From the beginning to the end of his career, the critical theorist and Frankfurt School philosopher Theodor W. Adorno sustained an uneasy but enduring bond with existentialism. His attitude overall was that of unsparing criticism, often verging on polemic. In Kierkegaard he saw an early paragon for the late flowering of bourgeois solipsism; in Heidegger an impresario for a "jargon of authenticity" that cloaked its idealism in an aura of pseudo-concreteness and neo-romantic kitsch; even in the more rationalist tradition of (...) Husserl's phenomenology he detected a vain attempt of the bourgeois spirit to break free from the prison-house of immanent consciousness. Yet his enduring fascination with the philosophical canons of existentialism and phenomenology suggests a connection far more complicated and productive than mere antipathy. From his first published book on Kierkegaard's aesthetic to the mature studies in negative dialectics, Adorno was forever returning to the philosophies of bourgeois interiority, seeking the paradoxical relation between their manifest failure and their hidden promise. Scholars of critical theory often regard these philosophical adventures as unfortunate lapses into reductive sociology or as marginal to Adorno's path of intellectual development. In Adorno and Existence, Peter E. Gordon challenges this assumption, showing how the confrontation with existentialism helps us toward a deeper understanding of Adorno's own intellectual commitments. In a critical discussion, interlocutors can strategically maneuver by shading their expressed degree of standpoint commitment for rhetorical effect. When is such strategic shading reasonable, and when does it cross the line and risk fallacious derailment of the discussion? Analysis of President George W. Bush’s 2002–2003 prewar commentary on Iraq provides an occasion to explore this question and revisit Douglas Ehninger’s distinction between argumentation as coercive correction and argumentation as a person-risking enterprise. Points of overlap between Ehninger’s account and pragma-dialectical (...) argumentation theory suggest avenues for harmonization of rhetorical and dialectical perspectives on argumentation. Out of this conceptual convergence comes theoretical resources for understanding strategic maneuvering, by accounting for ways that discussants exploit gaps between their externalized and actual discussion attitude. As such higher-order strategic maneuvering played a major role in the 2003 Iraq prewar discourse failure, perspicacious understanding of this particular argumentative maneuver carries practical, as well as theoretical import. In this paper we show how a realistic normative democratic theory can work within the constraints set by the most pessimistic empirical results about voting behaviour and elite capture of the policy process. After setting out the empirical evidence and discussing some extant responses by political theorists, we argue that the evidence produces a two-pronged challenge for democracy: an epistemic challenge concerning the quality and focus of decision-making and an oligarchic challenge concerning power concentration. To address the challenges we then (...) put forward three main normative claims, each of which is compatible with the evidence. We start with a critique of the epistocratic position commonly thought to be supported by the evidence. We then introduce a qualified critique of referenda and other forms of plebiscite, and an outline of a tribune-based system of popular control over oligarchic influence on the policy process. Our discussion points towards a renewal of democracy in a plebeian but not plebiscitarian direction: Attention to the relative power of social classes matters more than formal dispersal of power through voting. We close with some methodological reflections about the compatibility between our normative claims and the realist program in political philosophy. (shrink)

