Three proteins used to initiate DNA replication and carry out site‐specific recombination in E. coli generate organized nucleoprotein structures at their target sites. The association of proteins bound at multiple sites on DNA presumably folds or winds the DNA to produce a specific three‐dimensional conformation. This specialized nucleoprotein structure may be a general mechanism for achieving very high fidelity in DNA transactions in which even a rare mistake must be avoided. The overall interaction is more complex than that of prokaryotic (...) transcription regulators studied so far, but might be characteristic of eukaryotic transcription regulators, for which the problem of site‐localization is more difficult. Each of the essays included in this volume illuminates an aspect of law, reflecting an unorthodox perception of jurisprudence which combines interests in philosophy, legal theory, criminology, legal history, political and constitutional theory and the history of ideas. This work will broaden the jurisprudential scope of practitioners' professional concerns, but help academics enhance their knowledge of the wealth of information for their own studies.

There is a paucity of experimental data addressing how peers influence adolescent risk-taking. Here, we examined peer effects on risky decision-making in adults and adolescents using a virtual social context that enabled experimental control over the peer “interactions”. 40 adolescents (age 11-18) and 28 adults (age 20-38) completed a risk-taking (Wheel of Fortune) task under 4 conditions: in private; while being observed by (fictitious) peers; and after receiving ‘risky’ or ‘safe’ advice from the peers. For high-risk gambles (but not medium-risk (...) or even gambles), adolescents made more risky decisions under peer observation than adults. Adolescents, but not adults, tended to resist ‘safe’ advice for high-risk gambles. Although both groups tended to follow ‘risky’ advice for high-risk gambles, adults did so more than adolescents. These findings highlight the importance of distinguishing between the effects of peer observation and peer advice on risky decision-making. (shrink)

We present a spatial system called Specialized Egocentrically Coordinated Spaces embedded in an embodied cognitive architecture (ACT-R Embodied). We show how the spatial system works by modeling two different developmental findings: gaze-following and Level 1 perspective taking. The gaze-following model is based on an experiment by Corkum and Moore (1998), whereas the Level 1 visual perspective-taking model is based on an experiment by Moll and Tomasello (2006). The models run on an embodied robotic system.

Although activated spinal cord glia contribute importantly to neuropathic pain, how nerve injury activates glia remains controversial. It has recently been proposed, on the basis of genetic approaches, that toll-like receptor 4 may be a key receptor for initiating microglial activation following L5 spinal nerve injury. The present studies extend this idea pharmacologically by showing that TLR4 is key for maintaining neuropathic pain following sciatic nerve chronic constriction injury. Established neuropathic pain was reversed by intrathecally delivered TLR4 receptor antagonists derived (...) from lipopolysaccharide. Additionally, -naltrexone, -naloxone, and -naloxone, which we show here to be TLR4 antagonists in vitro on both stably transfected HEK293-TLR4 and microglial cell lines, suppressed neuropathic pain with complete reversal upon chronic infusion. Immunohistochemical analyses of spinal cords following chronic infusion revealed suppression of CCI-induced microglial activation by -naloxone and -naloxone, paralleling reversal of neuropathic pain. Together, these CCI data support the conclusion that neuron-to-glia signaling through TLR4 is important not only for initiating neuropathic pain, as suggested previously, but also for maintaining established neuropathic pain. Furthermore, these studies suggest that the novel TLR4 antagonists -naloxone and -naloxone can each fully reverse established neuropathic pain upon multi-day administration. This finding with -naloxone is of potential clinical relevance. This is because -naloxone is an antagonist that is inactive at the -opioid selective receptors on neurons that produce analgesia. Thus, these data suggest that -opioid antagonists such as -naloxone may be useful clinically to suppress glial activation, yet -opioid agonists suppress pain. (shrink)

