In this paper I defend the claim that the act of writing a work of fiction consists in the performance of a sui generis speech act, and propose a dynamic treatment for acts of fiction-making. Recently, speech act theories of fiction have become targets of the uniformity argument. According to it, in order to account for the myriad of speech acts present in works of fiction, speech act theories of fiction need to propose a similar amount of fiction-related illocutionary forces. (...) When uttered in the same context, these illocutionary forces give rise to the same relations raised by their non-fictional counterparts. While not a knock-down argument, this warrants an explanation. In order to defend speech act theories of fiction, I argue that the claim that speech act theories of fiction need more than one fiction-related sui generis illocutionary force is misguided and rests on an erroneous account of the content of an act of fiction-making. I take that the content of an act of fiction-making is more akin to a speech report than to a regular assertion. Following, I propose a dynamic treatment to the speech act of fiction-making. Concluding, I explore some related topics in order to distinguish my proposal from pretenseapproaches to fictional discourse. (shrink)

Carta escrita por Gilda de Mello e Souza, remetida ao colega Oswaldo Porchat, que se encontrava em Berkeley, quando a ditadura civil-militar brasileira, recrudescida desde a implantação, em agosto de 1968, do AI-5, representava uma verdadeira ameaça a estudantes e docentes da Universidade de São Paulo, especialmente se lhe fizessem qualquer tipo de oposição. Porchat trocou uma sequência de cartas com Gilda nessa época, nas quais relata sua desilusão com a Faculdade de Filosofia, e com os acontecimentos políticos no (...) Brasil. Ao mesmo tempo, confessa estar encantado com a descoberta de novos elementos da Lógica, e com a atmosfera mais amena dos Estados Unidos. Porchat sabe que Gilda enfrenta momentos difíceis, tendo de assumir a Presidência do curso em meio à tentativa do reitor Miguel Reale de submetê-lo a um interventor. Enfrentando a dúvida sobre se valeria a pena retornar ao Brasil naquele momento, Porchat escreve à amiga. A carta a seguir expressa, dentro do que era possível na época, quando as correspondências eram vigiadas, o parecer de Gilda sobre as indagações do amigo, sobre os rumos da ditadura, e sobre o que ela pensava de sua própria atitude de resistência naquele contexto. A carta original, assim como a sequência de correspondências da qual faz parte, está depositada no Fundo Gilda de Mello e Souza, no Instituto de Estudos Brasileiros (IEB/USP). Many recent commentators have noticed how Adorno, in his late works, borrows Kant’s definition of enlightenment to define key areas of his own critical practice. These discussions, however, have failed to notice how these late borrowings present an image of Kant’s enlightenment which is diametrically opposed to his previous discussions. By tracing the development of Adorno’s engagement with Kant’s essay, I discover Adorno deliberately sublating Kant’s definition as to enable its incorporation into his own works. Further, the article will examine (...) some problems which appear to arise for Adorno when borrowing Kant’s definition of enlightenment in his late works, which coalesce around the topics of negativism and the prospects for societal change. En este artículo se revisan las coincidencias que genera, entre la filosofía política de Hegel y de Rousseau, el hecho de que estos dos filósofos afirmen que el Estado es el fin que debe alcanzar lo político. Tanto Hegel como Rousseau consideran que la nación es una condición necesaria para que se establezca el Estado; es decir, que debe generarse una identidad compartida en la comunidad para que ésta pueda ser institucionalizada correctamente. De manera que, aunque desde el punto de (...) vista de Hegel la nación surge de un proceso histórico y para Rousseau proviene de las actividades y experiencias compartidas de un colectivo, ambos asumen un proceso fáctico que hace que sus teorías converjan de manera funcional a pesar de las diferencias conceptuales entre las mismas. We propose six guideposts that states and hospitals should follow to respect disability rights when designing policies for the allocation of scarce, lifesaving medical treatments. Four relate to criteria for decisions. First, do not use categorical exclusions, especially ones based on disability or diagnosis. Second, do not use perceived quality of life. Third, use hospital survival and near-term prognosis (e.g., death expected within a few years despite treatment) but not long-term life expectancy. Fourth, when patients who use ventilators in their (...) daily lives (e.g., home ventilation) present to acute care hospitals, their personal ventilators should not be reallocated to other patients. Fifth, designate triage officers to assess patients individually on the basis of objective medical evidence, not stereotypes or assumptions. Sixth, include disability rights advocates in policy development and dissemination. (shrink)

