What is the primary function of consciousness in the nervous system? The answer to this question remains enigmatic, not so much because of a lack of relevant data, but because of the lack of a conceptual framework with which to interpret the data. To this end, we have developed Passive Frame Theory, an internally coherent framework that, from an action-based perspective, synthesizes empirically supported hypotheses from diverse fields of investigation. The theory proposes that the primary function of consciousness is well-circumscribed, (...) serving the 'somatic nervous system[. For this system, consciousness serves as a frame that constrains and directs skeletal muscle output, thereby yielding adaptive behavior. The mechanism by which consciousness achieves this is more counterintuitive, passive, and “low level” than the kinds of functions that theorists have previously attributed to consciousness. Passive frame theory begins to illuminate (a) what consciousness contributes to nervous function, (b) how consciousness achieves this function, and (c) the neuroanatomical substrates of conscious processes. Our untraditional, action-based perspective focuses on olfaction instead of on vision and is 'descriptive' (describing the products of nature as they evolved to be) rather than 'normative' (construing processes in terms of how they should function). Passive frame theory begins to isolate the neuroanatomical, cognitive-mechanistic, and representational (e.g., conscious contents) processes associated with consciousness. (shrink)

In contemporary Western society, people are more often called upon to justify the choice not to have children than they are to supply reasons for having them. In this book, Christine Overall maintains that the burden of proof should be reversed: that the choice to have children calls for more careful justification and reasoning than the choice not to. Arguing that the choice to have children is not just a prudential or pragmatic decision but one with ethical repercussions, Overall (...) offers a wide-ranging exploration of how we might think systematically and deeply about this fundamental aspect of human life. Writing from a feminist perspective, she also acknowledges the inevitably gendered nature of the decision; the choice has different meanings, implications, and risks for women than it has for men. After considering a series of ethical approaches to procreation, and finding them inadequate or incomplete, Overall offers instead a novel argument. Exploring the nature of the biological parent-child relationship -- which is not only genetic but also psychological, physical, intellectual, and moral -- she argues that the formation of that relationship is the best possible reason for choosing to have a child. Who owns frozen human embryos? Are "surrogate motherhood" arrangements dangerous for women? Should access to in vitro fertilization be limited or increased? With the development of complex reproductive technologies and the ensuing controversies in reproductive ethics, there is an urgent need for more careful examination of moral principles, current practices, and social policies pertaining to reproduction. The issues examined in this collection of nine papers focusing of the Canadian experience include abortion, the cryopreservation of embryos, the selective termination of fetuses (...) within multiple pregnancies, social policy for gestational "surrogacy," and the regulation of in vitro fertilization. Phenomenology provides a method for disability theorists to describe embodied subjectivity lacking within the social model of disability. Within the literature on body integrity identity disorder (BIID), dominant narratives of disability are influential, individual bodies are considered in isolation, and experiences of disabled people are omitted. Research on BIID tends to incorporate an individualist ontology. In this article, I argue that Merleau-Ponty's conceptualization of “being in the world,” which recognizes subjectivity as embodied and intersubjective, provides a better starting point for (...) research describing the experiences of those with BIID and amputees. Research has shown that a majority of employed women experience sexual harassment and suffer negative repercussions because of it; yet only a minority of these women label their experiences “sexual harassment.” To investigate how people identify sexual harassment, in-depth interviews were conducted with 18 waitpeople in restaurants in Austin, Texas. Most respondents worked in highly sexualized work environments. Respondents labeled sexual advances as sexual harassment only in four specific contexts: when perpetrated by someone who exploited their powerful position for personal (...) sexual gain; when the perpetrator was of a different race/ethnicity than the victim—typically a minority man harassing a white woman; when the perpetrator was of a different sexual orientation than the victim—typically a gay man harassing a straight man; or when violence or the threat of violence was used. The authors argue that the hegemonic norms of acceptable sexual activity privilege heterosexual relationships, legitimize institutionalized forms of sexual exploitation in the workplace, and may protect assailants of the same race and sexual orientation as their victims from charges of sexual harassment. This book is a comparative study of the production and role of maps, charts, and atlases in early modern England and France with a particular focus on Paris and London.