Sometimes one can prevent harm only by contravening rights. If the harm one can prevent is great enough, compared to the stringency of the opposing rights, then one has a lesser-evil justification to contravene the rights. Non-consequentialist orthodoxy holds that, most of the time, lesser-evil justifications add to agents’ permissible options without taking any away. Helen Frowe rejects this view. She claims that, almost always, agents must act on their lesser-evil justifications. Our primary task is to refute Frowe’s flagship argument. (...) Many commentators have failed to identify the important issues at the heart of the debate between Habermas and Rawls. This is partly because they give undue attention to differences between Rawls’s original position and Habermas’s principle, neither of which is germane to the actual dispute. The dispute is at bottom about how best to conceive of democratic legitimacy. Rawls indicates where the dividing issues lie when he objects that Habermas’s account of democratic legitimacy is comprehensive and his is confined to (...) the political. But his argument is vitiated by a threefold ambiguity in what he means by ‘comprehensive doctrine’. Tidying up this ambiguity helps reveal that the dispute turns on the way in which morality relates to political legitimacy. Although Habermas calls his conception of legitimate law ‘morally freestanding’, and as such distinguishes it from Kantian and natural law accounts of legitimacy, it is not as freestanding from morality as he likes to present it. Habermas’s mature theory contains conflicting claims about the relation between morality and democratic legitimacy. So there is at least one important sense in which Rawls’s charge of comprehensiveness is made to stick against Habermas’s conception of democratic legitimacy, and remains unanswered. Quantum theory offers mathematical descriptions of measurable phenomena with great facility and accuracy, but it provides absolutely no understanding of why any particular quantum outcome is observed. It is the province of genuine explanations to tell us how things actually work—that is, why such descriptions hold and why such predictions are true. Quantum theory is long on the what, both mathematically and observationally, but almost completely silent on the how and the why. What is even more interesting is that, in (...) some sense, this state of affairs seems to be a necessary consequence of the empirical adequacy of quantum descriptions. One of the most noteworthy achievements of quantum theory is the accurate prediction of phenomena that, on pain of experimental contradiction, have no physical explanation. It is the purpose of this essay to make clear why quantum mechanics and quantum field theory are complete physical descriptions that describe the metaphysical incompleteness of the physical world, then to press the negative implications of this fact for naturalistic metaphysics. Using a sample of 652 college students, we examined several implications of the hypothesis that the shape of the human penis evolved to enable males to substitute their semen for those of their rivals. The incidence of double mating by females appears sufficient to make semen displacement adaptive (e.g., one in four females acknowledge infidelity, one in eight admit having sex with two or more males in a 24-hour period, and one in 12 report involvement in one or more sexual (...) threesomes with two males). We also document several changes in post-ejaculatory behavior (e.g., reduced thrusting, penis withdrawal, loss of an erection) which may have evolved to minimize displacement of the male’s own semen. Consistent with predictions derived from a theoretical model (Gallup and Burch 2006), we discovered that most females report waiting at least 48 hours following an instance of infidelity before resuming sex with their in-pair partners. This paper is concerned with learners who aim to learn patterns in infinite binary sequences: shown longer and longer initial segments of a binary sequence, they either attempt to predict whether the next bit will be a 0 or will be a 1 or they issue forecast probabilities for these events. Several variants of this problem are considered. In each case, a no-free-lunch result of the following form is established: the problem of learning is a formidably difficult one, in that (...) no matter what method is pursued, failure is incomparably more common that success; and difficult choices must be faced in choosing a method of learning, since no approach dominates all others in its range of success. In the simplest case, the comparison of the set of situations in which a method fails and the set of situations in which it succeeds is a matter of cardinality (countable vs. uncountable); in other cases, it is a topological matter (meagre vs. co-meagre) or a hybrid computational-topological matter (effectively meagre vs. effectively co-meagre). Four years after the Panama Papers scandal, tax avoidance remains an urgent moral-political problem. Moving beyond both the academic and policy mainstream, I advocate the “democratization of tax enforcement,” by which I mean systematic efforts to make tax avoiders accountable to the judgment of ordinary citizens. Both individual oligarchs and multinational corporations have access to sophisticated tax avoidance strategies that impose significant fiscal costs on democracies and exacerbate preexisting distributive and political inequalities. Yet much contemporary tax sheltering occurs within the (...) letter of the law, rendering criminal sanctions ineffective. In response, I argue for the creation of Citizen Tax Juries, deliberative minipublics empowered to scrutinize tax avoiders, demand accountability, and facilitate concrete reforms. This proposal thus responds to the wider aspiration, within contemporary democratic theory, to secure more popular control over essential economic processes. (shrink)

Agriculture occupies 38% of the planet’s terrestrial surface, using 70% of freshwater resources. Its modern practice is dominated by an industrial–productivist discourse, which has contributed to the simplification and degradation of human and ecological systems. As such, agricultural transformation is essential for creating more sustainable food systems. This paper focuses on discursive change. A prominent discursive alternative to industrial–productivist agriculture is regenerative agriculture. Regenerative discourses are emergent, radically evolving and diverse. It is unclear whether they have the potential to generate (...) the changes required to shift industrial–productivist agriculture. This paper presents a literature-based discourse analysis to illustrate key thematic characteristics of regenerative agricultural discourses. The analysis finds that such discourses: situate agricultural work within nested, complex living systems; position farms as relational, characterised by co-evolution between humans and other landscape biota; perceive the innate potential of living systems as place-sourced; maintain a transformative openness to alternative thinking and practice; believe that multiple regenerative cultures are necessary for deeply regenerative agriculture; and depart from industrialism to varying degrees. The paper concludes by reviewing three transformative opportunities for regenerative discourses—discourse coalitions, translocal organising and collective learning. (shrink)