En este trabajo se discute qué puede aportar la filosofía a la comprensión del dolor. Para ello, en la sección, apuntamos que la pregunta por el dolor tiene su origen en una experiencia personal. En, analizamos que, para conocer el dolor tenemos que tomar en consideración experiencias subjetivas. Razón por la cual la naturaleza del dolor es esquiva y tenemos que repensar constantemente su significado; al igual que los retos que deben afrontar la ciencia y la filosofía del dolor. Nuestra (...) conclusión sobre esta cuestión, es que la pregunta por el dolor requiere dos esfuerzos sociales: empatía y colaboración. A partir do século XVIII, a imposição do controle das principais instituições políticas e sociais à população passa a ocorrer precipuamente por meio de estratégias urbanísticas. A arquitetura revela o objetivo de disciplinamento dos corpos de modo a prepará-los para a inserção na incipiente sociedade capitalista, seja na forma das escolas, fábricas ou prisões. Objetivamos num primeiro momento refletir, por meio da trajetória histórica e arquitetônica da Biblioteca Pública Municipal de Marília, se a biblioteca antiga tem preponderância de uma instituição (...) disciplinar; para, em um segundo momento, apresentar a arquitetura no novo prédio, verificando se o novo modelo de biblioteca pode evidenciar a transição do modelo disciplinar ao de controle. Metodologicamente, trata-se de uma pesquisa de natureza qualitativa, documental e bibliográfica, na qual utilizamos o método Análise de Conteúdo da Bardin para analisarmos categorias de entrevista. Para tanto, nos valemos um pouco do pensamento de Foucault e Deleuze acerca do tema, bem como o histórico, arquitetura e um pouco da organização das coleções da biblioteca em questão, nos espaços e tempos diferentes. Concluímos que a nova biblioteca não é melhor do que a anterior. Ela apenas se adequa melhor aos ditames dos novos tempos, com novas perspectivas sociais e tecnológicas. A antiga biblioteca teve uma função muito importante na história da cidade e dos seus usuários. Somente não estava mais apropriada ao século XXI, necessitando de novo aspecto e sentido. (shrink)

The status of marijuana as an illegal drug has greatly evolved in recent years. Many countries have decriminalized possession of marijuana for personal use. Others have not decriminalized it but simply “tolerate” it for private personal use. Four countries have passed laws legalizing medical marijuana and one other tolerates the use of marijuana for medical purposes without having legislated a specific right for such possession and use. To date, 17 of the United States and the District of Columbia have also (...) passed laws regarding medical marijuana. However, state medical marijuana laws are at odds with the federal Controlled Substances Act, which prohibits possession of marijuana. This fact, in tandem with employer requirements under the Drug-Free Workplace Act, has created a dilemma for employers who have employees with medical conditions for which medical marijuana has been recommended. Given that 18 additional states currently have medical marijuana legislation pending, medical marijuana in the workplace is an issue which is not going to go away. As a result, it is time to examine the interface between federal and state laws as well as the public policy issues surrounding the lack of rights which medical marijuana patients have in their workplaces. El caso de la realidad virtual patentiza de hecho la habitual asunción de la tecnología como algo ajeno a la producción cultural, humana. Sin embargo, la tecnología comparte nuestros límites y está sometida a nuestro designio, por (...) más que se le quiera asumir independiente de nosotros y por más que se intente reemplazar nuestra interacción con el espacio natural por una relación enteramente controlada en un medio virtual.: The idea of the human being as a technological animal, coupled with the idea of progress as the very foundation of civilization, raises several issues that need to be carefully considered, including the meaning of progress and the meaning and value of technology. The case of virtual reality indeed makes explicit the common assumption of technology as something alien to cultural, human production. However, technology shares our limits and it is subject to our plans, regardless of whether someone insists on assuming it independent of ourselves or insists on replacing our interaction with natural space by an interaction in an entirely controlled virtual environment. ABSTRACT Legislation recently adopted by the United States Congress provides producers of pandemic vaccines with near‐total immunity from civil lawsuits without making individuals injured by those vaccines eligible for compensation through the Vaccine Injury Compensation Program. The unusual decision not to provide an alternative mechanism for compensation is indicative of a broader problem of inconsistency in the American approach to vaccine‐injury compensation policy. Compensation policies have tended to reflect political pressures and economic considerations more than any cognizable set of principles. (...) This article identifies a set of ethical principles bearing on the circumstances in which vaccine injuries should be compensated, both inside and outside public health emergencies. A series of possible bases for compensation rules, some grounded in utilitarianism and some nonconsequentialist, are discussed and evaluated. Principles of fairness and reasonableness are found to constitute the strongest bases. An ethically defensible compensation policy grounded in these principles would make a compensation fund available to all individuals with severe injuries and to individuals with less‐severe injuries whenever the vaccination was required by law or professional duty. Affective computing adopts a computational approach to study affect. We highlight the AC approach towards automated affect measures that jointly model machine-readable physiological/behavioral signals with affect estimates as reported by humans or experimentally elicited. We describe the conceptual and computational foundations of the approach followed by two case studies: one on discrimination between genuine and faked expressions of pain in the lab, and the second on measuring nonbasic affect in the wild. We discuss applications of the measures, analyze measurement accuracy (...) and generalizability, and highlight advances afforded by computational tipping points, such as big data, wearable sensing, crowdsourcing, and deep learning. We conclude by advocating for increasing synergies between AC and affective science and offer suggestions toward that direction. (shrink)