Sometimes beliefs that are shared are treated as if they are knowledge in spite of a lack of evidence or even in the face of evidence to the contrary. Beliefs informed by prejudices and ignorance about people with disabilities are often treated as certain and reinforced by social practices. In this paper, I distinguish between knowledge claims and beliefs that are treated as if they are true. I use Wittgenstein’s account of the connection between epistemic and other social practices in (...) On Certainty to consider how it is possible to change beliefs about disability. I draw on Naomi Scheman’s “Forms of life: Mapping the Rough Ground” to consider political applications of Wittgenstein’s thought. I use a Wittgensteinian framework to critique Peter Singer’s claims regarding the lives of disabilities in Practical Ethics. I draw attention to the ways in which unjustified beliefs about disability can inform and be reified through social practices. Likewise, changes in social practices can dislodge common ableist beliefs about disability. (shrink)

A serious moral weakness of reproductive ‘surrogacy’ is that it can be harmful to the children who are created. This article presents a proposal for mitigating this weakness. Currently, the practice of commercial ‘surrogacy’ operates only in the interests of the adults involved , not in the interests of the child who is created. Whether ‘surrogacy’ is seen as the purchase of a baby, the purchase of parental rights, or the purchase of reproductive labor, all three views share the same (...) significant flaws. They endorse the transfer, for a fee, of the infant from the woman who gestated it to those who commissioned it, but without justifying such a transfer; they fail to demonstrate that the commissioners have any entitlement to the infant, or, for that matter, suitability to be the infant's parents; and they fail to take any notice of the infant's needs, interests, and wellbeing. A mere genetic connection is not enough to establish that the commissioners are entitled to receive the baby or that they are competent to raise it. Their good intentions, however caring, are not enough. Therefore, just as in the practice of adoption, there should be a formal institutionalized system for screening and licensing the prospective social parents, which would make the infant's needs, interests, and wellbeing paramount. I reply to several potential objections to this proposal, including the objection that genetic parents who raise their own child are not screened and licensed. (shrink)

In this paper, we present a new semantic challenge to the moral error theory. Its first component calls upon moral error theorists to deliver a deontic semantics that is consistent with the error-theoretic denial of moral truths by returning the truth-value false to all moral deontic sentences. We call this the ‘consistency challenge’ to the moral error theory. Its second component demands that error theorists explain in which way moral deontic assertions can be seen to differ in meaning despite necessarily (...) sharing the same intension. We call this the ‘triviality challenge’ to the moral error theory. Error theorists can either meet the consistency challenge or the triviality challenge, we argue, but are hard pressed to meet both. This paper explores, from a feminist perspective, the justification of major surgical reshaping of the body. I define “transracialism” as the use of surgery to assist individuals to “cross” from being a member of one race to being a member of another. If transsexualism, involving the use of surgery to assist individuals to “cross” from female to male or from male to female, is morally acceptable, and if providing the medical and social resources to enable sex crossing is not morally (...) problematic, then transracialism should be morally acceptable, and providing medical and social resources to facilitate race crossing is not necessarily morallyproblematic. To explore this idea, I present and evaluate eight possible arguments that might be given against accepting transracialism, and I show that each of them is unsuccessful. (shrink)

Recent debate about the error theory has taken a ‘formal turn’. On the one hand, there are those who argue that the error theory should be rejected because of its difficulties in providing a convincing formal account of the logic and semantics of moral claims. On the other hand, there are those who claim that such formal objections fail, maintaining that arguments against the error theory must be of a substantive rather than a formal kind. The idea of dignity is often taken to be a foundation for principles of justice and democracy. In the West it has numerous formulations and conceptualisations. Within the capabilities approach to justice theorists have expanded the concept of dignity to encompass animals and ecological communities. In this article I rework the idea of dignity to include the Māori philosophical concepts of Mauri, tapu and mana – something I argue is necessary if the capabilities approach is to decolonise in the Aotearoa (...) context. Furthermore, the article links the nation’s recognition of three extensive geographical regions – Te Awa Tupua, Te Urewera and Mt Taranaki – as legal persons to Mātauranga Māori and nonhuman dignity. In doing so, I identify the potential that this understanding of dignity and these legal moves have to decolonise democracy within the settler state. (shrink)

