An introductory level text designed to explain and review basic ideas concerning the role of law in society. Assuming no previous knowledge of the field, the volume examines the theoretical and empirical dimensions of law in society from political, sociological, psychological and philosophical perspectives.

This paper elucidates the sense in which belief is a question-settling attitude. In her recent work, Jane Friedman suggests that we understand the settledness of belief in terms of a normative principle about belief and inquiry: one ought not inquire into a question and believe the answer to the question at the same time. On the basis of the distinction between dispositional and occurrent belief, I argue against Friedman that there is no principle linking belief and inquiry that is both (...) plausible and normative: on the dispositional reading of ‘belief’, such a principle is implausible; on the occurrent reading of ‘belief’, such a principle is not normative. I argue instead that the settledness should be understood as a descriptive relation between occurrent belief and inquiry: one cannot inquire into whether p while at the same time occurrently believing that p. The relative merits and demerits of historically prominent views such as the correspondence theory, coherentism, pragmatism, verificationism, and instrumentalism have been subject to much attention in the truth literature and have fueled the long-lived debate over which of these views is the most plausible one. While diverging in their specific philosophical commitments, adherents of these historically prominent views agree in at least one fundamental respect. They are all alethic monists. They all endorse the thesis that there is only one property (...) in virtue of which propositions can be true, and so, in this sense, take truth to be one. The truth pluralist, on the other hand, rejects this idea. There are several properties in virtue of which propositions can be true. The literature on truth pluralism has been growing steadily for the past twenty years. This volume, however, is the first of its kind—the first collection of papers focused specifically on pluralism about truth. Part I is dedicated to the development, investigation, and critical discussion of different forms of pluralism. An additional reason to look at truth pluralism with interest is the significant connections it bears to other debates in the truth literature—the debates concerning traditional theories of truth and the deflationism/inflationism divide being cases in hand. This paper deals with the identity problems of fictional objects, focusing on Anthony Everett's and Stuart Brock's leading criticisms against fictional creationism, the view that fictional objects are abstract objects created by our acts involving literary practices. My primary aim is to argue that creationism based on referentialism has enough resources to individuate fictional objects and hence can address the alleged identity problems: every alleged problematic case regarding the identity of fictional objects is well explained in terms of the notions (...) of authorial intention, gappy proposition, inadvertent creation, and reference shift. I defend the position argued previously by Germain Grisez and me that total brain death is a valid criterion of death on the grounds that a human being is essentially a rational animal, and a brain-dead body lacks the radical capacity for rational actions. I reply to Josef Seifert’s objection that our positions rest on a reductionist view of the human person, and to other objections concerning the inter-relation between the human soul, its powers, and functions of the brain. We argue that all human beings have a special type ofdignitywhich is the basis for (1) the obligation all of us have not to kill them, (2) the obligation to take their well‐being into account when we act, and (3) even the obligation to treat them as we would have them treat us, and indeed, that all human beings areequalin fundamental dignity. We give reasons to oppose the position that only some human beings, because of their possession of certain characteristics (...) in addition to their humanity (for example, an immediately exercisable capacity for self‐consciousness, or for rational deliberation), have full moral worth. What distinguishes human beings from other animals, what makes human beingspersonsrather thanthings, is their rational nature, and human beings are rational creatures by virtue of possessing natural capacities for conceptual thought, deliberation, and free choice, that is, the natural capacity to shape their own lives. On an increasingly popular view of rationality, rationality is fundamentally about responding correctly to reasons and there is no independent rational requirement to avoid incoherence: having an incoherent combination of attitudes is irrational not because there is a fundamental requirement of rationality that prohibits it, but rather because you are guaranteed to fail to respond correctly to reasons in having it. This paper argues that any such attempt to explain the irrationality of incoherence in terms of responsiveness to reasons fails. (...) For there is something distinctively irrational about incoherence that is not explained in terms of the guaranteed failure to respond to reasons. Any adequate account of the nature of coherence requirements on belief and intention should take into account the distinctive kind of commitments involved in each type of attitude. A Lockean metaphysics of belief that understands outright belief as a determinable with degrees of confidence as determinates is supposed to effect a unification of traditional coarse-grained epistemology of belief with fine-grained epistemology of confidence. But determination of belief by confidence would not by itself yield the result that norms for confidence carry over to norms for outright belief unless belief and high confidence are token identical. We argue that this token-identity thesis is incompatible with the neglected phenomenon of “mistuned (...) knowledge” – knowledge in the absence of rational confidence. We show how partial epistemological unification can be secured, even without token identity, given determination of outright belief by degrees of confidence. Finally, we suggest a direction for the pursuit of thoroughgoing epistemological unification. (shrink)

