In this Article we explore the evolution of property law and examine the applicability of the prevailing accounts according to which property institutions oscillate between the extreme points of open access and private property. We show that the evolution of property is a much more nuanced process, shaped by the interplay of the following three dimensions: number of owners, extent of dominion and asset configuration. Accordingly, property institutions can assume a myriad of positions along the aforementioned dimensions in response to (...) the constant change in exclusion and management costs. The dominance of the Abrahamic tradition in contemporary analytic philosophy of religion has led some to call for greater exploration of alternatives to the traditional conception of God, such as Pantheism, Ultimism, and Axiarchism. While we think this call for alternatives is important, we go in a different direction. Rather than explore and defend alternative conceptions of God, we defend a range of fairly traditional but non-religious conceptions of God. Ethnic markers are a prominent organizing feature of human society when individuals engage in significant anonymous interactions. However, identifying markers in natural settings is nontrivial. Although ad hoc assignment of markers to groups is widely documented in the ethnographic literature, predicting the membership of individuals based on stylistic variation is less clear. We argue that a more systematic approach is required to satisfy the basic assumptions made in ethnic marker theory. To this end we introduce a three-step ethnographic method to (...) assess the presence, recognition, and transmission of markers of group identity: continual scans, a utilization survey, and a comparative classification task. Applying the method to a study of culturally significant motifs in the South Pacific Island nation of Tonga, we provide evidence that the motif set satisfies basic theoretical assumptions and thus the motifs are likely expressions for social coordination. We also found that the coordinating role of each motif is variable and requires further investigation. (shrink)

_Higher Education in Nazi Germany_ was first published in 1944, when it was apparent that Germany was likely to lose the war. Developing themes that were to become commonplace in the analysis of totalitarian regimes, it provides an account of how higher education became a means of both installing and re-enforcing the dominant state ideology.

Why did Bernhard Riemann, arguably the most original mathematician of his generation, spend the last year of life investigating the mechanism of hearing? Fighting tuberculosis and the hostility of eminent scientists such as Hermann Helmholtz, he appeared to forsake mathematics to prosecute a case close to his heart. Only sketchy pages from his last paper remain, but here we assemble some significant clues and triangulate from them to build a broad picture of what he might have been driving at. Our (...) interpretation is that Riemann was a committed idealist and from this philosophical standpoint saw that the scientific enterprise was lame without the “poetry of hypothesis”. He believed that human thought was fundamentally the dynamics of “mind-masses” and that the human mind interpenetrated, and became part of, the microscopic physical domain of the cochlea. Therefore, a full description of hearing must necessarily include the perceptual dimensions of what he saw as a single manifold. The manifold contains all the psychophysical aspects of hearing, including the logarithmic transformations that arise from Fechner’s law, faithfully preserving all the subtle perceptual qualities of sound. For Riemann, hearing was a unitary physical and mental event, and parallels with modern ideas about consciousness and quantum biology are made. A unifying quantum mechanical model for an atom of consciousness—drawing on Riemann’s mind-masses and the similar “psychons” proposed by Eccles—is put forward. (shrink)

There is currently little empirical information about attitudes towards cognitive enhancement - the use of pharmaceutical drugs to enhance normal brain functioning. It is claimed this behaviour most commonly occurs in students to aid studying. We undertook a qualitative assessment of attitudes towards cognitive enhancement by conducting 19 semi-structured interviews with Australian university students. Most students considered cognitive enhancement to be unacceptable, in part because they believed it to be unethical but there was a lack of consensus on whether it (...) was similar or different to steroid use in sport. There was support for awareness campaigns and monitoring of cognitive enhancement use of pharmaceutical drugs. An understanding of student attitudes towards cognitive enhancement is important in formulating future policy. (shrink)