Much thought has been devoted to how metaethical disagreement between moral realism and expressivism can be saved once minimalism starts creeping. Very little thought has been given to how creeping minimalism affects error-theories’ disagreement with their metaethical competitors. The reason for this omission, I suspect, is found in the belief that whilst locating distinctive moral realist and expressivist positions within a minimalist landscape poses a severe challenge, no such difficulties are encountered when differentiating error-theories from moral realism and expressivism. In (...) the first part of this paper, I show that this belief is mistaken: Insofar as moral realists and error-theorists are still taken to disagree, creeping minimalism renders their disagreement moral, but makes these positions metaethically indistinguishable. In the second part of the paper, I present a modified inferentialist solution to the problem of creeping minimalism which seeks to put error-theories back on the metaethical map. Yet, this too comes at a cost, in that it significantly modifies our interpretation of error-theories. Whichever way we turn, then, creeping minimalism not only forces us to re-phrase metaethical positions in a way that is compatible with minimalism, but also requires us to change our very understanding of these positions. Research on academic pay finds an unexplained gender pay gap that has not fully dissolved over time and that appears to increase with years of experience. In this study, I consider how role congruity bias contributes to this pay gap. Bias is more likely to manifest in a context where there is some ambiguity about performance and where stereotypes are stronger. I predict that bias in the attribution of credit for coauthored research leads to lower returns to research for female (...) professors. To test this prediction, I use a sample of Canadian faculty in accounting, where research is typically coauthored, where females are underrepresented at the most senior ranks, and where many universities evaluate merit in research, teaching, and service to determine salary increases. In regressions of salary on individual and institutional determinants of salary, I find that women earn marginally less than men. However, the pay gap is only evident for women who publish in a selective list of journals; for the subset of faculty with no publications from this list, there are no significant differences in salary. For researching faculty, the pay gap relates specifically to research productivity. While women publish less on average than men, the returns to their research are also lower. In particular, the relation between the individual’s research ranking and salary is significantly lower for women who publish a higher proportion of their work with men, than for all other faculty. Additional analysis of salary and coauthor patterns confirms that women receive significantly less credit for coauthored articles they publish with men than those they publish with other women but that no similar variations in reward are evident for men across publishing patterns. These findings suggest bias in the attribution of credit for coauthored research in the determination of salary, consistent with role congruity theory, and provide an important potential explanation for why salaries for women vary systematically from those of men even after considering productivity. Providing lower rewards for equal work represents a continuing ethical issue in academe and compounds the challenges women already facing in the profession. (shrink)

Most of those who hold that emotions involve appraisals also accept that the content of emotions is nonconceptual. The main motivation for nonconceptulism regarding emotions is that it accounts for the difference between emotions and evaluative judgements. This paper argues that if one assumes a broadly Fregean account of concepts, there are good reasons to accept that emotions have nonconceptual contents. All the main arguments for nonconceptualism regarding sensory perception easily transpose to the case of emotions. The paper ends by (...) responding to two important objections: firstly, that nonconceptualism rules out the possibility that emotions justify evaluative judgements and secondly, that nonconceptualism cannot account for the fact that some emotions have conceptually articulated cognitive bases. Ascribing moral responsibility in collective action cases is notoriously difficult. After all, if my individual actions make no difference with regard to the prevention of climate change, the alleviation of poverty, or the outcome of national elections, why ought I to stop driving, donate money, or cast my vote? Neither consequentialist nor non-consequentialist moral theories have straightforward responses ready at hand. In this contribution, I present a new suggestion which, based on thoughts about causal overdetermination along the lines of Mackie’s (...) INUS account, aims to show that causally overdetermined collective action cases are morally arbitrary in a way that makes it possible to ascribe moral responsibility even if individual actions make no difference. This study seeks to understand women's use of makeup in the workplace. The authors analyze 20 in-depth interviews with a diverse group of women who work in a variety of settings to examine the appearance rules that women confront at work and how these rules reproduce assumptions about sexuality and gender. The authors found that appropriate makeup use is strongly associated with assumptions about health, heterosexuality, and credibility in the workplace. They describe how these norms shape women's personal choices to (...) wear makeup. Next, they examine how some women transform the meanings of wearing makeup and, in rare instances, attempt to subvert the institutionalized norms. Although many women find pleasure in wearing makeup, the authors conclude that the institutional constraints imposed by the workplace effectively limit the possibilities for resistance. (shrink)

