The Western history discipline has recently experienced a growing appreciation of animals as subjects of historical concern, part of what has been described as the “animal turn” in the humanities. While briefly examining some historiographical points related to this burgeoning trend, this article looks to the question of whether animals have history itself as a device to reframe the relationship humans have with both animals and history. Through this process, this article highlights how respecting the unknown possibility and the possibility (...) of the unknown history from the animal perspective recasts the inquiry into “history” as a parochial human endeavor, entangled in the limits of human knowledge, perception, and frailty. It is this same human frailty that explains why humans must understand animal history if only from a human perspective—because humans have fundamentally depended on animals for their survival and development in their own history. Taking these points together, this article asserts that appreciating the existence (and weakness) of the human lens gives new meaning and a sense of humility to the inquiry into animal history, such as how animal history may be better understood in the plural (“histories”), how humans might be freed from universal history and human exceptionalism, and how this humility encourages more ethical treatment of animals. Medical nihilism is the view that we should have little confidence in the effectiveness of medical interventions. The underdetermination of theory by data argument (UD) is traditionally construed as an argument that tells us that we ought to favour an anti-realist position over a realist position. I argue that when UD is constructed as an argument saying that theory choice is to proceed between theories that are empirically equivalent and adequate to the phenomena up until now, the argument will not favour constructive empiricism over realism. A constructive empiricist cannot account for why scientists are reasonable in expecting (...) one theory to be empirically adequate rather than another, given the criteria he suggests for theory choice. Robustness is a common platitude: hypotheses are better supported with evidence generated by multiple techniques that rely on different background assumptions. Robustness has been put to numerous epistemic tasks, including the demarcation of artifacts from real entities, countering the “experimenter’s regress,” and resolving evidential discordance. Despite the frequency of appeals to robustness, the notion itself has received scant critique. Arguments based on robustness can give incorrect conclusions. If Kant’s theory of justice is known for one thing, it is for offering a vision of a perfectly just society that is utterly disconnected from the imperfect societies that we occupy. The purity of Kant’s account has attracted criticism from those who claim that if a theory of justice is to be practical, it must offer more than a vision of a perfectly just society. It must also explain how existing societies mired in injustice are to be brought into (...) ever-closer conformity with the ideal that justice prescribes. In this essay, I will argue that this is exactly what Kant’s mature legal and political theory offers. To discern this feature of Kant’s theory, a neglected component must be integrated into his broader framework. This component is what Kant refers to in Toward Perpetual Peace as a permissive law of public right. (shrink)

This paper surveys and evaluates the answers that philosophers and animal researchers have given to two questions. Do animals have thoughts? If so, are their thoughts conceptual? Along the way, special attention is paid to distinguish debates of substance from mere battles over terminology, and to isolate fruitful areas for future research.

Publicly-enacted blood extractions (principally blood donation events and petitions or paintings in blood) in mass Indian political contexts (for instance, protest or political memorial events and election rallies) are a noteworthy present-day form of political enunciation in India, for such extractions – made to speak as and on behalf of political subject positions – are intensely communicative. Somewhat akin to the transformative fasts undertaken by Gandhi, such blood extractions seek to persuade from the moral high ground of political asceticism. This (...) essay seeks to shed light on how and why these extractions have become such a means, with a particular focus on blood-based portraiture. What makes such portraits – chiefly of politicians and ‘freedom fighter’ martyrs – interesting from a Strathernian point of view is their immanent persuasive relationality. The insights of Strathern can help us to explicate these objects’ dynamic relational features, while reciprocally, the portraits may help us to illuminate and clarify the very particular and interesting nature of the way Strathern treats (and creates) images. Are evolution and creation irreconcilably opposed? Is 'intelligent design' theory an unhappy compromise? Is there another way of approaching the present-day divide between religious and so-called secular views of the origins of life? Jacob Klapwijk offers a philosophical analysis of the relation of evolutionary biology to religion, and addresses the question of whether the evolution of life is exclusively a matter of chance or is better understood as including the notion of purpose. Writing from a Christian point of view, (...) he criticizes creationism and intelligent design theory as well as opposing reductive naturalism. He offers an alternative to both and an attempt to bridge the gap between them, via the idea of 'emergent evolution'. Although considerable attention has been devoted to the concepts of “visible” and “invisible” victims in general medical practice, especially in relation to resource allocation, far less consideration has been devoted to these concepts in behavioral health. Distinctive features of mental health care in the United States help explain this gap. This essay explores three specific ways in which the American mental health care system protects potentially “visible” individuals at the expense of “invisible victims” and otherwise fails to meet the needs (...) of great numbers of people with serious psychiatric conditions: prioritization of the wrong patients, incentivization of excessive caution among providers, and a narrow definition of psychiatry's purview. While each of these practices has been discussed elsewhere in the literature, they are rarely considered as part of an interrelated and systemic problem. Reconceptualizing these three issues as aspects of the larger conflict between the interests of “visible” and “invisible” victims may prove a path toward reform. (shrink)

