The relationship between legal pluralism and international human rights law is a complex and multi-faceted one. To fully appreciate the nature of this relationship, one has to desegregate the various forms of legal pluralism and analyse whether in their existence or operation they are compatible with international human rights law. This article undertakes such an exercise drawing on the jurisprudence of global and regional human rights bodies. In doing so, it goes beyond a mechanical audit of legal pluralism in the (...) light of specific human rights and explores more foundational issues such as the nature and extent of a State’s human rights obligations when legal pluralism exists within its borders, the possibility of waiving human rights and questions of cultural relativism which hover over any discussion of legal pluralism. What emerges from this analysis is that a tentative conceptual framework exists to regulate the relationship between legal pluralism and international human rights law. It is one that not only requires the State to render legal pluralism compatible with human rights but also stipulates the process by which this should be done. Effectively implemented, it can achieve this objective and harness the pull of religious and customary law to ensure the more effective protection of human rights. (shrink)

Most people believe that it is sometimes morally permissible for a person to use force to defend herself or others against harm. In Defensive Killing, Helen Frowe offers a detailed exploration of when and why the use of such force is permissible. She begins by considering the use of force between individuals, investigating both the circumstances under which an attacker forfeits her right not to be harmed, and the distinct question of when it is all-things-considered permissible to use force (...) against an attacker. Frowe then extends this enquiry to war, defending the view that we should judge the ethics of killing in war by the moral rules that govern killing between individuals. She argues that this requires us to significantly revise our understanding of the moral status of non-combatants in war. Non-combatants who intentionally contribute to an unjust war forfeit their rights not to be harmed, such that they are morally liable to attack by combatants fighting a just war. (shrink)

This article considers the nature of Mr Burke's concerns in bringing his action and the practical implications of similar situations. When artificial nutrition and hydration is provided, practical issues arise regarding future, potentially long-term care. This in turn raises concerns about place of care, provision of carers and funding, which may not easily be resolved. The GMC guidance exists to provide direction and help for practitioners when difficult decisions have to be made about future treatment with the intention that the (...) patients' wishes and benefit of any potential treatment will be central to the discussions. Nevertheless, the reality of having these conversations, raising emotive issues with the patient and/or carers, and the implications of the final decision, may be very different in practice. This article examines the study of natural history on the imperial periphery in late colonial Spanish America. It considers the problems that afflicted peripheral naturalists—lack of books, instruments, scholarly companionship, and skilled technicians. It discusses how these deprivations impacted upon their self-confidence and credibility as men of science and it examines the strategies adopted by peripheral naturalists to boost their scientific credibility. The article argues that Spanish American savants, deprived of the most up-to-date books and sophisticated instruments, emphasised instead their (...) sustained experience of local nature and their familiarity with indigenous knowledge. It details how some creole naturalists, such as the Mexican José Antonio Alzate, questioned the applicability of European classificatory systems to American fauna and flora, and it analyses the complex relationship between natural science and creole patriotism. This is a reply to Esther Frances's comment, "Some Thoughts on the Content of Hypatia," in which she makes specific reference to the special issue on "Feminist Ethics and Medicine" which I edited.

In this article it is argued that there are barriers to effective and non-discriminatory practice when mentoring overseas nurses within the National Health Service (NHS) and the care home sector. These include a lack of awareness about how cultural differences affect mentoring and learning for overseas nurses during their period of supervised practice prior to registration with the UK Nursing and Midwifery Council. These barriers may demonstrate a lack of effective teaching of ethical practice in the context of cultural diversity (...) in health care. This argument is supported by empirical data from a national study. Interviews were undertaken with 93 overseas nurses and 24 national and 13 local managers and mentors from six research sites involving UK health care employers in the NHS and independent sectors in different regions of the UK. The data collected showed that overseas nurses are discriminated against in their learning by poor mentoring practices; equally, from these data, it appears that mentors are ill-equipped by existing mentor preparation programmes to mentor overseas-trained nurses from culturally diverse backgrounds. Recommendations are made for improving mentoring programmes to address mentors’ ability to facilitate learning in a culturally diverse workplace and thereby improve overseas nurses’ experiences of their supervised practice. Most work on John Stuart Mill focuses on his account of civil or political liberties. But as Bruce Baum (2006) argues, Mill's commitment to “the free development of individuality” applied in the economic sphere as well as the social and political. As part of his decentralized, ‘liberal’, socialism (McCabe, 2021) he endorsed a ‘pluralist’ economy which combined consumer- and producer-co-operatives with some state provisions. This ‘utopia’ reveals a road untravelled by both socialism and liberalism, but aimed at achieving normative principles (...) dear to both – liberty, equality, security, fraternity, and progress – and which is worth serious consideration today. Dale E. Miller (2003) argues that, given the arguments of On Liberty, Mill should have been open to ‘capitalistic’ as well as ‘socialistic’ enterprises in his utopia. I argue that Mill's socialism (and his account of transition) involves a significant change in attitudes, which would rule out ‘capitalistic’ motivations and thus structures and organisations. One such structure is the labour market. Building on earlier work (McCabe, 2021) and comments by Joseph Persky (2024), I explore the implications of Mill's commitment to ending a competitive labour market whilst maintaining the plurality of economic enterprises for capital, ‘progress’, and Mill's commitment to diversity. Bas van Fraassen’s empiricist reading of Perrin’s achievement invites the question: whose doubts about atoms did Perrin put to rest? This comment recontextualizes the argument and applies the notion of empirical grounding to some contemporary work in behavioral biology.

