BackgroundThe last few decades have seen the rising global acknowledgment of the importance of ethics in the conduct of health research. But research ethics committees or institutional review boards (IRBs) have also been criticized for being barriers to research. This article examines the case of the Philippines, where little has been done to interrogate the health research and IRB culture, and whose circumstances can serve as reflection points for other low- and middle-income countries.MethodsSemi-structured interviews were conducted from July to October (...) 2020 to elicit health researchers’ perspectives and experiences regarding IRBs and the ethics approval process in the country, as well as counterpoint narratives from researchers who have also worked for IRBs.ResultsAcross the fields of clinical, public health, and social science research, the issue of ethics review revealed itself to be foremost an issue of inequity. IRB processes serve as a barrier for those outside the academe; those belonging to institutions, cities, or entire regions without their own accredited IRBs; and researchers working independently, without ample budget, or on highly specialized topics—more so for non-clinical researchers who must grapple with the primarily biomedical framework of most IRBs. Consequently, the research landscape invariably favors those with the resources to do research, and researches that tend to attract funding.ConclusionThe broader challenge of equity in health research will entail more fundamental reforms, but proximal interventions can be done to make the ethics approval process more equitable, such as enhancing institutional oversight, regulating IRB fees, and enabling a more supportive and welcoming environment for early-career, student, independent, and non-clinical health researchers. This article ends by reflecting on the implications of our findings toward the larger research culture. (shrink)

The paper examines the conditions under which we are responsible for actions performed under duress, focusing on a real case in which a soldier was compelled at gunpoint to participate in the massacre of civilian prisoners. The case stands for a class of cases in which the compelled act is neither clearly justified nor clearly excused on grounds of temporary incapacity, but in which it is nonetheless plausible that the agent is not morally blameworthy. The theoretical challenge is to identify (...) the excuse in such cases and to explain its basis. The paper argues that when mortal duress excuses in cases of this sort, it does so because the compelled act, though impermissible and freely chosen, nonetheless fails to manifest ‘an insufficiently good will’. The argument depends on a potentially controversial thesis in the ethics of concern, namely, that a thoroughly decent moral agent—someone who cares enough about morality and the values that underlie it—will not always be moved to do what he knows he ought to do. In this Article we explore the evolution of property law and examine the applicability of the prevailing accounts according to which property institutions oscillate between the extreme points of open access and private property. We show that the evolution of property is a much more nuanced process, shaped by the interplay of the following three dimensions: number of owners, extent of dominion and asset configuration. Accordingly, property institutions can assume a myriad of positions along the aforementioned dimensions in response to (...) the constant change in exclusion and management costs. In this stimulating investigation, Gideon Freudenthal has linked social history with the history of science by formulating an interesting proposal: that the supposed influence of social theory may be seen as actual through its co herence with the process of formation of physical concepts. The reinterpre tation of the development of science in the seventeenth century, now widely influential, receives at Freudenthal's hand its most persuasive statement, most significantly because of his attention to the theoretical form which is charac (...) teristic. of classical Newtonian mechanics. He pursues the sources of the parallels that may be noted between that mechanics and the dominant philosophical systems and social theories of the time; and in a fascinating development Freudenthal shows how a quite precise method - as he descriptively labels it, the 'analytic-synthetic method' - which underlay the Newtonian form of theoretical argument, was due to certain interpretive premisses concerning particle mechanics. If he is right, these depend upon a particular stage of con ceptual achievement in the theories of both society and nature; further, that the conceptual was generalized philosophically; but, strikingly, Freudenthal shows that this concept-formation itself was linked to the specific social relations of the times of Newton and Hobbes. Frequently, those who commit a crime forcibly are subject to greater punishment than those who commit the same crime without using force. But uncertainty surrounds the conditions that must be met for an act to be performed with force. It is particularly puzzling that acts that are committed through threat, which are in no way harmful, are nonetheless classified under the law as forcibly committed. This paper explains why by offering an account of a particular kind of harmless force. On (...) the account offered, an act is performed with this type of force just in case it manifests a disposition to escalate in the face of obstacles permissibly imposed by the victim. The paper argues that conduct that manifests such a disposition causes the victim’s agency to be implicated in the wrong done to them by causing them to refrain from realizing obstacles to the wrong. Forcible conduct, therefore, invades another’s autonomy in a way that non-forcible conduct does not and is, for that reason, more wrongful. (shrink)