OBJECTIVE: To describe the issues faced, and how they were addressed, by the University of Toronto Critical Care Medicine Program/Joint Centre for Bioethics Task Force on Appropriate Use of Life-Sustaining Treatment. The clinical problem addressed by the Task Force was dealing with requests by patients or substitute decision makers for life-sustaining treatment that their healthcare providers believe is inappropriate. DESIGN: Case study. SETTING: The University of Toronto Joint Centre for Bioethics/Critical Care Medicine Program Task Force on Appropriate Use of Life-Sustaining (...) Treatment. PARTICIPANTS: The 24-member Task Force included physician and nursing leaders from five critical care units, bioethicists, a legal scholar, a health administration expert, a social worker, and a hospital public relations professional. INTERVENTIONS: None. MEASUREMENTS AND MAIN RESULTS: Our specific lessons learned include a) a policy focus on process; b) use of a negotiation and mediation model, rather than a hospital ethics committee model, for this process; and c) the policy development process is itself a negotiation, so we recommend equal involvement of interested groups including patients, families, and the public. CONCLUSIONS: This article describes the key issues faced by the Task Force while developing its policy. It will provide a useful starting point for other groups developing policy on appropriate use of life-sustaining treatment. (shrink)

This volume consists of papers given to the Royal Institute of Philos ophy Conference on 'Philosophy and the Visual Arts: Seeing and Abstracting' given at the University of Bristol in September 1985. The contributors here come about equally from the disciplines of Philosophy and Art History and for that reason the Conference was hosted jointly by the Bristol University Departments of Philosophy and History of Art. Other conferences sponsored by the Royal Institute of Philosophy have been concerned with links between (...) Philosophy and related disciplines, but here, with the generous support of South West Arts and with the enthusiastic co-operation of the staff of the Arnolfini Gallery in Bristol we were able to attempt even more in the way of bridge building; not only were we able to hold some of our meetings in as possible to the general the Gallery, thus making them as accessible public, but we were also privileged in having our discussions supported by two exhibitions of contemporary painting that together presented contrasting aspects of the abstracting enterprise. One, featuring works by Ian McKeever, and drawings and painting by Frank Auerbach, some of which are discussed and illustrated in the present volume, was about the painterly exploration of 'abstracting from' images in nature and in painting itself. The other, curated by Waldemar Januszczak, while showing some figurative works, was concerned with the 'pure' power of colour perceived 'abstractly, in its own right. (shrink)

Stakeholder theory focuses on how more value is created if stakeholder relationships are governed by ethical principles such as integrity, respect, fairness, generosity and inclusiveness. However, it has not adequately addressed strategies that stakeholders perceive as harmful to their interests and how this perception can even lead some stakeholders to view the firm’s strategies as unethical. To fill the void, this paper directly addresses strategies that stakeholders perceive as harmful to their interests, or what we refer to as harmful stakeholder (...) strategies. Specifically, it identifies factors associated with stakeholder perceptions of harm that are likely to cause them to consider a strategy unethical, examines the negative implications for firms that pursue such strategies in terms of likely stakeholder responses and damage to stakeholder relationships, and provides theory to help explain how firms are likely to respond to stakeholder claims that a strategy is unethical, based on factors such as the strategic importance of the claim to the firm, how long the strategy has been in use, the costs of remediation, the risk of stakeholder mobilization or new regulation, and whether firms can reasonably rationalize their actions. Assessing harm allows a firm to make a more accurate estimate of the costs of a strategy and can assist managers in allocating resources intended to reduce or remediate harm. (shrink)

The stakeholder perspective has provided a rich forum for a variety of debates at the intersection of business and society. Scholars gathered for two consecutive years, first in North America, and then in Europe, to discuss the major issues surrounding what has come to be known as stakeholder theory, to attempt to find common ground, and to uncover areas in need of further inquiry. Those meetings led to a list of “tensions” and a call for papers for this special issue (...) to help address them. In this article, we introduce the resulting articles and provide some brief commentary on their importance. We end with a few of our own observations about the stakeholder perspective and stakeholder research. (shrink)

Many traditional Christians hold that since God created the world, the world is noetically real, that is, not dependent, generally, on human noetic contributions for its ontological status. This essay argues that traditional Christianity only requires noetic realism about God. William Alston and Plantinga are taken as examples of two traditional Christian philosophers who hold to noetic realism and their arguments touching on the connection between the Christianity and realism are considered.