The formerly established medically-based idea of disability, with its charity-based approach to treatment and services, is being replaced by a human rights-based approach in which people with impairments are no longer considered medical problems, totally dependent on the beneficence of non-impaired people in society, but have fundamental rights to support, inclusion, and participation. In work on the ethics of cognitive enhancement use, there is a pervasive concern that such enhancement will—in some way—make us less authentic. Attempts to clarify what this concern amounts to and how to respond to it often lead to debates on the nature of the “true self” and what constitutes “genuine human activity”. This paper shows that a new and effective way to make progress on whether certain cases of cognitive enhancement problematically undermine authenticity is to make use of (...) considerations from the separate debate on the nature of authentic emotion. Drawing in particular on Wasserman and Liao, the present paper offers new conditions that can help us assess the impact of cognitive enhancements on authenticity. (shrink)

There is a very plausible principle linking abilities and possibilities: If S is able to Φ, then it is metaphysically possible that S Φ’s. Jack Spencer recently proposed a class of counterexamples to this principle involving the ability to know certain propositions. I renew an argument against these counterexamples based on the unknowability of Fitch propositions. In doing so, I provide a new argument for the unknowability of Fitch propositions and show that Spencer’s counterexamples are in tension with a principle (...) weaker than the one linking abilities and possibilities. Adam Ferguson has received little of the renewed attention that contemporary philosophers have given to the philosophers of the Scottish Enlightenment, most notably David Hume, Thomas Reid and Adam Smith. There are good reasons for this difference. Yet, the conception of moral philosophy at work in Ferguson's writings can nevertheless be called upon to throw important critical light on the current enthusiasm for philosophical ethics and applied philosophy. In this essay, Mordechai Gordon interprets Martin Buber's ideas on dialogue, presence, and especially his notion of embracing in an attempt to shed some light on Buber's understanding of listening. Gordon argues that in order to understand Buber's conception of listening, one needs to examine this concept in the context of his philosophy of dialogue. More specifically, his contention is that closely examining Buber's notion of embracing the other is critical to making sense of his conception of listening. (...) Gordon's analysis suggests that, in Buber's model, listening involves a kind of active attentiveness to another's words or actions, engaging them as though they are directed specifically at us. Gordon's discussion of dialogue and listening also indicates that the relation between speaking and listening is one of reciprocity and mutual dependence and that listening plays an essential role in initiating many dialogues by creating a space in which two people can embrace each other as complete individuals. Our examination of universal origins and fine-tuning will begin with a discussion of infl ationary scenarios grafted onto Big Bang cosmology and the proof that all infl ationary spacetimes are past-incomplete. After diverting into a lengthy critical examination of the “different physics” offered by quantum cosmologists at the past-boundary of the universe, we will proceed to dissect the inadequacies of infl ationary explanations and string-theoretic constructs in the context of three cosmological models that have received much attention: the Steinhardt-Turok cyclic (...) ekpyrotic model (which does not invoke inflation), the Gasperini-Veneziano pre-Big Bang infl ationary model, and the inflationary string landscape model advanced by Susskind, Polchinski, Bousso, and Linde. We will argue that none of these highly speculative string cosmologies removes the necessity of a beginning to the process of universe generation, and we will emphasize the implications of this fact. Then, since the inflationary “mechanism” only really addresses the fi ne-tuning of the initial conditions of the universe and not the conditions embodied in its finely tuned laws and constants, we will analyze the adequacy of the string multiverse in its three versions (cyclic ekpyrotic, pre-Big Bang, and landscape) for explaining the nomological structure and values of these precisely tuned life-compatible universal parameters. When all is said and done, it will be clear that transcendent intelligent agency is not just the only causally suffi cient and therefore metaphysically sound explanation for universal origins and fine-tuning, but it is also much more parsimonious, elegant, and resonant with meaning than all of the ad hoc machinations of multiverse cosmology. The practice of science rests on the assumption of dependable regularity in the behavior of the physical world. It presumes that the world has an investigable causal structure and that scientific experimentation, observation, and theorizing provide a reliable pathway to its discernment. This much is not in dispute. What is in dispute is what warrants the metaphysical and methodological assumption—essential to the heuristic utility of science—that nature is uniform in such a way that the present can serve as a key (...) to both the past and the future. This article focuses on the metaphysical foundation and justification for uniformitarian assumptions about nature and argues that they are inconsistent with both metaphysical and methodological naturalism. The problem of divine impassibility, i.e., of whether the divine nature in Christ could suffer, stands at the center of a debate regarding the nature of God and his relation to us. Whereas philosophical reasoning regarding the divine nature maintains that the divine is immutable and perfect in every respect, theological needs generated an ever-growing demand for a passionate God truly able to participate in the suffering of his creatures. Correlating with the different approaches of Thomas Aquinas and John Duns (...) Scotus, the paper develops an incarnation model that aims, on the one hand, to solve the dualistic problem between the divine and human natures, and on the other hand to make room for both impassible and passible elements in God, and so to make room within the patristic impassible model for genuine suffering in God. The discussion, though centered around Christ's im/passibility and passions, can easily be modified to approach the body-mind problem since the essence of the problems is the same. (shrink)

