Resumen: El siguiente artículo presenta la formulación del concepto identidad cultural regional, a partir de una selección del aspecto mental de la cultura, lo que dio como resultado una definición discursiva narrativa de identidad cultural regional. Para esto se presentan fundamentos metafísicos, lingüísticos e históricos, y una contextualización compuesta de definiciones de identidad cultural, identidad cultural latinoamericana e identidad cultural regional. Respecto de esta última, se presentan aplicaciones al estudio de la Identidad Cultural de la Región de los Ríos, debido (...) a las características de este territorio como nueva región. El concepto resultante describe el fenómeno como un sentido del ser regional presente en la semiosfera cultural, formando parte de la memoria y del imaginario colectivo, manifestado en el modo de la unidad temática de una narración histórica coherente y ordenada, progresivamente más compleja y heterogénea, que combina la progresión lineal de los subtemas y el tema constante de la identidad cultural regional.: The following article presents the formulation of the concept of regional cultural identity, based on a selection of the mental aspect of culture, which resulted in a narrative discursive definition. For this, metaphysical, linguistic and historical foundations are presented, and a contextualization composed of definitions of cultural identity, Latin American cultural identity and regional cultural identity. Regarding the latter, applications to the study of the Cultural Identity of the Region de los Rios are presented, due to the characteristics of this territory as a new region. The resulting concept describes the phenomenon as a sense of the regional being present in the cultural semiosphere, forming part of the collective memory and imaginary, manifested in the way of the thematic unity of a coherent and ordered historical narrative, progressively more complex and heterogeneous, which combines the linear progression of the subthemes and the constant theme of regional cultural identity. Resumen: Este artículo tiene como propósito interpretar los pensamientos de Karl Jaspers y Martin Heidegger con los parámetros amalgama y sinergia de Cristóbal Holzapfel, y a partir de estos derivar proyecciones hacia la ontoepistemología de las ciencias sociales y humanas. Para esto se lleva a cabo un análisis comparativo entre las principales estructuras existenciales del esclarecimiento existencial presente en "Filosofía II" de Jaspers y la analítica existencial presente en "Ser y tiempo" de Heidegger. A partir de las amalgamas evidenciadas entre (...) ambas analíticas se deducen determinados existenciales que son analizados en su sinergia epistémica y proyectados hacia el esbozo de una posible ontoepistemología con base en las estructuras: concepto de ser humano, relación sujeto-objeto y relación investigador-investigado. Se obtuvo una concepción situada y proyectiva de ser humano, una relación sujeto-objeto como escisión compleja y una relación investigador-investigado fundada en una comunicación existencial enmarcada en la tradición discursiva de su respectiva comunidad semiótica.: This article intends to interpret the thoughts of Karl Jaspers and Martin Heidegger with the parameters amalgam and synergy of Cristóbal Holzapfel in order to propose an ontoepistemology of the social and human sciences. For this objective, a comparative analysis is carried out between the main existential structures of the existential enlightenment present in "Philosophy II" of Jaspers and the existential analytic present in "Being and time" of Heidegger. From the amalgams evidenced between the two analytics, certain existential are deduced that are analyzed in their epistemic synergy and projected towards the outline of a possible ontoepistemology based on the structures: concept of human being, subject-object relationship and researcher-researched relationship. It was obtained a situated and projective conception of the human being, a subject-object relationship as a complex cleavage and a researcher-researched relationship founded on an existential communication framed in the discursive tradition of their respective semiotic community. Academic engagement describes students’ involvement in academic learning and achievement. This paper reports the psychometric properties of the University Student Engagement Inventory (USEI) with a sample of 3992 university students from nine different countries and regions from Europe, North and South America, Africa, and Asia. The USEI operationalizes a trifactorial conceptualization of academic engagement (behavioral, emotional and cognitive). Construct validity was assessed by means of confirmatory factor analysis and reliability was assessed using Cronbach’s alpha and McDonald’s omega coefficients. Weak measurement (...) invariance was observed for country/region, while strong measurement invariance was observed for gender and area of graduation. The USEI scores showed predictive validity for dropout intention, self-rated academic performance, and course approval rate while divergent validity with student burnout scores was also evident. Overall, the results indicate that the USEI can produce reliable and valid data on academic engagement of university students across the world. (shrink)

