Public health law research reveals significant complexities underlying the use of law as an effective tool to improve health outcomes across populations. The challenges of applying public health law in practice are no easier. Attorneys, public health officials, and diverse partners in the public and private sectors collaborate on the front lines to forge pathways to advance population health through law. Meeting this objective amidst competing interests requires strong practice skills to shift through sensitive and sometimes urgent calls for action (...) to address known threats to the health of individuals and the community. Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward building (...) a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. Mission-oriented climate change research is often unverifiable. Therefore, many stakeholders look to peer-reviewed climate change research for trustworthy information about deeply uncertain and impactful phenomena. This is because peer-review signals that research has been vetted for scientific standards like reproducibility and replicability. Here we evaluate the transparency of research methodologies in mission-oriented computational climate research. We find that only five percent of our sample meets the minimal standard of fully open data and code required for reproducibility and replicability. The widespread (...) lack of minimal openness standards in peer-reviewed climate change research jeopardizes scientific credibility and risks poor societal outcomes as we manage growing climate risks. This essay examines various intellectual affinities between Dewey and Baldwin, including their pragmatic and tragic conceptions of history. I argue in the first section that Dewey’s attention to the precarious dimensions of experience and his critique of dominant modes of inquiry that prioritize the stable over the precarious pay insufficient attention to race, though this focus on the precarious over the stable aspects of experience is enough to show that pragmatism does acknowledge the tragic dimension. The subsequent section argues that (...) this insufficiency might be rectified through a reading of Baldwin’s work. While Dewey and Baldwin both acknowledge that existence is finite and precarious, Baldwin shows that racism and the promotion of white identity is essentially an attempt to disavow the precariousness of existence. Baldwin’s writings should supplement Dewey’s theory of experience and his account of history because we find in them an acknowledgement of the deep institutional roots of racial oppression and various forms of resistance to this oppression as a key dimension of American history. For those who subscribe to a pro-Black political ideology, like that of Pan-Africanism or Black Nationalism, is there a specific moral obligation between Black agents to protect one another against intersectional/multidimensional oppressions? Africana people are often subjugated to other forms of domination outside of anti-Black racism exclusively. When examining offenses against Black women, queer Black people, poor Black people, etc., both Black Nationalist and Pan-Africanist ethics suggest a moral obligation of protection to all Africana people, but there are varying ways (...) that obligation is explicated. In this argument, I assert that Amílcar Cabral’s text Resistance and Decolonization provides a critical framework for the ways in which disenfranchised, Africana people should be advocated for by their Africana counterparts that take Black collectivity seriously. This argument, as a starting point, conceptualizes Africana people defending one another as a form of decolonization, and it describes four dimensions of moral obligation for defense both within and outside of Black communities: political, economic, cultural, and armed defense. Developments in the Academy from the time of Arcesilaus to that of Carneades and his successors tend to be classified under two heads: scepticism and probabilism. Carneades was principally responsible for the Academy's view of the latter subject, and our sources credit him with an elaborate discussion of it. The evidence furnished by those sources is, however, frequently confusing and sometimes self-contradictory. My aim in this paper is to extract a coherent account of Carneades' theory of probability from the testimony (...) with a further end in view, namely to understand better the uses to which that theory was put by the Academy in its debate with the Stoa. Though it is not its principal object, the investigation should also help make clear how the Academy's scepticism and its probabilism were related to each other as parts of a single consistent practice of philosophy. Machamer, Darden, and Craver's account of the nature and role of mechanisms in the special sciences has been very influential. Unfortunately, a confusing array of ontic, epistemic, and pragmatic distinctions is required to individuate their mechanisms, mechanism schemata, and mechanism sketches. I diagnose this as a conflation of token-level causal relations with type-level relations. I propose instead that a mechanism is an