El trabajo utiliza las herramientas conceptuales de la discusión sobre injusticia epistémica para analizar tres contextos de cuidado emocional y la atención a la salud mental, tales como: las redes sociales de apoyo informal, la atención terapéutica y la atención psiquiátrica. El propósito es mostrar el tipo de dinámicas sociales que, en dichos contextos, derivan en una exclusión del testimonio de las personas que recurren a ellas. La tesis central sostiene que entender las diversas dinámicas sociales que propician los distintos (...) tipos de exclusiones, implica desglosar circunstancias sociales de diferente calado, algunas de las cuales se encuentran interrelacionadas, como lo representan la producción de sesgos derivados de diferentes tipos de prejuicios (de identidad o participación), mientras que, otras, responden a la constitución de un exceso de credibilidad otorgado a determinados campos expertos. De esta forma la invitación es a pensar que la restitución de la justicia epistémica en este tipo de atención y cuidado no depende ni de la corrección de una sola instancia social, ni de la mejora de un solo sistema experto. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

Este artículo sostiene que la exacerbación autoritaria y totalitaria del capitalismo, en la primera mitad del siglo xx, tuvo su origen en la crisis experimentada por el capitalismo de libre mercado, debido a dinámicas propias de la sociedad liberal. El resultado fue una masiva violación de los derechos humanos liberales que habían posibilitado la consolidación y legitimación del propio capitalismo de libre mercado. De esta manera, en el texto se esboza que a la sociedad liberal moderna le es inherente una (...) tendencia autoritaria, vinculada a la dinámica inestable y propensa tendencia a la crisis de la reproducción del capital. Este rasgo estructural es ilustrado con los debates de la Escuela de Frankfurt sobre el fin del capitalismo liberal. Y dentro de este horizonte general, se sigue con especial detalle el análisis crítico que Franz Neumann realiza, en tensión con “la tesis del capitalismo de Estado” de Friedrich Pollock, sobre el devenir totalitario de la República de Weimar. Reseá crítica sobre el libro de Ángeles Eraña, De un mundo que hila personas (o de la inexistencia de la paradoja individuo/sociedad), UNAM-Instituto de Investigaciones Filosóficas/UAM-Cuajimalpa-División de Ciencias Sociales y Humanidades, Ciudad de México, 2021, 175 pp.

Para identificar las tendencias de la investigación teológica latinoamericana se hace una Revisión Sistemática de Literatura sobre 494 artículos de siete revistas teológicas de alto impacto en este continente, teniendo presente como marco teórico las definiciones de la Teología Latinoamericana, de la Liberación y del Pueblo, en el contexto actual de la Iglesia Católica, a propósito de los desafíos para una Teología en contexto y en salida. Con una metodología mixta, se miden varias dimensiones de las publicaciones como, por ejemplo, (...) las universidades de mayor producción, la procedencia de los investigadores, el lugar de la mujer en la investigación teológica y los principales temas que se investigan en Teología en América Latina, desde la generalidad de los campos teológicos hasta la particularidad de temáticas específicos. En conclusión, se evidencia, entre otros asuntos, la preferencia por la reflexión teológica desde el magisterio del Papa Francisco, la recuperación de la memoria de las conferencias de Medellín y Aparecida, los aportes del Concilio Vaticano II, la mística y la espiritualidad y la vigencia de la Teología latinoamericana en la investigación actual. Después de la publicación de su tesis doctoral titulada La acción (1893), el filósofo francés Maurice Blondel escribió algunas obras en las que trató asuntos de enorme importancia, tanto en el campo filosófico como teológico, que desarrollaron las temáticas centrales de La acción, obra que a finales del siglo XIX generó tanto revuelo en el ambiente filosófico francés. Con la conciencia de su actualidad y su inmenso valor para una perspectiva novedosa de la metafísica y el diálogo fe-razón, se pretende (...) aquí una aproximación a cuatro obras que los estudiosos del pensamiento blondeliano han llamado “menores”. El presente artículo desarrolla los principales aportes de dichas obras a la reflexión filosófica contemporánea, indagando al mismo tiempo por la filosofía de la acción en cada una de ellas. Después de una corta biografía del pensador en cuestión, se abordará el significado de la filosofía de la acción con vistas a su elucidación para el lector. Posteriormente se presentará el contexto histórico de cada obra y se mostrarán sus vínculos con La acción, para terminar con algunas reflexiones que su lectura suscita en nuestro tiempo, cuyos desafíos son similares a los que Blondel tuvo que enfrentar en su momento. This paper explores food commoning through an ethnographic case study in Catalonia as our primary site while the Norwegian case is juxtaposed as a comparison, two agriculturally and economically different European countries. The ethnography analyses cooperation networks between organic food producers’ and consumers’ involving different nodes of community gardening initiatives, self-employed growers, local farmers and all of them under a unique cooperative integrating a community economy. The result it is a myriad of exchange practices ranging from reciprocity and barter to (...) market exchange without intermediaries through on-line platforms. Along these exchanges different options of currency intervene giving rise to novel social and cooperative relations. Similar initiatives in Norway show less variation and are less experimental regarding forms of payment but share similarities in relation to material articulations, concerns and forms of alternative practice. Although these novel forms do not represent a complete break from the more standardized supply chains, and hence from the oppositions/contradictions of production and consumption, the participants see themselves as contributing to a more general process of de-commodification of food. We explore the extent to which the meaning and moral values are mutually constituted in relation to socioeconomic exchanges and environmental caring that each person experiences based on different forms of cooperation and reciprocity. Food, we suggest, is more than a commodity on the market that we may influence through our role as consumers. It is a significant focal point connecting our lives to those of others that articulates one’s relations to society in a political manner. (shrink)

