In his invited essay for Business & Society’s 60th anniversary, Archie B. Carroll (2021, p. 16) refers to human rights as “a topic that holds considerable promise for CSR [corporate social responsibility] researchers in the future.” The objective of this article is to unpack this promise. We (a) discuss the momentum of business and human rights (BHR) in international policy, national regulation, and corporate practice, (b) review how and why BHR scholarship has been thriving, (c) provide a conceptual framework to (...) analyze how BHR and corporate social responsibility (CSR) relate to each other, and (d) provide a research agenda outlining how BHR can expand business and society scholarship in general and one of its foundational constructs, CSR, in particular, beyond the current confines of the business and society field. Warning research participants and patients about potential risks associated with participation/treatment is a fundamental part of consent. However, such risk warnings might cause negative expectations and subsequent nocebo effects (i.e., negative expectations cause negative outcomes) in participants. Because no existing review documents how past research has quantitatively examined nocebo effects – and negative expectations – arising from consent risk warnings, we conducted a pre-registered scoping review (N = 9). We identified several methodological issues across these studies, which in addition to (...) mixed findings, limit conclusions about whether risk warnings cause nocebo effects. (shrink)

I’d like to start by thanking all those who’ve played a part in making this conference such a success, including all the readers who helped us decide which papers to include, Jane (McIntyre) who chaired the Reading Committee, and especially Tony (Pitson), who organized the splendid local arrangements here in Stirling. Compared to Jane and Tony, I’ve had it relatively easy. Though I proposed, back at Lancaster in 1989, that this year’s conference should be mainly focused on the first (...) Enquiry on its 250th anniversary, and originally planned to host it in Leeds, the last few years have been so horrendously busy and stressful for me that I would have found it very hard to cope as local organizer. This essay is my review of the classic TV series, Route 66. It was a classic “buddy movie,” with two young men who tour the country in a gorgeous 1956 Chevy Corvette, staying in various towns and working at various blue-collar jobs. The acting was generally superb, and the scripts were mainly written by the fine script writer Stirling Silliphant, and produced by the famous producer Herbert Leonard. I suggest that this 50-year-old series tells us a lot about cultural (...) change in America during that time. I suggest also that it helps demonstrate that the charge made by a famous cultural critic of the time—Newton Minow, who was Chairman of the Federal Communications Corporation from 1961 to 1963—that this period of commercial TV was a “vast wasteland” was not merely arrogantly elitist, but was in fact patently false. The 1950s and early 1960s saw many amazingly good series in a wide variety of genres. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:76 AN UNNOTICED ERROR IN HUME'S TREATISE "...the conformity between love and hatred in the agreeableness of their sensation makes them always be excited by the same objects..." Treatise, Book II, Part II, Sec. X. This passage from Hume's A Treatise of Human Nature is taken from the first edition of 1739. It can also be found in the Everyman Edition, the editions of Selby-Bigge Mossner, and Green and (...) Grosse, without editorial comment of any kind. Yet it contains a glaring and obvious error. The most superficial reading of Book II will convince one that it is love and pride that conform in the agreeableness of their sensation they are both indirect passions that aire pleasant in feeling. On the other hand, humility and hatred share in being disagree able or unpleasant impressions. This might have been a printer's error, or Hume's own mistake, and the reason for it is not hard to find. This part of Book II was called "Of love and hatred" ; the expression "love and hatred" recurs several times throughout the whole. In ei»ther the writing of the manuscript or the type setting of the text, a habit was established. Habit, which Hume himself used to explain so much else, must here be cited as the explanation of this slip. What is more interesting is the reason why such an obvious error has gone so long unnoticed. Here an ambiguity in Hume's use of the word "object" should be noticed. It is sometimes used simply as a synonym for "thing" and this is the usage in "excited by the same objects". Hume is merely saying that love and pride have the same sorts of cause. When this cause is found in oneself it leads to pride and when in another it leads to love. This of course is connected with the fact that both these passions are aggreeable or pleasant in sensation. 77 "Object" also has a special technical use in Book II when it refers to the person towards whom the passion is directed, as in "the object of the passion". Now love and hatred do have a similar sort of object, i.e. another person, whereas the object of pride and humility is, according to Hume, always oneself. In this usage, the object of a passion is carefully distinguished by Hume from its cause. It is possible that a careless and superficial reading of this passage might lead one to think that Hume meant to say that love and hatred agree in having the same sort of object, i.e. another person. Such inattention is to be deplored, but after all, until very recently, such inattention was typical of the attitude of philosophers towards Book II 2 as a whole. D. W. D. All subsequent English Hegelians were more or less influenced by this eloquent and enthusiastic manifesto. Although later generations were sometimes repulsed by the romanticism of this first adept, they were persuaded that something great could be recognized in Hegel's rational theology. Indeed, I believe this theology attracted the English mind much more than did Kant's critical and negative attitude towards "natural theology." Stirling with his alarming and agitating proselytism awakened Hegelianism on the foreign soil; indeed, he eventually created a (...) new type of English thought, more metaphysically minded than any of the typically English philosophers of modern times. Before examining de Moivre's contributions to the science of mathematics, this article reviews the source materials, consisting of the printed works and the correspondence of de Moivre, and constructs his biography from them. The analytical part examines de Moivre's