Non-cognitive gadgets are fancy tools shaped to meet specific, local needs. Cecilia Heyes defines cognitive gadgets as dedicated psychological mechanisms created through social interactions and culturally, not genetically, inherited by humans. She has boldly proposed that many human cognitive mechanisms are gadgets. If true, these claims would have far-reaching implications for our scientific understanding of human social cognition. Here we assess Heyes’s cognitive gadget approach as it applies to mindreading. We do not think that the evidence supports Heyes’s thought-provoking thesis (...) that human children are taught to read minds the way they are taught to read words. We highlight a potential circularity lurking behind this analogy, and we explain why we are unpersuaded by Heyes’s anti-mentalistic proposal for handling data inconsistent with the gadget view, which others take to be evidence for mindreading in human infancy. We conclude that while human minds may well be filled with gadgets, mindreading is unlikely to be one of them. (shrink)

Despite their vulnerability, adolescents are often excluded from health research due to ethical concerns about research with minors, especially in low-income regions like Sub-Saharan Africa. We enrolled adolescent girls aged 15–17 years and caregivers of girls of the same age. Using a 25-question Comprehension Score Sheet, we applied a quantitative approach to compare the comprehension of informed consent of 33 adolescent girls and 41 caregivers of adolescent girls aged 15–17 years. The assessments were audio-recorded and reviewed for quality check. The (...) results showed that adolescent girls were significantly better than caregivers in comprehending informed consent information overall and specifically on study procedures, voluntarism and study purpose. This suggests that adolescents can understand informed consent information at the same level as or better than caregivers who are entrusted with providing permission for adolescents to participate in research. This paper assesses the scope and limits of a widely influential model of goal-ascription by human infants: the shared-intentionality model. It derives much of its appeal from its ability to integrate behavioral evidence from developmental psychology with cognitive neuroscientific evidence about the role of mirror neuron activity in non-human primates. The central question raised by this model is whether sharing a goal with an agent is necessary and sufficient for ascribing it to that agent. I argue that advocates of the (...) shared-intentionality model underestimate both the distinction between the target and the goal of a goal-directed action and the gap between sharing and ascribing a goal. If there is one point on which defenders and critics of the doctrine of proportionality agree, it is that Dworkin's rights as trumps model stands as a radical alternative to the doctrine. Those who are sympathetic to proportionality reject the rights as trumps model for failing to acknowledge that there are conditions under which a right may be justifiably infringed. In turn, those who regard rights as trumps reject the doctrine of proportionality for failing to take rights seriously. This paper (...) argues that each of these views is mistaken. On the one hand, Dworkin's rights as trumps model elides with a prominent version of the proportionality doctrine. On the other, this version takes rights seriously. (shrink)