The present volume, _Smart Technologies and Fundamental Rights_, contains fourteen outstanding and challenging articles concerning fundamental rights and Artificial Intelligence at the intersection of law, ethics and smart technologies.

One of the major adaptations during the evolution of Homo sapiens was an increase in brain size. Here we present evidence that a significant and substantial proportion of variation in brain size may be related to changes in temperature. Based on a sample of 109 fossilized hominid skulls, we found that cranial capacities were highly correlated with paleoclimatic changes in temperature, as indexed by oxygen isotope data and sea-surface temperature. Indeed, as much as 52% of the variance in the cranial (...) capacity of these skulls could be accounted for by temperature variation at 100 ka intervals. As an index of more short-term seasonal fluctuations in temperature, we examined the latitude of the sites from which the crania originated. More than 22% of the variance in cranial capacity of these skulls could be accounted for by variation in equatorial distance. (shrink)

The Eucharist, as a pillar of Christian life and faith, stands at the center of the Mass. It bears multi-dimensional meanings and functions, each of which addresses a different aspect of Christian life and mindset. The study resonates dialectically between the Eucharist as a unique religious affirmation of faith and philosophical strategies that are developed to meet its challenges, particularly the rational frameworks by which the believer affirms that the consecrated bread and wine are Christ’s body and blood. On the (...) one hand, the philosophical examination offers new perspectives to understand the Eucharist and its influence on the faithful; on the other hand, the Eucharist and the unique challenges it poses allow us to examine man’s relation to reality within the colors of faith. It will be argued that Edward Schillebeeckx’s discussion of the Eucharist, particularly his attempt to bridge between reality and the symbolic sphere, accords with Heidegger’s reevaluation of the question of Being. The present reading limits itself to the encounter between the mind and the phenomenon and does not proceed to the meaning of the Eucharist as part of the Mass and the crucifixion of Christ. However, the focus of the article is not on the phenomenon but rather on the existential position of the subject and his orientation toward reality. (shrink)

Google Earth allows us to obtain a new vision of the planet we live on, with an ability to zoom in from space to ground level detail at any point on Earth. As it is only recently that we have been able to look toward the Earth from space, we review instead the history of imaging of the Jupiter moon Ganymede, another globe, first seen by Galileo. Observations of Ganymede are mined for lessons on the importance and impact of improving (...) imaging technology. Similarly, new insights may await us when we have proper tools for quantitatively looking at another unexplored globe, the embryo, in a sense for the first time. (shrink)

The most discussed and most significant issue on the religious scene today is whether it is possible, or even desirable, to believe in God. Mr. Kaufman's valuable study does not offer a doctrine of God, but instead explores why God is a problem for many moderns, the dimensions of that problem, and the inner logic of the notion of God as it has developed in Western culture. His object is to determine the function or significance of talk about God: how (...) the concept of God is generated in human experience; the special problems in turn generated by this concept (for example, the intelligibility of the idea of transcendence, the problem of theodicy) and how they are met; and under what circumstances the idea of God is credible or important or even indispensable. He does not try to prove God's existence or nonexistence, but elucidates what the concept of God means and the important human needs it fulfills. The practice of nonphysician ethicist-consultants giving ethics advice concerning the appropriate medical treatment of patients in hospitals is a relatively recent development. Although only a minority of hospitals make substantial use of any formal ethics consulting service, the number is growing and apparently will continue to do so. Indeed, at least among urban teaching hospitals, some sort of ethics consulting service is increasingly commonplace.
