Much ink has already been spilled on the relationship of constitutional originalism to precedent. The debate includes contributions from Randy Barnett, Steven Calabresi, Kurt Lash, Gary Lawson, John McGinnis with Michael Rappaport, Michael Paulsen, and Lee Strang, not to mention Justice Antonin Scalia—all representing originalism in some form. Living constitutionalism has also been represented both implicitly and explicitly, with important contributions from Phillip Bobbitt, Ronald Dworkin, Michael Gerhardt, Randy Kozel, and David Strauss. Some writers are more difficult to classify; (...) Akhil Amar comes to mind. And there are many other contributions to the debate. Opinions range from the view that precedent should invariably prevail over the original public meaning of the constitutional text to the polar opposite view, that precedent must give way to original meaning in almost every case. Here is the roadmap. Part I provides a brief introduction to contemporary originalism. Part II describes the problem of precedent for originalism, emphasizing that the nature of the problem depends in part on our understanding of precedent. The late 20th century saw a remarkable flourishing of philosophy in France. The work of French philosophers is wide ranging, historically informed, often reaching out beyond the boundaries of philosophy; they are public intellectuals, taken seriously as contributors to debates outside the academy. Gary Gutting tells the story of the development of a distinctively French philosophy in the last four decades of the 20th century. His aim is to arrive at an account of what it was to 'do philosophy' (...) in France, what this sort of philosophizing was able to achieve, and how it differs from the analytic philosophy dominant in Anglophone countries. -/- His initial focus is on the three most important philosophers who came to prominence in the 1960s: Michel Foucault, Gilles Deleuze, and Jacques Derrida. He sets out the educational and cultural context of their work, as a basis for a detailed treatment of how they formulated and began to carry out their philosophical projects in the 1960s and 1970s. He gives a fresh assessment of their responses to the key influences of Hegel and Heidegger, and the fraught relationship of the new generation to their father-figure Sartre. He concludes that Foucault, Derrida, and Deleuze can all be seen as developing their fundamental philosophical stances out of distinctive readings of Nietzsche. The second part of the book considers topics and philosophers that became prominent in the 1980s and 1990s, such as the revival of ethics in Levinas, Derrida, and Foucault, the return to phenomenology and its use to revive religious experience as a philosophical topic, and Alain Badiou's new ontology of the event. Finally Gutting brings to the fore the meta-philosophical theme of the book, that French philosophy since the 1960s has been primarily concerned with thinking the impossible. (shrink)

Health care is transitioning from genetics to genomics, in which single-gene testing for diagnosis is being replaced by multi-gene panels, genome-wide sequencing, and other multi-genic tests for disease diagnosis, prediction, prognosis, and treatment. This health care transition is spurring a new set of increased or novel liability risks for health care providers and test laboratories. This article describes this transition in both medical care and liability, and addresses 11 areas of potential increased or novel liability risk, offering recommendations to both (...) health care and legal actors to address and manage those liability risks. This paper argues (a) that the concept of “potential being” is central to the theory and practice of contemporary cosmology and evolutionary science, and (b) that the reality of potential being points to the existence of an intelligent and purposive cause of the intelligible order among potential beings that existed from the first moments of the Big Bang. The paper introduces and explains the concept of “potential being” and then traces the existence of potential beings back to the beginnings of (...) the cosmos at the instant of the Big Bang. This primeval existence of potential beings is shown to possess a character and order that points to a cause external to that order. The paper concludes with a consideration of the features that must be possessed by that external cause in order to make sense of what we know. (shrink)

The apparent very close similarity between the learning of the past tense by Adam and the Plunkett and Marchman model is exaggerated by several misleading comparisons--including arbitrary, unexplained changes in how graphs were plotted. The model's development differs from Adam's in three important ways: Children show a U-shaped sequence of development which does not depend on abrupt changes in input; U-shaped development in the simulation occurs only after an abrupt change in training regimen. Children overregularize vowel-change verbs more than no-change (...) verbs; the simulation overregularizes vowel-change verbs less often than no-change verbs. Children, including Adam, overregularize more than they irregularize; the simulation overregularized less than it irregularized. Interestingly, the RM model--widely criticized as being inadequate--does somewhat better, correctly overregularizing vowel-change verbs more often than no-change verbs, and overregularizing more often than it irregularizes. Although Plunkett and Marchman's (1993) state of the art model incorporated hidden layers and back-propagation, used a more realistic phonological coding scheme, and explored a broader range of parameters than Rumelhart and McClelland's model, their results are farther from psychological reality. It is unknown whether any connectionist model can mimic a child's performance without resorting to unrealistic exogenous changes in the training or input, but it is clear that adding a hidden-layer and back-propagation does not ensure a solution. Davidson's paratactic account of indirect quotation preserves the apparent relational structure of indirect speech but without assuming, in the Fregean manner, that the thing said by a sayer is a proposition. I argue that this is a mistake. As has been recognised by some critics, Davidson's account suffers from analytical shortcomings which can be overcome by redeploying the paratactic strategy as a means of referring to propositions. I offer a quick and comprehensive survey of these difficulties and a concise propositional (...) solution. Further, I argue that Davidson's more general philosophical commitments provide no reason not to embrace the propositional strategy: despite appearances, to invoke propositions in the way suggested is consistent with Davidson's holism and consequent doctrine of semantic indeterminacy. The current study analyzes trans-cultural universalities and specificities in the recognition of status roles, dominance perception and social evaluation based on nonverbal cues. Using a novel methodology, which allowed to mask clues to ethnicity and cultural background of the agents, we compared impression of Germans, Americans and Arabs observing computer-animated interactions from the three countries. Only in the German stimulus sample the status roles could be recognized above chance level. However we found significant correlations in dominance perception across all countries. (...) Significant correlations were only found for evaluation between German observers and observers from the other two countries. Perceived dominance uniformly predicted the assignment of status-roles in all cultures. Microanalysis of movement behavior further revealed predictive value of specific nonverbal cues for dominance ratings. Results support the hypothesis of universalities in the processing of dominance cues and point to cultural specificities in evaluative responses to nonverbal behavior. (shrink)

This book advances a persuasive account of Christian belief organized around the theme of love while also employing love as a constraint on theological formulation. Throughout, Gary Chartier seeks to understand divine action in ways that make it possible to affirm divine love in the face of evil. The Analogy of Love offers a stimulating model for thinking about God and the world.