contributions and achievements in the study of equations, series, and the calculus of probability. De Moivre contributed to the continuing development from Viète to Abel and Galois of the theory of solving equations by means of constructing particular equations, the roots of (...) which can be written in the form $$\sqrt[n]{{a + \sqrt b }} + \sqrt[n]{{a - \sqrt b }}$$. He also discovered the reciprocal equations. In the course of this work de Moivre discovered an expression equivalent to (cos α+i sin α) n =cos n α+i sin n α and, following Cotes, he succeeded in expressing the nth roots of unity in trigonometric form. In the theory of series, de Moivre developed a polynomial theorem encom-passing Newton's binomial theorem and, in particular, a theorem of recurrent series useful in the calculus of probability. The demands of the calculus of probability led de Moivre to an approximation for the binomial coefficients $$\left( {_m^n } \right)$$ for large values of n. The interaction between de Moivre and James Stirling, particularly in regard to the asymptotic series for log (n!), is treated at length. This work supplied the foundation for de Moivre's limit theorem for the binomial distribution. The calculus of probability, which occupied him from 1708 onward, became in time ever more the center of de Moivre's inquiries. Proceeding from contemporary collections of gambling exercises, de Moivre, by introducing an explicit measure of probability for the so-called Laplace experiments, found the beginnings of a theory of probability. De Moivre expanded the classic application of probability calculus to games of chance by addressing himself to the problem of annuities and by adopting Halley's work with its conception of “Probability of life”. De Moivre was the first to publish a mathematically formulated law for the decrements of life derived from mortality tables. (shrink)

The original Specker–Blatter theorem (1983) was formulated for classes of structures $\mathcal {C}$ of one or several binary relations definable in Monadic Second Order Logic MSOL. It states that the number of such structures on the set $[n]$ is modularly C-finite (MC-finite). In previous work we extended this to structures definable in CMSOL, MSOL extended with modular counting quantifiers. The first author also showed that the Specker–Blatter theorem does not hold for one quaternary relation (2003).If the vocabulary allows a constant (...) symbol c, there are n possible interpretations on $[n]$ for c. We say that a constant c is hard-wired if c is always interpreted by the same element $j \in [n]$. In this paper we show: (i)The Specker–Blatter theorem also holds for CMSOL when hard-wired constants are allowed. The proof method of Specker and Blatter does not work in this case.(ii)The Specker–Blatter theorem does not hold already for $\mathcal {C}$ with one ternary relation definable in First Order Logic FOL. This was left open since 1983.Using hard-wired constants allows us to show MC-finiteness of counting functions of various restricted partition functions which were not known to be MC-finite till now. Among them we have the restricted Bell numbers $B_{r,A}$, restricted Stirling numbers of the second kind $S_{r,A}$ or restricted Lah-numbers $L_{r,A}$. Both rhetoric and dialectic belong to no definitive science. They treat those things that come within the purview of all human beings. As an antistrophes to dialectic, rhetoric concerns particular cases and "may be defined as the faculty [dynamis] of (...) observing in any given case the available means of persuasion" (1355b). Dialectic concerns reasoning on general issues and in its generality it is like deduction. But unlike deductive demonstration, dialectic, as Aristotle says in Topics, "reasons from reputable opinions," rather than from premises that are true and primitive (100a).Kant in the Critique of Pure Reason takes a more extreme view of dialectic than Aristotle. Kant regards dialectic as a logic of illusion (Schein) that occurs when reason takes its powers beyond experience to make claims concerning the nature of the soul, world, and God. When reason attempts to determine the nature of what the soul is in itself, its assertions end in paralogisms; when it does so about the world its claims end in antinomies; and when it does so about God its efforts end in the impossibilities of the ontological, cosmological, and teleological arguments. Kant regards rhetoric as having no role in the philosophical pursuit of truth. In the Critique of Judgment Kant classifies rhetoric (Beredsamkeit) as belonging [End Page 203] to fine art. He regards ars oratoria as an art of manipulation and deception that achieves its end by a beautiful show (Schein) of speech that plays upon human weaknesses. He says oratory deserves no respect whatsoever—"ist gar keiner Achtung würdig" (1951, 172n50; 1974, 185n).1 Kant's exclusion of rhetoric from Kritik (with which he identifies philosophy) establishes the general exclusion of rhetoric in the development of philosophical idealism.Hegel interpretation for a century and a half presumed that rhetoric was irrelevant to understanding Hegel's thought. It considered Hegel's dialectic as a method independent of any connection to rhetoric. The first book on Hegel in English, James Hutchinson Stirling's The Secret of Hegel, published in 1863, regards the key to Hegel's system as his formulation of the concrete universal (Begriff). Smith's The Spirit and Its Letter: Traces of Rhetoric in Hegel's Philosophy of "Bildung" (1988).2 Verene's work showed that there is a dialectic between image (Bild) and concept (Begriff) within Hegel's mode of expression that provides the reader with a necessary means of access to the work. Smith's study showed not only that Hegel employs rhetorical principles in the composition of the Phenomenology but that Hegel in his early years studied rhetoric closely and was concerned to master it. Smith's work, although developed independently of Verene's, joined with it to present a new reading of Hegel. This poetical and rhetorical grasp of Hegel's thought has been recently restated in Verene's Hegel's Absolute (2007).My views that follow begin where Verene's and Smith's accounts leave off. No crucial experiment demonstrates that four hue categories are needed to describe color appearance. Instead, converging lines of evidence suggest that the terms red, yellow, green, and blue are sufficient and precise enough for deriving color discrimination functions and for a useful model constraining relations between color appearance and neuronal responses. Such a model need not be based on linguistic universals. Until something better is available, this holds.