Emotional regularity is the degree to which a person maintains and returns to a set of emotional states over time. The present investigation examined associations between emotional regularity and extant emotion measures as well as psychologically relevant dimensions of personality, health, and real-world occupational outcomes. Participants included 598 U.S. adults who provided daily experience sampling reports on their emotional states for approximately two months. Results suggest that emotional regularity was related to, but distinct from, well-established measures of emotion including emotional (...) intensity, variability, covariation, inertia, granularity, and emodiversity. Furthermore, emotional regularity significantly predicted measures of personality, psychological health, and occupational outcomes even when accounting for extant emotion measures and sociodemographic covariates. Finally, it explained modest (7.5%) improvement (in terms of cross-validated RSq.) over baseline models containing emotional intensity, variability, and sociodemographic covariates. These findings suggest that emotional regularity may provide an important indicator of healthy emotional functioning and may be a promising area for further scientific discovery. (shrink)

We report the results of an experiment designed to determine the effects of psychological proximity—proxied by awareness of pain and friendship—on moral reasoning. Our study tests the hypotheses that a moral agent’s emphasis on justice decreases with proximity, while his/her emphasis on care increases. Our study further examines how personality, gender, and managerial status affect the importance of care and justice in moral reasoning. We find support for the main hypotheses. We also find that care should be split into two (...) components, one related to protection and the other to the preservation of relationships. Although gender does not affect moral reasoning directly, we find that it does so indirectly via personality, controlling for age, professional status, and professional background. We do not find a significant effect of managerial status on ethics of justice, but do find that holding a managerial position has a negative impact on ethics of care. Regarding personality, we detect significant positive effects of conscientiousness on ethics of justice and of neuroticism on ethics of care. (shrink)