The temporally immediate transcendence of space through the use of the telephone creates a bi-localized space of interaction. Unique structures of spatial experience are constituted through the intending of spatial sectors in telephonic conversation. In the first section of this paper, six eidetic variations are presented that establish the various ways in which environmental sectors are intended through the intersubjective space of the telephonic medium. The telos of these descriptions is to characterize changes in social praxis that have been made (...) available with the inclusion in the life-world of the telephone as a typical tool. In the second section, a constitutive analysis is undertaken in order to investigate how empty intentions are brought to fulfillment in the telephonic conversational thematizations of environmental sectors. Telephone space involves a modified we-relationship through which meaning-intentions are intersubjectively synthesized, yet from bi-local environmental standpoints. The intersubjective achievements concerning projects grounded within the immediacy of telephonic transcendence create a unique structure of meaning-fulfillment. (shrink)

Rogers & McClelland's (R&M's) précis represents an important effort to address key issues in concepts and categorization, but few of the simulations deliver what is promised. We argue that the models are seriously underconstrained, importantly incomplete, and psychologically implausible; more broadly, R&M dwell too heavily on the apparent successes without comparable concern for limitations already noted in the literature.

Harry Frankfurt characterizes love as "a disinterested concern for the existence of what is loved, and for what is good for it." As such, he views romantic love as an inauthentic paradigm for love since such love desires reciprocation, sexual gratification and so on. I argue that Frankfurt's conception of love is too general—he does not distinguish between the type of love one has for one's partner, one's country, a moral ideal, etc., it overemphasizes the role of bestowal at the (...) expense of the part played by appraisal and it is insufficiently social. Certain forms of love, romantic love and friendship for instance, are defined largely in terms of reciprocation. For Frankfurt, reciprocation is somewhat of an accidental feature of love. This deficiency in Frankfurt's conception of love can be traced to a problem in his conception of selfhood which I argue is insufficiently social in nature. (shrink)

As the health care system transitions to a precision medicine approach that tailors clinical care to the genetic profile of the individual patient, there is a potential tension between the clinical uptake of new technologies by providers and the legal system's expectation of the standard of care in applying such technologies. We examine this tension by comparing the type of evidence that physicians and courts are likely to rely on in determining a duty to recommend pharmacogenetic testing of patients prescribed (...) the oral anti-coagulant drug warfarin. There is a large body of inconsistent evidence and factors for and against such testing, but physicians and courts are likely to weigh this evidence differently. The potential implications for medical malpractice risk are evaluated and discussed. (shrink)

Marriage is ordinarily a public practice, supported by, as well as supportive of, society. But it need not fall within the purview of the state. Public Practice, Private Law articulates a conception of marriage as a morally rich and important institution that ought to be subject to private rather than legislative or judicial ordering. It elaborates a robust understanding of marriage that captures what both different-sex and same-sex couples might see as valuable about their relationships. It explains why sexual ethics (...) won't yield a normative model of marriage, and why the kind of marital love worth wanting, can. It goes on to show how an understanding of marriage as rooted in demanding commitments can allow for divorce before arguing that the state should cease to sponsor marriages. It concludes by suggesting that both state and non-state institutions should acknowledge the marriages of same-sex couples. (shrink)

Faculty continue to address academic dishonesty in their classes. In this follow-up to an earlier study on general perceived faculty student cheating, using a sample of business school faculty, we compared three levels of faculty classification: full-time non-tenure track, full-time tenured/tenure-track, and part-time adjuncts. Results showed that NTTs perceived higher levels for three different types of student cheating, i.e., paper-based, forbidden teamwork, and hiring someone to take an exam. In addition, NTTs were more likely to report a student for cheating. (...) NTTs reported a higher course load and average class size, and average class size was positively related to all five types of cheating measured. Given the predicted increase in NTTs across all disciplines, making sure that all faculty,, have the resources needed to deter student cheating is important. All faculty have an obligation to hold students accountable for their behavior. Individual integrity is paramount; and it is what employers expect. Regardless of the chosen field or discipline, an employer’s expectations, in terms of character, is to hire individuals who possess a level of honesty that is above reproach. Addressing cheating is an obligation that all faculty need to address purposefully. Providing resources to help faculty address cheating is critical. Resources might include conflict resolution training to provide instructors with the necessary guidance so that they can better handle these difficult situations. This is important not only for the student while in school, but also for a university/college’s reputation. (shrink)

This illustrated technical manual is the first comprehensive book in 95 years de­signed to lead the reader through the process of producing a photogravure print from a black and white negative. Kolb’s premise is that the best way to learn the photogravure process is to produce a straightforward, full-scale translation of a photographic negative. Through the production of such a print the reader learns all of the basic technical controls available. Internationally known photographer Charles A. Swedlund notes that “Photo­gravure is (...) technical and challenging. It is not forgiving. Many of the steps in the process involve a host of variables. A slight error in any one of them can often produce drastic results. These dif­ficulties have often proved frustrating to beginning students. As a result, the widespread use of photogravure has been hindered in photography and art departments. However, this situation is remedied with the publication of this fine work by Gary Kolb.”.