A growing body of research highlights that adults with autism spectrum disorder have poor health outcomes, yet effective health interventions are lacking for this population. While mobile health applications demonstrate potential for promoting physical activity in adults with ASD, scientific evidence for supporting this tool’s long-term effectiveness on PA behavior change remains inconclusive. This study aimed to provide the latest information on PA research and the prospective role of mobile health applications for promoting PA in adults with ASD. A literature (...) review demonstrated that a few available studies show contradictory results regarding PA levels in adults with ASD, and behavior change techniques and gamification-guided mobile health applications can be promising tactics to leverage autism’s strengths and increase PA in these individuals. Optimizing design decisions based on needs analysis and user feedback is crucial to identifying and developing a sustainable mobile health intervention for PA promotion in adults with ASD. (shrink)

Several attempts have recently been made to explain moral systems and moral sentiments in light of evolutionary biological theory. It may be helpful to modify and extend this project with the help of a theory of communication developed by ethologists. The core of this approach is the idea that signals are best seen as attempts to manipulate others rather than as attempts to inform them. This addition helps to clarify some problematic areas in the evolutionary study of morals, and it (...) generates new, testable predictions about moral statements. (shrink)

Recent developments in the literature suggest cognitive representation can be conceived of as a kind of mechanism that meets the functional profile set out by the S-representation account. However, this approach is threatened by worries that the S-representation account cannot tell a satisfactory story about content determination at the subpersonal level. One solution is to complement the S-representation account with a traditional etiological theory of content determination. This paper argues such a move is unwarranted and threatens the broader project of (...) understanding representation in mechanism-friendly terms. Once properly situated within a mechanistic framework, the S-representation account can address the issue of content determination without supplementing it with an etiological theory. In turn, this strengthens the notion that combing a mechanistic framework with the S-representation account provides a robust and comprehensive defense of representation’s positive role in cognitive science. For over one hundred and fifty years G.W.F. Hegel’s ghost has haunted theoretical understanding and practice. His opponents first, and later his defenders, have equally defined their programs against and with his. In this way Hegel’s political thought has both situated and displaced modern political theorizing. This book takes the reception of Hegel’s political thought as a lens through which contemporary methodological and ideological prerogatives are exposed. It traces the nineteenth century origins of the positivist revolt against Hegel’s legacy forward (...) to political science’s turn away from philosophical tradition in the twentieth century. The book critically reviews the subsequent revisionist trend that has eliminated his metaphysics from contemporary considerations of his political thought. It then moves to re-evaluate their relation and defend their inseparability in his major work on politics: the_ Philosophy of Right_. Against this background, the book concludes with an argument for the inherent metaphysical dimension of political theorizing itself. Goodfield takes Hegel’s reception, representation, as well as rejection in Anglo-American scholarship as a mirror in which its metaphysical presuppositions of the political are exceptionally well reflected. It is through such reflection, he argues, that we may begin to come to terms with them. The ' argument from queerness', made famous by J. L. Mackie, remains one of the most influential arguments in metaethics. However, many philosophers focus on just one or two of its strands, while others assume a particular but by no means universal reading of it. This essay attempts to disentangle and evaluate all strands of the argument. Surprisingly, when this is done, not much is left as a distinct argument from queerness. Much of the argument collapses into other types of (...) argument, and what is left, though intuitively appealing, is not viable as philosophical argument. (shrink)

I argue that high level causal relationships are often more fundamental than low level causal relationships. My argument is based on some general principles governing when one causal relationship will metaphysically ground another—a phenomenon I term derivative causation. These principles are in turn based partly on our intuitive judgments concerning derivative causation in a series of representative examples, and partly on some powerful theoretical considerations in their favour. I show how these principles entail that low level causation can derive from (...) high level causation, and in particular that neural causation can derive from mental causation. I then draw out several important consequences of this result. Most immediate among these are the implications the result has for aspirations to reduce high level causation to its low level counterpart. But the result also bears on the possibility of downward causation, the relationship between counterfactuals and causation, and the idea—familiar from both the literature on the exclusion problem and the literature on proportionality constraints on causation—that causal relationships at different levels compete for their existence. This study examines why individuals who are deeply embedded in the organization may engage in unethical pro-organizational behavior (UPB). Drawing from social identity theory and self-affirmation theory, we propose that deeply embedded employees may engage in UPB as a way of promoting or maintaining their status in the organization. We further propose that this positive relationship between organizational embeddedness and UPB, mediated through status perceptions, is stronger for employees working under managers who display low levels of ethical leadership. Using data (...) gathered in a two-wave survey from 224 working adults, the results of the study lend support for the hypothesized relationships and remained significant even after controlling for affective commitment. The study advances our understanding of both contextual and individual factors motivating employees to engage in UPB and the boundary conditions under which UPB can be reduced. (shrink)