In the debate between the Historische Rechtschule (Hugo and Savigny) and Hegel about who is legitimately entitled to develop legal theory, the former considered philosophy of law to be inherent to systematic science of law, whereas the latter considered the concept of Law in a necessary transdisciplinary dialectic – there would then be a difference between ‘the jurists’ philosophy of law’ and ‘the philosophers’ philosophy of law’. I will demonstrate that such distinction cannot stand. A ‘jurists’ philosophy of law’ (...) does not exist precisely because legal norms and their application are merely one of the law’s moments. The law’s attitude is one of inclusion: philosophy of law’s disciplinary autonomy occurs in the law’s interdisciplinary immanence. (shrink)

Este ensayo trata de la confrontación entre principios universalistas y particularistas en lo que respecta a la construcción de identidades colectivas y nacionalidades (con especial referencia al Tercer Mundo). Por un lado tenemos los principios universalistas, basados generalmente en el racionalismo clásico y la Ilustración, cuyo representante más conspicuo en el campo de la filosofía comparativa de la historia fue el Marqués de Condorcet. A esta corriente se le puede achacar una equiparación entre ciencias naturales y sociales, un optimismo histórico (...) acrítico y una clara tendencia niveladora y centralizadora. Por otro lado tenemos los principios particularistas, relativistas y parcialmente tradicionalistas, que sostienen la autonomía de las ciencias sociales y que buscan comprender la verdad inherente a las llamadas culturas arcaicas y extra-europeas, mediante un impulso intuitivo y reconstructivo (que contiene aspectos identificatorios y empáticos). Dos de los representantes moderados de esta tendencia son G.B. Vico y J.G. Herder. Mediante una crítica de ambas corrientes el autor cree posible una síntesis fructífera de ambos principios, considerados como complementarios (sobre todo en sus versiones moderadas): la ética universal (en especial los derechos humanos) sería la base para un derecho efectivo a la diferencia. It is still possible to rescue some factors of premodern societies and to blend them with the positive aspects of modernity. The recent alleged doping case of the figure skater Kamila Valieva at the Winter Olympic Games in Beijing 2022 dramatically raised the issue of the protection of minors in anti-doping policy. We firstly present the literature on doping in relation to minors. Secondly, we present WADA’s Protected Person (PP) concept and its implications. Thirdly, we analyse the WADA Code’s purpose and the vulnerability of minors under the Code, and fourthly, we identify the real threats from which minors should be (...) protected by analysing the ineffective PP concept, and showing how it cannot be a real protection. We explain how preventing one threat can generate another, thus converting minor athletes from victims into suspects. We conclude by stressing the necessity for further research, and we indicate our future research direction, towards the development of a much wider concept of protection, and its application into sporting contexts. Trata-se de traçar uma aproximação comparativa entre dois autores oriundos de campos distintos do saber e da cultura e visualizar a mútua contribuição decorrente dessa aproximação, a saber, entre a filosofia de Paul Ricoeur (1913-2005) e o romance de Milan Kundera (1929-). Na medida em que tanto a filosofia de Ricoeur quanto a prosa ficcional de Kundera refletem sobre a constituição da subjetividade na modernidade, a presente contribuição visa estabelecer paralelos entre suas concepções de subjetividade e suas reflexões sobre (...) os destinos da prática da narração ficcional na virada do século. Tendo isso em vista, pretendo realizar uma interpretação comparativa entre as teses de Ricoeur, especialmente apresentadas em Tempo e narrativa e O si-mesmo como outro e as de Kundera, expostas tanto em seus ensaios quanto apresentadas de forma esparsa em digressões reflexivas que permeiam sua prosa romanesca. Meu intuito será mostrar como se diferenciam de forma discreta mas se sintonizam de forma robusta no que concerne a relação entre a constituição da subjetividade, o papel do romance na existência e a imersão desta em enredos historicamente considerados. After two years of discussions and revisions, the World Anti-Doping Agency (WADA) published the 2021 World Anti-Doping Code on June 16, 2020. Among the most significant additions to this iteration of the Code was the inclusion of new categories of athletes subject to differential treatment by WADA, including the “protected person” category. In this paper, we examine the recent case of figure skater Kamila Valeryevna Valieva, the first athlete given differential treatment due to her being categorized as a “protected person.” (...) We apply a relational justice framework to the case to provide a nuanced, descriptive analysis of the case generally, and the application of the “protected person” category in particular.We first describe details of the athlete, her performances and anti-doping rule violation, and the “protected person” category, to provide context. We then describe and analyze the relations between several institutional actors, principally WADA and the International Court for the Arbitration of Sport (CAS), the athlete and her team, and other figure skating athletes at the Beijing Winter Olympic Games. To do so, we use two concepts of justice, conservative and ideal, and their component parts, entitlement, desert, and need.Our description and analyses demonstrate that (1) WADA’s notions of justice are essentially conservative, while CAS acted toward more ideal notions, creating a fundamental disagreement in what was owed and to whom. We show (2) that CAS’ decision may have nonetheless caused harm to the athlete, raising questions about the efficacy and capability of the “protected person” category. Finally, (3) our analyses show the influence that notions of justice necessarily have these actors shape each other, thus change the sporting institutions and activities themselves. (shrink)