Although there has been significant academic interest in the complex relationship between gender and migration, the relevant literature often focuses on women as victims of trafficking, sexism and racism in the host and sending societies. This article discusses instead the question of gender and migration as an open field of contestation within which transitory and incomplete identities are performed. Based on a series of focus group discussions with Albanian women working in the domestic sector in Athens, the article documents the (...) emergence of a discourse of `becoming masculine' while performing typically `feminine tasks'. Drawing from Judith Butler's theoretical challenge to subject formation, the analysis traces the development of gender relations within discourse. While Albanian women are doubly disadvantaged in the mind—body relationship, they gradually come to perform roles that redefine the space of domesticity where the limits between men/women, private/public and migrants/nationals lie. In this paper, I carry out an analysis of an event in Sweden called ‘the spring turnout’. It is a traditional event where cows are allowed out into the fields after the winter. I show how it has been colonized by Arla Foods, the diary company which controls part of the milk production in Sweden and in many other countries. Of interest in this analysis is how Arla infuses the event, and its own marketing, with discourses about nature that are (...) specifically Swedish and can be traced to the nation building of the nineteenth and twentieth centuries, used systematically as part of the social democratic project for equality and progress through a strong welfare system. The paper examines how Arla recontextualizes these discourses for commercial purposes. I show how such recontextualized discourses carry reassurances to Swedish people that this project is still intact despite huge social political changes in Swede over the past decades embracing neoliberalism, global capitalism and becoming one of the fastest deregulating countries in the world. In this study we explored how the science department shaped the relationship between a science department head, Mr Greg, and a teacher, Ms Horton, as they grappled with their expectations of, and responsibilities for, teaching and leadership in the daily life in the department. We found that, from their life histories and their positions in the department, Mr Greg and Ms Horton have developed different values and visions that shape the ways they construct their work, particularly in relation to the (...) place of subject matter, goals for students, teamwork, roles and responsibilities and accountability. Although both shared a commitment to their students and to their subject, Mr Greg saw his contribution in subject organizational terms and Ms Horton saw hers in personal student terms. Orderliness and stability were important to the department head whereas Ms Horton valued spontaneity and innovation. Collaboration was Mr Greg's method of achieving the business of the department; working alone allowed Ms Horton the freedom and flexibility she needed. Accountability for Mr Greg was framed in organizational terms; Ms Horton was more concerned with the learning that took place in her classroom. Our case study looks at the range and intensity of the forces shaping the work of teachers and the way they organize themselves at work. We argue that, if we wish to continue to improve teaching and learning, particularly in secondary schools, we need to know a great deal more about the forces that operate in subject departments. Kindergarten Narratives on Froebelian Education showcases the latest scholarship and historical understandings concerning the casting of the kindergarten idea abroad: across cultures, continents and centuries. Each chapter reveals previously unknown narratives of intrepid endeavour, political pragmatism and pedagogical innovation that collectively provide insight into the transformation of Froebel's ideas on early education into a global phenomenon. Across global contexts, each chapter will present a case study of the ideas scattering abroad, illustrative of the movement of ideas, curricula and pedagogical change; (...) in effect taking the kindergarten beyond the geographies and pedagogies of its German beginnings and borders. Chapters draw on historical examples of Froebelian education from The Netherlands, New Zealand, Japan, Sweden, the UK and the USA. In the journal History of Education in 2006, Froebelian history scholar Professor Kevin J. Brehony (1948-2013) lamented the 'relative neglect' of the history of early years education at the same time there was a heightened global social and political interest in educating the young child. In this book, an international team of contributors respond to Brehony's challenge that historical perspectives can play a role in current debates and suggest ways historical narratives might inform policies and practices in twenty-first century early childhood education, care settings and contexts. Reconnecting past lessons and insights with present and future concerns for early education, young children and their place in society, this important collection also includes an historical timeline charting the spread of Frobelian education ideas and kindergartens across the world. Advances in neuroscience have revolutionized our understanding of the central nervous system. Neuroimaging technologies, in particular, have begun to reveal the complex anatomical, physiological, biochemical, genetic, and molecular organizational structure of the organ at the center of that system: the human brain. More recently, neuroimaging technologies have enabled the investigation of normal brain function and are being used to gain important new insights into the mechanisms behind many neuropsychiatric disorders. This research has implications for psychiatric diagnosis, treatment, and risk assessment. (...) John Stuart Mill has several good claims to be considered as one of the founders of modern social and political thought, particularly given his central role in the foundations of liberalism, and thus, though a good deal has been written about him already, a book on Mill in this ‘Founders’ series should be welcomed. Frederick Rosen brings his wealth of scholarship on both Mill and Jeremy Bentham to play, giving a fresh and informative perspective. The book is structured around Mill’s (...) two largest compositions, the texts which made him famous in his own age—namely, the System of Logic Ratiocinative and Inductive (1843) and Principles of Political Economy (1848)—which Rosen follows Alexander Bain in describing as being where ‘Mill’s creative energy was mainly confined’ (7). It is refreshing to find a book on Mill which is not centred around On Liberty or Utilitarianism as being the only works of interest in Mill’s canon, though Bain’s remarks seem a little harsh.Rosen’s avouched plan is to .. In The Political Economy of Progress, Joseph Persky argues for seeing John Stuart Mill as a consistent ‘radical’ with much to offer modern ‘radical’ political discourse. In this article, I further this claim with consideration of Mill's political philosophy, as well as his political economy. Exploring Mill's commitment to radical reordering of the economy, as well as emphasizing his commitment to egalitarianism; his historically nuanced view of ‘the progress of justice’; and his desire for a transformation of social relations allows (...) us to see more clearly how Mill's radicalism was a specific species of socialism. That is, Mill's early radical enthusiasm for the ideals of ‘liberty, equality and fraternity’ is also to be seen in his later socialism. Recognizing his ‘radicalism’ as a species of socialism allows greater understanding of the depth, importance and ‘radicalism’ of Mill's desired socialist reforms. (shrink)

