Barbara H. Fried presents a powerful critique of the nonconsequentialist approaches that have been dominant in recent Anglophone moral and political thought. She argues that nonconsequentialist theories have disastrous consequences in the political domain and are inadequate at dealing with conflicts of individual interests in the moral domain.

My topic is authenticity in or perhaps as painting, not the authenticity of paintings; I know next to nothing about the problem of verifying claims of authorship. I am interested in another kind of genuineness and fraudulence, the kind at issue when we say of a person that he or she is false, not genuine, inauthentic, lacks integrity, and, especially when we say he or she is playing to the crowd, playing for effect, or is a poseur. These are not (...) quite moral distinctions (no one has a duty to be authentic), but they are robustly normative appraisals, applicable even when such falseness is not a case of straight hypocrisy but of lack of self-knowledge or of self-deceit. (A person can be quite sincere and not realize the extent of her submission to the other’s expectations and demands.) This sort of appraisal also has a long history in post-Rousseauist reflections on the dangers of uniquely modern forms of social dependence, and they are prominent worries in the modern novel. The classic opening scene of 2001, A Space Odyssey shows an ape-man wreaking havoc with humanity's first invention--a bone used as a weapon to kill a rival. It's an image that fits well with popular notions of our species as inherently violent, with the idea that humans are--and always have been--warlike by nature. But as Douglas P. Fry convincingly argues in Beyond War , the facts show that our ancient ancestors were not innately warlike--and neither are we.

Currently, we find ourselves in a paradigm in which we believe that accepting climate change data will lead to a kind of automatic action toward the preservation of our environment. I have argued elsewhere (Fried 2020) that this lack of civic action on climate data is significant when placed in the historical, military context of the technologies that collect this data––Earth remote sensing technologies. However, I have not yet discussed the phenomenological or moral implications of this context, which are (...) deeply interconnected. In this paper, I assert that Earth remote sensing technologies can, if we are not careful, lead us to a kind of environmental deskilling. This assertion comes in four parts. First, the military context of Earth remote sensing technologies––which collect important data on climate change––acts as a kind of stability, as defined by Don Ihde and others. Second, I invoke Sir Patrick Heelan to argue that the theoretical underpinnings of Earth systems science do not translate from military to environmental praxes as we imagine they do. Third, Hannah Arendt makes the case that a state’s trust in simplifying narratives like that of climate data, meant to create “islands” of certainty in an uncertain world, can be self-defeating. That is to say, they can silence public action. I extend these arguments through Vallor’s analysis of moral deskilling, in which she points out that an overemphasis on autonomous data collection––and trust in a kind of automated decision-making on that data––can deskill us from important questions relevant to our collective flourishing. In all of these examples, the lines between environmental and military research are blurry. (shrink)

In this article I discuss what I am calling “ally aesthetics.” I suggest a set of necessary, though not necessarily sufficient, considerations for the creation of successful instances of ally art. Focusing on three case studies, I propose some key characteristics of ally aesthetics, such as its contextual/temporal nature and how that relates to success and the importance of understanding the place of the ally aesthetic within the larger movements they are allying with.

Investigates a complex structure of morality, the demands such morality places on individuals, and the behavioral consequences of the system of right and wrong.

This paper examines the efforts of contractualists to develop an alternative to aggregation to govern our duty not to harm (duty to rescue) others. I conclude that many of the moral principles articulated in the literature seem to reduce to aggregation by a different name. Those that do not are viable only as long as they are limited to a handful of oddball cases at the margins of social life. If extended to run-of-the-mill conduct that accounts for virtually all unintended (...) (in the sense of undesired) harm to others—noncriminal activities that impose some risk of harm on others—they would rule out all action. Moreover, because such conduct poses an irreducible conflict between freedom of action and freedom from expected harm, it can be regulated only by principles that accept the necessity of making precisely the sorts of interpersonal trade-offs that contractualism is foundationally committed to reject: trade-offs in which the numbers count, such that a risk of serious harm to one person can be justified by small benefits to the many. In part one of this paper we shall elucidate an operational concept of logical simplicity as it seems to function in natural science. Although this is a tentative and exploratory formulation, its novelty, relative to the great European philosophical tradition, seems to require a preliminary warning about misunderstandings.In Part Two we shall apply the formulation to social inquiry and make a positive suggestion for further development of the proposal.

The book presents the case for the making of a new political imagination by offering a critique of existing political institutions, philosophy and practices that are unable to provide the thinking, means and leadership to deal with the complexity and crises of specific locales and the world at large. The book tackles the political underpinnings of social and economic life in a world still embedded in the inequities of the afterlife of colonialism and state socialism. This new edition of Charles Fried's Medical Experimentation includes a general introduction by Franklin Miller and the late Alan Wertheimer, a reprint of the 1974 text, an in-depth analysis by Harvard Law School scholars I. Glenn Cohen and D. James Greiner, and a new essay by Fried reflecting on the original text and how it applies to the contemporary landscape of medicine and medical experimentation.