abstraction that relates entity types and activity types on the model of a directed graph. At the empirical center of James’s theory of emotion is the prediction that people induced to act emotionally will report feeling the corresponding emotion. While the research more or less inspired by James is complex, it is also large. Reisenzein and Stephan (2014) identify a number of problems in this literature, but we think, on balance, the research supports James’s hypothesis. At a minimum, there are literally hundreds of studies showing that people induced to act as if (...) they felt an emotion, an attitude, or a judgment report those feelings. Resolving Dooyeweerd’s temporal/supratemporal dialectic opens the way to a deeper appreciation of naive experience and human identity as the image of God. This essay makes a case for that proposition, building on my critique of Dooyeweerd’s idea of cosmic time published previously in this journal. There I hypothesized that time—temporality—should be recognized as the first modal aspect rather than as a transaspectual common denominator of the other aspects. The religious root unity of the human community is not a supratemporal, spiritual (...) concentration point but rather humans themselves in their generations answering to God in all that they are and do. Humans are not temporal bodies directed by imperishable souls but whole persons-in-community, subject to all the modal laws and norms, living by faith in the true God or in false gods throughout this age, which opens to creation’s fulfillment in the age to come. I have no doubt that in the background to the story we're dealing with an historical incident of a healing carried out by Jesus on a Sabbath. However, here the "miraculous healing" element doesn't receive much emphasis, nor does the Sabbath or rather, the matter ofthe Sabbath does receive a certain weight, as we will see later on, but with some very idiosyncratically Johannine touches. In any case, the purpose of this Chapter is determined by the debate about sin, sight, blindness and judgement within which it is set: these are the jeweller's artwork which show forth, and make sense of, the gem ofthe healing. Let us look at the beginning of the story. Jesus sees a man born blind, and his disciples ask him: "Master, who sinned, this man or his parents, that he was born blind?" Why the paradigm of the world-class university is an implausible dream for most institutions of higher education Universities have become major actors on the global stage. Yet, as they strive to be "world-class," institutions of higher education are shifting away from their core missions of cultivating democratic citizenship, fostering critical thinking, and safeguarding academic freedom. In the contest to raise their national and global profiles, universities are embracing a new form of utilitarianism, one that favors market power over academic values. (...) In this book, James Mittelman explains why the world-class university is an implausible dream for most institutions and proposes viable alternatives that can help universities thrive in today's competitive global environment. Mittelman traces how the scale, reach, and impact of higher-education institutions expanded exponentially in the post-World War II era, and how the market-led educational model became widespread. Jedi ethics are flawed because they submit to the demands of hierarchy. Hierarchy in its many forms – whether on the job, in government, or even within a Star Wars fan club – makes demands due to its very nature. One way in which reliance on hierarchy can cause moral trouble is when it's allowed to overtake other moral values. The Jedi Council prove themselves unworthy of Ahsoka's trust, as they end up turning her over. The Jedi Council places more (...) value on playing their part in hierarchical political and military systems than trusting one of their own. The Jedi's claim to ethical impartiality is due in large part to their denial of their feelings. One key step to impartiality is found in recognizing that moral duties must be prioritized over hierarchical demands. James Lovelock, creator of the Gaia hypothesis and the greatest environmental thinker of our time, has produced an astounding new theory about future of life on Earth. He argues that the anthropocene the age in which humans acquired planetary-scale technologies - is, after 300 years, coming to an end. A new age, the novacene has already begun. New beings will emerge from existing artificial intelligence systems. They will think 10,000 times faster than we do and they will regard us (...) as we now regard plants as desperately slow acting and thinking creatures. But this will not be the cruel, violent machine takeover of the planet imagined by sci-fi writers and film-makers. These hyper-intelligent beings will be as dependent on the health of the planet as we are. They will need the planetary cooling system of Gaia to defend them from the increasing heat of the sun as much as we do. And Gaia depends on organic life. We will be partners in this project. It is crucial, Lovelock argues, that the intelligence of Earth survives