The currently leading cognitive theory of consciousness, Global Workspace Theory,1,2 postulates that the primary functions of consciousness include a global broadcast serving to recruit internal resources with which to deal with the current situation and to modulate several types of learning. In addition, conscious experiences present current conditions and problems to a "self" system, an executive interpreter that is identifiable with brain structures like the frontal lobes and precuneus.1Be it human, animal or artificial, an autonomous agent3 is said to be (...) functionally conscious if its control structure (mind) implements Global Workspace Theory and the LIDA Cognitive Cycle, which includes unconscious memory and control functions needed to integrate the conscious component of the system. We would therefore consider humans, many animals4 and even some virtual or robotic agents5,6 to be functionally conscious. Such entities may approach phenomenal consciousness, as found in human and other biological brains, as additional brain-like features are added.Here we argue that adding mechanisms to produce a stable, coherent perceptual field7 in a LIDA controlled mobile robot might provide a small but significant step toward phenomenal consciousness in machines.>8 We also propose that implementing several of the various notions of self in such a LIDA controlled robot may well prove another step toward phenomenal consciousness in machines. The author critiques the expedient application of market valuation principles by the transnational corporations and other large firms in the Indian pharmaceutical industry on a number of issues like patents, pricing, irrational drugs, clinical trials, etc. He contends that ethics in business is chiseled and etched within the confines of particular social structures of accumulation. An ascendant neo-liberal social structure of accumulation has basically shaped these firms' sharp opposition to the Indian Patents Act, 1970, government administered pricing, etc. The author (...) contends that the practice of neo-liberal economics is strongly associated with a "one dimensional" ethics that privileges market valuation principles over all others. This seems to inevitably generate a social counter-movement that struggles for social protections. He critiques neo-liberal business practices from a perspective that derives from the work of the economic anthropologist Karl Polanyi. Before the present phase of liberalization in India, markets were "managed", but without a "welfare state" in place. Moving toward deregulation of the markets without a welfare state in place is unethical. Keeping the debilities of the institutional framework of public policy in mind, the author adopts a Polanyian perspective that places its trust and hope in the growing social legitimacy of the counter-movement in opposition to both neo-liberal business practices and the degenerate behavior of state agencies. Este artigo tem como objetivo analisar a Sociologia do Direito de Jürgen Habermas, mostrando a centralidade do direito na sua teoria da ordem social. Como sociólogo formado na tradição alemã de grandes sínteses filosóficas, Habermas, em seu livro " Direito e Democracia – Entre facticidade e validade ", que nos guiará neste artigo, descreve o objetivo ambicioso de produzir uma teoria geral da ação social à maneira de Parsons. Em sua explicação sobre a natureza das sociedades, o direito positivo é (...) entendido como uma linguagem estabilizadora das interações sociais tendo o importante papel de estruturar a ordem social. Celebrado entre os juristas, o entendimento completo das proposições de Habermas requer conhecimento amplo e crítico das teorias sociológicas sobre a natureza da ordem social. Muitas vezes secundarizado por sociólogos, especialmente os tradicionalistas e conservadores, o autor promove um entendimento das normas legais como um processo dialógico e multideterminado, que não é apenas um reflexo das relações sociais, mas que também estabelece parâmetros para a composição de conflitos inerentes às interações sociais. The use of brain imaging technology as a common tool of research has spawned concern and debate over how investigators should respond to incidental fndings discovered in the course of research. In this article, we argue that investigators have an obligation to respond to incidental fndings in view of their entering into a professional relationship with research participants in which they are granted privileged access to private information with potential relevance to participants' health. We discuss the scope and limits of (...) this professional obligation to respond to incidental fndings, bearing in mind that the relationship between investigators and research participants differs fundamentally from the doctor-patient relationship. Adolescent gender-based violence prevention and sexuality education is a topic of current concern given the increasing numbers of violence directed at girls. International organizations indicate that one in three girls aged 15 to 19 have experienced gender-based violence in their sexual relationships that this risk may be as much as 3–4 times higher for girls with disabilities. Following the good results obtained in the research project “Free_Teen_Desire” led by the University of Cambridge and funded by the Marie Curie Actions Program (...) in the prevention of gender violence in adolescents through Dialogic Feminist Gatherings (DFG), the aim of study is to analyze Its transfer and impact on adolescent girls with intellectual disabilities. The DFGs are here understood as generators of a more dialogic environment for girls in general and we wonder if and how It is extended to the context of girls with disabilities. Thus, the research takes the form of a case study with a communicative approach on a DFGs. The intervention is carried out in a special school located in Valencia during the 2018–2019 and 2019–2020 academic years with a group of 19 non-mixed female students, female teachers, and the mother of one of the students. The study analyzes which are the transfer criteria to incorporate the DFGs in a special education context and what is their impact on the prevention of gender violence in girls with disabilities. The data collection techniques consist of two in-depth interviews, analysis of the field diary of 24 intervention sessions and a focus group with seven teachers. It is demonstrated that DFGs are successfully transferred to the special education context of the case study. The results show how contexts of safety, solidarity and friendship are generated which protect adolescent girls with disabilities from relationships with gender violence. (shrink)

Este trabalho pretende confrontar as concepções teóricas das análises sociológicas tradicionais sobre a “ordem social”, as quais chamaremos de “sensualistas” - por pressuporem uma ordem social naturalizada, com as teorias cognitivistas que veem a “ordem social” como construção teórico-intelectiva dos indivíduos. Nossa expectativa é que essa discussão nos auxilie a entender o contexto atual da emergência de movimentos políticos radicalizados, não importa por qual matiz ideológico, e o risco real e a ameaça potencial que eles representam para a estabilidade dos (...) consensos tácitos assumidos pelos agentes na ordem social, tais como as noções de justo e injusto, certo e errado, bem e mal. Esperamos que a discussão sobre os fundamentos da ordem social, na forma colocada pelos cientistas sociais, se apodícticos e factuais ou cognitivos e racionais, ajude-nos a esclarecer até que ponto o radicalismo político, e os radicalismos de maneira geral, seja religioso, moral, bem como as ameaças de diáspora que os acompanham, têm o potencial de impor revezes ao que alguns analistas costumam chamar de “marcos civilizatórios”. Até que ponto, o extremismo político tem condições de impor perturbações de natureza moral aos pactos sociais ameaçando-os real e massivamente. (shrink)
