The purpose of this document is to consider possible industrial policy measures that could be contemplated by the South African Government to provide support for the export competitiveness of the country’s processed fruit products. It follows an earlier analysis by Don Ross, which argued for the conclusion that the industry meets key criteria for economically justifiable industrial policy assistance. That is, it offers a premium product that can be amplified in value by brand strengthening, can be positioned more advantageously than (...) at present in international value chains, and would benefit from an environment made more competitive by liberalization of international trade practices and reduction in management of input prices (chiefly tin plate and sugar). In short: the main factors now limiting the competitiveness of the industry’s exports derive neither from its product characteristics nor from independent market dynamics, but from exogenous constraints that are in principle correctible by policy. Recent moral philosophy has seen a revival of interest in the concept of virtue, and with it a reassessment of the role of virtue in the work of Aristotle and Kant. This book brings that reassessment to a new level of sophistication. Nancy Sherman argues that Kant preserves a notion of virtue in his moral theory that bears recognizable traces of the Aristotelian and Stoic traditions, and that his complex anthropology of morals brings him into surprising alliance with Aristotle. This essay situates some recent empirical research on the origin, nature, role, and reliability of moral intuitions against the background of nineteenth-century debates between ethical naturalism and rational intuitionism. The legitimate heir to Millian naturalism is the contemporary method of reflective equilibrium and its defeasible reliance on moral intuitions. Recent doubts about moral intuitions—worries that they reflect the operation of imperfect cognitive heuristics, are resistant to undermining evidence, are subject to framing effects, and are variable—are best addressed by ethical naturalism (...) as part of a broad dialectical equilibrium. This article examines whether a retributivist conception of punishment implies legal moralism and asks what liberalism implies about retributivism and moralism. It makes a case for accepting the weak retributivist thesis that culpable wrongdoing creates a pro tanto case for blame and punishment and the weak moralist claim that moral wrongdoing creates a pro tanto case for legal regulation. This weak moralist claim is compatible with the liberal claim that the legal enforcement of morality is rarely all‐thing‐considered desirable. A situation, in which a finite set of players can obtain certain payoffs by cooperation can be described by a cooperative game with transferable utility, or simply a TU-game. A (point-valued) solution for TU-games assigns a payoff distribution to every TU-game. In this article we discuss a class of equal surplus sharing solutions consisting of all convex combinations of the CIS-value, the ENSC-value and the equal division solution. While much has been written on specificity (e.g., in texts on new institutional economics, agency theory, and team production theory), there are still some insights to be learnt by business ethicists. This article approaches the issue from the perspective of team production, and will propose a new form of corporate governance: enlightened corporate governance, which takes into consideration the specific investments of employees. The article argues that, in addition to shareholders, employees also bear a residual risk which arises due to (...) their specific investments. This residual risk presents a valid and legitimate basis for residual claims. In this way, employees can be seen as residual claimants due to the fact that their income depends upon a hazardous quasi rent. Therefore, this article will call on the fiduciary duty of board members to protect those employees who are exposed to such residual risks and may thus be vulnerable as a result. This leads to a fundamental change of perspective on the “theory of the firm” – a change which will adopt the theories of new institutional economics, agency theory, and team production theory in order to promote business ethics research. Against this background, enlightened corporate governance aims to follow the criterion of specific investments as a legitimate basis for residual claims. Furthermore, it seeks to understand the consequences for board members, and to promote the sharing of control and ownership. In his Encyclopedia, the late Hegel makes the highest demands on truth and justification from the first paragraph onward. With this, Hegel takes up the skeptical challenge and believes that he can overcome this problem. However, it is not easy to see how Hegel tries to meet this challenge in the Science of Logic, which plays a fundamental role in Hegel’s encyclopedic project. The present article argues that the question of the justification of the claim to truth is a fruitful (...) perspective for the interpretation of the Science of Logic. For this purpose Hegel’s answer to the Agrippan Trilemma is examined, which P. Franks analyzed as a basic problem for Classical German Philosophy. One possible interpretation of Hegel sees him solving the skeptical trilemma at the beginning of the Logic. The article argues against this possibility that the Logic of the Concept contains Hegel’s actual solution. This solution consists in that the concept represents the principle of logic and that the concept itself must be presented in the form of an apagogical argument. Finally, the article gives a reason why Hegel sees an analogy to the ontological argument in this attempt of an ultimate justification. (shrink)

Though Jung's main researches have centred on the subject of individuation as an adult ideal he has a unique contribution to make to the psychology of childhood. Jung repeatedly underlined the importance of the psychology of parents and teachers in a child's development and he emphasized that an unsatisfactory psychological relationship between parents may be an important cause of disorders in childhood. He maintained that all real education of children needs teachers who not only know how to learn but who (...) can also develop their own personalities. Jung devotes a large part of the book to expounding his views on these important subjects. There is also an outline of the theory of child development, a delightful snapshot from the life of a girl called Anna and her parents, and a stimulating discussion of marriage as a psychological relationship. This essay is a sympathetic reconstruction and assessment of Ronald Dworkin’s interpretive approach to the law, his insistence on the normative dimensions of interpretation, and his defense of right answers in legal interpretation. It looks at Dworkin’s critique of Hart’s model of rules and judicial discretion; Dworkin’s distinction between concepts and conceptions; his claim that constitutional adjudication should identify the best conception of the framers’ concepts, rather than reproducing their specific conceptions; and his account of constructive interpretation with its dimensions (...) of fit and acceptability. I argue that Dworkin’s commitments support a kind of originalist jurisprudence, but an originalism of principle. The essay concludes by considering how normatively infused interpretation might be defended in the face of significant normative disagreement. (shrink)

Both were from outside Rome, Quintilian certainly of provincial, Spanish, origin, Tacitus very probably from one of the Galliae, yet both exemplars of Romanitas.