Experimental work has revealed causal links between physical cleansing and various psychological variables. Empirically, how robust are they? Theoretically, how do they operate? Major prevailing accounts focus on morality or disgust, capturing a subset of cleansing effects, but cannot easily handle cleansing effects in non-moral, non-disgusting contexts. Building on grounded views on cognitive processes and known properties of mental procedures, we proposegrounded proceduresof separation as a proximate mechanism underlying cleansing effects. This account differs from prevailing accounts in terms of explanatory (...) kind, interpretive parsimony, and predictive scope. Its unique and falsifiable predictions have received empirical support: Cleansing attenuates or eliminates otherwise observed influences of prior events (1) across domains and (2) across valences. (3) Cleansing manipulations produce stronger effects the more strongly they engage sensorimotor capacities. (4) Reversing the causal arrow, motivation for cleansing is triggered more readily by negative than positive entities. (5) Conceptually similar effects extend to other physical actions of separation. On the flipside, grounded procedures ofconnectionare also observed. Together, separation and connection organize prior findings relevant to multiple perspectives (e.g., conceptual metaphor, sympathetic magic) and open up new questions. Their predictions are more generalizable than the specific mappings in conceptual metaphors, but more fine-grained than the broad assumptions of grounded cognition. This intermediate level of analysis sheds light on the interplay between mental and physical processes. (shrink)

The idea of human-like robots with artificial intelligence (AI) engaging in sports has been considered in the light of robotics, technology and culture. However, robots with AI can also be used to clarify ethical questions in sports such as boxing with its inherent risks of brain injury and even death.This article develops an innovative way to assess the ethical issues in boxing by using a thought experiment, responding to recent medical data and overall concerns about harms and risks to boxers. (...) The thought experiment imagines a fight between a human and a robot. Critical issues about head trauma and brain injuries are then discussed. These can be summed up in two ethical questions: ‘why is it acceptable for a boxer to deliver concussive and recurrent subconcussive punches to a human head (skull and brain), powerful enough to achieve a knockout, or score more points, or to potentially inflict an injury immediately or eventually resulting in death?’, with the reciprocal question, ‘why is it acceptable to allow oneself to be injured in a like manner, possibly fatally, by an opponent?’The two questions are explored using the thought experiment in two matching perspectives: where the human boxer is attacking and the robot boxer is defending; and conversely, where the human boxer is on the receiving end of punches delivered by the robot. Each perspective opens with some general remarks, followed by an analysis of the boxing contest and eliciting some implications for future opportunities for the sport. (shrink)

My aim in this paper is to contribute to the substantial body of feminist scholarship on the place of women in Aristotle’s psychic and political hierarchy. Whereas the traditional point of departure for such analyses is more typically Aristotle’s Politics, mine is his hylomorphic or organizational/ecological account of what defines a living thing and its powers in de Anima. My primary claim is that although his de Anima account does offer a more promising view of what defines particular kinds of (...) living things, including human beings qua the power of intellection, it does not ultimately save him from the ambiguity endemic to his account of women’s capacity to deliberate in his Politics. Such a result is significant for feminists who, in seeking nondualistic accounts of embodied human existence, have sometimes turned to Aristotle’s hylomorphism for support, but, I suggest, might be better off to seek such support elsewhere. Leibniz's views on divine concurrence have presented interpreters with great difficulty. On the one hand, Leibniz thought that creatures have genuine causal powers, causing their own states. But he also believed that God is immediately involved in every aspect of the world by endorsing the 'conservation is but continuous creation' thesis . Accordingly, when faced with the question of how divine and creaturely causality relate, Leibniz held that God and creatures concur. It is not obvious, however, how this 'concurrence' is (...) supposed to work or even whether these two commitments can be consistently maintained. ;The key challenge comes from Malebranche who argues, rather persuasively, that occasionalism follows from CCC. Leibniz, thus, needs to avoid this inference if he is to maintain real forces in creatures. In chapter two, I show how he avoids the inference by holding a restricted version of CCC. I go on to propose that Leibniz's account of concurrence is basically a cooperation model, in which God produces the modifications of creatures in accordance with the reasons presented within each creature's nature. Though God is the sole efficient cause, the creature contributes and acts in the form of rational determination, i.e., it determines which particular modification God is to produce. ;This proposal raises the worry that Leibnizian reasons are uncomfortably similar to Malebranchean occasions. In chapter three, I examine Leibniz's own attempts to distance himself from occasionalism but argue that whatever the merits of these arguments are they fall short of addressing this problem. ;Chapter four concentrates on this issue of distinguishing reasons and occasions. I argue that their core difference lies in that Leibnizian reasons demand, unlike Malebranchean occasions. This demand consists in the creature's states having an intrinsic value and this inherent goodness accounts for why they function as reasons behind God's decision to act. Furthermore, reasons as such motivate but do not necessitate and this motivating power of the goodness of reasons is a genuine power for Leibniz. For Malebranche, however, that which does not necessitate is not a cause and I conclude that this is the core difference between Leibniz and Malebranche. (shrink)

