The current system of ethical oversight in the United States is based on Institutional Review Board (IRB) review. The system was established in response to well-known and egregious mistreatment of subjects in both biomedical and social and behavioral research. In the decades since the research regulations were enacted, reaction to the burden of IRB oversight has led the system to focus on compliance and limit its active oversight disproportionately to studies that could present the risk of physical harm. At the (...) same time, the characteristics of the research enterprise have changed and methodologies now present novel risks that were not envisioned in the regulations. We convened a group of IRB professionals, academic leaders, and others to discuss limitations of the current system, how that system could be changed to recognize evolving risks and an increasing focus on participant and community voice, and how it could better serve the needs of researchers and support the societal project of science as a public good. Recommendations included a call to reexamine the academic incentive structure, to develop a system to support consideration of ethical principles from the time of study design, and to explicitly provide different ethical support and oversight for high-risk interventional trials and lower risk biomedical and social behavioral research. Meditation is an umbrella term for a number of mental training practices designed to improve the monitoring and regulation of attention and emotion. Some forms of meditation are now being used for clinical intervention. To accompany the increased clinical interest in meditation, research investigating the neural basis of these practices is needed. A central hypothesis of contemplative neuroscience is that meditative states, which are unique on a phenomenological level, differ on a neurophysiological level. To identify the electrophysiological correlates of meditation (...) practice, the electrical brain activity of highly skilled meditators engaging in one of six meditation styles was recorded. A mind-wandering task served as a control. Lempel–Ziv complexity showed differences in nonlinear brain dynamics during meditation compared with mind wandering, suggesting that meditation, regardless of practice, affects neural complexity. In contrast, there were no differences in power spectra at six different frequency bands, likely due to the fact that participants engaged in different meditation practices. Finally, exploratory analyses suggest neurological differences among meditation practices. These findings highlight the importance of studying the electroencephalography correlates of different meditative practices. (shrink)

“Ordo,” as it has come to be used, suggests the basic structure of Christian worship that centers on table, font, and pulpit, and the shape of Christian living that flows from these centers. It is a commitment to that which grounds and guides our lives in the world.

We provide a qualitative analysis of resistance to calls for gender-neutral language. We analyzed more than 900 comments responding to two essays—one on AlterNet and another on Vox posted to the Vox editor’s Facebook page—that critiqued a pervasive male-based generic, “you guys.” Five rhetorics of resistance are discussed: appeals to origins, appeals to linguistic authority, appeals to aesthetics, appeals to intentionality and inclusivity, and appeals to women and feminist authorities. These rhetorics justified “you guys” as a nonsexist term, thereby allowing (...) commenters to continue using it without compromising their moral identities as liberals or feminists. In addition to resisting an analysis that linked their use of “you guys” to social harms, commenters positioned the authors who called for true generics as unreasonable, divisive, and authoritarian. We conclude with suggestions for how feminists can challenge the status quo and promote social change. (shrink)