Smart cities are now an established area of technological development and theoretical inquiry. Research on smart cities spans from investigations into its technological infrastructures and design scenarios, to critiques of its proposals for citizenship and sustainability. This article builds on this growing field, while at the same time accounting for expanded urban-sensing practices that take hold through citizen-sensing technologies. Detailing practice-based and participatory research that developed urban-sensing technologies for use in Southeast London, this article considers how the smart city as (...) a large-scale and monolithic version of urban systems breaks down in practice to reveal much different concretizations of sensors, cities, and people. By working through the specific instances where sensor technologies required inventive workarounds to be setup and continue to operate, as well as moments of breakdown and maintenance where sensors required fixes or adjustments, this article argues that urban sensing can produce much different encounters with urban technologies through lived experiences. Rather than propose a “grassroots” approach to the smart city, however, this article instead suggests that the smart city as a figure for urban development be contested and even surpassed by attending to workarounds that account more fully for digital urban practices and technologies as they are formed and situated within urban projects and community initiatives. The role of the ‘ideal’ in political philosophy is currently much discussed. These debates cast useful light on Mill's self-designation as ‘under the general designation of Socialist’. Considering Mill's assessment of potential property-relations on the grounds of their desirability, feasibility and ‘accessibility’ (disambiguated as ‘immediate-availability’, ‘eventual-availability’ and ‘conceivable-availability’) shows us not only how desirable and feasible he thought ‘utopian’ socialist schemes were, but which options we should implement. This, coupled with Mill's belief that a socialist ideal should guide social reforms (...) (as the North Star guides mariners), reveals much more clearly the extent of his socialist commitments (even if he thought political economists would be concerned with forms of individual property for some time to come). Moreover, this framework for assessments of ‘ideal’ institutions makes a useful contribution to an ongoing contemporary debate. (shrink)

The US Supreme Court’s abortion decisions over the past forty years have helped to shape cultural beliefs and practices concerning heterosexual relationships, marriage, and parenting. This is true both in the practical and in the legal senses. Practically speaking, definitively separating sex from childbearing, as only abortion can do (given how often contraception fails), inevitably changes the meaning of sex, and therefore of heterosexual relationships. Legally speaking, the Court’s influence was mediated significantly by its decision to locate the right of (...) abortion in an area of constitutional law—substantive due process—which claims to contain only those rights that are indispensable to our national understanding of freedom, both at the level of the individual and respecting our overarching democratic order. In particular, over the course of forty years of abortion opinions, the Court’s reflections on a claimed link between abortion and freedom have led it to conclusions broadly reflected in modern American beliefs and practices insofar as sex, marriage, and parenting are concerned. These include, inter alia, a suspicion of motherhood on the grounds of its risks and harms, the dispensable roles and violent characters of men, the great importance of adults’ wishes, and the importance of sexual expression for individual identity, divorced from consequences for partners or children. Representational art, when it first emerges in the archaeological record between 30,000-40,000 years ago, is seen as a watershed. It is upheld as one of the defining characteristics that makes us 'human', argued as the 'gold standard'by which cultural modernity is measured and identified and intimately linked with the development of language. In the past decade it has been suggested that the emergence of representational art in prehistory and the concomitance of language are assumptions that may need reviewing. This enquiry (...) looks to recent neuroscientific research, particularly in the area of neural connectivity that may provide some valuable insights between drawing and language. The significance of neural interconnectivity in this enquiry is that the emotional content of our lives may lie at the core of what makes us unique in the animal world and a significant contributory factor to our cognitive evolution, particularly in terms of cultural development.