One winter morning, the two of us—both postdoctoral fellows in medical humanities and bioethics—gathered with a handful of reproductive science graduate students in the lab to watch a demonstration on making alginate beads. Due to their three-dimensional nature, the beads are capable of holding ovarian follicles—the beads act as though they were a small ovary. The scientists in the lab have managed to mature the follicles maintained in the beads into eggs, fertilize these eggs, and produce the birth of (...) live mice. This research was begun in an effort to develop a means of gathering ovarian follicles from young human cancer patients before they commence cancer treatment that may result in their infertility, thus .. En el artículo se hacen aproximaciones a los enunciados utópicos de una economía para la vida y se determinan las relaciones que establecen los sujetos con las utopías. En el método de análisis se detectan las trascendencias que realizan los sujetos durante el desarrollo del proceso económico. Los resultados señalan que el enunciado utópico general de una economía para la vida es “la vida en la Tierra es vida eterna y plena” (trascendencia general). Los sujetos proyectan cuatro enunciados utópicos específicos (...) (trascendencias parciales) en dicha perspectiva económica, uno de ellos centrado en la satisfacción total de las necesidades físico-biológicas mediante el consumo óptimo de bienes. De este enunciado, que se encuentra inmerso en el campo económico, se derivan otros diez enunciados (trascendencias subparciales) vinculados, a partir de una economía para la vida, con el pleno empleo, con la factibilidad económica y técnica en las producciones y con el ingreso de los sujetos. Las utopías se distorsionan cuando entran al cuadro de la ilusión trascendental; en contraste, obtienen sentido en relación con la vida humana cuando se basan en imaginaciones. (shrink)