Philosophy typically ignores biographical, historical, and cultural aspects of theorists' lives in an attempt to take a supposedly abstract and objective view of their work. This book makes some new conclusions about Arendt’s theory by emphasizing how her experience of the world as displayed in her archival materials impacted her thought. Some aspects of Arendt’s life have been examined in detail before, including the fact she was stateless as well as her affair with Heidegger. Instead, this work explores different topics (...) including the biographical and narrative moments of Arendt's own work, the role of archiving in her thought, pivotal events that have not been archived, her understanding of her own identities, and how it affected the role of identity politics in her work. Typically, group action is underemphasized in Arendt scholarship in comparison to individual action and often identity politics questions are considered to lie within the realm of the private. Although Arendt’s theory is problematic when discussing issues concerning identity politics, she did think identity politics could be public and political and that effective political actions may occur within groups. What makes this project unique are the innovative conclusions made by moving the archival and biographical evidence to the center in order to understand her theory more accurately and within its historical and cultural context. Philosophers of science diverge on the question what drives the growth of scientific knowledge. Most of the twentieth century was dominated by the notion that theories propel that growth whereas experiments play secondary roles of operating within the theoretical framework or testing theoretical predictions. New experimentalism, a school of thought pioneered by Ian Hacking in the early 1980s, challenged this view by arguing that theory-free exploratory experimentation may in many cases effectively probe nature and potentially spawn higher evidence-based theories. Because (...) theories are often powerless to envisage workings of complex biological systems, theory-independent experimentation is common in the life sciences. Some such experiments are triggered by compelling observation, others are prompted by innovative techniques or instruments, whereas different investigations query big data to identify regularities and underlying organizing principles. A distinct fourth type of experiments is motivated by a major question. Here I describe two question-guided experimental discoveries in biochemistry: the cyclic adenosine monophosphate mediator of hormone action and the ubiquitin-mediated system of protein degradation. Lacking underlying theories, antecedent data bases, or new techniques, the sole guides of the two discoveries were respective substantial questions. Both research projects were similarly instigated by theory-free exploratory experimentation and continued in alternating phases of results-based interim working hypotheses, their examination by experiment, provisional hypotheses again, and so on. These two cases designate theory-free, question-guided, stepwise biochemical investigations as a distinct subtype of the new experimentalism mode of scientific enquiry. (shrink)

Gregory Fried offers in this book a careful investigation of Martin Heidegger's understanding of politics. Disturbing issues surround Heidegger's commitment to National Socialism, his disdain for liberal democracy, and his rejection of the Enlightenment. Fried confronts these issues, focusing not on the historical debate over Heidegger's personal involvement with Nazism, but on whether and how the formulation of Heidegger's ontology relates to his political thinking as expressed in his philosophical works. The inquiry begins with Heidegger's interpretation of Heraclitus, (...) particularly the term polemos ("war," or, in Heidegger's usage, "confrontation"). Fried contends that Heidegger invests polemos with broad ontological significance and that his appropriation of the word provides important insights into major strands of his thinking--his conception of the human being, understanding of truth, and interpretation of history--as well as the meaning of the so-called turn in his thought. Although Fried finds that Heidegger's politics are continuous with his thought, he also argues that Heidegger's work raises important questions about contemporary identity politics. Fried also shows that many postmodernists, despite attempts to distance themselves from Heidegger, fail to avoid some of the same political pitfalls his thinking entailed. (shrink)

To be human is to be in the world with others, and so what it means to be goes to the root of ethical and political life. One would have to be exceptionally obtuse not to recognize that this age, which we now share as a planetary humanity, is indeed in crisis, despite all our apparent progress if not because of it: the economic and political upheavals that threaten to throw whole regions into uproar, the shifts in climate that threaten (...) the entire globe with unparalleled disruption, the “advances” in technology that threaten to lay waste to entire cities and reduce human beings to “human resources.” Despite these ongoing or potential disasters, what Heidegger’s work challenges us to think is that the most fundamental disaster is a failure to think what it means to be human, that these other dangers can only be addressed if we confront this question first. My argument here is that Heidegger misreads a form of thinking vital to ethical–political life, phronêsis, so-called practical wisdom, because his radical historicism prevents him from seeing the intersection of principled norms with life as we find it. This paper calls attention to a philosophical presupposition, coined here the continuity thesis which underlies and unites the different, often conflicting, hypotheses in the origin of life field. This presupposition, a necessary condition for any scientific investigation of the origin of life problem, has two components. First, it contends that there is no unbridgeable gap between inorganic matter and life. Second, it regards the emergence of life as a highly probable process. Examining several current origin-of-life theories. I indicate the implicit (...) or explicit role played by the continuity thesis in each of them. In addition, I identify the rivals of the thesis within the scientific community — the almost miracle camp. Though adopting the anti-vitalistic aspect of the continuity thesis, this camp regards the emergence of life as involving highly improbable events. Since it seems that the chemistry of the prebiotic stages and of molecular self-organization processes rules out the possibility that life is the result of a happy accident, I claim that the almost miracle view implies in fact, a creationist position. The aim of this essay is to contribute to the development of a paradigmatic shift in how design is understood, transformed and practiced in the Global South. It does this by establishing the case for building a strong contextual relation between design, colonialism, and the mobilised counter-agency of decoloniality. Thereafter, design for/by the Global South is presented within a critical epistemological reframing subordinate to a situated imperative of the ‘Sustainment’.

