L’article analyse les contextes et les finalités de ces trois citations. Il montre comment Rosenzweig est débiteur à son maître Hermann Cohen de sa vision de Goethe en tant que panthéiste, c’est‑à-dire défenseur d’une fusion entre la vie et l’esprit qui est caractéristique du christianisme des xix e et xx e siècle, identifié avec la vraie réalisation de l’évangile de Jean. Et pourtant, selon Cohen et Rosenzweig, Goethe a été profondément influencé par la Bible hébraïque : la conclusion présente ce dernier thème comme exemple d’une relation féconde entre Deutschtum et Judentum, christianisme et judaïsme. This article considers what happened to American anthropology, which was initiated by the scientist Franz Boas, who commanded all fields of anthropology,physical, biological, and cultural. Boas was a brave field worker who explored Eskimo land, and inspired two famous students, Ruth Benedict and Margaret Mead, to cross borders in new kinds of studies. After this florescence, there was a general return to linear descriptive positivism, superficial comparisons of quantitative cultural traits, and false evolutionary schemes, which did not introduce us to (...) the personalities and inner worlds of the tribal peoples studied. The 1953 study by the philosopher David Bidney was a revelation. Bidney enunciated and clarified all my doubts about the paths of anthropology and his work became to some extent a model for a narration of the story of American anthropology. In many ways he envisaged a semiotics of culture formulated by Lotman. I try to illustrate the fallacies listed by Bidney and how they have been partially overcome in some later anthropological studies which have focused on symbolism, artistry, and subjective qualities of the people studied. I then try to give an overview of the school started by Lotman that spans all human behavior, that demonstrates the complexity of meaning and communication, in vast areas of knowledge, from art, literature, science, and philosophy, that abjured strict relativism and closed systems and has become an inspiration for those who want anthropology to encompass the self and the other, and Bahtin’s double meaning. This paper was inspired by Bidney as a call to explore widely all possible worlds, not to abandon science and reality but to explore deeper inner interrelations and how the aesthetic may be indeed be paramount in the complexities of communication. In the field of socio-legal studies or law and society scholarship, it is rare to find empirically rich and conceptually sophisticated understandings of actual legal practice. This book, in contrast, connects the conceptual and the empirical, the abstract and the concrete, and in doing so shows the law to be an irreducibly social, material and temporal practice. Drawing on cutting-edge work in the social study of knowledge, it grapples with conceptual and methodological questions central to the field: how and where (...) judgment empirically takes place; how and where facts are made; and how researchers might study these local and concrete ways of judging and knowing. Drawing on an ethnographic study of how narratives and documents, particularly case files, operate within legal practices, this book's unique and innovative approach consists of rearticulating the traditional boundaries separating judgment from knowledge, urging us to rethink the way truths are made within law. The imbalance between supply of organs for transplantation and demand for them is widening. Although the current international drive to re-establish procurement via non-heart beating organ donation/donor is founded therefore on necessity, the process may constitute a desirable outcome for patient and family when progression to brain stem death does not occur and conventional organ retrieval from the beating heart donor is thereby prevented. The literature accounts of this practice, however, raise concerns that risk jeopardising professional and public confidence in (...) the broader transplant programme. This article focuses on these clinical, ethical, and legal issues in the context of other approaches aimed at increasing donor numbers. The feasibility of introducing such an initiative will hinge on the ability to reassure patients, families, attendant staff, professional bodies, the wider public, law enforcement agencies, and the media that practitioners are working within explicit guidelines which are both ethically and legally defensible. Oppressive ideology regularly misrepresents features of structural injustice as normal or appropriate. Resisting such injustice therefore requires critical examination of the evaluative judgments encoded in shared concepts. In this paper, I diagnose a mechanism of ideological misevaluation, which I call "hermeneutical misfit." Hermeneutical misfit occurs when thick concepts, or concepts which both describe and evaluate, mobilize ideologically warped evaluative judgments which do not fit the facts (e.g. "slutty"). These ill-fitted thick concepts in turn are regularly deployed as if they merely (...) describe--a phenomenon I call "descriptive masquerade." I argue that, via descriptive masquerade, ill-fitted thick concepts smuggle in warped evaluative judgments alongside apparently value-neutral ‘mere facts’, a process which both reinforces those judgments and increases the difficulty of critique. I investigate the concept "obesity" as an example: scientists and medical practitioners will deploy this concept as if it "merely" describes, enabling the smuggling of a host of warped evaluative judgments. I suggest that, to resist this process, we should develop collective consciousness and articulate "meta-hermeneutical resources," or thick concepts which encode critique of other, ill-fitted concepts (e.g. "slut-shaming" or "fat-shaming"). In this introduction to part three of the Common Knowledge symposium “Fuzzy Studies: On the Consequence of Blur,” the journal’s editor argues that blur is not a medium of concealment, confusion, or evasion. Making distinctions between kinds of relative unclarity, he reserves the word blur for the kind that results from de-differentiating objects or qualities or states of affairs whose differences have been overstated. To refine what blur is and is not, he compares kinds of unclarity found in images by (...) Giotto, Rubens, Hokusai, Kunitora, Manet, Zeshin, and Richter. With reference to art criticism by Hubert Damisch, Wayne Andersen, Anthony Hughes, Robert Storr, Julian Bell, Christopher Prendergast, and especially T. J. Clark, he agrees that choosing between focus and blur can be a moral decision, though not in the sense for which Clark arraigns the Impressionists. Characterizing the way of seeing that Clark encourages in The Painting of Modern Life as a form of staring, this essay argues that “lean and hungry looking” is indecent, whereas unfocused receptivity is irenic. What Bell calls the “aestheticized halfheartedness” of Manet is redescribed here as a genre of moral heroism, and the essay concludes that it is differentiation that is on morally shaky ground. While there are those who object to the prospective use of propranolol to prevent or treat post-traumatic stress disorder (PTSD), most obstreperous among them the President’s Council on Bioethics, the use of propranolol can be justified for patients with severe PTSD. Propranolol, if effective, will alter the quality of certain memories in the brain. But this is not a serious threat to the (...) self understood in terms of narrative identity. A narrative identity framework acknowledges that memory is always being subtly altered or modified. For severe cases of PTSD propranolol may help victims who don’t respond to any other therapy or therapy combination regain their authentic self-narrative and engage once more in life activities. For those whose symptoms are not so severe the potential risks and side-effects of the drug may outweigh the benefits. Patients and family members should be allowed to decide, in consultation with their physician, whether this drug is appropriate in their case. (shrink)

