BackgroundThe last few decades have seen the rising global acknowledgment of the importance of ethics in the conduct of health research. But research ethics committees or institutional review boards (IRBs) have also been criticized for being barriers to research. This article examines the case of the Philippines, where little has been done to interrogate the health research and IRB culture, and whose circumstances can serve as reflection points for other low- and middle-income countries.MethodsSemi-structured interviews were conducted from July to October (...) 2020 to elicit health researchers’ perspectives and experiences regarding IRBs and the ethics approval process in the country, as well as counterpoint narratives from researchers who have also worked for IRBs.ResultsAcross the fields of clinical, public health, and social science research, the issue of ethics review revealed itself to be foremost an issue of inequity. IRB processes serve as a barrier for those outside the academe; those belonging to institutions, cities, or entire regions without their own accredited IRBs; and researchers working independently, without ample budget, or on highly specialized topics—more so for non-clinical researchers who must grapple with the primarily biomedical framework of most IRBs. Consequently, the research landscape invariably favors those with the resources to do research, and researches that tend to attract funding.ConclusionThe broader challenge of equity in health research will entail more fundamental reforms, but proximal interventions can be done to make the ethics approval process more equitable, such as enhancing institutional oversight, regulating IRB fees, and enabling a more supportive and welcoming environment for early-career, student, independent, and non-clinical health researchers. This article ends by reflecting on the implications of our findings toward the larger research culture. (shrink)