On October 27, 1991, a Jewish woman named Rachel Drouk, a settler in the West Bank, was killed by Palestinian Intifada fighters. Twenty-five women spontaneously gathered at the site of the murder and held a vigil—a vigil that eventually developed into a protest settlement. The women, all of whom were married mothers, presented their initiative in maternal narratives: grounds, motives, and justifications for the act, and targets and anticipations were all related to the practice of care. This article conducts an (...) artificial dialogue between the women's discourse and Ruddick's theory of maternal thinking, enabling deconstruction of the former and a critique of the theory of care. Calls to ?build civil society?, ?create active citizenship?, ?empower communities?, or ?widen political participation? are growing by the day. They are heard in academia, the private sector, among NGOs and increasingly in government. In short, the rhetoric of self?government, that ideal dear to republicans, is back on the political agenda. This time, however, it is increasingly tied to the category of civil society. Yet can the programme of ?more power to civil society? really achieve democratic autonomy in the way that (...) many neo?republicans want it to? This article pursues this question, first, by reconstructing an ideal?type model of republican civil society from the writings of Hannah Arendt and Vaclav Havel ? two influential theorists of self?organisation in civil society. Second, it asks, sceptically, where such a civil society will come from, whether it can be fully reconciled with modernity and how ? if at all ? it can meet the charge of voluntarism. These critical interrogations are followed by a further three, focusing on the problematic absence of the market in the republican account of civil society, its under?theorised ? even Utopian ? notion of power and, finally, its likely complicity in the ongoing exclusion of women from the public sphere. The article concludes by calling for a more ambitious, wide?ranging vision of republican autonomy than the narrow emphasis on civil society will allow. (shrink)

The widely held assumption about what motivated On Denoting is irreconcilable with Russell's position shortly beforehand; but discarding it leaves one with a carefully worked out solution whose problem is missing. The real motivation is to be found in a notoriously obscure passage in OD, in which Russell exposes a decisive (though easily overlooked) flaw in his former theory of denoting; a flaw which also cripples Frege's theory of sense and reference. A comprehensive account of this passage is the chief (...) concern of the present paper. Recognizing the critical role of this argument of Russell's leads to a more credible account of his argumentation in that essay. It also suggests that the fundamental standpoint underlyingThe Principles of Mathematics remains intact. In this light, the appropriation of OD to the philosophy of language may be misguided. The philosophy of punishment’s focus on the question of justification has left the question of definition neglected. This article explains why there is a need for necessary and sufficient conditions for punishment and offers a new account. Under the theory proposed, to inflict a punishment is to make fewer things permissible for another to do. Since not every such restriction is punishment, an account is offered of the additional conditions needing to be met. Van Fraassen defines constructive empiricism as the view that science aims to produce empirically adequate theories. But this account has been misunderstood. Constructive empiricism in not, as it seems, a description of the intentional features of scientific practice, nor is it a normative prescription for their revision. It is rather a fiction about the practice of science that van Fraassen displays in the interests of a broader empiricism. The article responds to an influential critique of the view that there is a conceptual distinction between kinds of liberty. The critique in question began with Gerald MacCallum Jr’s famous argument that liberty is a single concept that has a triadic structure between agent, constraint, and end. Against this view, the article argues that the triadic structure offered by MacCallum is unable to conceptualize a particular distinct understanding of liberty. Following Charles Taylor, the article defends the view that