Christine Battersby is a leading thinker in the field of philosophy, gender studies and visual and literary aesthetics. In this important new work, she undertakes an exploration of the nature of the sublime, one of the most important topics in contemporary debates about modernity, politics and art. Through a compelling examination of terror, transcendence and the ‘other’ in key European philosophers and writers, Battersby articulates a radical ‘female sublime’. A central feature of _The Sublime, Terror and Human Difference_ is (...) its engagement with recent debates around ‘9/11’, race and Islam. Battersby shows how, since the eighteenth century, the pleasures of the sublime have been described in terms of the transcendence of terror. Linked to the ‘feminine’, the sublime was closed off to flesh-and-blood women, to ‘Orientals’ and to other supposedly ‘inferior’ human types. Engaging with Kant, Burke, the German Romantics, Nietzsche, Derrida, Lyotard, Irigaray and Arendt, as well as with women writers and artists, Battersby traces the history of these exclusions, while finding resources within the history of western culture for thinking human differences afresh _The Sublime, Terror and Human Difference_ is essential reading for students of continental philosophy, gender studies, aesthetics, literary theory, visual culture, and race and social theory. This contribution considers whether or not it is possible to devise a coherent form of external skepticism about the normative if we ‘relax’ about normative ontology by regarding claims about the existence of normative truths and properties themselves as normative. I answer this question in the positive: A coherent form of non-normative error-theories can be developed even against a relaxed background. However, this form no longer makes any reference to the alleged falsity of normative judgments, nor the non-existence of normative (...) properties. Instead, it concerns a specifically inferentialist construal of error-theories which suggests that error-theorists should abstain from any claims about normative ontology to focus exclusively on claims about the inferential role of normative vocabulary. As I will show, this suggestion affords a number of important advantages. However, it also comes at a cost, in that it might not only change the letter, but also the spirit of traditional error-theories. (shrink)

When women work in male-dominated professions, they encounter a “glass ceiling” that prevents their ascension into the top jobs. Twenty years ago, I introduced the concept of the “glass escalator,” my term for the advantages that men receive in the so-called women’s professions, including the assumption that they are better suited than women for leadership positions. In this article, I revisit my original analysis and identify two major limitations of the concept: it fails to adequately address intersectionality; in particular, it (...) fails to theorize race, sexuality, and class; and it was based on the assumptions of traditional work organizations, which are undergoing rapid transformation in our neoliberal era. The glass escalator assumes stable employment, career ladders, and widespread support for public institutions —which no longer characterize the job market today. Drawing on my studies of the oil and gas industry and the retail industry, I argue that new concepts are needed to understand workplace gender inequality in the 21st century. (shrink)

: Public toilets are a key part of the urban environment. This paper examines and evaluates the pervasive sex segregation, throughout North America, of public toilets. The issue is situated within a larger context—the design and management of the urban environment; larger assumptions about sexuality, reproduction, and privacy that govern that environment; and continuing compulsory sex identification and segregation which still define key areas of "public" space. I examine seven groups of arguments in favor of sex segregation, arguing that all (...) of them are inadequate. This article uses elements of autoethnography to theorize an in/formal support relationship between a friend with a physical disability, who uses attendant services, and me. Through thinking about our particular “frien-tendant” relationship, I find the common scholarly orientations toward “care” are inadequate. Starting from the conversations between feminist and disability perspectives on care, I build on previous work to further develop the theoretical framework of accessible care. Accessible care takes a critical, engaged approach that moves beyond understanding “accessibility” as merely (...) concrete solutions to create more inclusive forms of care. Care, in this context, is positioned as an unstable tension among competing definitions, including that it is a complex form of oppression. Accessible care draws on feminist disability perspectives and the feminist political ethic of care to build bridges in four areas: from daily experiences of disability and support to theoretical discussions; across feminist care research and disability perspectives; across divisions and anxieties within disability communities; and from the local to transnational applications. These bridges do not aim to resolve debates but allow us to travel back and forth between differing perspectives and demonstrate the tenuous possibility of accessible practices and concepts of care.