Everyone else does. " Socrates was hardly alone in his knack for asking such questions. Phi losophers have always asked peculiar questions most other people would never dream of asking, convinced as the latter are that the answers were settled long ago in the collective "wisdom" of society, including ques (...) tions about woman: should women be educated? should they rule socie ties? should they be subordinate in marriage? do women and men have the same virtues, or are there separate virtues for each? which of the dif ferences between women and men are conventional, and which are natu ral? is there a woman's work? do women and men have different types or degrees of rationality? Philosophers of the most diverse periods have raised these questions and their answers were often quite creative, not merely reflecting the conventions and mores of their societies. Everyday ethics refers to those issues which have a sometimes unrecognized moral dimension and that arise regularly within healthcare and research. These issues are often contrasted to dramatic ethics issues (i.e. issues that have seemingly higher stakes such as those arising in acute care situations or with invasive or life-threatening interventions). Claims have been made that scholarly bioethics tends to focus on dramatic ethics to the detriment of everyday ethics discussions. However, empirical evidence showing this has been lacking. Our own (...) research investigating bioethics discussions in the Parkinson’s disease literature suggested this trend. Consequently, we decided to characterize the context and content of the Parkinson’s disease bioethics literature to empirically test the hypothesis that everyday ethics is under discussed. We conducted a broad literature search using the keywords “Parkinson’s disease” AND (“ethics” OR “bioethics”) and classified results inductively based on the context in which the bioethics discussion occurred. In line with our hypothesis and initial observations, we found that there is indeed a greater focus on dramatic ethics where topics such as deep brain stimulation and neuronal cell transplantations, dominated bioethics discussions. Given the potential utility of everyday ethics in improving healthcare and research, this mismatch in focus ought to be addressed. There is a clear need for further understanding and discussion of everyday ethical issues in scholarly bioethics. (shrink)

With an upsurge of interest and investment in new legal technologies comes consideration of who is making them and whether these individuals or entities should be subject to regulation. This article looks at how such regulation might function in light of the existing regulatory regimes governing lawyers and the capacities of legal regulators. It considers the ramifications both of maintaining the existing system, or in extending some form of regulation to these new entrants to the legal services market.

Some attitudes typically take whole persons as their objects. Shame, contempt, disgust and admiration have this feature, as do many tokens of love and hate. Objectors complain that these ‘globalist attitudes’ can never fit their targets and thus can never be all-things-considered appropriate. Those who dismiss all globalist attitudes in this way are misguided. The fittingness objection depends on an inaccurate view of the person-assessments at the heart of the globalist attitudes. Once we understand the nature of globalist attitudes and (...) we recognize that we may legitimately treat some traits as more important than others in our overall evaluation of persons, we ought to conclude that our globalist attitudes can, in some cases, fit their targets and should not be summarily dismissed as unfitting. This article considers that reasoning over archives is a joint enterprise between archivists and researchers and that both groups are increasingly using machine agents to assist them in it. It starts by considering the processing of archivists, researchers and machine agents separately. Using the different perspectives this brings to highlight different aspects of that processing, as a process of sense-making, as scholarly research activity, as practices that realise and achieve data for the drawing of further inference, it reasserts the argument (...) that archives cannot be regarded as raw data to be reasoned over, but must be seen as the result of multiple representative and interpretive acts, of iterative realisation and activation as ‘data’ potentially involving many, many additional actors. It then goes on to consider how the involvement of machine agents fits into and potentially alters this picture by providing more detail about the basis on which they currently perform such acts. Canada’s Tri-Council Policy Statement: Ethical Conduct for Research Involving Humans mandates that all research involving human subjects be reviewed and approved by a research ethics board . We have little evidence on how researchers are dealing with this requirement in multisite studies, which involve more than one REB. We retrospectively examined 22 REB submissions for two minimal-risk, multisite studies in leading Canadian institutions. Most REBs granted expedited review to the studies, while one declared the application to be exempt from review. (...) Time between submission and approval ranged greatly, from four to 546 days. We received a total of 155 REB queries for changes and clarifications, most of which asked for further information, clarification, or additional documents. Less than a third of the REB queries were requests for specific changes, and a vast majority had a very limited impact on the research projects. Institutions also varied broadly in their description of what was required of local principal investigators. We conclude that the organizational and practical challenges these results imply could deter researchers from embarking on multisite research projects, and that recently proposed changes to the TCPS will not solve these problems. Animal pain and suffering is mostly caused by humans, particularly by the human use of domestic animals. This calls for the recognition of animal pain and suffering. My focus is on pain-related suffering. I argue for recognition in the phenomenological sense of giving adequate regard to pain experience in animals and their capacity to express it in their own species-specific terms, in a way that will motivate us to prevent it. Queste domande sono alla base della indagine sulla tecnica compositiva della tintinnabulatio, inventata e sperimentata dal musicista estone Arvo Pärt . I tintinnabuli consistono di due elementi apparentemente contraddittori: la sonorità pastosa dello zvod e l’armonia della triade perfetta. Muovendo da un disco ricevuto in dono e dalla interpretazione in parte (...) inedita di un passo di san Paolo, l’autore cerca di individuare il punto di articolazione dei tintinnabuli, quella “grana” dove – come disse una volta Roland Barthes – una lingua incontra una voce. Il problema musicale sottende le interminabili discussioni trinitarie dell’Oriente cristiano – qui per sfortuna solo accennate – e si manifesta nella figura dell’iconografo medievale Andrej Rublëv, cui il regista russo Tarkovskij ha dedicato, nel 1966, un denso e ispiratissimo film. Could the rustling of a voice be also the place of a language? And does it happen all the same, when the voice at issue is that of an instrumental body? Such questions are the basic ones for any inquiry into Arvo Pärt’s tintinnabuli—the technique invented and experienced by the famous Esthonian composer . It consists of two seemingly conflicting elements: the doughy resonance of the zvot ; and the harmony of the perfect triad. The present paper moves from the personal memory of listening Pärt’s elegy Silouans Song. The delicate instrumental piece is said to conceal a prosodical calque of the voice of the famous staretz Silouan the Athonite . Silouan’s song —to use Barthes’ words—is the very place where “a language does meet a voice”. Some interpretive consequences lead off such a meeting: from a misunderstanding of a Pauline passage to the art of sacred Icons; and from the Trinitarian controversies of Byzantine church fathers to the medieval painter St.Andrej Rublëv and his most famous icon: “The Holy Trinity”. A work where—as Andrej Tarkovski has shewed in his celebrated movie of 1966—Abraham’s oak is a like a bell concealing the threefold person of God. (shrink)

