Review of Why Music Moves Us by Jeanette Bicknell.

In this article, I examine both the problem of so-called postmodern history as it relates to the Holocaust and suggest the ways that Saul Friedlander's recent work successfully mediates between the somewhat overly polemicized positions of "relativist" and "positivist" history. In this context, I find that in his search for an adequately self-reflexive historical narrative for the Holocaust, Hayden White's proposed notion of "middle-voicedness" may recommend itself more as a process for eyewitness writers than as a style for historians after (...) the fact. From here, I look at the ways Saul Friedlander's reflections on the historian's voice not only mediate between White's notions of the ironic mode and middle-voicedness, but also suggest the basis for an uncanny history in its own right: an anti-redemptory narrative that works through, yet never actually bridges, the gap between a survivor's "deep memory" and historical narrative.For finally, it may be the very idea of "deep memory" and its incompatibility to narrative that constitutes one of the central challenges to Holocaust historiography. What can be done with what Friedlander has termed "deep memory" of the survivor, that which remains essentially unrepresentable? Is it possible to write a history that includes some oblique reference to such deep memory, but which leaves it essentially intact, untouched and thereby deep? In this section, I suggest, after Patrick Hutton, that "What is at issue here is not how history can recover memory, but, rather, what memory will bequeath to history." That is, what shall we do with the living memory of survivors? How will it enter the historical record? Or to paraphrase Hutton again, "How will the past be remembered as it passes from living memory to history?" Will it always be regarded as so overly laden with pathos as to make it unreliable as documentary evidence? Or is there a place for the understanding of the witness, as subjective and skewed as it may be, for our larger historical understanding of events?In partial answer to these questions, I attempt to extend Friedlander's insights toward a narrow kind of history-telling I call "received history"-a double-stranded narrative that tells a survivor-historian's story and my own relationship to it. Such a narrative would chart not just the life of the survivor-historian itself but also the measurable effect of the tellings-both his telling and mine-on my own life's story. Together, they would compose a received history of the Holocaust and its afterlife in the author's mind-my "vicarious past.". (shrink)

This article argues that Jeremy Bentham put forward a distinctive and original theory of representative democracy which can be helpfully analysed through his concept of the ‘deputy’. A deputy, Bentham argued, evoked a specific political relationship between governors and the governed – a relationship that was functionally different to that between the people and a ‘representative’ or a ‘delegate’. Whereas a representative was suggestive of too great a degree of governmental independence from the people and a delegate implied an excessive (...) dependency of governors upon the governed, a deputy for Bentham best described the relationship between the rulers and the ruled that should subsist in a representative democracy. A political form based on deputies, who were to be relatively free to conduct the business of government yet simultaneously accountable to their sovereign electors, was the only way in his eyes to guarantee the promotion of utility in politics and the security of the people from being misruled. In Laws 5, the Athenian argues in favour of virtuous over vicious lives on the basis that the former are preferable to the latter when we consider the pleasures and pains in each. This essay offers an interpretation of the argument which does not attribute to the Athenian an exclusively hedonist axiology. It argues for a new reading of the division of ‘types of life’ at 733c-d and suggests that the Athenian relies on the conclusion established earlier in the Laws (...) that we humans take pleasure in harmony and order. Virtuous lives exhibit just such harmony and order and are therefore always more pleasant than and preferable to vicious lives. (shrink)

Argues that the Holocaust has caused a mutation of the world. Our new world is Planet Auschwitz, an unworld with satellites separate and incommunicable. In this new world, the forces of nihilism are at work - e.g. terrorism, mass murder. Face-to-face with this destruction process, its administrators, and its survivors, we mutations must rewrite everything that has been projectively written about us in the old world. The tendency to repression keeps us from thinking, binding us to cynicism and nostalgia. This research assessed the impact of the participants’ personal value orientation preferences and level of principled moral reasoning when comparing undergraduate business students with undergraduate pharmacy students before and after students completed a professional ethics course. Overall there was little significant change in the students’ value orientations and principled moral reasoning after completing a professional ethics course, yet some important findings emerged when comparing business to pharmacy students.

What do we know when we know the law? Not a set of rules or theories, but a set of practices that are at bottom practices of reading--reading the texts of the law, reading the world--and writing (including of course speaking), especially writing in news ways in the inherited language of the law. Legal knowledge is a writer's knowledge. It always has as one of its deepest themes the question of justice. These themes are explored through an examination of the (...) Model Penal Code, which respect to which I ask what it would be like to learn this material with an eye to using it as a language of thought and argument. It is full of tensions and fissures about the most important matters, including its conceptions of justice and the purposes of criminal law, its central ideas of blameworthiness as a function of intention or state of mind, and its conception of proportionality. These can be seen as defects to be cured, or as reflections of irremediable tensions deep in our thought about these matters which it is a virtue not a vice of the Code to render explicit. To shift from legislative to judge-made law, I next examine Holmes's famous opinions in Shenck and Abrams, which I read in the light offered by the Model Penal Code, using that text to help define the criminal law issues presented in the two cases. This in turn helps define Holmes's achievement in these cases as a transformation of the criminal law, which leads to his constitutional doctrine. Finally, I analyze Brandeis's opinion in Whitney as an intellectual and rhetorical achievement of a different, and more extraordinary, kind. In all of these, the idea is to demonstrate how it is that legal knowledge is a writer's knowledge: for the drafter of statutes, for the composer of judicial opinions applying statutory and constitutional law alike, and for the lawyer thinking through and arguing a case. Even though Slavoj Žižek has written many words about music without really saying much about it, his work nevertheless contains much that for the philosophically minded musicologist, or for the musically minded philosopher, can stimulate thinking. For the author of this article, for example, some of the ideas presented in Žižek’s 2006 The Parallax View have stimulated thinking about the possibilities of taking a comparable approach—that is, a metaphorically ‘parallax’ approach that involves considering an object of attention alternately from more (...) than one perspective—not just to music but to sounds in general. Along with summarizing Žižek’s views on music per se, “Focused Listening: The Aesthetics of Parallax” explores various ways in which persons in the presence of a single ‘sound object’ might listen to, and thus perceive and hear, that sonic phenomenon.