Like other groups associated with social movements, rape crisis centers have been judged co-optive by some and progressive by others. This article argues that organizational theory yields fuller explanations of their dynamics and character. In a case study, two subcultures—dubbed the politicized and service perspectives—developed and epitomized fundamentally different approaches to sexual violence. These subcultures emerged for a number of reasons, including the organization's goals, the character of the fiminist movement, and organizational features such as permeability, a broad constituency, a (...) collective goods orientation, and an emphasis on open discourse. This article argues that similar organizational and environmental features in rape crisis centers and other social movement-related organizations are associated with organizational fluidity and conflict. While these groups may not be cohesive and stable actors for broad social change, they contribute incrementally to long-term shifts in gendered social structures. (shrink)

In his writings on non-human animals, David Hume draws comparisons between non-human animals' cognitive capacities and the cognitive capacities of humans. That Hume draws such comparisons might seem to be evidence that Hume was influenced on this issue by epistemologically skeptical thinkers such as Sextus Empiricus, Michel de Montaigne, and Pierre Bayle. This is enticing, as Hume was influenced by them on other issues and they too make comparisons between human and non-human animal reasoning. Comparing Hume's arguments in the sections (...) on animal reasoning to these skeptics' arguments shows that there is scant evidence for such an attribution of direct, positive influence on those arguments by these... This paper extends Being-centered and spiritual leadership theory using non-self from the Buddhist philosophy to further our understanding of how inner life functions as the source of spiritual leadership. While spiritual leadership theory has received widespread acceptance and considerable empirical support, its developmental process and potential for being used to pursue self-centered ends remain underdeveloped. Drawing on non-self from the Buddhist emptiness theory, we identify different egoistic forms of attachment at each level of being that can lead to forms of (...) suffering in spiritual leadership. Then we show how leaders operating at lower levels of being can fall into the trap of practicing a form of pseudo-spiritual leadership that is overly focused on self-centered or instrumental purposes and economic rationality. We then introduce mechanisms to move beyond pseudo-spiritual leadership practices and discuss implications for future theory, research, and practice. (shrink)

Various explanations are offered to explain why employees increasingly work longer hours: the combined effects of technology and globalization; people are caught up in consumerism; and the "ideal worker norm," when professionals expect themselves and others to work longer hours. In this article, we propose that the processes of employer recruitment and selection, employee self-selection, cultural socialization, and reward systems help create extended work hours cultures (EWHC) that reinforce these trends. Moreover, we argue that EWHC organizations are becoming more prevalent (...) and that organizations in which long hours have become the norm may recruit for and reinforce workaholic tendencies. Next, we offer spiritual leadership as a paradigm for organizational transformation and recovery from the negative aspects of EWHC to enhance employee wellbeing and corporate social responsibility without sacrificing profitability, revenue growth, and other indicators of financial performance. Finally, we will offer suggestions for future theory, research, and practice. (shrink)

Contract as Promise is a study of the philosophical foundations of contract law in which Professor Fried effectively answers some of the most common assumptions about contract law and strongly proposes a moral basis for it while defending the classical theory of contract. This book provides two purposes regarding the complex legal institution of the contract. The first is the theoretical purpose to demonstrate how contract law can be traced to and is determined by a small number of basic (...) moral principles. At the theory level the author shows that contract law does have an underlying, and unifying structure. The second is a pedagogic purpose to provide for students the underlying structure of contract law. At this level of doctrinal exposition the author shows that structure can be referred to moral principles. Together the two purposes support each other in an effective and comprehensive study of contract law. This second edition retains the original text, and includes a new Preface. It also includes a substantial new essay entitled Contract as Promise in the Light of Subsequent Scholarship--Especially Law and Economics which serves as a retrospective of the work accomplished in the last thirty years, while responding to present and future work in the field. The influence of neuroscience looms large today. In this introductory essay, we provide some context for the volume by acknowledging the expansion of applied neuroscience to everyday life and the proliferation of neuroscientific disciplines. We also observe that some individuals have sounded cautionary notes in light of perceived overreach of some claims for neuroscience. Then we briefly summarize the articles that comprise this volume. This diverse collection of papers represents the beginning of a conversation focused on the intersection of sport, (...) ethics and neurophilosophy. As such, the essays also represent a new mode of interaction between philosophy and science with sport in the center of the discussion. (shrink)

A mental heuristic is a shortcut (means) to a desired end. In the moral (as opposed to factual) realm, the means/end distinction is not self-evident: How do we decide whether a given moral intuition is a mere heuristic to achieve some freestanding moral principle, or instead a freestanding moral principle in its own right? I discuss Sunstein's solution to that threshold difficulty in translating “heuristics” to the moral realm.