The Precautionary Principle is typically construed as a conservative decision rule aimed at preventing harm. But Martin Peterson (JME 33: 5–10, 2007; The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, Oxford, 2017) has argued that the principle is better understood as an epistemic rule, guiding decision-makers in forming beliefs rather than choosing among possible acts. On the epistemic view, he claims there is a principle concerning expert disagreement underlying precautionary-based reasoning called the ecumenical principle: (...) all expert views should be considered in a precautionary appraisal, not just those that are the most prominent or influential. In articulating the doxastic commitments of decision-makers under this constraint, Peterson precludes any probabilistic rule that might result in combining expert opinions. For combined or consensus probabilities are likely to provide decision-makers with information that is more precise than warranted. Contra Peterson, I argue that upon adopting a broader conception of probability, there is a probabilistic rule, under which expert opinions are combined, that is immune to his criticism and better represents the ecumenical principle. The ICD-11 personality disorder model is the first fully dimensional assessment of personality pathology. It consists of a personality disorder dysfunction-severity dimension, which encompasses both self- and interpersonal dysfunction, and six optional qualifiers for five prominent personality traits—Negative Affectivity, Detachment, Dissociality, Disinhibition, and Anankastia —plus a borderline pattern that is defined by the criteria of DSM-IV borderline PD. This article reports on the development of a new self-report measure to assess self- and interpersonal dysfunction and the five trait qualifiers. It (...) is the first comprehensive measure of the ICD-11 PD model in that it is the only one to include both PD dysfunction-severity as well as trait scales and because it is based on the Clinical Description and Diagnostic Guidelines, which are more detailed than the “statistical” model description that is currently on the ICD-11 website. The authors wrote 992 items and then reduced the pool to 300 items by eliminating redundancy and selecting the consensus best few items for each subconstruct. Data were collected using an online sample of 383 Prolific workers. Using exploratory factor analysis, seven domain scales were developed, each of which contained two to four scales assessing components of the domain. These preliminary scales’ psychometrics were excellent, as were the domains’ and their components’ convergent and discriminant validity, with a few generally minor exceptions. Structural analyses at the component level revealed a three-factor structure consisting of two moderately correlated Internalizing factors, one centered on Self Dysfunction with two NA components and a DSN component and the other on Interpersonal Dysfunction with DET and ANK components; as well as an Externalizing factor with DSL and a DSN component that was uncorrelated with the other two factors. Two aspects of the results in particular are striking: ANK was not the opposite end of a DSN dimension, but rather contributed to an Internalizing Interpersonal Dysfunction dimension and DSN had both an Internalizing and an Externalizing component. Mental toughness (MT) is a key psychological variable related to achievement in performance domains and perseverance in challenging circumstances. We sought to understand the lived experiences of mentally tough high-altitude mountaineers, focusing primarily upon decisions to persevere or abort summit attempts. Phenomenological interviews were conducted with 14 mountaineers including guides, expedition leaders, and doctors (Mage = 44 years). A content analysis was employed to identify key themes in the data. Participants emphasized the importance of MT in extreme environments and described (...) rational, flexible, and vigilant decision-making. Turning around without summiting was the toughest decision reported, with recognition of the thin line between persevering and overstretching. In contrast to much MT literature, mountaineers accepted limits, demonstrated restraint, and sacrificed personal goals to aid others. Costly perseverance was also reported with some mountaineers described as “too tough”: overcompetitive, goal-obsessed, and biased decision-makers. These findings revealed both benefits and dangers of MT in mountaineering. (shrink)