En los estudios sobre participación política se observan diferencias tanto conceptuales como metodológicas relativas a su evaluación que afectan la producción del conocimiento en este campo. Tales diferencias configuran un nivel de complejidad mayor cuando refieren a estudios hechos sobre una misma población. Con el fin de evaluar la participación política de la población cordobesa se desarrollaron 7 estudios en un período de 14 años utilizando diferentes innovaciones metodológicas tendientes a mejorar la calidad de los datos y con el propósito (...) de contribuir a la discusión en torno a la evaluación de este constructo de marcada relevancia social y complejidad. Los resultados reportados son consistentes con la tendencia observada en el campo de estudios que sugiere la complejización de la evaluación de este constructo abarcando su intensidad, amplitud y orientación para conocer de modo más preciso su multidimensionalidad. El artículo aborda de modo breve la extensa producción epistemológica y metodológica de Hugo Zemelman. El esfuerzo está centrado en mostrar su potencialidad no como reemplazo de un modo aceptado de hacer investigación científica, sino más bien en valorizar una forma diferente de hacer el recorte del campo de observación y posterior intervención en el mismo. A partir de este objetivo, se revisan categorías relevantes de la propuesta, procurando conformar un “corpus” de conocimiento coherente y pertinente a los fines (...) de comprender el planteo que realiza el autor estudiado.The article briefly summarizes the extensive epistemological and methodological production of Hugo Zemelman. The effort shows its potentiality not as a replacement of an accepted mode of scientific research, but in give value to a different form to make the frame of the observation field and later its intervention. O texto tem por objetivo analisar e desenvolver uma crítica filosófica sobre o sistema capitalista globalizado, que atinge a vida de muitos no mundo todo influenciando não apenas o campo econômico, mas a vida concreta das pessoas, tendo como base teórica pensadores da Escola do DEI, Costa Rica. Trata-se de um processo injusto apadrinhado pelas teorias econômicas e pela realidade da escassez dos bens econômicos, que articula dois polos opostos: um que ao mesmo tempo domina, explora e exige sacrifícios, provoca (...) a adesão e fascínio das pessoas através do consumo de mercadorias; e outro cuja fundamentação mítica impõe como legítimo a exigência de sacrifícios humanos. Ao mesmo tempo que fascina e seduz, envolve a sociedade num caráter sacrifical, sedutor e de injustiça social. Assim, é possível destacar que nem o Estado, nem o mercado se apresentam capazes de evoluir para uma sociedade mais humana, justa e democrática. Atualmente a democracia e a justiça econômica amparam, sobretudo, os favorecidos e satisfeitos, cujo modelo prioriza a política do imediatismo da acomodação do pensamento econômico e político, levando a sociedade à regressão social e antropológica. I argue against the tendency in the philosophy of science literature to link abduction to the inference to the best explanation (IBE), and in particular, to claim that Peireean abduction is a conceptual predecessor to IBE. This is not to discount either abduction or IBE. Rather the purpose of this paper is to clarify the relation between Peireean abduction and IBE in accounting for ampliative inference in science. This paper aims at a proper classification—not justification—of types of scientific reasoning. In (...) particular, I claim that Peireean abduction is an in-depth account of the process of generating explanatory hypotheses, while IBE, at least in Peter Lipton's thorough treatment, is a more encompassing account of the processes both of generating and of evaluating scientific hypotheses. There is then a two-fold problem with the claim that abduction is IBE. On the one hand, it conflates abduction and induction, which are two distinct forms of logical inference, with two distinct aims, as shown by Charles S. Peirce; on the other hand it lacks a clear sense of the full scope of IBE as an account of scientific inference. (shrink)