The paper examines the conditions under which we are responsible for actions performed under duress, focusing on a real case in which a soldier was compelled at gunpoint to participate in the massacre of civilian prisoners. The case stands for a class of cases in which the compelled act is neither clearly justified nor clearly excused on grounds of temporary incapacity, but in which it is nonetheless plausible that the agent is not morally blameworthy. The theoretical challenge is to identify (...) the excuse in such cases and to explain its basis. The paper argues that when mortal duress excuses in cases of this sort, it does so because the compelled act, though impermissible and freely chosen, nonetheless fails to manifest ‘an insufficiently good will’. The argument depends on a potentially controversial thesis in the ethics of concern, namely, that a thoroughly decent moral agent—someone who cares enough about morality and the values that underlie it—will not always be moved to do what he knows he ought to do. In this Article we explore the evolution of property law and examine the applicability of the prevailing accounts according to which property institutions oscillate between the extreme points of open access and private property. We show that the evolution of property is a much more nuanced process, shaped by the interplay of the following three dimensions: number of owners, extent of dominion and asset configuration. Accordingly, property institutions can assume a myriad of positions along the aforementioned dimensions in response to (...) the constant change in exclusion and management costs. This chapter explores bridge-law non-naturalism: the view that when a particular thing possesses a moral property or stands in a moral relation, this fact is metaphysically grounded in non-normative features of the thing in question together with a general moral law. Any view of this sort faces two challenges, analogous to familiar challenges in the philosophy of science: to specify the form of the explanatory laws, and to say when a fact of that form qualifies as a law. In this stimulating investigation, Gideon Freudenthal has linked social history with the history of science by formulating an interesting proposal: that the supposed influence of social theory may be seen as actual through its co herence with the process of formation of physical concepts. The reinterpre tation of the development of science in the seventeenth century, now widely influential, receives at Freudenthal's hand its most persuasive statement, most significantly because of his attention to the theoretical form which is charac (...) teristic. of classical Newtonian mechanics. He pursues the sources of the parallels that may be noted between that mechanics and the dominant philosophical systems and social theories of the time; and in a fascinating development Freudenthal shows how a quite precise method - as he descriptively labels it, the 'analytic-synthetic method' - which underlay the Newtonian form of theoretical argument, was due to certain interpretive premisses concerning particle mechanics. If he is right, these depend upon a particular stage of con ceptual achievement in the theories of both society and nature; further, that the conceptual was generalized philosophically; but, strikingly, Freudenthal shows that this concept-formation itself was linked to the specific social relations of the times of Newton and Hobbes. When a person acts from ignorance, he is culpable for his action only if he is culpable for the ignorance from which he acts. The paper defends the view that this principle holds, not just for actions done from ordinary factual ignorance, but also for actions done from moral ignorance. Van Fraassen defines constructive empiricism as the view that science aims to produce empirically adequate theories. But this account has been misunderstood. Constructive empiricism in not, as it seems, a description of the intentional features of scientific practice, nor is it a normative prescription for their revision. It is rather a fiction about the practice of science that van Fraassen displays in the interests of a broader empiricism. The question of nihilism is always a question of truth. It is a crisis of truth that causes the experience of the nothingness of existence. What elevated truth to this existential position? The answer is: philosophy. The philosophical will to truth opens the door to nihilism, since it both makes identifying truth the utmost aim and yet continually calls it into question. Baker develops the central insight that the crises of truth and of existence, or 'loss of world', that occur (...) within nihilistic thought are inseparable, in a wide-ranging study from antiquity to the present, from ancient Cynics, St Paul, Nietzsche, Heidegger, Foucault, Agamben, and Badiou. Baker contends that since nihilism is always a question of the relation to the world occasioned by the philosophical will to truth, an answer to nihilism must be able to propose a new understanding of truth. Moses Mendelssohn is considered the foremost representative of Jewish Enlightenment. In _No Religion without Idolatry_, Gideon Freudenthal offers a novel interpretation of Mendelssohn’s general philosophy and discusses for the first time Mendelssohn’s semiotic interpretation of idolatry in his _Jerusalem _and in his Hebrew biblical commentary. Mendelssohn emerges from this study as an original philosopher, not a shallow popularizer of rationalist metaphysics, as he is sometimes portrayed. Of special and lasting value is his semiotic theory of idolatry. From a semiotic (...) perspective, both idolatry and enlightenment are necessary constituents of religion. Idolatry ascribes to religious symbols an intrinsic value: enlightenment maintains that symbols are conventional and merely signify religious content but do not share its properties and value. Without enlightenment, religion degenerates to fetishism; without idolatry it turns into philosophy and frustrates religious experience. Freudenthal demonstrates that in Mendelssohn’s view, Judaism is the optimal religious synthesis. It consists of transient ceremonies of a “living script.” Its ceremonies are symbols, but they are not permanent objects that could be venerated. Jewish ceremonies thus provide a religious experience but frustrate fetishism. Throughout the book, Freudenthal fruitfully contrasts Mendelssohn's views on religion and philosophy with those of his contemporary critic and opponent, Salomon Maimon. _No Religion without Idolatry _breaks new ground in Mendelssohn studies. Calls to ?build civil society?, ?create active citizenship?, ?empower communities?, or ?widen political participation? are growing by the day. They are heard in academia, the private sector, among NGOs and increasingly in government. In short, the rhetoric of self?government, that ideal dear to republicans, is back on the political agenda. This time, however, it is increasingly tied to the category of civil society. Yet can the programme of ?more power to civil society? really achieve democratic autonomy in the way that (...) many neo?republicans want it to? This article pursues this question, first, by reconstructing an ideal?type model of republican civil society from the writings of Hannah Arendt and Vaclav Havel ? two influential theorists of self?organisation in civil society. Second, it asks, sceptically, where such a civil society will come from, whether it can be fully reconciled with modernity and how ? if at all ? it can meet the charge of voluntarism. These critical interrogations are followed by a further three, focusing on the problematic absence of the market in the republican account of civil society, its under?theorised ? even Utopian ? notion of power and, finally, its likely complicity in the ongoing exclusion of women from the public sphere. The article concludes by calling for a more ambitious, wide?ranging vision of republican autonomy than the narrow emphasis on civil society will allow. (shrink)

In Michael Moore's important book Causation and Responsibility, he holds that causal contribution matters to responsibility independently of its relevance to action. We are responsible for our actions, according to Moore, because where there is action, we typically also find the kind of causal contribution that is crucial for responsibility. But it is causation, and not action, that bears the normative weight. This paper assesses this claim and argues that Moore's reasons for it are unconvincing. It is suggested that sometimes (...) a person's responsibility for that to which he causally contributes depends on his recognition of an identity between himself and the protagonist of the event for which he is held responsible. Since this fact about identity is not captured by causal contribution, action matters to responsibility for reasons that are not exhausted by the fact that action involves causal contribution. The relevance of this idea for accomplice liability is also briefly discussed. (shrink)