there is (...) a distinct ‘exercise-concept’ of liberty that the triadic structure cannot account for. In support of this claim, the article contests a recent argument that an exercise-concept of liberty can be conceptualized in terms of the triadic structure. The article argues that the triadic framework can only conceptualize an exercise-concept of liberty at the cost of abandoning the substance of that framework. To defend this, the article explains that the triadic structure and an exercise-concept are basically conceptually distinct in virtue of the fact that the former embodies a ‘static’ concept, whereas the latter embodies a ‘dynamic’ one. To complete the argument that an exercise-concept is a distinct concept of liberty, the article articulates a common theme that unifies both the triadic structure and an exercise-concept as concepts of liberty. In the present paper I shall deal with Adam Smith's application of the analytic-synthetic method, which he considered to be the scientific method par excellence. I shall concentrate on some shortcomings in Smith's arguments and endeavour to explain them as resulting from a particular interpretation of the aforesaid method. The peculiarity of Smith's interpretation was that he omitted the analysis and that he thought the synthesis reflects the composition of an object out of pre-existing elements which are endowed with ‘essential (...) qualities’. I shall then try to show that this methodological concept presupposed the view that society is a compound of independent individuals, i.e. an aggregate of Robinson Crusoes. Finally I shall discuss possible political reasons for this view. On the systematic level, I shall argue that political and scientific partisanship do not necessarily stand in contradiction to objective knowledge, and on the historical level, I shall plead for a ‘Social History of Ideas’.1. The ArgumentIn this paper I argue first that Marx's Critique of Political Economy employs “critique” in the Kantian meaning of the term—i.e., determining the domain of legitimate application of the categories involved and maintaining that outside these borders understanding is led into error and entangled in metaphysics.According to Marx, his predecessors in political economy transgressed these boundaries of application, and therefore conceived of all different modes of production as being essentially similar to commodity production, and thus implied that commodity production (...) and the bourgeois form of life corresponding to it are “natural” not historical and transitory. In Marx's conception there are no super-historical economic categories or laws.I argue moreover that Marx's methodology of reconstructing the “development” of socioeconomic entities and categories from their “germ” or “cell” also serves his critical intention. Whereas social theorists of the time referred with organic metaphors to human collectives, Marx referred with such metaphors to economic entities only. The difference is crucial, since the first carries deterministic consequences for the development of society while the latter does not: Social form and historical development in Marx are contingent and not necessary, historical and not natural, transitory and not eternal.I also stress that Marx's procedure of critique is internal. He uses only such assumptions, observations, and arguments as could in principle also be used by the scholars criticized. Nevertheless the outcome of the critique is not merely a new theory but an entirely different one — i.e., a historical conception of the discipline of political economy and of its laws. (shrink)

Moses Mendelssohn is considered the foremost representative of Jewish Enlightenment. In _No Religion without Idolatry_, Gideon Freudenthal offers a novel interpretation of Mendelssohn’s general philosophy and discusses for the first time Mendelssohn’s semiotic interpretation of idolatry in his _Jerusalem _and in his Hebrew biblical commentary. Mendelssohn emerges from this study as an original philosopher, not a shallow popularizer of rationalist metaphysics, as he is sometimes portrayed. Of special and lasting value is his semiotic theory of idolatry. From a semiotic (...) perspective, both idolatry and enlightenment are necessary constituents of religion. Idolatry ascribes to religious symbols an intrinsic value: enlightenment maintains that symbols are conventional and merely signify religious content but do not share its properties and value. Without enlightenment, religion degenerates to fetishism; without idolatry it turns into philosophy and frustrates religious experience. Freudenthal demonstrates that in Mendelssohn’s view, Judaism is the optimal religious synthesis. It consists of transient ceremonies of a “living script.” Its ceremonies are symbols, but they are not permanent objects that could be venerated. Jewish ceremonies thus provide a religious experience but frustrate fetishism. Throughout the book, Freudenthal fruitfully contrasts Mendelssohn's views on religion and philosophy with those of his contemporary critic and opponent, Salomon Maimon. _No Religion without Idolatry _breaks new ground in Mendelssohn studies.