Slogans on commercial vehicles are a common sight in Ghana. These material artefacts can provide insight into beliefs and values about the sociocultural, spiritual, and political experiences of life in the contemporary Ghanaian context. In this study, we collected and analysed a total of 438 commercial vehicles’ slogans from 5 main transportation terminals in the Accra metropolitan area. Our thematic analysis of these slogans shows a major emphasis on religious and spiritual values to the extent that most of the recorded (...) slogans serve as positive affirmations of religious values and sources of spiritual encouragement. The dominance of religious references in such slogans highlights the importance of religiosity as a cultural value in everyday life in Ghana. (shrink)

This book examines reason and unreason in the legal and political responses to terrorism. Terrorism is often perceived as sheer madness, unreasonable use of extreme violence and senseless, futile political action. These assertions are challenged by this book. Combining ‘traditional’ thought on reason and unreason in terrorism with empirical explorations of post-modern terrorism and its use of communication platforms the work uses interdisciplinary and cross disciplinary dimensions to provide a multidimensional picture of critical issues in current politics and a deeper (...) examination of their implications than previously available. The book looks at various aspects of modern politics, from terrorism to protest, from decision-making to political discourse, applying the perspective of philosophical thought. To do so, political issues and actions are examined by using concepts such as reason, emotions, madness, magic, morality, absolutism, extremism, psychopathology, rationality and others. The analysis is rooted in theories and concepts derived from history, philosophy, religion, art, sociology, psychology, and political science. This book, which was mostly written by the late Abraham Kaplan, an American philosopher, and edited and updated by Gabriel Weimann, will be of much interest to students of political violence/terrorism, philosophy, war and conflict studies and political science in general. Bodunrin, in his 1981 essay, asks: ‘Is there an African Philosophy, and if there is, what is it?’ This question has occupied centre stage among younger African intellectuals for about a decade now. The most articulate among these intellectuals, who are themselves philosophers, are Bodunrin , Kwasi Wiredu , H. Odera Oruka , Marcien Towa and Eboussi Boulaga , and Paulin Hountondji .