Building rapport is considered important in investigative interviewing of children about alleged sexual abuse, but theoretical understanding of the nature of rapport and how to judge its presence remains sketchy. This article argues that the conversation analytic concept of progressivity may provide empirical tractability to the concept of rapport and indeed may be partially what people are detecting when they judge the presence of rapport. A single case is analysed, drawn from a corpus of 11 video-taped interviews with children conducted (...) by police in an Australian sexual crime unit. Analysis focuses on how the interviewer responds when progressivity breaks down, and how restoration is collaboratively achieved. Findings are discussed in terms of implications for future work that might investigate a more thoroughly social interactional account of rapport, and in terms of new ideas about what might constitute skilful interviewing practices amongst investigative interviewers. O sublime vem sendo analisado desde a antiguidade com uma marcante relaçáo com a tragédia, seja como gênero literário, seja por meio da Poética , de Aristóteles que nos traduz pela catarse o sentimento do sublime. Na modernidade, novos nomes foram chegando para colaborar com esta teoria: o próprio Hume, em seu ensaio Da tragédia , mostrou-se impressionado com a capacidade que esta forma de arte tem de produzir efeitos táo intensos no espectador. A terceira crítica de Kant dedicou um momento especial à analise do sublime, a qual já havia servido como base também para Schopenhauer que, no entanto, a partir dela, construíra sua própria estética que viria a ser de suma importância para o jovem Nieztsche, sobretudo devido à consideraçáo da música como arte sublime. Commenting on Alfaro and Bui’s article “Mental Health Professionals’ Attitudes, Perceptions, and Stereotypes Toward Latino Undocumented Immigrants,” this article explores and confirms the importance of continued and increased attention to language and word choice regarding Latina/latino/latinx immigrants as well a multicultural awareness and competence training for mental health professionals. Mental health professionals must be aware of connections between social determinants of health and well-being, as well as the impact of their own cultural awareness and language use, on their implicit bias (...) and capacity for empathy with clients who they may perceive to be different than themselves. Ethical guidelines require mental health professionals to consistently seek learning opportunities to increase their cultural awareness in order to provide competent mental health services to Latina/latino/latinx undocumented immigrant clients that ameliorate suffering and facilitate flourishing. A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. Martha Nussbuam is one of the most prolific and original philosophers working today. Influenced by ancient philosophy, she has written on the relationship between fiction, the emotions and moral reasoning. With Amartya Sen she developed the capabilities approach to human well-being, which helped shape the UN’s Human Development Index. She is Ernst Freund Distinguished Service Professor of Law and Ethics at the University of Chicago.

The cosmopolitan tradition begins with Diogenes, who claimed as his identity "citizen of the world." Martha Nussbaum traces the cosmopolitan ideal from ancient times to the present, weighing its limitations as well as merits. Using the capabilities approach, Nussbaum seeks to integrate the "noble but flawed" vision of world citizenship with cosmopolitanism's concern with moral and political justice for all.--.

Contrary to political and philosophical consensus, we argue that the threats posed by climate change justify population engineering, the intentional manipulation of the size and structure of human populations. Specifically, we defend three types of policies aimed at reducing fertility rates: choice enhancement, preference adjustment, and incentivization. While few object to the first type of policy, the latter two are generally rejected because of their potential for coercion or morally objectionable manipulation. This chapter offers an interpretation of the integrated dance theatre of the Restless Dance Company as involving a process of turning away from the determinations of intellectually disabled bodies in medical discourses using the Deleuzian concepts of ‘becoming’ and ‘affect’. It contends that bodies with intellectual disability are constructed through specific systems of knowledge and argues that performance spaces can offer radically new ways of being affected by people with disabilities. In this paper I argue that individuals are, prior to the existence of just institutions requiring that they do so, bound as a matter of global distributive justice to restrict their use, or share the benefits fairly of any use beyond their entitlements, of the Earth’s capacity to absorb greenhouse gases (EAC) to within a specified justifiable range. As part of the search for an adequate account of climate morality, I approach the task by revisiting, and drawing inspiration from, two (...) prominent models from classical political philosophy for thinking about norms (rights, permissions, limits, etc.) regarding “pre-institutional” appropriation of unowned resources; Locke and Kant, respectively. The basic resources they develop—connected to fundamental norms of equality and rights to self-preservation and freedom—in order to generate their particular schema for distributive shares prior to the existence of just institutions can be usefully and plausibly connected up with the scarce, valuable, rival, non-excludable, global, and unowned resource that is EAC in order to undergird a picture of individual climate duties in the contemporary world. It is a picture that comes with some fairly radical implications, especially for the well-off. (shrink)

In this article, I respond to Augustin Fragnière's recent attempt to understand the demandingness of individual climate duties by appealing to the difference between “concentrated” harm and “spread” harm and the importance of “moral thresholds”. I suggest his arguments don't succeed in securing the conclusion he is after, even from within his own commitments, which themselves are problematic. As this is primarily a critical project, the upshot of this discussion is that if there is a defensible way to justify the (...) intuition that the duty to reduce emissions can't be overly demanding, it has to be found elsewhere. Children, the image of the child, and the gendered figures of the girl and the boy are thematics that run through the work of Deleuze and feature prominently in his joint writing with Guattari. However, there are many different children in Deleuze's writings. Various child figures do distinct things in Deleuze's work. In this article, I argue that his work on children can be utilized to rethink popular, teleological notions of childhood and growing up.