and prospers. He does not think there are intelligent aliens, so we are the only beings capable of understanding the cosmos. Maybe, he speculates, the novacene could even be the beginning of a process that will finally lead to intelligence suffusing the entire cosmos. Ethical Politics and Modern Society introduces and critically examines British idealist philosopher, Thomas Hill Green, his practical philosophy and its reception in China between the late nineteenth century and the early twentieth century. As a response to the modernity issue in Great Britain, Green's philosophy, in particular his ethical politics, anticipated a practical solution to the individual alienation issue in modern society. Witnessing the resemblance between Green's ethical politics and classical Chinese ethical and political thought, some Chinese scholars became inclined (...) to take Green's thought as an intellectual approach to assimilate Western modernity. While Green and the Chinese scholars both intended to articulate an ethical conception of modern politics in response to the issue of modernity, their results were very different. In this book, James Jia-Hau Liu analyses why modern Chinese scholars introduced Green's philosophy to China and why the studies of Green's philosophy in China have since faded away. Modern Chinese scholars, such as Gao Yi-Han, Chin Yueh-Lin, Tang Jun-Yi, Chang Fo-Chuan and Yin Hai-Guang, are explored in greater detail. The contradictory standings towards modernity between Green and Chinese scholars illustrate how to understand the difference forms of modernity that can be embodied therein. In the half decade following the 2007 financial crisis, the reform of global financial governance was driven by two separate policy debates: one on the substantive content of regulations, the other on the organizational architecture of their governance. The separation of the two debates among policymakers has been mirrored in academia, where postcrisis analyses of financial governance have remained detached from reinvigorated discussions about the nature of financial markets. We argue that this separation is deeply flawed. Presenting an analysis of (...) interactions between standards for banking, credit rating, accounting, and derivatives trading, this article demonstrates why the appropriateness of the organizational architecture of global financial governance is necessarily contingent upon one’s understanding of how financial markets work. In particular, if financial markets are not anchored to external “economic fundamentals” but instead exhibit reflexivity, then the reciprocal interactions between different regulatory arenas demand considerably more organizational coordination than presently exists. Writers such as Kurt Baier, William Frankena, Paul Taylor, Kai Nielsen, G.J. Warnock, and J.O. Urmson1 have all urged a view of the nature of morality according to which, in making a moral judgment, what a person is doing is expressing a preference from within (...) a certain point of view. Different accounts are given of just how “the moral point of view” is to be distinguished from other points of view,2 but most of these writers – Baier, Frankena, Nielsen, and Warnock – say that it is distinguished at least in part by the fact that anyone taking this point of view is thereby committing himself to the impartial promotion of “the interests of everyone alike,” where no one’s interests (including those of the agent himself) are given more importance than anyone else’s interests. On this view, moral principles are easily and naturally contrasted with principles of prudence; the egoist, by definition, has no moral principles since he does not care about promoting “the interests of everyone alike.” As an egoist, he is only.. This truism assumes a deeper, more puzzling, and unsettling significance in the programmatic section 6 of Sein und Zeit, which promises nothing less than a Destruktion of the history of philosophy centered on a few pivotal figures and guided by the problem of temporality as the horizon and transcendental condition of any understanding and explicit interpretation of the sense of being. If the Seinsfrage cannot be formulated, let alone (...) answered, without this detour through the history of ontology, it is precisely because the philosophizing human being is its past, because the philosopher's past does not merely trail behind the present as a foregone conclusion but "always already advances ahead of it." Every effort to free ourselves from tradition and to begin with a tabula rasa "is pervaded by traditional concepts and...horizons and traditional angles of approach." An understanding shaped and governed by the past plays its enabling role whether the individual recognizes and welcomes it or not, whether he makes the past an object of study and cultivates an interest in tradition or abandons history to the historian or philosopher. An individual or a people or an entire era can lack historical consciousness, philosophy of history, and historiography, and can remain indifferent to tradition only because the human being is historical "in the ground of its being.".