This paper attempts to refute the familiar sceptical argument based upon the theoretical possibility of systematic transpositions of colours in different observers? colour?vision. The force of this argument lies in its apparent demonstration that cases of transposed colour?vision would be on a quite different cognitive footing from ordinary cases of colour?blindness; since colour transposition, unlike colour?blindness, could not possibly have any effect on the use of language by a person who suffered from it. It is argued (1) that this demonstration (...) works only if we assume the truth of a certain theory of the logical nature of our colour vocabulary, and (2) that this theory is false. (shrink)

The claim that moral responsibility requires relevant alternative possibilities is encapsulated by the following principle: PAP: A person is morally responsible for what he has done only if he could have done otherwise. In 1969 Harry Frankfurt devised what purported to be a counterexample to PAP: Suppose someone, Black, let us say, wants Jones to perform a certain action. Black is prepared to go to considerable lengths to get his way, but he prefers to avoid showing his hand unnecessarily. So (...) he waits until Jones is about to make up his mind what to do, and he does nothing unless it is clear to him that Jones is going to decide to do something other than what he, Black, wants him to do. If it does become clear that Jones is going to decide to do something else, Black takes effective steps to ensure that Jones decides to do, and that he does do, what he, Black, wants him to do. Whatever Jones's initial preferences and inclinations, then, Black will have his way. . . . Now suppose that Black never has to show his hand because Jones, for reasons of his own, decides to perform and does perform the very action Black wants him to perform. In that case, it seems clear, Jones will bear precisely the same moral responsibility for what he does as he would have borne if Black had not been ready to take steps to ensure that he do it. In a recent essay in this journal, Tom O’Shea defends socialist republicanism, marrying the value of freedom as nondomination to public ownership of the means of production. In this reply, I argue that the efficiency costs that often attach to public ownership may undercut the ability of the socialist republic to combat domination by public agents. I provide two reasons in support of this claim. First, the economic gains provided by efficiency can insulate individuals from the discretionary power of other (...) agents. Put briefly, the more wealth you have, the less the discretionary power threatens your basic interests. Second, the efficiency costs of public ownership also make it more difficult to hold accountable the managers of economic organizations. This shortcoming of O’Shea’s argument reveals a point hitherto neglected in the republican literature—caring about nondomination implies caring about efficiency. (shrink)

Questions about how to negotiate belief and non-belief in social and public spheres are attracting an increasing amount of attention from academics in a range of disciplines, and from concerned members of the public. This volume addresses the emergence of ‘new atheism’ and the developing ‘spiritual but not religious’ phenomenon. Avoiding simplistic accounts of atheism, and of religious belief, it provides readers with insight into a wide range of nuances within theism and a-theism, as well as spiritual practice and faith. Jeremy Waldron argues that claims to reparation for historic injustices can be superseded by the demands of justice in the present. For example, justified Maori claims to reparation resulting from the wrongful appropriation of their land by European settlers may be superseded by the claim to a just distribution of resources possessed by the world’s existing inhabitants. However, if we distinguish between reparative and restitutive claims, we see that while claims to restitution may be superseded by changes in circumstance, this (...) does not entail that claims to reparation are. ABSTRACTNoncompete clauses, or agreements by employees to not work for a competitor or start a competing business, have recently faced increased public scrutiny and criticism. This article provides a qualified defense of NCCs. I focus on the argument that NCCs should be banned because they unfairly restrict the options of employees. I argue that this argument fails because it neglects the economist Thomas Schelling’s insight that limiting exit options can be beneficial for a person. This employee-based defense of NCCs does (...) not absolve all their uses, but it does give us a rough test for evaluating the permissibility of NCCs. With this test in hand, I turn to some of the more controversial uses of NCCs. For those who weigh heavily the interests of employees, the question is not whether NCCs, but when. (shrink)