Emotion regulation is one of the major foci of study in the fields of emotion and emotional development. This article proposes that to properly study emotion regulation, one must consider not only an intrapersonal view of emotion, but a relational one as well. Defining properties of intrapersonal and relational approaches are spelled out, and implications drawn for how emotion regulation is conceptualized, how studies are designed, how findings are interpreted, and how generalizations are drawn. Most research to date has been (...) conducted from an intrapersonal perspective, and the shortcomings of this approach for understanding emotion regulation are highlighted. This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. This commentary defines what shared yet differentiated ethical responsibilities to tackle antimicrobial resistance (AMR) mean, by introducing a threefold principled account of AMR global governance. It argues that the principles of solidarity, subsidiarity, and stewardship can be especially helpful for further justifying some of the universal, differentiated, and individual responsibilities that Van Katwyk et al propose. The upshot of my threefold principled account of AMR global governance is a less ambitious AMR treaty, one that can only justify (i) universal duties (...) of global coordination (as per the principle of solidarity); (ii) differentiated duties to local communities, which bear the primary AMR responsibilities (as per the principle of subsidiarity); and (iii) individualized duties for ensuring truthful, evidence-based, consistent, and timely shared accountable communication (as per the principle of stewardship). This article delves into the philosophical theses on law and ethics as presented by Thomas Hobbes and Immanuel Kant, with a focus on the notion of resistance in a legal context. It contrasts Hobbes’ advocacy for nearly unrestricted state authority and a morality closely tied to the state, against Kant’s emphasis on moral law and natural rights as the underpinnings of legality. A pivotal discussion point is Kant’s perceived contradiction in supporting a fundamental right to freedom while limiting the right (...) to resist laws that infringe upon this freedom. By comparing these philosophical authors, the article posits that Kant’s theory of resistance requires integration with his broader ethical views, suggesting that human rights should constrain positive law. The standard account of the relation between democracy and the rule of law focuses on law’s liberty-enhancing role in constraining official action. This is a faint echo of the complex, constitutive relation between the two. The Greeks used one word – isonomia – to describe both. If democracy is the system in which people have an equal say in determining the rules that govern social life, then the rule (...) of law is simultaneously before, after, concurrent and synonymous with democracy: It contributes to the formation of citizens with the capacity for self-governance, serves as the instrument through which democratic decisions are implemented, functions as one of the central social practices that constitute citizens as equals and addresses the question of how to ensure that government by the people operates for the people. The rule of law has many independently valuable qualities, including impartiality and predictability. But, to valorise the rule of law for its own sake is to fetishize authority. The fundamental values of the rule of law are as the instrument of democratic self-governance and the expression of the equal dignity of all persons. Democracy thus entails the rule of law, but both implicate the yet more comprehensive ideal of equality. Core rule-of-law values require political norms and conditions of equality, generality and comprehensiveness. In a modern, differentiated society, however, the constitutive relation between democracy and the rule of law is fractured and law becomes the agent of authority. Courts in the modern constitutional state have contributed to the decline of rule-of-law values, supporting role specialization through judge-made immunity doctrines that protect officials at all levels. The crisis of police violence against minorities is a symptom of this breakdown. Greater accountability can ameliorate the problem. But an effective solution requires the fair and equal distribution of political power. (shrink)

This paper aims at answering some of the objections to the NIP’s criticism of the idea of rights of future persons. Those objections usually adopt different perspectives depending on how they understand differently the nature of the correlativity between rights and duties – some adopt a present-rights-of-future-persons view, others a future-rights-of-future-persons view, others a transitive present-rights-of-present-persons view, and others still an eternalist view of rights and persons. The paper will try to show that only a non-transitive present-rights-of-present-persons view can survive (...) the challenges posed by the notion of correlativity inherent in the NIP, and thus preserve rights language when discussing the future. This view is proved also more suitable for the legal and political realms, where policies and law-making are usually more concerned with present addressees and short term effects. (shrink)

This paper argues that the existing definition of pandemics is not nuanced enough, because it is predicated solely on the criterion of spread, rather than on the criteria of spread and severity. This definitional challenge is what I call ‘the conflation problem’: there is a conflation of two different realities of global health, namely global health emergencies (i.e., severe communicable diseases that spread across borders) and nonemergencies (i.e., communicable or noncommunicable diseases that spread across borders and that may be severe). (...) To put this argument forth, this paper begins by discussing the existing and internationally accepted definition of pandemics, its requirements, as well as its strengths (section 1). Section 2 then considers the problem with the standard definition of pandemics (i.e., the conflation problem) and some examples of it. Finally, section 3 evaluates some practical implications of the conflation problem to then explore conceptual clarity as the adequate solution. (shrink)

Understanding Gay and Lesbian Youth assists the classroom teacher, school counselor, and administrator in relating to gay and lesbian youth and creating accepting and supportive learning climates. David Campos begins with a discussion of the current state of affairs regarding gay and lesbian youth in schools, including a discourse on the developmental milestones, and provides practical strategies for working effectively with these students.

