aspectos pueden capturarse en contenido digital, cómo llevar a cabo dicho proceso y qué requisitos deben cumplir los dispositivos utilizados. Ante esta situación, se justifica la necesidad de realizar una investigación exhaustiva para determinar qué aspectos deben incorporarse en la normativa de tránsito con el fin de garantizar un debido proceso. El objetivo principal de esta investigación fue identificar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito, así como proponer recomendaciones para mejorar el marco normativo existente. Se buscó determinar qué aspectos deben ser incorporados en la normativa de tránsito para garantizar un debido proceso y una aplicación justa de la ley. Para abordar esta problemática, se llevó a cabo una investigación cualitativa con un enfoque descriptivo. Se empleó el método dogmático-jurídico analítico-sintético para analizar en detalle la legislación existente y las lagunas normativas relacionadas con la obtención de pruebas digitales en casos de infracciones de tránsito. Además, se realizaron entrevistas a expertos en derecho procesal penal y se recopiló información de jurisprudencia relevante. Este enfoque metodológico permitió una comprensión profunda de los desafíos y las posibles soluciones en este ámbito. Los resultados de la investigación revelaron importantes lagunas en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se identificaron problemas relacionados con la falta de claridad en los procedimientos de obtención de pruebas digitales y la ausencia de criterios específicos para la admisibilidad de dichas pruebas en los procesos legales. Además, se destacó la necesidad de establecer estándares claros y procedimientos adecuados para garantizar la integridad y fiabilidad de la evidencia digital en el contexto del tránsito. Esta investigación resalta la importancia de abordar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se recomienda la implementación de medidas específicas para mejorar la recopilación y admisibilidad de pruebas digitales, así como la revisión y actualización de la normativa existente. Esto contribuirá a garantizar un proceso legal justo y transparente en el ámbito del tránsito, fortaleciendo así el Estado de derecho y la confianza en el sistema judicial. (shrink)

Scholarship has tended to focus on the deleterious impacts of chronic exposure to violence, to the detriment of understanding how residents living in dangerous contexts care for themselves and one another. Drawing on 30 months of ethnographic fieldwork, this article examines two sets of practices that residents exercise in the name of protecting themselves and their loved ones. The first set (“making toast”) includes the mundane, “small acts,”—often embedded in routine—that residents draw on in an effort to form connections and (...) create order in a fundamentally chaotic and stressful environment. The second set (“splitting apples”) involves the teaching and exercise of violence in the name of protecting daughters and sons from further harm. Using interviews and field notes, we argue that both sets of practices, when viewed in situ, reveal an “ethics of care.” Resisting the urge to either romanticize or sanitize these efforts, we engage with the difficult question of what it means when an expression of “care” involves the (re)production of violence, especially against a loved one. En este artículo se defiende la necesidad de introducir modelos teológicos que resistan el diálogo con la ciencia y se apuntan algunas líneas de trabajo abiertas por dichos autores; la causalidad descendente como modelo de acción creadora continua, la posibilidad o no de acciones particulares de Dios, la relación de Dios con la creación a través del tiempo. Encontramos (...) en estos campos un ejemplo de cómo desarrollar el futuro de la Teología de la Creación, constituyendo en sí mismos campos de estudio que necesitan mayor profundidad. (shrink)

This article discusses one of the most controversial topics on the creation of Rabbinic Jewish Liturgy—the origin of the Amidah, the main prayer in the Jewish religious public service, after the destruction of the Second Temple in 70 E. C. To this end, the formal and literary structure of the Amidah is analyzed followed by a critical discussion on its origin that contributes to the scholarly debate on the topic. Si bien la Escuela de Bellas Artes de Viena frustró, por dos veces, su sueño en el terreno de las artes plásticas, la política le brindó la oportunidad de hacerlo realidad; y, una vez convertido en Führer de todos los alemanes, se concibió a sí mismo como el gran artista que debía regenerar (...) y dar forma a una nueva Alemania. A través de este ensayo, trataré de presentar los principales trazos de la estética con que el nacionalsocialismo recubrió al iii Reich. Jackson has ellaborated an argument to show that our experiences or qualitative states gather information which cannot be obtained in any other way. Functionalists reject in many ways that experience may bring new information. The point of this paper is to argue that, if func-tionalism is right, if experiences or "qualia" are not informative, then functionalism cannot report about them. The functionalist criticism of Jackson's argument makes it impossible for any functionalist theory to know experience.