The integration of psychedelic substances into modern Western therapeutic practice has sparked a critical examination of many topics including: efficacy of psychedelics to treat mental health diagnoses without psychotherapeutic intervention, what models of therapy to use, and ethical implications related to altered states of consciousness. Of utmost concern are issues of power dynamics leading to incidents of sexual abuse. These issues underscore the importance of understanding therapeutic dynamics within the context of psychedelic-assisted therapy. This paper aims to explore these intersections, (...) addressing sexual abuse issues in Western psychedelic-assisted therapy while elucidating pathways towards ethical practice and regulatory frameworks. What role does audience uptake play in determining whether a speaker refuses or consents to sex? Proponents of constitution theories of uptake argue that which speech act someone performs is largely determined by their addressee’s uptake. However, this appears to entail a troubling result: a speaker might be made to perform a speech act of sexual consent against her will. In response, we develop a social constitution theory of uptake. We argue that addressee uptake can constitute a speaker’s utterance of (...) ‘no’ as a speech act of consent under some conditions, but that this does not prevent us from judging that an addressee committed rape. Second, we claim that addressee uptake is not the only form of uptake that matters—the uptake of other members of the discursive community matters too, and can override the addressee’s uptake, constituting the speaker’s utterance as the speech act it was intended to be. Nicolas Malebranche 1In his Éloge du Pere Malebranche, delivered to the Parisian Academy of Sciences on 22 April 1716, Bernard Fontenelle recounted the story of Nicolas Malebranche's somewhat controversial conversion to Cartesianism. When friends and colleagues had taken him to task over his new-found commitment to the doctrines of Descartes, Malebranche responded with this question: "Did Adam have the perfect science?" It was agreed that this was the common view. Malebranche responded that he, too, aspired to the perfect science, and that his quest for this knowledge could not be satisfied by following the historical or critical pursuits of his colleagues, but by adopting the procedures set out by Descartes. 2 For Malebranche, the Cartesian method offered a means of overcoming the limitations of the fallen intellectual faculties of Adam's seventeenth-century descendents, and thus of restoring the fabled encyclopedic knowledge of the first man. [End Page 239]Aspirations to recover the science of Adam provided a common motivation for a number of early-modern philosophical projects. Earlier in the seventeenth century Francis Bacon had famously observed in his Novum Organum (1620) that the human dominion over nature which Adam had lost at the Fall could be restored in some measure by the sciences: "For man by the fall fell at the same time from this state of innocency and from his dominion over creation." The moral losses of the human race were to be restored in some measure by "religion and faith"; Adam's lost knowledge, and the dominion which it made possible, by "arts and sciences." 3 Bacon's vision of a reconstructed knowledge of nature during the period which he regarded (somewhat prematurely) as "the last times" clearly played an important role in legitimizing the goals and methods of the new natural philosophy. Indeed the program of the Royal Society of London from its inception in 1660 explicitly relied upon a Baconian rhetoric of the restoration of that human knowledge and dominion over nature which Adam had once enjoyed.While historians such as Charles Webster have alluded to the ways in which the myth of an original perfect philosophy motivated projects for the advancement of learning in a rather general way, little attention has been paid to the manner in which early-modern views of the nature of the original fall from knowledge directly informed the methods of the new sciences, determined the scope of their enquiry, and provided ammunition for use against traditional learning. 4 Moreover, most commentators, following Webster's lead, have restricted their attention to Francis Bacon, and to the Baconian aspirations of subsequent reformers of knowledge in seventeenth-century England. In this paper I shall suggest that the biblical narrative of the Fall played a far more direct role in the development of early modern knowledge—both in England and on the Continent—than has often been assumed, and that competing strategies for the advancement of knowledge in the seventeenth century were closely related to different assessments of the Fall and of its impact upon the human mind. Reports of ethical lapses in the business world have been numerous and widespread. Ethical awareness in business education has received a great deal of attention because of the number and severity of business scandals. Given Sarbanes-Oxley legislation and recent Association to Advance Collegiate Schools of Business International’s (AACSBI) recommendations, this study examined respective websites of Securities and Exchange Commission (SEC) regulated public companies and AACSBI-accredited business schools for ethical policy statement content. The analysis was accomplished by classifying ethical expressions into (...) a framework consisting of the attributes of thematic content and focus/themes partially based on the 2004 research of Gaumnitz and Lere. Findings indicate that public companies have been diligent in presenting website ethical content that closely follows authoritative recommendations. Business schools appear not to have prioritized such disclosure to the extent done so by public companies. Although there was improvement between two samples taken in 2005 and 2007, this study provides evidence that many accredited business schools have little or no disclosed ethical expectations in their mission, vision, goals, or other similar types of statements on their websites.