This title was first published in 2002. This collection of essays aims to present a wide range of interpretations of central themes in Spinoza's philosophy. Philosophical interpretations of Spinoza divide into three general categories. The first sets Spinoza within what is taken to be his historical context. Special emphasis is laid here on aspects of his teaching that seem to bear the influence of Spinoza's own education (and self-education), either through concepts assimilated into his own thinking, or those he undertook (...) to refute and displace. A second interpretative approach uses analytical tools in an attempt to reconstruct Spinozistic issues and theories critically. Finally, there are philosophers who explore Spinoza's texts in their own terms, attempting to present a coherent picture of one or more aspects of Spinoza's teaching. Given the broad span of issues with which Spinoza deals, the latter is often the most difficult track to follow. The 25 articles in this collection exemplify these three attitudes to Spinoza interpretation, though most avail themselves of more than one. In making the selection the editors preferred studies that treat their subject as a viable, endurable philosophical issue, whether the writer accepts Spinoza's presentation or highlights his difficulties. On each issue the articles critically analyze the texts, rather than simply portraying the Spinozistic ideas they express. (shrink)

It’s not uncommon for people to try to shield themselves from blame or punishment by saying, “But everybody does that!”. This BEDT defense seems more appealing as a defense to some offenses than to others. In a neglected paper, Doug Husak describes various types of crime to which the BEDT ought, he argues, be a defense. This paper extends his work by identifying a category he overlooks. The paper argues that often the BEDT shields from blame and punishment because the (...) prevalence of the offense in the community shows that the punisher does not speak for the community when issuing the punishment. Since the punisher’s authority depends on its doing so, the BEDT shows in such cases that the punisher should stay its hand. (shrink)

Fictionalism about possible worlds is the view that talk about worlds in the analysis of modality is to be construed as ontologically innocent discourse about the content of a fiction. Versions of the view have been defended by D M Armstrong (in "A Combinatorial Theory of Possibility") and by myself (in "Modal Fictionalism', "Mind" 99, July 1990). The present note argues that fictionalist accounts of modality (both Armstrong's version and my own) fail to serve the fictionalists ontological purposes because they (...) imply that as a matter of necessity there exist many worlds. Howard Adelmann’s majestic five volume Marcello Malpighi and the Evolution of Embryology was published nearly 50 years ago. A mix of paraphrase and translation, as well as extended commentary, Adelmann described Malpighi as “one of the cardinal figures in the history of biology. As we look back over the three centuries that separate him from us, he may, for all his towering stature, at first glance seem a distant figure. And yet he and his work are not so remote after (...) all” . Much has changed in the history of biology since Adelmann’s groundbreaking work, and among the many lessons to be taken from Domenico Bertoloni-Meli’s carefully researched, persuasive and, at times, beautifully rendered book is that the life sciences in the early modern period must be studied with an eye to the history of science, medicine and philosophy—i.e., calling Malpighi simply a “biologist” is very liable to mislead. As part of the preparations to establish a population-based biobank in a large Israeli health organization, we aimed to investigate through focus groups the knowledge, perceptions and attitudes of insured Israelis, toward biobanking, and then, after input from focus groups’ participants, to empirically assess the impact of a revised recruitment process on recruitment rates. 1) Six Focus group discussions were conducted with individuals who had routine blood laboratory tests taken in the last 2 years. 2) After addressing the issues raised (...) in the focus groups and revising the recruitment process, individuals undergoing routine blood tests in phlebotomy clinics were invited to participate in the future biobank. At the outset of the focus groups there was an overall positive response to the prospect of a population-based biobank. Concerns revolved around infringement on privacy, fears of the “big brother”, and anxiety about inequality. Reaction to the language of the informed consent document revolved around concerns over ability to maintain anonymity, to withdraw consent, involvement of commercial entities, and the general tenor of the informed consent, which was perceived as legalistic and unilateral. In general, the longer participants were exposed to discussion about the biobank, the less likely they were to consent to sign in. Overall, only 20% of the 60 participants stated they would agree to sign in by the end of the 2 hour group session. The feedback obtained from the focus groups was used in the second stage of the study. A team of recruiters received extensive training to enable fruitful discussion and a detailed explanation to questions and concerns raised during the recruitment process. During the second stage of the study, after revising the consent form and training recruiters, a 53% consent rate was observed among 10,262 participants, more than 4 fold higher than estimated at the focus group stage. The qualitative focus group research helped identify important perceptions and concerns, which were subsequently addressed in the revised consent form and in the discussion the recruiters had with potential biobank donors.