Explorar y debatir múltiples perspectivas sobre los acontecimientos del pasado es una orientación curricular tan aceptada entre los investigadores, como poco frecuente en nuestras aulas de historia. Como en entregas anteriores de esta serie de artículos, se analiza aquí esta orientación curricular a la luz de las investigaciones y experiencias publicadas, tratando de esclarecer en qué consiste, sus claves, sus prácticas más habituales y por qué resulta valiosa para los estudiantes. La multiperspectividad está en la misma esencia de la historia (...) como disciplina. Se opone a la memoria, caracterizada por relatos cerrados que imponen una única versión del pasado. En esta tensión entre disciplina y memoria, la práctica de la enseñanza de la historia ha apostado habitualmente por la segunda. Pero aprender a analizar, valorar y debatir las distintas versiones del mundo del pasado tiene mucho más valor curricular. Multiperspetividad no sólo significa comprender la verdadera naturaleza polémica, abierta y crítica de la historia, sino que es la misma base de la ciudadanía democrática. (shrink)

This paper aims to analyze a specific way in which a scientific programme or area can, in Lakatosian terms, degenerate: namely, through a developmental process of intellectual inflation. Adopting a pluralist approach to the notion of scientific progress, we propose that the historical development of a particular scientific area can be analyzed as being intellectually inflationary during a bounded period of time if it has considerably increased its productive output (thus displaying productive progress) while the overall semantic or epistemic value (...) of those products have not improved in a significant fashion (thus lacking progress in a semantic or epistemic sense). Then, we apply this concept to thoroughly assess whether there are some intellectually inflationary patterns in the development of two areas of research: (i) information-theoretical evolutionary biology in 1961-2023, and (ii) ensemblist non-equilibrium statistical mechanics in 1938-2023. And finally, we argue that tracking and analyzing intellectually inflationary patterns in the history of sciences might contribute to vindicate a non-productivist picture of current scientific research. From the diversity of applications of Network Science, in this Opinion paper we are concerned about its potential to analyse one of the most extended group sports, Football (soccer in U.S. terminology) [29], since it allows addressing different aspects of the team organization and performance not captured (...) by classical analyses based on the performance of individual players. The reason behind relies on the complex nature of the game, which, paraphrasing the foundational paradigm of complexity sciences “can not be analysed by looking at its components (i.e., players) individually but, on the contrary, considering the system as a whole” or, in the classical words of after-match interviews “it’s not just me, it’s the team”. The recent ability of obtaining datasets of all events occurring during a match, including the position of the players and the interactions between them has opened the door to new kind of studies where it is possible to analyse and quantify the behaviour of a team as a whole, together with the role of a single player [17]. Partiendo de la lectura de la obra de Zygmunt Bauman Modernidad y Holocausto, el objeto del presente artículo consiste en poner de manifiesto la vinculación entre el periodo de la Modernidad, con los rasgos que la definen, y el genocidio perpetrado por los nazis en los campos de concentración, mostrando cómo el segundo solo pudo acaecer dentro de un marco de posibilidades ofrecido por el primero. Empezando, a modo de ejemplo, con la decepción de Heidegger ante el hecho de que (...) el nacionalsocialismo continuara la senda de la Modernidad, analizaré brevemente la situación de la figura del judío ante el advenimiento de la sociedad y civilización modernas, para finalmente concluir cómo la racionalidad y la burocracia consustanciales al periodo moderno permitieron, sin contravenir ninguna de sus máximas, la realización de la solución final. In this paper we deal with some limitations of the Philosophy of Religion and the Philosophical Theology of Zubiri. In section 1 we discuss ten topics relevant to Phenomenology of Religion as explained in the course The Theologal Problem of Man (1971). They have to do with the intellectual access to God, the nature of faith, religion, the divine and the sacred, the personal and institutional dimensions of religion, the diversity of religions, their historicity, the superiority of theism and Christianity (...) as the supreme truth of religion. In section 2.1 we discuss the approach to the ‘problem of God’ in the Final Writing (1983) of Man and God. Starting from the ‘relatively absolute’ character of human being, Zubiri shows that he is ‘religated’ to the ‘power of the real’. The ‘enigmatic’ nature of this situation would ‘throw us’ towards its ground. In 2.2 we deal with the exposition that he made in the Rome Course (1973) of the ‘path of religation’, which intends to lead from the fact of religation to the reality of an ‘absolutely absolute’ ground of reality. Throughout these three sections we explain the multiple difficulties of historical, phenomenological, epistemological and metaphysical nature that we find in his argumentation. (shrink)