This collection demonstrates how physical objects, materials, space and environments teach us, and redefines practice with theory as a more-than-human network. The contributions illustrate how the materials, process, pedagogies and theories of Arts making question and disrupt the many forms of cultural dominance that exist in our society.

The complexities of how justice comes to be realized, and by which agents, is a relatively neglected element in contemporary theories of justice. This has left several crucial questions about agency and justice undertheorized, such as why some particular agents are responsible for realizing justice, how their contribution towards realizing justice should be understood, and what role agents such as activists and community leaders play in realizing justice. We aim to contribute towards a better understanding of the landscape of these (...) kinds of questions. First, we argue that theorists should distinguish between (i) agents who are responsible for realizing justice, but not committed to it, (ii) agents who are not responsible for realizing justice, but who are committed to it, and (iii) agents who are both responsible for and committed to realizing justice. An expanded edition of Hickey's controversial and exquisitely written apologia for beauty--championed by artists, reviled by art critics, and as powerful as ever 30 years on 1993: the AIDS pandemic rages through yet another decade, leaving society and the arts devastated and bereft. Dave Hickey sits down to produce a slim volume, The Invisible Dragon. The book ignites a firestorm, and from its ashes "beauty" again rises as a dominant force in artistic life. Academics argue about theoretical minutiae. (...) Artists pass the book around like a samizdat. This 30th-anniversary edition brings back into print Dragon's four essays on beauty and commingles them with five previously uncollected essays. Hickey's 1974 profile of Dolly Parton anticipates Dolly's longevity as a cultural and feminist icon; his appreciation of Richard Pryor weaves an elegiac tapestry; his review of John Rechy's seminal gay novel Numbers outs its literary innovation in the face of a homophobia that otherwise ghettoized it; and his singular essay on Ed Ruscha, a paragon of arts writing by an extraordinary prose stylist, enjoins us to listen to art, not just look at it. An afterword by Hickey's friend and Dragon's editor "queers" the brash, heterosexual gambler as it situates the creation of Dragon squarely within the AIDS pandemic. The book was in part an attempt to make beauty visible under the looming presence of death and bodily decay. Only now can we fully appreciate how artists continue to harness beauty as a source of meaning and joy. Dave Hickey (1938-2021) was one of the preeminent arts and cultural writers of the turn of the 21st century. A MacArthur "Genius" Fellow known as the "beauty guy" in the popular press, Hickey opened A Clean, Well-Lighted Place gallery in Austin, Texas, in the 1960s, before becoming executive editor at Art in America magazine. In the 1970s, he was a songwriter in Nashville, Tennessee, where he coined and helped create the "Outlaw country" music movement. By the 1990s, Hickey had made a home in Las Vegas, from where he regularly traveled to speak with audiences worldwide. (shrink)

Many traditional arguments in favor of enhancement are consequentialist in nature. Many of the classic arguments against enhancement seem to have loosely Kantian origins. In this paper I offer a different interpretation of what a Kantian should be committed to with respect to enhancement by focusing on Kant's sometimes overlooked imperfect duty to cultivate our talents. I argue that in promoting an end that Kant thinks we have a duty to set, enhancing is more than just permissible, but has morally (...) weighty reasons behind it and would in part constitute a duty we owe to ourselves. This shows that Kantians have a unique position to add to debates about enhancement and positions Kant as pushing a view that is potentially more radical than even most ethicists friendly to enhancement, who might grant that enhancement is permissible in a wide array of cases, but often fall short of judging it part of a duty we owe to ourselves.