Objective: Deep brain stimulation targeted to the ventral intermediate nucleus of the thalamus is effective for motor symptoms in essential tremor, but there is limited data on cognitive outcomes. We examined cognitive outcomes in a large cohort of ET DBS patients.Methods: In a retrospective analysis, we used repeated-measures ANOVA testing to examine whether the age of tremor onset, age at DBS surgery, hemisphere side implanted with lead, unilateral vs. bilateral implantations, and presence of surgical complications influenced the cognitive outcomes. Neuropsychological (...) outcomes of interest were verbal memory, executive functioning, working memory, language functioning, visuospatial functioning, and general cognitive function.Results: We identified 50 ET DBS patients; 29 males; the mean age of tremor onset was 35.84 years with a median age of 38 years. The mean age at DBS was 68.18 years. There were 37 unilateral 30 left, seven right, and 13 bilateral brain implantations. In the subgroup analysis, there was a significant interaction between assessment and age of tremor onset ; F = 4.47; p = 0.043 for working memory. The post hoc testing found improvements for younger onset ET. Similarly, there was a significant interaction between assessment and complications vs. no complications subgroups; F = 4.34; p = 0.043 for verbal memory with worsening scores seen for ET patients with complications. The remaining tests were not significant.Conclusion: In this large cohort of ET patients with, DBS was not accompanied by a significant decline in many cognitive domains. These outcomes were possibly related to the selection of patients with normal cognitive functioning before surgery, unilateral DBS implantations for the majority, and selection of patients with optimal response to DBS. Kant said that logic had not had to take a single step forward since Aristotle, but German Idealists in the following generation made concerted efforts to re-think the logical foundations of philosophy. In this book, Jacob McNulty offers a new interpretation of Hegel's Logic, the key work of his philosophical system. McNulty shows that Hegel is responding to a perennial problem in the history and philosophy of logic: the logocentric predicament. In Hegel, we find an answer to a question (...) so basic that it cannot be posed without risking incoherence: what is the justification for logic? How can one justify logic without already relying upon it? The answer takes the form of re-thinking the role of metaphysics in philosophy, so that logic assumes a new position as derivative rather than primary. This study examined the effect of the pique technique preceded by a disrupting process. Passersby in the street were asked for money, either for a common amount of change (control) or 37 cents (pique technique). In half of the cases, the requester added a disrupting sentence at the beginning of the request. Results showed that the pique technique alone and the disrupting technique alone increased compliance with the request. Adding a first disrupting sentence to the pique also increased compliance compared (...) with the other three conditions. These results support the theoretical explanation that the initial disrupting sentence associated with the pique could reduce the influence of the refusal script activated by the money request. This paper is a reading of Aristotle's book on justice (Book V of the Ethics) as what he says it is, a study of the disposition or inclination towards doing just (or unjust) acts. In that light, the content of Aristotle's famous treatments of distributive and corrective justice are only incidental, for their true role is as clues to a meaningful picture of the Just and the Unjust person. Aristotle's treatment of Being Just as a specific virtue is the most (...) detailed treatment he offers of any moral virtue. Being Just as distributive justice emerges as a commitment to the equal treatment of all citizens, but to an equality tempered by always contentious considerations of merited reward. Being Just as corrective justice is a commitment to protecting and repairing the sphere of each person's dignity and opportunity from damaging and sometimes malicious interactions. But more is required. For Being Just means overcoming the disordered and misdirected desire that both Aristotle and Plato call "pleonexia", wanting - tyrant-like - more-of-and-more-than. If that is overcome by re-directed libido, the virtuous will then have to integrate more subtle elements if they are to achieve an inclination to this tempered, but real equality. These elements are two. One is present only implicitly, the passion Aristotle calls nemesis, a demand that the world - and justice within the world - must never permit an evil person to go unpunished or a good one, to suffer harm. That passion cannot be admitted, but at best can only be temporarily stilled. The second impediment arises from the dynamic of human communities that are made up of diverse and actively striving individuals: such citizens, haunted by suspicion grounded in their own pleonexia, demand that the community be one of laws. That creates a true dilemma, for in Aristotle's estimation, no set of rules can cabin any virtue. The Rule of Law is in tension with the particularity of justice in real life, and that tension is ultimately only bearable through the invention of equity, the trusted deviation from the law to preserve the law. In making this abstract I have had to leave untouched the subject matter of the first and two last chapters, but in my paper I do treat these. More importantly, I also show how all political community and the inclination to seek to be a Just Person rests on a gracious act of reciprocal commitment. (shrink)

In these pages we seek to integrate two claims. First, we argue that, taken to their logical conclusions, the considerations that support a strict form of protection for tangible property rights do not call for a similar form of protection when applied to the case of copyright. More dramatically, these considerations demand, on pain of glaring inconsistency, a substantially weaker protection for copyright. In pursuing this claim, we show that the form of protecting property rights is, to an important extent, (...) a feature of certain normal, though contingent, facts about the human world. Second, the normative question concerning the selection of a desirable protection for creative works is most naturally pursued from a tort law perspective, in part because the normative structure of copyright law simply is that of tort law. What makes one individual’s experience vicarious is that it is both similar to, and caused by, another’s psychological state. Vicarious responses are mediated by the observation of another’s goal-directed or expressive action. While the evidence from cognitive neuroscience suggests the ubiquity of vicarious responses to others’ goals, intentions, sensations and emotions, the question is: is the general function of vicarious responses to understand another’s mind?