Comment Dieu soutient-il l'existence et pourquoi lui est-il nécessaire de le faire ? L'auteur analyse l'apparente contradiction, qui fait problème, entre la doctrine de la création continuée et l'affirmation par Descartes que le mouvement se poursuit à moins que n'intervienne quelque force extérieure. This essay seeks to understand Descartes's doctrine that what exists cannot continue to exist unless God sustains it by continuous creative activity. How does God sustain existence and why is it necessary for Him to do this ? The essay explores a puzzling apparent contrast between the doctrine of continuous creation and Descartes's claim that motion continues unless an external force interferes. Further, it considers and rejects the thesis (maintained by Gilson and Gueroult) that the doctrine of continuous creation entails that time is discontinuous. (shrink)

Canada’s Tri-Council Policy Statement: Ethical Conduct for Research Involving Humans mandates that all research involving human subjects be reviewed and approved by a research ethics board . We have little evidence on how researchers are dealing with this requirement in multisite studies, which involve more than one REB. We retrospectively examined 22 REB submissions for two minimal-risk, multisite studies in leading Canadian institutions. Most REBs granted expedited review to the studies, while one declared the application to be exempt from review. (...) Time between submission and approval ranged greatly, from four to 546 days. We received a total of 155 REB queries for changes and clarifications, most of which asked for further information, clarification, or additional documents. Less than a third of the REB queries were requests for specific changes, and a vast majority had a very limited impact on the research projects. Institutions also varied broadly in their description of what was required of local principal investigators. We conclude that the organizational and practical challenges these results imply could deter researchers from embarking on multisite research projects, and that recently proposed changes to the TCPS will not solve these problems. Everyday ethics refers to those issues which have a sometimes unrecognized moral dimension and that arise regularly within healthcare and research. These issues are often contrasted to dramatic ethics issues (i.e. issues that have seemingly higher stakes such as those arising in acute care situations or with invasive or life-threatening interventions). Claims have been made that scholarly bioethics tends to focus on dramatic ethics to the detriment of everyday ethics discussions. However, empirical evidence showing this has been lacking. Our own (...) research investigating bioethics discussions in the Parkinson’s disease literature suggested this trend. Consequently, we decided to characterize the context and content of the Parkinson’s disease bioethics literature to empirically test the hypothesis that everyday ethics is under discussed. We conducted a broad literature search using the keywords “Parkinson’s disease” AND (“ethics” OR “bioethics”) and classified results inductively based on the context in which the bioethics discussion occurred. In line with our hypothesis and initial observations, we found that there is indeed a greater focus on dramatic ethics where topics such as deep brain stimulation and neuronal cell transplantations, dominated bioethics discussions. Given the potential utility of everyday ethics in improving healthcare and research, this mismatch in focus ought to be addressed. There is a clear need for further understanding and discussion of everyday ethical issues in scholarly bioethics. (shrink)

Partindo da leitura mitológica do fenômeno «tempo» no mito de Kronos-Saturno, contrasta-se a experiência que ela expõe com a vivência de plenitude, alheia ao tempo, ligada ao momento da relação fusional do bebê com a mãe. A integração do Pai no marco (...) configurado pelo vínculo materno-filial deverá contribuir para a abertura ao mundo, culminando no que Heidegger chamou Geviert, e, nessa medida, sustentar o processo de amadurecimento do infante até ao pleno desenvolvimento da vida pessoal. One of the most familiar uses of the Russell paradox, or, at least, of the idea underlying it, is in proving Cantor's theorem that the cardinality of any set is strictly less than that of its power set. The other method of proving Cantor's theorem — employed by Cantor himself in showing that the set of real numbers is uncountable — is that of diagonalization. Typically, diagonalization arguments are used to show that function spaces are "large" in a suitable sense. (...) Classically, these two methods are equivalent. But constructively they are not: while the argument for Russell's paradox is perfectly constructive, (i.e., employs intuitionistically acceptable principles of logic) the method of diagonalization fails to be so.