ABSTRACT Despite Institutional Review Board concerns about psychological harm arising from research participation, evidence from trauma-questionnaire research suggests that participation is typically well-tolerated by participants. Yet, it is unclear how participant experiences of in-lab trauma simulations align with IRB ethical guidelines. Thus, we compared reactions to a trauma film paradigm with reactions to a positive film task or cognitive tasks. Overall, relative to other conditions, the trauma film was well-tolerated by participants: they generally reported low-to-moderate negative emotions, moderate benefits, and (...) that participation was not worse than everyday stressors. Our results have implications for the research community in designing trauma-based research. (shrink)

Key accomplishments of political corporate social responsibility scholarship have been the identification of global governance gaps and a proposal how to tackle them. Political CSR scholarship assumes that the traditional roles of state and business have eroded, with states losing power and business gaining power in a globalized world. Consequently, the future of CSR lies in political CSR with new global governance forms which are organized by mainly non-state actors. The objective of the paper is to deepen our understanding of (...) political CSR and reintegrate notions of state power into political CSR scholarship by highlighting how states set the context within which business takes place, regulate offshore business practices, and play pivotal roles in new global governance mechanisms. Discursive deference in the governance of science and technology is rebalancing from expert analysis toward participatory deliberation. Linear, scientistic conceptions of innovation are giving ground to more plural, socially situated understandings. Yet, growing recognition of social agency in technology choice is countered by persistently deterministic notions of technological progress. This article addresses this increasingly stark disjuncture. Distinguishing between “appraisal” and “commitment” in technology choice, it highlights contrasting implications of normative, instrumental, and substantive imperatives in appraisal. Focusing on the role of (...) power, it identifies key commonalities transcending the analysis/participation dichotomy. Each is equally susceptible to instrumental framing for variously weak and strong forms of justification. To address the disjuncture, it is concluded that greater appreciation is required—in both analytic and participatory appraisal—to facilitating the opening up of governance commitments on science and technology. This case study discusses the economic, legal, and ethical considerations for conducting clinical trials in a controversial context. In 2010, pharmaceutical giant Roche received a shame award by the Swiss non-governmental organization Berne Declaration and Greenpeace for conducting clinical trials with organs taken from executed prisoners in China. The company respected local regulations and industry ethical standards. However, medical associations condemned organs from executed prisoners on moral grounds. Human rights organizations demanded that Roche ended its clinical trials in China immediately. (...) Students are expected to review the economic and ethical issues regarding the outsourcing of clinical trials to controversial human rights contexts, and discuss how to make business decisions when there are conflicts between making profit and ethical considerations. Was Roche complicit in the human rights violations that were related to its clinical trials? Future patients might benefit from these clinical trials. During the last years, there has been an increasing discussion on the role of business in human rights violations and an increase in human rights litigation against companies. The result of human rights litigation has been rather disillusioning because no corporation has been found guilty and most cases have been dismissed. We argue that it may nevertheless be a useful instrument for the advancement of the business and human rights agenda. We examine the determinants of successful human rights litigation in (...) terms of judicial, educational, and regulatory effects. This article reviews more than 40 corporate foreign direct liability cases and their effects on corporate human rights policies and conduct. The review shows that most corporations adjusted their human rights policies and adopted additional measures to cope with human rights issues during or shortly after the legal proceedings. Opening legal channels for human rights litigation may be one way for governments to incentivize firms to respect human rights. These findings have implications for the United Nations Guiding Principles on Business and Human Rights as well as on our interpretation of the most recent U.S. Supreme Court decision in Kiobel v.