En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. The Iowa Gambling Task (IGT) is a popular method for examining real-life decision-making. Research has shown gender related differences in performance, in that men consistently outperform women. It has been suggested that these performance differences are related to decreased emotional control in women compared to men. Given the likely role of emotion in these gender differences, in the present study we examine the effect of a humor induction on IGT performance and whether the effect of humor is moderated by gender. IGT performance and parameters from the Expectancy Valence Model were measured in 68 university students (34 men; mean age 22.02, SD = 4.3 and 34 women; mean age 22.3, SD = 4.1) during a 100 trial-IGT task. Participants were exposed to a brief video before each of the IGT decisions available; one half of the sample (17 men and 17 women) was exposed to 100 humor videos, while the other half was exposed to 100 non-humor videos during the task. We observed a significant interaction between gender and humor, such that under humor, women’s performance during the last block (trials 80-100) improved (compared to women under non-humor), whereas men’s performance during the last block was worse (compared to men under non-humor). Consistent with previous work, under non-humor, men outperformed women in the last block. Lastly, our EVM results show that humor impacts the learning mechanisms of decision-making differently in men and women. Humor impaired men’s ability to acquire knowledge about the payoff structure of the decks, and as a consequence they were stuck in suboptimal performance. On the other hand, humor facilitated women’s ability to explore and to learn from experience, improving performance. These findings deepen our understanding of the mechanisms underlying IGT decision-making and differential effects of humor in men and women. (shrink)

The contributors to this volume imagine a discourse in which revolution requires no temporalized march of progress or takeovers of state power but instead aims at local control and the material conditions for human dignity.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. This paper examines from a historical perspective Tarski's 1936 essay, "On the concept of logical consequence." I focus on two main aims. The primary aim is to show how Tarski's definition of logical consequence satisfies two desiderata he himself sets forth for it: (1) it must declare logically correct certain formalizations of the -rule and (2) it must allow for variation of the individual domain in the test for logical consequence. My arguments provide a refutation of some interpreters of Tarski, (...) and notably John Etchemendy, who have claimed that his definition does not satisfy those desiderata. A secondary aim of the paper is to offer some basic elements for an understanding of Tarski's definition in the historical logico-philosophical context in which it was proposed. Such historical understanding provides useful insights on Tarski's informal ideas on logical consequence and their internal cohesion. (shrink)

Working memory is thought to be the psychological capacity that enables us to maintain or manipulate information no longer in our environment for goal-directed action. Recent work argues that working memory is not a so-called natural kind and in turn cannot explain the cognitive processes attributed to it. This paper first clarifies the scope of this earlier critique and argues for a pluralist account of working memory. Under this account, working memory is variously realized by many mechanisms that contribute to (...) the maintenance and manipulation of information across tasks. This view in effect updates one of the earliest pluralist formulations of working memory. Juxtaposing this view against deflationary descriptions allows us to delineate two gradients that help us chart various accounts of working memory and identify their respective theoretical commitments. In turn, we can isolate those accounts that fail to accord with the evidence supporting a pluralist view, and we can begin to rehabilitate working memory as a pluralist, and ultimately more informative, construct. The paper reconstructs the connections between the evolution of Patrick Suppes’ measurement theory from 1951 to 1958 and the research in utility analysis he conducted between 1953 and 1957 within the Stanford Value Theory Project. In particular, the paper shows that Suppes’ superseding of the classical understanding of measurement, his endorsement of the representational view of measurement, and his conceiving of an axiomatic version of the latter were prompted by his research in utility analysis.

Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. The main aim of this paper is to point out that Davidsonian and Fregean theories of quotation do not accommodate certain facts about disquotation. A second aim is to dispel some errors of interpretation in a common Davidsonian reading of Tarski's claims about quotation. This allows a correct exegesis of Tarski's view, which is then seen not to be affected by the arguments usually adduced against the view wrongly attributed to Tarski. This article explores the relationality between women’s bodies and selfies on NSFW (Not Safe For Work) tumblr blogs. We consider the way selfie practices engage with normative, ageist and sexist assumptions of the wider culture in order to understand how specific ways of looking become possible. Women’s experiences of their bodies change through interactions, sense of community and taking and sharing selfies. This article provides an empirical elaboration on what sexy selfies are and do by analysing interviews, selfies and blog (...) content of nine women in the NSFW self-shooters community on tumblr. For our participants, self-shooting is an engaged, self-affirmative and awareness raising pursuit, where their body, through critically self-aware self-care, emerges as agentic, sexual and distinctly female. Thus, this is a reading of selfies as a practice of freedom. (shrink)