Spinoza studies have paid little attention to the concept of justice for centuries. However, he refers to it quite often in different contexts, especially in his mature texts. More specifically, he defines it as synonymous with suum cuique tribuere, even though he fails to provide a reasonable account of how this traditional legal expression fits into his philosophical system. This article shows that there is a relevant philosophical dimension in Spinoza’s treatment of the suum cuique that emerges out of his (...) notion of equality. The main section identifies the connection between Spinoza’s references on justice as suum cuique and the different conceptions of equality that are inherent in his system (an ontological, a metaphysical, a productive (ethical), a legal, and a political equality). The conclusion tries to answer the question of whether such an understanding of the suum cuique as equality constitutes a theory of justice or not. (shrink)

Os debates, na cidade de Belém-PA, em torno do divórcio com possibilidade de segundo casamento, doutrina católica da indissolubilidade das alianças e família são os princípios diretores das reflexões que seguem. As fundamentações concentram-se no ponto de vista de que a lógica do matrimônio inquebrantável e domador da fornicação de homens e mulheres, não era a única visão, a respeito dele, no seio da capital paraoara. Alguns literatos e profissionais do direito compreendiam que ninguém poderia ser submetido eternamente a um (...) enlace falido, isto é, neste caso o desejo do até que a morte os separasse deveria ser arrefecido pelas leis brasileiras por meio da aprovação do divórcio absoluto. Assim, existiam pensamentos contrários aos da Igreja: a ruptura efetivamente em nada promoveria a poligamia como queria fazer crer o dogma católico, mas sim que a imoralidade poligâmica crescia com a forma de separação existente no Brasil que autorizava “tão somente” o desenlace de corpos e bens, deixando intactos os vínculos matrimoniais. In representative democracies, the absence of responsiveness by elected officials to the interests of the represented often generates problems of legitimacy, accountability and effectiveness. However, responsiveness also tends to narrow the time horizons of democratic decision-making and promote short-termism. This paper advances the notion that responsiveness to interests involving distant time horizons is possible by reconfiguring the franchise in a time-sensitive and future-oriented way. It is divided into two parts. The first pinpoints a few inconsistencies in the available proposals for (...) making responsiveness and the long term compatible (e.g., promoting youth turnout, narrowing the franchise to robust epistemic fitness, establishing future-oriented institutions). The second advances the creation of temporal electoral circles operating alongside territorial electoral circles in order to prompt responsiveness to multitemporal interests. The conclusion asserts that this kind of franchise design is the best available option for introducing temporal aspects into the character of democratic representation. (shrink)

Human rights advocates often use inflated and thus underspecified terminologies when addressing the content of their claims. One example of such loose terminology is the term ‘well-being’, as currently employed in connection with a definition for the right to health. What I call the ‘well-being conception of health’ conflates the distinct ideas of basic and non-basic health needs, as well as those of individual autonomy and freedom. I call this the conflation problem. O texto consiste em uma tradução do artigo Penser l’après : Sciences, pouvoir et opinions dans l’après Covid-19 escrito pela professora e filósofa de ciências Bernadette Bensaude-Vincent. A tradução foi autorizada pela autora e sua eventual publicação deve seguir as diretrizes do jornal The Conversation, no qual o artigo foi originalmente publicado. A partir das medidas implementadas mundialmente para o combate ao coronavírus, a autora analisa o vínculo entre as comunidades científicas e o governo. A gestão da crise sanitária, segundo (...) Bensaude-Vincent, baseia-se não só em dispositivos atuais, mas recorre a um modelo bastante arcaico: o confinamento generalizado. A diferença, segundo a filósofa, estaria no fato de hoje tal medida visar a salvar, sobretudo, o sistema hospitalar. Tal contexto nos remete a imagens de um passado que se considerava superado, lançando, assim, uma dúvida sobre o vínculo entre ciências e poder das últimas décadas. Os interesses locais, políticos, econômicos, religiosos e mesmo os interesses e valores dos próprios pesquisadores mostram-se, por vezes, incompatíveis com o “dever do ceticismo organizado que resta como um dos grandes princípios do éthos científico”. Daí a desconfiança do público que, por sua vez, é reduzido ao silêncio por pertencer ao inferior âmbito da doxa. A ideia de uma hierarquia na ordem do conhecimento que estabelece a opinião como um saber inferior não é nova, no entanto, segundo a autora, para os antigos isso não implicaria, como atualmente, uma hierarquia política. Bensaude-Vincent convoca, assim, a reabilitação dos "saberes de campo não científico como fontes de invenção e de soluções" em regime, como o nosso, de incerteza. (shrink)