In recent years, the concept of reifcation has sparked new interest among scholars, particularly in the domain of contemporary critical theory. Authors discussing reifcation usually mention Heidegger, but this is often limited to his major work, Being and Time. In this paper, though, I focus on machination, a fundamental concept that appears in Heidegger’s posthumous texts of the 1930s. Using this concept, Heidegger tries to elucidate how modernity has emptied the meaning of Being of its efective reality. I frst show (...) how the notion of Machenschaft ofers a new perspective on reifcation and how it opens up a historical-metaphysical approach to Heidegger’s other key concepts. To complete this analysis, the second section uses Adorno’s critique in Negative Dialectics to interpret the concept of Machenschaft-reifcation, clarifying its limits and the fruitful possibilities it ofers. Appearing in English for the first time, this book comprises two of Ortega’s most important works, ¿Qué es conocimiento? and the essay “Ideas y creencias.” This is Ortega’s attempt to systematically present the foundations of his metaphysics of human life and, on that basis, to provide a radical philosophical account of knowledge. In so doing, he criticizes idealism and overcomes it. Accordingly, this book goes well beyond a treatise on epistemology; in fact, as understood in modern philosophy, this discipline and (...) its questions are shown to be derivative and, in that sense, they are transcended here by Ortega’s systematic effort. Written during the time of his maturity, these works are representative of his fruitful and radical period. Both ¿Qué es conocimiento? and “Ideas y creencias” are equally decisive not only for the understanding and radical completion of Ortega’s work, but also for their relevance to the work of continental philosophers during the same period and for years to come. The philosopher Jorge J. E. Gracia engages fifteen prominent scholars on race, ethnicity, nationality, and Hispanic/Latino identity in the United States. Their discussion joins two distinct traditions: the philosophy of race begun by African Americans in the nineteenth century, and the search for an understanding of identity initiated by Latin American philosophers in the sixteenth century. Participants include Linda M. Alcoff, K. Anthony Appiah, Richard J. Bernstein, Lawrence Blum, Robert Gooding-Williams, Eduardo Mendieta, and Lucius T. Outlaw Jr., and their dialogue (...) reflects the analytic, Aristotelian, Continental, literary, Marxist, and pragmatic schools of thought. These intellectuals start with the philosophy of Hispanics/Latinos in the United States and then move to the philosophy of African Americans and Anglo Americans in the United States and the philosophy of Latin Americans in Latin America. Gracia and his interlocutors debate the nature of race and ethnicity and their relation to nationality, linguistic rights, matters of identity, and Affirmative Action, binding the concepts of race and ethnicity together in ways that open new paths of inquiry. Gracia's Familial-Historical View of ethnic and Hispanic/Latino identity operates at the center of each of these discussions, providing vivid access to the philosopher's provocative arguments while adding unique depth to issues that each of us struggles to understand. The article deals with the financing of investment projects by the World Bank, especially the rehabilitation of hydropower plants. It is noted that cooperation with Ukraine World Bank launched since 1992. The World Bank develops and finances projects at the request of the Government of Ukraine. After evaluating the project and the terms of the loan are following the negotiations, the approval of the Board of Directors and the signing of the agreement. The funds of the World Bank in Ukraine (...) are on the system of financing and investment projects. The content system projects is to change the conditions and rules of certain sectors of the public administration or industries. The aim of the investment projects is the technical reconstruction of some existing businesses a particular industry or region, creating new companies or provide funds to replenish the working capital of enterprises. This clearly defined list of goods, services and works to be procured through the World Bank loan. The paper conclusions on the results of the project of rehabilitation of hydropower plants. SuccessinitiatedenergyreforminUkraineislargelydeterminedbytheefficiencyoftheinvestmentpolicy, including attracting loans from international financial organizations. On receipt of credit, including the World Bank, depend on the possibility of upgrading technologically obsolete and worn-out fixed assets of the energy sector and problems olving reduce country's energy dependence, improve energy efficiency and reduce the impact on the environment. In turn Hydropower Rehabilitation project funding by the World Bank Ukraine will ensure uninterrupted operation of hydropower plants and have a positive impact on the environmental and energy security. I defend a semantic theory of quotation marks, according to which these are ambiguous, as they have several different acceptations involving corresponding different conventional indications. In particular, in allusion (“mixed”) uses, the corresponding conventional indication is one with an adverbial or prepositional content, roughly equivalent to “using the quoted expression or an appropriate version of it”. And in “scare” uses, the corresponding conventional indication is that the enclosed expression should be used not plainly but in some broadly speaking distanced way, (...) or that it is being so used by the utterer. I also defend this view against some alternative views on which allusion and distance indications are to be seen as pragmatically conveyed. In particular, I consider several views that attempt to explain especially allusion and distance indications as pragmatic suggestions generated from a meager conventional basis, and I argue that they cannot accommodate a number of linguistic phenomena and reflectively supported theses about the use of quotation marks. I lay special emphasis on the fact that the main pragmatic theories fail to pass an extremely plausible test for challenges to polysemic accounts of an expression. (shrink)
